IV.CONSIDERATION OF BIDS -None V.PETITIONS.COMMUNICATIONS.OR PUBLIC HEARINGS //^REQUEST TO USE CITY STREETS -MOSES LAKE BUSINESS ASSOCIATION TheMoses Lake Business Association requested permission to closethe 100 East,100 Westand 200 West blocks of ThirdAvenue for the annual sidewalk sale during the Spring Festival on May26 and 27, 2000. Itwas also requested that ThirdAvenue from Cedar to Balsam and Balsam fromThirdto the CityHall be closed on Saturday,May 27 for the Kiddie Parade. Action Taken:Mr.Tracy moved that the request be approved,seconded by Mr.Blessing, and passed unanimously. ..j{;REQUEST TOUSE SINKIUSE SQUARE -MOSES LAKE BUSINESS ASSOCIATION The Moses Lake Business Association requested permission to use McCosh Park for a Cinco De Mayo celebration on May 5, 2000. The event would run from noon to 9 p.m. Sally Goodwin,Moses Lake Business Association,stated that due to scheduling conflicts, they are now requesting the use of Sinkiuse Square for the Cinco De Mayo celebration.All activities would becontained within the square and itwould last from noon to 7 p.m. Action Taken:Dr.Covey moved that the request to use Sinkiuse Square be granted,seconded by Mr. Porter, and passed unanimously. /OQ OUTSTANDING COMMUNITY AWARD O The City of Moses Lake has been named an Outstanding Community for 2000 by The Searchers.This award has been granted to fewer than 160 communities throughout the nation. REQUEST TO USE SINKIUSE SQUARE -SAMARITAN HOSPITAL Samaritan Hospital has requested the useofSinkiuse Squarefor the2000 bicycle rodeoon May20 between 7 a.m.and 5 p.m. Action Taken:Mr.Porter moved that the request to use Sinkiuse Square be granted,seconded by Dr. Covey,and passed unanimously. gt/MOSES POINTE n W Mike Moore,representing Moses Pointe,explained that the project is within Grant County and includes an - 18 hole championship golf course,club house,and a restaurant.There will be about 859 residential units, a hotel, a commercial area,a boatlaunch,etc. Five years agoMoses Pointe entered intoan Extra Territorial Utility Agreement with the city for water and sewer services.The golf course has been ranked as the third most difficult inthe state.This project is good for the community aswellas for Grant County. He mentioned that Exhibit E of the agreement is being amended to refine the provision of water and sewerservices to the project.He presented a proposed amendment to Exhibit E and would liketo seethe issues resolved by the next Council meeting.One of the changes proposed is an additional 400 acrefeetof waterto be converted from strictly irrigation use to domestic use. Joseph K.Gavinski,City Manager,stated that the city has been discussing the extension ofwater and sewer ^ms^ utilities with Moses Pointe.Staff has been working with the developer tobesurethe city is protected over i) the issue of water and sewer services.Since the draft proposed by Moses Pointe was not received by the city until last Friday, city staff has not had time to consider the proposal. Since there are Councilmen who have had no exposure to this project,staff was requested to provide a summary of the negotiations between the city and Moses Pointe prior to the next Council meeting. VI.ORDINANCES AND RESOLUTIONS ORDINANCE -PAYROLL AND CLAIMS FUND -2ND READING An ordinance was presented which deletes Chapter 3.04 of the Moses Lake Municipal Code concerning Payroll and Claims Fund. 5604 CITY COUNCIL MINUTES:2 April 25,2000 The ordinance deleting Chapter3.04of the Moses Lake MunicipalCode entitled"Payrolland Claims Funds" was read by title only. ORDINANCES -AMEND UTILITY OCCUPATIONAL TAX -SINGLE READING An ordinance was presented which amends Chapter 3.30 of the Moses Lake Municipal Code concerning utility occupational tax.The ordinance provides thatthe propertyannexed intothe Cityof Moses Lakewould W not be subject to the utility occupational tax until July 1,2000. Joseph K.Gavinski,City Manager,gave some background on the impact of utilityoccupational taxes on industries being annexed to the city.The Council determined that a system should be devised which would make it revenue neutral for the industries being annexed to the city.This ordinance will establish the effective date of the utility tax as July 1,2000. There was some discussion by the Council. The ordinance repealing Ordinance No.1878 and amending Chapter 3.30 of the Moses Lake Municipal Code entitled "Utility Occupational Tax"was read by title only. Action Taken:Dr.Covey moved that an emergency be declared and the ordinance be adopted on a single reading,seconded by Mr.Porter, and passed unanimously. RESOLUTION -COFFIN ANNEXATION A resolution was presented which initiatesthe procedure forannexing propertyowned by Kenneth and Ruth Coffin located inSection 9 and which is surrounded on three sides by property already annexed into the city. Joseph K.Gavinski, CityManager,stated thatthis proposed annexation was held inabeyance untilafterthe Gear annexation was completed.Mr.Coffin has agreed to the annexation. The resolution stating desire to annex an unincorporated island of territory to the City of Moses Lake and setting a public hearing was read by title only. Action Taken:Dr.Covey moved that the resolution be adopted and a public hearing be set for May 9, seconded by Mr.Porter, and passed unanimously. /0*<P u VII.REQUESTS TO CALL FOR BIDS TRIM MOWER Staff requested authorization to call for bids for a trim mower for use by the Parks and Recreation Department. Action Taken:Dr.Covey moved that staff be authorized to call for bids for a trim mower,seconded by Mr. Porter, and passed unanimously. VIII.REFERRALS FROM COMMISSIONS -None IX.OTHER ITEMS FOR COUNCIL CONSIDERATION DARE OFFICER/24-HOUR COUNTER SERVICE -POLICE DEPARTMENT A report was presented to the Council from the Police Chief concerning the DARE program and 24-hour counter/phone service forthe Police Department.Ifthe Council wishes to continue withthe DARE program a currently vacant officer position would be offered to an employee who is currently a clerk.This reduces the numberofclerks inthe Police Departmentto fiveand theoffice could be open from 8 a.m. to 12 midnight seven days a week.IfCouncil agrees with this proposal, a policywould need to be adopted which restricts prisoners being detained inthe city's facilities from 8 a.m. to 12 midnight and necessary adjustments would be needed to accommodate lobby and phone operations during the suggested closure time. Joseph K.Gavinski,City Manager,stated that,due to impacts of I-695,the Police Chief had proposed eliminating the DARE officer and reducing the public hours of operation of the Police Department from 24 hours a day to 8 hours a day.The legislature has not yet offered any relief from the loss of revenue due to I-695.Because of loss of revenue,the city has come upwiththe solution of filing the police officer position, i^J then an officer would bechosen to bethe DARE officer,and then reduce the number ofclerks in the Police Department with the resulting loss of24-hour service in the Police Department. Fred Haynes,PoliceChief,stated that itwill take up to 18 months to replace the DARE officer. The reason forthe time lag is that the new officer must be trained and then a trained officer must be selected and sent to DARE training. There was some discussion by the Council.
