MINUTES:Mr.Deane moved that the minutes of the November 27,2007 meeting be approved, seconded by Mr.Liebrecht,and passed unanimously. APPROVAL OF CLAIMS.PREPAID CLAIMS.CHECKS.AND PAYROLL Action Taken:Mr.Pearce moved that the bills,checks,prepaid claims,and payroll issued be approved,seconded by Mr.Ecret, and passed unanimously. Vouchers audited and certified by the Finance Directoras required by RCW 42.24.080,and those expense reimbursement claims, certified as required by RCW 42.24.090,have been recorded on a listing which has been made available to the Council for approval and is retained for public inspection at city hall. As of December 11,2007 the Council does approve for payment claims in the amount of $820,770.01;prepaid claims in the amounts of $103,774.58, $100,778.00, $34,65.93, and $476,671.71;checks inthe amountof $1,177,124.90;and payroll intheamountsof $40,950.97 and i j $11,127.77. PRESENTATIONS AND AWARDS -None CONSENT AGENDA AcceptWork -2007 Seal Coat Project:Granite Northwest,dba Basin Asphalt,has completed work on the 2007 Seal Coat Project.This projectconsisted of chip sealing portionsof Central Drive, Grape Drive,Peninsula Drive,A Street,Knolls Vista Drive,BurressAvenue, and Interlake Road, and overlying Stratford Roadand Montlake Park.The workshouldbe accepted andthe 45day lien period entered into. Accept Work -2006 Downtown Reconstruction Project: MRM Construction has completed work on the 2006 Downtown Reconstruction Project. This project consisted of constructing a small stage with a grass seating area,restrooms and fountain in Sinkiuse Square, and reconstructing Third Avenue from Division Street to the post office with wide sidewalks,two raised crosswalks and installing a traffic circle with the clockatthe intersection ofThird Avenue andAsh Street. The work should be accepted and the 45 day lien period entered into. Desertpoint Retail Preliminary Major Plat and Findings ofFact:Columbia Northwest Engineering,//Ab on behalfof Maiers Development Corporation,submitted a preliminary majorplatfor aone lot22.09 acre piece of property located at the northeast intersection of SR-17 and Yonezawa Boulevard. The site is zoned C-2,General Commercial and Business.The Planning Commission recommended thatthe preliminary platbe approvedwithconditions. As noappealwas taken from this decision of the Planning Commission,the Council's approvalof this decision incorporates and \_J adopts the Findings,Conclusion and Decision of the Planning Commission. /O/?/•) //0 7 6634 CITY COUNCIL MINUTES December 11,2007 //<?&>Desertpoint Retail Final Maior Plat and Findings of Fact:Columbia Northwest Engineering,on (\) behalf of Maiers Development Corporation,submitted a final major plat for a one lot22.09 acre pieceof property located atthenortheastintersection of SR-17 andYonezawa Boulevard.Thesite is zoned C-2,General Commercial and Business.The Planning Commission recommended that the final platbe approved withconditions. The Findings of Factwere also presented for approval. /Of3 Resolution -AbandonEasement -Municipal Airport:A resolution was presentedwhichabandons an easement on Parcels 19-34,Municipal Tract No.12 Lot2 Commercial Binding Site Planand re-establishes the easement on the same lots but in a different location. fc2/0 Resolution -Accept Grant -Dept.of Transportation:A resolution was presented which accepts a grant in the amount of $290,000 from the Department of Transportation for the Wanapum Drive Activity Trail. Action Taken:Mr.Ecret moved that the Consent Agenda be approved,seconded by Mr.Lane, and passed unanimously. COMMISSION APPOINTMENTS -None CONSIDERATION OF BIDS AND QUOTES -None PETITIONS.COMMUNICATIONS.OR PUBLIC HEARINGS jObO VARIANCE -SECURITY PERSONNEL T &MSurplus requested permission to retain on-site security personnel at the business at 1102 Broadway. Gilbert Alvarado,Community Development Director,statedthatthereisa 5th wheellocated onthe premises that is being used to house the on-site security person. He pointedout that to allowthe occupancy of a recreationalvehicle inthe commercial zones forsecurity purposes would require an amendment to the ordinance. Mike Davis, T &MSurplus,stated that because of numerous break ins over the past several years he installed security cameras both inside and outside the building. The security system is monitored from the recreational vehicle.The security person usesthe restroom facilities inside the building. There was some discussion by the Council and itwas the consensus that a security office should be housed within the existing building. Council directed staffto investigate the possibility of amending the city's