MINUTES:Mr.Deane moved that the minutes of the May 23,2006 meeting be approved as submitted,seconded by Mr.Lane, and passed unanimously. APPROVAL OF BILLS.CHECKS.AND PREPAID CLAIMS Action Taken:Mr.Pearce moved that the bills,checks,and prepaid claims issued be approved, seconded by Mr.Ecret, and passed unanimously. Vouchers audited and certified bythe Finance Director as required by RCW 42.24.080, and those expense reimbursement claims certified as required by RCW42.24.090,have been recorded on a listing which has been made available to the Council for approval and is retained for public inspection at city hall. As ofJune 13,2006 the Council does approve for payment vouchers inthe amountof $629,135.78 and prepaid claimsof $136,852.69, $6,208.89, $12,683.12, and 82,749.36. ^J U PRESENTATIONS AND AWARDS Dean Mitchell,Police Chief, explained that the Police Department depends a great deal on the public.A Certificate of Recognition was presentedto KBSNand Al Sackman for theirassistance to the PoliceDepartmentand the community by sponsoring a program called Moses Lake Police Beat. CONSENT AGENDA Accept Work - 2006 Crack Seal Proiect:Quality Paving,Inc.has completed work on the 2006 CrackSeal Project.This project included sealing approximately 107,000 feet ofcracksonvarious streets,parking lots,and pathsthroughout the city.The Council shouldaccept the workandenter into the 45 day lien period. Accept Work -Water and Sewer Proiect:Desert Rock Construction has completed the Loring,//{,& Harris,Owen,Westover Water and Sewer Project. This project was funded by an economic development grant applied for bythecounty.Grant CountyPublic Works administered the project. The work is completed and should be accepted by the Council. Accept Work -2005 Sewer Tv and Cleaning Proiect:Pipe Experts,Inc.has completed work on the //&^ 2005 Sewer TV and Cleaning Project.This project consisted ofcleaningand recording morethan 80,000 feet of8",10",and 12"sanitary sewermaininthe KnollsVista, Lakeview, and Larsonareas. The work should be accepted and the 45 day lien period entered. JO/3 Resolution-Grant Easement -PUD:A resolution was presented whichgrantsan easementtothe PUD for electric,telecommunication,and other services along Sixth Avenue. /£#£Resolution -Pioout in McCosh Park Festival:A resolution was adopted which authorizes Six Bridges Arts Association to operate the Pigout in McCosh Park festival on July 20 - 23,2006. /£?UU Resolution - RollinThunder Motor Ministries Festival: A resolution was adopted which authorizes the RollinThunder Motor Ministries to operate a car and motorcycle show and associated activities on July 21-23,2006. Action Taken:Mr.Lane moved that the Consent Agenda be approved,seconded by Mr.Pearce, and passed unanimously. COMMISSION APPOINTMENTS -None CONSIDERATION OF BIDS -None PETITIONS.COMMUNICATIONS.OR PUBLIC HEARINGS //ft)ORDINANCE -FODE/PALMERTON ZONE CHANGE -PUBLIC HEARING - 1ST READING An ordinancewas presented which zones property outside the city's limits and is intended to be effective once the property is annexed intothe city. This process isauthorizedby state law.The property proposed for rezoning isthe property intendedto be purchasedby Guardian Industries. A part ofthis property is insidethe city'sUGA andthe other part is in the processofbeing brought into the city's UGA. The ordinancezoning property to become effective upon annexation of the said propertyintothe city was read by title only. Joseph K.Gavinski,City Manager,stated that Guardian Industrieshas requested this pre-zoning of the propertyas they wish to be assured their projectwill be compatible with the zoning on the property.He mentioned that their attorney has sent a letter concerning this pre-zoning of the property andhasalso suggested additional languagefor the DeveloperAgreementaddressingthe issue. Terry Brewer, Grant County Economic Development Council,stated that this has been a long process and he was appreciative of the efforts of the cityto find a solution to Guardian's concern. The public hearing was opened. Action Taken:Mr.Reese moved the publichearing be closed,seconded by Mr.Lane, and passed unanimously. ORDINANCES AND RESOLUTIONS ORDINANCE -PARKING REGULATIONS -1st READING Anordinance was presented which limits on-street habitual vehicle parking orstorage onanycity street to10days and prohibits habitual vehicle parking orstorage onundeveloped city right-of-way. The ordinance amending Chapter 10.12 of the Moses Lake Municipal Code entitled "Parking Regulations" was read by titleonly. Joseph K.Gavinski,City Manager,stated that many cities have regulations limiting parking on city streets and on undeveloped right-of-way. Action Taken:Mr.Reese moved thatthe first reading ofthe ordinance be adopted, seconded by Mr.Lane, and passed unanimously. ORDINANCE -SMOKING BAN - 1st READING U An ordinance was presented which prohibits smoking and the use oftobacco products in certain locations within the city's parks. The ordinance creating Chapter 8.56ofthe Moses