ANORDINANCEAMENDINGCHAPTER12.10OFTHE MOSES LAKEMUNICIPALCODEENTITLED"DRIVEWAYCONSTRUCTION STANDARDS"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 12.10 of theMoses Lake MunicipalCode entitled"Driveway Construction Standards"isamendedbychangingthetitlefrom"Driveway Construction Standards"to "Driveway Access ControlStandards".
Section 2.Chapter 12.10 oftheMoses Lake MunicipalCode is amended as follows:
12.10.035 Restricted Access ControlLocations:Private accesses are restricted as listed on thefollowingstreets:
A.Paxson Drive:Valley RoadtoCrestview Drive.No private accesses are allowed.
B.Valley Road:Crestview Driveto Stratford Road.No additional private accesses are allowed.
C.Yonezawa Boulevard:DivisionStreet toSR-17.No additionalprivate accesses are allowed.
D.Wheeler Road:SR-17 east totheeasterly corporate limits.Access locations willbe approvedbyusingthefollowingcriteria:
1.Commondriveways shall be used wherever possible.
2.No more thanone driveway per platted lotor taxparcel willbe allowed unless itcan beshownthatanadditionalaccesspointwouldnotadverselyaffecttrafficflowsorcreateasafetyhazard.Acommondriveway servingtwolots isconsideredas theone driveway foreachlot.
3.The minimum distance toanother publicor private access shall be twohundredfiftyfeet(250')from centerlineto centerline,wherever possible,
12.10.036 On-Site Access Points:On-site access pointsfordriveways extendingontoprivate propertyalongYonezawaBoulevardfromSR-17toDivisionStreet and along Wheeler Road from SR-17 to theeastcitylimitsarerestrictedtothefollowingminimumsetbacks:
O Average Daily Traffic (ADT)-On a WeekDav MinimumSet Back1-1,500 30 feet1,500 -5,000 50 feet5,000+75 feet
These setback restrictions do not applyto driveways in R-1 and R-2 Zones.
The setbacks willbe measured from thefront face ofthe existing curb or theprojected curb.
The ADTwillbe calculatedby usingtheexpected use for the entirelot thatthe driveway serves.
12.10.037 Variance:The CityCouncil maygrant variances from thestandards setforth inthischapteruponthefindingsthatthegrantofavarianceisinthebestinterestandwelfareofthecommunityandthatatraffichazardwillnotbecreated.Atrafficstudy prepared by an engineer licensed by theStateofWashingtonmayberequiredbytheCouncilbeforegrantingavariance.
12.10.040 Conflicting Ordinances or Standards;Where thereis a conflictbetween theprovisionsofthisordinanceandothercityordinancesorcommunitystandards,theprovisions ofthisordinance shallprevail.
Section 3.This ordinance shalltake effect and be inforce five (5)days after its passage and publication ofitssummaryasprovidedbylaw.
