COMMONLYREFFRREDTO AS PACWEST,TO THE CITY OF MOSES LAKE,WASHINGTON,AND INCORPORATING THE SAME WITHIN THE CORPORATELIMITSOFTHECITYOFMOSESLAKE,ANDWHICH PROVIDES FOR THE AS-SUMPTION OF EXISTINGINDEBTEDNESSANDESTABLISHESTHE ZONING
THE CITYCOUNCILOF THECITYOF MOSES LAKE,WASHINGTONDO ORDAINAS FOLLOWS:
Section 1.Consistent with the decision of the Grant County Boundary Review Board,#98-11-BRB datedFebruary8,1999,marked ExhibitAwhichbythisreference is incorporated withinthisordinance,the followingdescribedrealestate,as shown on theattached map marked Exhibit Bwhich by thisreference is incorporatedwithinthisordinance,situated in Grant County contiguousto the Cityof Moses Lake is hereby annexed to andincorporatedintheCityofMosesLake:
That portion of Township 19 North,Range 28 East,W.M.more particularly described as follows:
Section 9 Northeast 1/4 of thesoutheast 1/4 lyingnortherlyofthe southwesterly right-of-way lineofstatehighwaySR17
Southeast 1/4 ofthenortheast 1/4 lying northerly ofthe southwesterly right-of-way lineofstatehighwaySR17

Section 2.Allproperty withinthe territoryannexed shall hereinafter be assessed and taxed at the same rateandonthesamebasisasotherpropertywithinthecitytopayforanyoutstandingindebtednessoftheCityofMosesLakecontractedpriortoorexistingatthedateofannexation.No property herein annexed shall bereleasedfromanyoutstandingindebtednessleviedagainstitpriortosaidannexation.
Section 3.The property shall be zoned R-3,Multi-familyResidential.
Section 4.A copy of this ordinance shall be filed with theBoard of County Commissioners ofGrant County,Washington.
Section 5.The CityCouncildeclares thatan emergency exists and thisordinance shalltakeeffect immediatelyasprovidedbylawupononereadingif2/3 of theentire CityCouncil present vote in favor of passage.

-SE ¼of the NE ¼lying northerly of the southwesterly

WHEREAS,A Notice of Intention was filed with the Boundary Review Board,and
resubmitted on December 11,1998 proposing the annexation of 83 acres
located adjacent to the Gateway Estates subdivision south of Harris Road,
east of Patton Blvd.,and north of SR 17.The site and the property.
surrounding it are zoned S-2 Suburban and neighborhood commercial.
There are no existing residences within the proposed annexation.The
Gateway Park mobile home park is being developed on 3.77 acres of the
land;and
WHEREAS,A Public Meeting to consider this issue was scheduled for January
27,1999;and
WHEREAS,said public notice procedures pursuant to RCW 36.93.160 were
carried out and a public hearing was held on January 27,199 at 7:00 p.m.in
the County Commissioners Hearing Room,35 C Street NW,Ephrata,WA
and all proceedings were tape recorded;and
WHEREAS,the Clerk of the Board administered an oath to those planning to
testifyand
WEREAS,opportunityfor public testimonywas given to allwho so desired;and
WHEREAS the Boundary .Review Board considered all testimonyand after
questions to those giving testimony and discussion,closed the public
hearing;and
WHEREAS,the Boundary Review Board then held a Closed Record Public
Meeting and consideredeach factor (RCW 36.93.170)and determined which
objectives (RCW 36.93.180)were met or not met by the proposal,and
WHEREAS,the proposed annexation does not meet with the objectives of RCW
O 36.93.180 concerning the preservation of natural neighborhoods and
communities;and
WHEREAS a motion was made by Shane Kenison and seconded by James
Weitzel that the proposal be modifiedto exclude 40 acres of the northeast
section and all property west of Owens Road.The motion carried with 2
members voting in favor and one against.
FINDINGS
BRB File Number 98-11-BRB:Proposed Annexation of 83 acres to the City of
Moses Lake was approved as modifiedby the Washington State Boundary
Review Board for Grant County.The action is based upon findings pursuant
to RCW 36.93.170,"Factors to be considered by the Board"and RCW
36.93.180,"Objectives ofthe Boundary Review Board".