ordinances to address the issue of security in commercial and industrial zones. /Of 7 ORDINANCE -VACATE BALSAM AND FOURTH -2nd READING/PUBLIC HEARING An ordinance was presented which vacates a portion of Balsam Street and that portion of Fourth Avenue between Balsam Street and Alder Street. The ordinance vacating a portion of Fourth Avenue and Balsam Street was read by title only. O O u ^J u 6635 CITY COUNCIL MINUTES December 11,2007 Gilbert Alvarado,Community Development Director,stated that conceptual drawings have been provided that shows how the vacated right-of-way might be used. The public hearing was opened. Pastor Floyd Wilks,First Church ofthe Nazarene,located atthe intersection of Balsamand Fifth Street, stated thatthe church members were concernedaboutthe vacation of4th and Balsamand requested the following issues be addressed: they felt they had not been given complete information onthe urgency to vacate atthistime; Balsam Street isthe mainentrance tothe church; Balsam Street is a main traffic flow between Fifth and Third Streets;there would be a dead end in the middle ofthe block;and Balsam Street is a route for the school and GTA buses and the access to the policestation. He wanted to know ifa traffic study had been conducted on these two streets and whether or not a traffic memo has been submitted.Since the city is promoting downtown businesses,why are streets beingvacated and isthis vacation partofthe Vision2020 project.He was concerned about the impact on the church's propertyof this proposed development and its impact ontheir proposed parking lot on 5th andAlder.He was concerned thatthenewdevelopment may restrict the church's parking on Balsam. Mayor Covey statedthatno traffic study has been done and none is anticipated.The vacation of Balsam and Fourth is in conjunctionwith the new city hall which was considered as part of the downtown core by the downtown improvement consultants.It was pointed out that parking on Balsam is open to the public. Mr.Alvarado stated that a traffic memo is used when development is proposed. June Groff,414 Balsam,was concerned how the vacation of the streets and the new facilities will impact herproperty andsuggestedthatthevacation ofthestreetswait until a design ofthe property is submitted. Alicia Brogan was concerned howthis proposed vacation will affectthe Community Gardens.She suggested thatthe Community Gardens remain andthe parking lot be placed around it. Joseph K.Gavinski,City Manager,pointed out that the architect needsto know theextentofthe propertyavailable for the new facilities before design can begin. Action Taken:Mr.Pearce moved that the publichearing be closed,seconded by Mr.Reese,and passed unanimously. ActionTaken:Mr.Pearce moved that the second readingofthe ordinance be adopted,seconded by Mr.Reese. There was considerable discussion by the Council. The motion passed with Mr.Ecret and Mr.Liebrecht opposed. ORDINANCES AND RESOLUTIONS ORDINANCE - UTILITY SYSTEM DEVELOPMENT CHARGES - 2ndREADING An ordinance was presented with increases the utility system development charges. J/fr/ORDINANCE -AMEND 12.40 - STREET CONSTRUCTION OR IMPROVEMENTS REIMBURSEMENT CHARGES -1st READING An ordinance was presented which establishes the street reimbursement charges for the construction of the righthand turn lane at Grape Driveand Highway 17. The ordinance amending Chapter 12.40 of the Moses Lake Municipal Code entitled "Street Construction or Improvements Reimbursement Charges" was read by title only. ActionTaken:Mr.Pearce moved that the first reading of the ordinance be adopted,seconded by Mr.Lane,and passed unanimously. /O/O ORDINANCE - AMEND 2007 BUDGET - 1st READING An ordinance was presented which amends the 2007 budget. The ordinance amending the 2007 budget forthe Cityof Moses Lake,Washington,was read bytitle only. Action Taken:Mr.Reese moved that the first reading of the ordinance be adopted,seconded by Mr.Deane,and passed unanimously. /OSY ORDINANCE -AMEND 18.23 -MULTI-FAMILY HOUSING TAX EXEMPTION -1st READING An ordinance was presented which amends Chapter 18.23,Multi-Family HousingTax Exemption, by increasing the number of years the tax exemption is allowed. The ordinance amending Chapter 18.23 of the Moses Lake Municipal Code entitled "Multi-family Housing Tax Exemption"was read by title only. Joseph K.Gavinski,City Manager recommended that the ordinance be amended by changing section Fto read "Within thirty ...for a period of 8 or 12 years,depending on the tax exemption granted, the propertyowner...following:"He mentioned thatthe changes will bringthe ordinance into compliance with state law. w Action Taken:Mr.Lane