2007 11 27U u u MOSES LAKE CITY COUNCIL November 27,2007 6628 Council Present:Ron Covey,Bill Ecret, Dick Deane,Richard Pearce,Brent Reese,Jon Lane, and Jim Liebrecht PLEDGE OF ALLEGIANCE:Mayor Covey led the Council in the pledge of allegiance. MINUTES:Mr.Deane moved that the minutes of the November 13,2007 meeting be approved, seconded by Mr.Lane,and passed unanimously. APPROVAL OF CLAIMS.PREPAID CLAIMS.CHECKS.AND PAYROLL Action Taken:Mr.Ecret moved that the bills,checks,prepaid claims,and payroll issued be approved,seconded by Mr.Reese,and passed unanimously. Vouchers audited and certified by the Finance Directoras required by RCW 42.24.080,and those expense reimbursement claims, certified as required by RCW 42.24.090,have been recorded on a listing which has been made available to the Council for approval and is retained for public inspection at city hall. As of November 27,2007 the Council does approve for payment claims in the amount of $350,087.54;prepaid claimsinthe amounts of $311.63 and $766,466.15;checks inthe amount of $2,182,186.01;and payroll inthe amount of $38,853.26. PRESENTATIONS AND AWARDS -None CONSENT AGENDA Power Pointe 1 Final Major Plat and Findings ofFact:Columbia Northwest Engineering,on behalf of Smart Homes,Inc.,submitted the Power Pointe 1 Final MajorPlatforreview.The 10.5 acre plat has 29 residential lots and a 1.65 acre lot intended for development as a neighborhood park.The site is located at the northeast intersection of Linden Avenue and Beaumont Drive and east of the railroad right-of-way.The plat has no lake frontage,but itis within 200'ofthe ordinary highwater mark,and a Category III wetlandwas delineated alongthe water's edge. The site is zoned R-1, Single Family Residential,and the Comprehensive Plan Land Use Designation is Low Density Residentialwhichcorresponds withthe existing zoning. The Planning Commission recommended thatthe final plat be approved with conditions.As no appealwas taken from this decision ofthe Planning Commission,the Council's approval ofthisdecision incorporates andadoptsthe Findings, Conclusion and Decision ofthe Planning Commission. COMMISSION APPOINTMENTS -None CONSIDERATION OF BIDS AND QUOTES -None /A?6 6629 CITY COUNCIL MINUTES:2 November 27,2007 PETITIONS.COMMUNICATIONS.OR PUBLIC HEARINGS /D/Q ORDINANCE -ADOPT 2008 BUDGET -2nd READING -PUBLIC HEARING The ordinance adopting the 2008 budget was presented. The ordinance adopting the budget for the Cityof Moses Lake,Washington for the year of 2008 was read by title only. The public hearing was opened.There were no comments. ActionTaken:Mr.Reese moved thatthe publichearing be closed,seconded by Mr.Liebrecht,and passed unanimously. Action Taken:Mr.Liebrecht moved that the second reading of theordinance be adopted,seconded by Mr.Lane, and passed unanimously. //£(#ORDINANCE -HAYDEN HOMES -DEVELOPMENT AGREEMENT -2nd READING AND PUBLIC HEARING An ordinance was presented which adopts the pre-annexation development agreement with Hayden Homes.This agreement concerns the dedication of park property associated with the Crossroads Major Plat. The ordinance approving a pre-annexation development agreement between the City of Moses (]) Lake and Hayden Homes,LLC, Inc.was read by title only. Larry Angell,Columbia Northwest Engineering,representing Hayden Homes, stated that the agreement states that Hayden Homes will dedicate 5% of the developed gross area of the Crossroads Major Plat.The area will be plattedinthree phases butthe 5%to be dedicated for park property includes the total amount of property in all three phases. ORDINANCES AND RESOLUTIONS 07 ORDINANCE -VACATE BALSAM AND FOURTH -1st READING An ordinance was presented which vacates a portionof Balsam Street and that portionof Fourth Avenue between Balsam Street and Alder Street. The ordinance vacating a portion of Fourth Avenue and Balsam Street was read by title only. o O o u o 6630 CITY COUNCIL MINUTES:2 November 27, 2007 Anne Henning,Senior Planner,explained that the vacation of these portions of FourthAvenue and Balsam Street will facilitate the construction ofthe new city hall complex. Floyd Wilkes, pastorof the Church of the Nazarene, stated that the main entrance to the church is on Balsam Street which is also the main traffic flow between Third Avenue and Fifth Avenue.He waned to know ifa traffic study had been conducted and was concerned about closing streets in the downtown when