Lake Municipal Code entitled "Smoking and Tobacco Use Prohibited in City Parks"was read by titleonly. Joseph K.Gavinski,City Manager,stated thatthe ordinance hasbeen drafted to prohibit smoking in certain areasofthecity's parks wherepeoplecongregate.Hementioned thatthe Council needs to establish the penalty amount. Mr.Ecretquestioned the fact thatthe Farmer's Market was notaddressed inthis ordinance. There was some discussion by the Council. Action Taken:Mr.Pearce moved that the ordinance be amended by adding "within 25'of any public market orfestival or public gathering conducted in any city park",the penalty besetatC-7, andthe first reading ofthe ordinance beadopted,secondedby Mr.Ecret,andpassed unanimously. •RESOLUTION -DONATION -SPECIAL OLYMPICS A resolution was presented which accepts $407.84 from Virginia Jones, Candy Davis,and the participants of a Special Olympics fund raiser.The funds are to be used for the Parks and Recreation Special Olympics Program. A resolution accepting a cash donation of $407.84 from Virginia Jones,Candy Davis,and participants ofthe Special Olympic car fund raiser was read by title only. ^•—'Action Taken:Mr.Ecret moved that the resolution be adopted,seconded by Mr.Lane,and passed unanimously. /027 J/S3 /&V& 6370 CITY COUNCIL MINUTES June 13,2006 REQUEST TO CALL FOR BIDS -None REFERRALS FROM COMMISSIONS -None OTHER ITEMS FOR COUNCIL CONSIDERATION /05~f ANNEXATION -CARROLL PatrickCarrollhassubmitted a Notice of Intent to Commence Annexation Proceedings for property south ofthe proposed Lakes Major Plat at the end of Hamilton Drive. Action Taken:Mr.Reese moved that the Notice of Intent be receipted,seconded by Mr.Pearce, and passed unanimously. )0*?MOTORIZED FOOT SCOOTERS The Police Department conducted a survey of 29 Washington cities that regulate motorized foot scooters.Of the 29 cities,19 require operators to be 16 years of age. There was considerable discussion by the Council. Action Taken:Mr.Pearce moved that the requestto lowerthe age limit for operating motorized foot scooters be denied,seconded by Mr.Deane. There was additional discussion bythe Council.{] The motion failed with Mr.Pearce,Mr.Ecret,and Mr.Deane in favor and Mr.Lane,Mr.Reese,and Mayor Covey opposed. Staffwas directed to draft an ordinance amendmentto allow 12 year olds to operate motorized foot scooters on city streets with appropriate head gear. //$7 PIGEONS Staff requested direction from the Council concerningthe keeping of pigeons inthe city limits. Joseph K.Gavinski,City Manager,stated that the raising of pigeons is not permitted underthe city's current regulations. James A. Whitaker, City Attorney, pointed out that, inthe dictionary,fowl means birds. Mayor Covey pointed out that the reason the city became aware of the raising of pigeons was because of a complaint from a neighbor. MickNicholas,114 E.Tanglewood,stated that ifallbirds are considered fowl,then allbirds kept inthe city are illegal,including parrots,parakeets, and other pet birds. He mentioned that ifthe ordinance is adopted to allow the raising of pigeons he would volunteer to provide guidance to others who would wish to raise pigeons. There was some additional discussion by the Council. n n 6371 CITY COUNCIL MINUTES .June 13,2006 ^_J Staff was directed to provide adraft ordinance prohibiting pigeons inside the city limits and allowing caged birds within a home. NEPPEL LANDING -TAXES The Grant County Assessorhasdetermined that therailroad property leased bythe City of Moses Lakeis taxable.The property will be placed onthe tax rolls for the 2006tax year. Joseph K.Gavinski,City Manager,stated that there is a possibility the lease could beterminated and thecity could request a license from therailroad for the property.That may create a different status for the property anditwould no longer be taxable.He felt this could be a significant issue in the future and he will continue to work towards a solution. MOSES LAKE PIRATES BASEBALL CLUB -ALCOHOL IN PARK Brent Kirwan,owner ofthe Moses Lake Pirates Baseball Club,previously requested permission to havean adult beveragearea,operated bya non-profit group,during the baseball games. Joseph K.Gavinski,City Manager,distributed a survey ofthe other baseball teams in this league and whether or not alcohol is served during the games. Spencer Grigg,Parks and Recreation Director,stated that in contacting the various teams and facility managers, no significant issues were reported. i,)Mr.Kirwan stated that they would like to set up an area for adult beverages that will be manned by trained personnel.He mentioned that ifthere are problems thenitwill be eliminated.He felt that they could keep good control and serving will cease atthe beginning ofthe 7th inning. There was some discussion by the Council. Action Taken:Mr.Pearce moved that the request to serve alcohol at the Moses Lake Pirates Baseballgames at Larson Playfield be granted,seconded by Mr.Ecret,and passed unanimously. TUCKER MINI-STORAGE -WATER MAIN Columbia Northwest