APPROVAL OF BILLS.CHECKS.AND PREPAID CLAIMS ActionTaken:Mr.Chandler moved that the bills,checks,and prepaidclaims issued be approved,seconded by Mr.Edwards,and passed unanimously. Vouchers audited and certified by the Finance Directoras required by RCW 42.24.080, and those expense reimbursement claims certified as required by RCW 42.24.090, have been recorded on a listing which has been made available to the City Council. Claims: The vouchers included on the below list as modified by the Council and noted upon said list for the Council meeting of January 8,1991 for the funds listed below are approved in the amount of $211,795.90. Prepaid Claims: Prepaid claims approved by the City Manager according to the process established by Moses Lake Municipal Code 3.42.030 and the internalcontrol policy approved by theCityCouncil have been recorded on a listing which has been made available to the City Council.The claims listed below are approved in the amount of $20,937.60 Forail funds. I.CITIZEN INPUT -None II.EMPLOYEE PRESENTATIONS -None III.CONSENT AGENDA -None IV.CONSIDERATION OF BIDS STRATFORD ROAD IMPROVEMENT IwJ Marchand Construction was the low bidder for the base bid for the Stratford Road project.The four alternatives were(1)construction of parks north andsouthofthe bridge with additional trees,shrubs,park benches, seeded lawn and irrigation system;(2)bus turn-out laneon the southend ofthe fill atthe railroad tracks;(3)360 additional shrubs along both sides ofthe fill between the trees and along the backside of thebikepath andsidewalk;and (4)extra traffic control work andspecial working conditions inorder tokeep one lane open both ways during business hours. Phil Bloom,Municipal Services Director,stated that the amount of Marchand's bid and the engineer's estimate was reported incorrectly in the letter;Marchand's bid is $856,312.13 and the engineer's estimate is $819,515.38. Action Taken:Mrs. Brown moved that the base bid and the four alternates be awarded to Marchand Construction,seconded by Mr.Johnson. The motion passed with Mr.Chandler and Mr.Biallas opposed. V.PETITIONS.COMMUNICATIONS.OR PUBLIC HEARINGS -None VI.ORDINANCES AND RESOLUTIONS *(a ORDINANCE -UNDERGROUNDING UTILITIES - 1ST READINGMO**^ An ordinance was presented which amends the undergrounding utilities requirements by eliminating the requirement to obtain a permit from the city for the installation of underground servicelines and allowing forthe installationof an aerial service line in an area already served by aerial service lines. The ordinance amending Chapter 16.56of the Moses Lake Municipal Code entitled "Undergrounding of Utilities'1 was read by title only. ActionTaken:Mr.Biallasmoved that the first reading of the ordinance be adopted,seconded by Mr.Reese, and passed unanimously. ion )!& VII.REQUESTS TO CALL FOR BIDS VEHICLES -SEWER AND FIRE Staffrequested authorization to call for bids fora one ton servicevehicle forthe Sewer Division and a quick response vehicle for the Fire Department. Action Taken:Mr.Chandler moved that staff be authorized to call for bids,seconded by Mrs. Brown, and passed unanimously. VIII.REFERRALS FROM COMMISSIONS LAGUNA WEST PRELIMINARY PLAT Dr.Milo Novotny has submitted a preliminary major plat for a single family residential subdivision to be _. located on Laguna Drive.The original proposal was for a subdivision approximately 7.9 acres in size and [^ containing 29 lots. The proposed subdivision has been revised pursuant to the environmental review forthe proposed subdivision and shoreline improvements.Twelve lots which were located in an R-3 Zone and in an undesignated shoreline area have been withdrawn from the proposed subdivision. The revised plat con sists of 18 lots and is approximately 5.06 acres in size. The area is zoned R-1,Single Family Residential. The plat will be served with city water and sanitary sewer.Full width street improvements to Laguna Drive are required.The proponent is requesting that the requirement to construct full width improvements be waived. The Commission recommended to the City Council that the preliminary plat be approved with the following variances and stipulations: 1.Variances be granted for the angles and width to depth ratios on Lots 1,16,17,and Tract A. 2. A variance to defer required street improvements to Laguna Drive be granted for five years with a covenant to run with the land requiring the subdivision property owners to participate in any future street improvements or LID,as may be required by the city for required Laguna Drive street improvements if not constructed by the city within the five year period, and that when the natural cover on the property is disturbed that dust and erosion control measures be required. 3.Sidewalk on Sandalwood Drive be required through the plat if it is needed. Ron Baker,representingthe developer,requested clarificationof the Council's position on the improvements to Laguna Drive proposed when the sewerline was installed on Laguna Drive.The developer is requesting that the improvements required on Laguna Driveunder the Subdivision Ordinance be waived since the city has indicated itwould construct the improvements in the future. He mentioned that the city had agreed to place Laguna on the street reconstruction list ifthe property owners agreed to participate in the sewer LID for the Laguna area.