2000 05 165616-A MOSES LAKE CITY COUNCIL SPECIAL MEETING May 16,2000 CouncilPresent: Richard Pearce,Chris Blessing,Larry Tracy,Tom Porter,Lee Blackwell,and Ron Covey MOSES POINTE -EXTRA TERRITORIAL UTILITY AGREEMENT Joseph K.Gavinski, City Manager,presented the status ofthe negotiations between the Cityof Moses Lake and Moses Pointe with regard to a new "Exhibit E"which appears as an attachment to the Extra Territorial Utility Agreement between the City and Moses Pointe. (^/Adraft ofa new "Exhibit E"was presented to the City Council although the city was not fully in agreement with some of the provisions.Moses Pointe representatives presented their position on the new"Exhibit E". There was considerable discussion by the City Council. Action Taken:Dr.Covey moved that the City Manager be authorized to execute a new Extra Territorial Utility Agreement with a new "Exhibit E"as the City of Moses Lake staff and the Moses Pointe representatives presented with the following changes: 1.The sewer force main be installed adjacentto and westof Westshore Driveincounty right-of-way between approximately 22'and 27'of centerline. 2.The watermain be installed adjacentto and eastofWestshore Driveincounty right-of-way between 12'and 15'of centerline. 3.Moses Pointe Golf Course be allowed to purchase water from the city during off-peak hours forhalf of the City of Moses Lake's published commercial price for a maximum of 14 calendar days per emergency event. 4.Moses Pointe's abilityto use City of Moses Lakewaterand sewer is vested as a matterof law since the Moses Pointe development is included in the City's Urban Growth Area as approved by Grant County and the draft of the City ofMoses Lake's Comprehensive Plan,which is yet to be adopted. 5.Moses Pointe be given a oneyearextension forvesting underthe ExtraTerritorialUtility Agreement, seconded by Mr.Porter, and passed unanimously.