Engineering,requested a deferral of the requirement to extend water main from Broadway Avenue to Lee Street to serve the Tucker mini-storage development.The request is to only extend the water main from Broadway down Mario Avenue to the edge of the Tucker property. A covenant would be required for the extension of the water main in the future. Action Taken:Mr.Lane moved that the request be granted with the stipulation that a covenant be required for the improvements in the future,seconded by Mr.Pearce,and passed unanimously. NON-AGENDA ITEMS AND PUBLIC QUESTIONS AND COMMENTS DOWNTOWN IMPROVEMENTS -THIRD AVENUE s Rich Engleman,Spring Festival,stated that they have an issuewith locating the clock from Sinkiuse i j Square to the center ofthe intersection ofThird Avenue and Ash Street.He pointed out that the ^—^Spring Festival and Ag parades are designed to bring people to the downtown area and the floats will be unable to get around the clock if it is placed in the center of the intersection. yj?30 //// //6>G J/0? 6372 CITY COUNCIL MINUTES June 13,2006 Brent Kirwan,Spring Festival,stated that the clock in the center of the intersection will have an impact on the two parades as itwill be difficult to get the floats and tractors around it. Vern Hellewell,4496 Road E NE,stated that there were several options for the downtown redevelopment,including the clock in the intersection. He mentioned that the entries in the Ag parade will be unable to maneuveraround a clock in the middle of the intersection. MayorCovey mentioned that the clock inthe middle of the intersection was proposed by people in the downtown area and discussed by the Council, including the fact that the clock would be within the parade route. There was some discussion by the Council concerning the possibility of rerouting the parade or moving the clock.Because the Third Avenue Redevelopment Project has already gone to bid, it was the consensus of the Council that no changes should be made at this time,so the clock will remain in the center of the intersection. —)A ESSENTIAL AIR SERVICE -BIG SKY Terry Brewer, GrantCounty Economic Development Council,stated that the FAA will no longer subsidize airservice at Moses Lake unless more people use it. Itis important to emphasize to the FAA and our senators and representatives that air service is vital to this area.He mentioned that 8,000 people have used the air service in the past year. Delone Kruger,Port ofMoses Lake Commissioner,stated that they are working on keeping the air ^^ service in Moses Lake and will be glad of support from the Council.He mentioned that one f ) problem is that the $200 subsidy amount was set 16 years ago and has never been adjusted and they are working on getting that changed. Mayor Covey mentioned that there is only a short time in which to try to prevent the elimination of the essential air service subsidy. COUNCIL QUESTIONS AND COMMENTS /DO0!COUNCIL IN THE PARK Mr.Ecret feltthat the availability of the Council members at the parkshould be advertised and the location moved closerto the centerofthe Farmers Market. He suggested that the sign bechanged and that the next publicforum be on a day when more Council members are available. /C3j>FIREWORKS Mayor Covey stated that the restroom in the Civic Center Park was damaged when someone dropped lighted fireworks in the toilet.He also mentioned thatthe new wing ofaschoolinCentralia was destroyed by a fire caused by children playing with fireworks. /OOLp MUNICIPAL AIRPORT Mr.Pearce stated that the Airport Commission is in the process of developing an operations ^^^ manual.Oneofthe issues addressed inthe manual iswhoisthe developeronthe airport,the city f) orthe lessee. June 13,2006 and in the past those persons have paid for the development charges.The issue will bediscussed atthe next Airport Commission meeting and a recommendation will be forwarded tothe Council. CITY MANAGER REPORTS AND COMMENTS PROJECTS UPDATE /030 The projects update report from Community Development was presented. BUILDING ACTIVITY REPORT /0%6/•) The May 2006 Building Activity Reportwas presented. INVESTMENT REPORT The investment report showed the city earned $79,995.80 in investment income in May 2006. SALES TAX/TRANSIENT RENTAL INCOME //S(f'£ Joseph K.Gavinski,City Manager,reported that the city received $375,652.50 in sales tax and $21,728.22 in transient rental income in May 2006. UNIFORM CRIME REPORT The 2004-2005 Uniform Crime Report for Moses Lake was presented. The regular meeting was recessed at 10:15 p.m.and the Council met in an executive session to discuss a real estate purchase. Theexecutivesession was adjournedat 10:20 p.m.andthe regular meeting was reconvened. REAL ESTATE PURCHASE Joseph K.Gavinski,City Manager, reportedthat Don Swanson has offered property in Longview Tracts to the city. Action Taken:Mr.Lane moved that the staff be authorized to spend $95,000 to purchase approximately 3 acres of property in Longview Tracts for a park,seconded by Mr.Reese,and passed unanimously.