^""N* » Phil Bloom,Municipal Services Director,stated that when sewerwas installedon Lagunathe city had agreed to reconstruct the street from the bridge to the end of Laguna. That portion of Laguna from I-90 to the bridge was not included inthat project. However, the property owners adjacent to the street inthat area did participate in the sewer LID.He stated that Laguna is still on the street reconstruction list and is proposed to be constructed in 1992 or 1993. Joseph K.Gavinski,City Manager,pointed out thatthe commitment to reconstruct Laguna ifsewer were installed was forthe developed area. The currentrequest to waivethe required street improvements is for undeveloped property.Hepointedoutthatthe Council has made no commitmentto develop Laguna Drive from the bridge to i-90. SAGE BAY #7 PRELIMINARY PLAT The Moses Lake Property Partnership has submitted a preliminary plat for a single family residential "^^ subdivision to be locatedon Crestview Drive inthe Knolls Vista area.The proposed majorsubdivision will be approximately 4.33 acres in size and contain 11 single family residential lots. The Planning Commission recommended to the CityCouncilthatthe preliminary platbe approved withthe following variances: 1.Deferralof street improvements to Paxson Drivewith the condition that a covenant run with the land binding the property owners of the lots within the subdivision to construct the required street improvements when requiredto do so by the city or to participate inan LID forthe construction of the required improvements. 2. A variance be granted for angles on Lots 1, 2, 6, 7,and 8. 3. A variance be granted for Lot 9 on the width to depth ratio. ActionTaken:Mr.Chandler moved that the preliminary platbe approved as recommended by the Planning Commission,contingent upon approval of the shoreline permit by the Department of Ecology, and the Findings of Fact be approved,seconded by Mr.Johnson,and passed unanimously. IX.OTHER ITEMS FOR COUNCIL CONSIDERATION WATER/SEWER REIMBURSEMENT AGREEMENT -LPS CHURCH Authorization was requested to execute a water/sewer reimbursement agreement with the LDSChurch for the water/sewer lines they extended in the Sharon Avenue area. Action Taken:Mr.Johnson moved that staff be authorized to sign the agreement,seconded by Mr.Reese, and passed unanimously. TEST BORING -VALLEY ROAD White Shield, Inc. has requested permission to take a test boring on the north side of Valley Road nearthe intersection of Valley and Stratford for the purpose of monitoring groundwater. The test boring and monitoring well will obstruct city right-of-way.The boring and well installation would be done on a Sunday in order to reduce traffic problems. Action Taken:Mr.Reese moved that permission be granted to White Shield, Inc. to use city right-of-way, seconded by Mr.Johnson,and passed unanimously. X.COUNCIL QUESTIONS AND COMMENTS -None XI.CITY MANAGER REPORTS AND COMMENTS COUNCIL/STAFF RETREAT Dates for the Council/staff retreat have been tentatively set for March 22, 23, and 24 at the Red U- on/Thunderbird in Pasco. AWC LEGISLATIVE CONFERENCE The AWC LegislativeConference will be held on Wednesday and Thursday, February20 and 21,inOlympia./oo^~ Six Council members indicated they would be attending along with the City Manager, City Attorney,and Finance Director. The city would liketo discuss the Road Jurisdiction Committee's recommendation to give Broadway to the \^J city and theState Park asthe Governor has excluded the campground from thebudget. The regular meeting was recessed at 9:30 p.m. and the Council met inan executive session to discuss labor relations.The executive session was adjourned at 10:00 p.m. and the regular meeting was reconvened. From the foregoing findings of fact the Commission makes the following conclusions: 3.1 The Planning Commission of the City of Moses Lake is vested with the authority to recommend to the City Council the advisability of approving a preliminary plat. 3.2 The revised plat is properly before the Commission for its recommendation. 3.3 It is proper at this time for the Planning Commission to make a recommendation on this plat. 3.4 The Planning Commission declared this plat, if granted, to have a non-significant adverse impact on the environment on November 29,1990 provided that the area within the undesignated shoreline area is withdrawn and erosion and dust are controlled.Therefore, there should be no undesirable environmental problems created. 3.5 It is in the best interests and welfare of the city's citizens to plat the property as proposed. 4.RECOMMENDATION OF THE PLANNING COMMISSION. On the basis ofthe foregoing findings of fact and conclusions,it is the recommendation of the Planning Commission of the City of Moses Lake to the City Council of the City of Moses Lake that the plat be approved with the following variances: 1.Variance on angles and width to depth ratios on Lots 1,16,17,and Tract A. 2. Variance to defer street improvements to Laguna Drivefor 5 years with the condition that a covenant run with the land requiring the property owners to participate in any future street improvements or UD for street improvements if not constructed by the city withinthe 5 year period. 3.