moved that the ordinance be amended as recommended by the City Manager and the firstreading of the ordinance be adopted,seconded by Mr.Reese,and passed unanimously. /Qf>y ORDINANCE -VACATE JUNIPER DRIVE - 1stREADING An ordinance was presented which vacates a portion of Juniper Drive. The ordinance vacating a portion of Juniper Drive was read by title only. Action Taken:Mr.Liebrecht moved that this item be removed from the table,seconded by Mr. Lane,and passed unanimously. O o 6637 CITY COUNCIL MINUTES December 11,2007 ()Gilbert Alvarado,Community Development Director,stated that the property owners in the neighborhood werenot provided additional notification thatthisvacation was being considered by the Council at this time. Mayor Covey mentioned that$155,000 would beaboutone third ofthecostto improve Lark Avenue as an alternative traffic route if Juniper were vacated. David Olsen,Administrator of the Moses Lake Clinic,distributed a plan showing howthe vacated portion of Juniper Drive would be developed and mentioned thatthe clinic's Board would haveto consider the proposal to contribute to the improvements to Lark. There was some discussion by the Council. Action Taken:Mr.Reese moved that the ordinance be changed to require the city be compensated for 100%of the appraised value of $155,000,the funds be dedicated to the improvement of Lark Avenue,and the first readingof the ordinance be adopted,seconded by Mr.Liebrecht,and failed with Mr.Liebrecht,Mr.Reese,and MayorCovey infavorand Mr.Ecret,Mr.Pearce,Mr.Lane, and Mr.Deane opposed. REQUEST TO CALL FOR BIDS VEHICLES u Staff requested authorization to call for bids for fivepolicecars,two service truckcab chassis, one spray truck cab and chassis,and one pickup. Action Taken:Mr.Lane moved that staff be authorized to call for bids,seconded by Mr.Liebrecht, and passed unanimously. REFERRALS FROM COMMISSIONS -None OTHER ITEMS FOR COUNCIL CONSIDERATION MOSES LAKE SCHOOL DISTRICT -HERMIT ROAD The Moses Lake School District submitted a proposal for the development of Hermit Road adjacent to the new elementary school on the lower Peninsula between Peninsula Drive and Lakeshore Drive. P. J. DeBennetti,Moses Lake School District,provided a proposed layout of the new school and Hermit Road.Hermit Road would extend from Lakeshore Drive and end in a cul-de-sac about half way to Peninsula Drive. Brent Harding,Moses Lake School District,explained the layout ofthe school andhow it relates to Hermit Road. Action Taken:Mr.Liebrecht moved that the City Manager be authorized to sign the permit, seconded by Mr.Lane,and passed unanimously. JO'Si ANNEXATION -REC SOLAR GRADE SILICON II REC Solar Grade Silicon submitted a new Notice of Intentto Commence Annexation and a Petition for Annexation.The new forms were submitted because a small portion of property was inadvertently left out of the original notice and petition. GilbertAlvarado,Community Development Director,pointed out the small portion of property that was included. Action Taken:Mr.Ecret moved that the Notice of Intent be receipted and the Notice of Intent and the Petition be accepted,seconded by Mr.Pearce,and passed unanimously. CITY MANAGER REPORTS AND COMMENTS //3f AMBULANCE UTILITY RATES Joseph K.Gavinski,City Manager, distributed information on ambulance utility rates in various cities in the State ofWashington. /030A BUILDING ACTIVITY REPORT The October 2007 Building Activity Report was presented. /003 INVESTMENT REPORT The city received $47,823.08 in investment income for November 2007. itfjr SALES TAX/TRANSIENT RENTAL INCOME I1 The city received $528,050.31 in sales tax and $41,168.74 in transient rental income in November I 2007. o 6639 CITY COUNCIL MINUTES December 11, 2007 2008 COUNCIL/STAFF RETREAT Joseph K.Gavinski, City Manager,stated that the Council/staff Retreat has been set for March 7 and 8 at the ATEC building at Big Bend Community College. The regular meeting was recessed at 9:30 p.m. and the Council met in an executive session to discuss labor relations. The executive session was adjourned at 10 p.m.and the regular meeting was reconvened. EMPLOYEE SALARIES Joseph K.Gavinski,City Manager recommended a 4.4%wage increase for Moses Lake Professional and Clerical Association members,non-union staff,and exempt employees.This is the same increase the firefighters will receive under their contract.The police officers will receive a 5%increase under their contract. Action Taken:Mr.Pearce moved that the city provide a 4.4%wage increase to the Moses Lake Professional and Clerical Association members,non-union staff,and exemptemployees,seconded by Mr.Liebrecht,and passed unanimously.