the city is trying to promote business in the downtown area.The church was also concerned about the impact ofthe campus style complex on the church property, their new parking lot,and possible decrease in propertyvalue. The church was concerned about ending a street in the middle of the block and the loss of parking on Balsam.He pointed out that Balsam Street is also heavily used by Grant Transit Authority. June Groff,414 Balsam,mentioned that she has some ofthe same concerns as the church as well asthe fact thatthe school buses use Balsam and Fourth.She wanted to know if access to the alley would be available if the streets were vacated. Mayor Covey explained that the bus routes would probably have to be adjusted. He pointedout thatthe additionalparkingthat will be created wouldalleviatethe parkingproblemon Balsam Street andthe alleycouldbe accessed from thevacated portion of Fourth Avenue. Hementionedthatthe vacated streets and the area adjacent are partof the proposed new city halland museum complex and the proposed layout would be available at the next Council meeting. A letter was received from John Ahlers,Carl T. Properties, LLC,which expressed concern about the impact the vacation would have on the adjacent properties. Action Taken:Mr.Reese moved that the first reading of the ordinance be adopted,seconded by Mr.Liebrecht,and passed unanimously. ORDINANCE -AMEND SPEED LIMITS - 2nd READING An ordinance was presented which establishes a 35 mph speed limit on Road N from Wheeler Road to Road 4. The ordinanceamending Chapter 10.10 ofthe Moses Lake Municipal Code entitled"Speed Limits- was read by title only. Action Taken:Mr.Reese moved that the second reading of the ordinance be adopted,seconded by Mr.Pearce,and passed unanimously. ORDINANCE - AMEND FIRE DEPARTMENT PERMIT FEES - 2nd READING An ordinance was presentedwhichincreasesthe fees for the inspectionsand reviews required by the Fire Department. The ordinance amending Chapter 16.40 of the Moses Lake Municipal Code entitled "Fire Department Permit Fees"was read by title only. GaryG.Harer,Municipal Services Director,stated thatthe watercontains some lead, diesel, and other contaminants but not in sufficient quantities to be of concern to staff. Action Taken:Mr.Liebrecht moved that the request to discharge water to the city system be granted,seconded by Mr.Pearce,and passed unanimously. )QSp-ANNEXATION -REC SOLAR GRADE SILICON II REC SolarGrade Siliconis proposingto annex approximately 95.65 acres of propertylocated west of Road N and south of Road 4.The Notice of Intention to Commence Annexation Proceedings and the Petition for Annexation were presented. Action Taken:Mr.Ecret moved that the Notice of Intent and Petition for Annexation be accepted,f] seconded by Mr.Liebrecht,and passed unanimously. WAIVER -NOISE REGULATIONS Shane Carlile,Advanced Excavation,Inc.is requesting a variance to the noise regulations inorder to allow his crew to warm up the equipment beginning at 6:30 a.m.The noise regulations prohibit construction activity priorto 7 a.m.and after 10 p.m. Gary G. Harer, Municipal Services Director,stated that this project is the water line being constructed on Luta and Virginia Streets and the early start should last about a month. NON-AGENDA ITEMS AND PUBLIC QUESTIONS AND COMMENTS -None COUNCIL QUESTIONS AND COMMENTS JI At AGCCT MEETING Mayor Covey reminded the Council members of the AGCCT meeting on Thursday,November 30, at the Museum and Art Center beginning at 6:30 p.m. O O CITY COUNCIL MINUTES:2 6632 November 27,2007 GRANT COUNTY FAIRGROUNDS Mayor Covey reported that the Grant County Commissioners bid out construction at the Grant County Fairgrounds and then provided an addendum to the bidders which was for construction of a septic system to service two of the buildings.He mentioned that the system is small enough that no approval is required from the Health Department and that it is the intent of Grant County to construct a sufficient number of these small septic systems to service the fairgrounds rather than connect to city sewer.He was concerned about the accumulative effect of all these small systems on the surrounding property,which includes areas within the city limits. It was the consensus of the Council that a letter be sent to the appropriate agencies and persons expressing the city's concern overthe accumulative effect of the septic systems on the fairgrounds.
