The ordinance amending Chapter 2.34 of the Moses Lake Municipal Code entitled "Public Safety - Police Department and Fire Department"was read by title only. Action Taken: Mrs. Brown moved that the second reading of the ordinance be adopted and the summary for publication be approved,seconded by Mr.Reese,and passed unanimously. ORDINANCE -ELECTED OFFICIALS -2ND READING An ordinance was presented which eliminates the Board of Adjustment,Building Code Board of Appeals, and Mechanical Board of Appeals from the list of boards and commission that an elected official may not serve on.These boards are no longer in existence.The newly created Tourism Commission has been added to this list. Also attached for Council approval is the summary for publication. The ordinance amending Chapter 2.92 of the Moses Lake Municipal Code entitled"Elected Officials"was read by title only. Action Taken:Mr.Biallas moved that the second reading of the ordinance be adopted and the summary for publication be approved,seconded by Mrs.Brown, and passed unanimously. ORDINANCES -CIRCUSES AND CARNIVALS/PRIVATE DETECTIVES/PUBLIC DANCES -2ND READINGS Three ordinances were presented which adds a section dealing with violations to the provisions of the chapters concerning Circuses and Carnivals, Private Detectives,and Public Dances.Also attached for Council approval are the summaries for publication. The ordinance amending Chapter 5.16 of the Moses Lake Municipal Code entitled "Circuses and Carnivals" was read by title only. Action Taken:Mr.Biallas moved that the second reading of the ordinance be adopted and the summary for publication be approved,seconded by Mr.Reese,and passed unanimously. The ordinance amending Chapter 5.24 of the Moses Lake Municipal Code entitled "Private Detectives"was read by title only. Action Taken:Mr.Chandler moved that the second reading of the ordinance be adopted and the summary for publication be approved,seconded by Mrs. Brown, and passed unanimously. The ordinance amending Chapter 5.28 of the Moses Lake Municipal Code entitled "Public Dances"was read by title only. Action Taken:Mrs. Brown moved that the second reading of the ordinance be adopted and the summary for publication be approved,seconded by Mr.Chandler, and passed unanimously. 0j(„ORDINANCE -UNDERGROUNDING UTILITIES -2ND READING An ordinance was presented which requires the undergrounding of utilities.Also attached for Council approval is the summary for publication. Larry Petersen,Port of Moses Lake,felt that the ordinance is well intentioned but too costly.The PUD at ^) the present time requires undergrounding in all new developments,whether residential or commercial.The — ordinance requires the undergrounding of transmission lines,which can beveryexpensive,and also requires the undergrounding of lines when a repair is made.He felt this ordinance would increase the rates to the people in the Moses Lake area. He suggested that passage of the ordinance be tabled for 90 days and a task force be established to research the idea. George Chappel, U. S.West,stated that the telephone companies pass on costs for undergrounding to the customer if that cost is more than an aerial route. Ifthis ordinance were to be passed,the cost of putting lines underground in the city would be passed on to the City of Moses Lake. He mentioned that currently 95%of the lines are buried. n u 4483 CITY COUNCIL MINUTES:3 November 27,1990 Mark Thornton, Gary Mann Real Estate, representing about 300 home owners who are opposed to undergrounding utilities as is proposed at this time, wanted to know ifthe cost for undergroundingwould be assessed againstthe home owner. The present low utility ratesarea positiveaspect inMoses Lakeand most people do not want to see them raised. Randy Dickinson,2220Beaumont, pointedoutthat undergrounding linesthat need repairing is not required and replacement of a single pole is also exempted.He pointed out that the rates inGrantCounty are low because about 40 years ago the PUD builttwo dams to provide power. He distributed a listof citiesthat have ordinances requiring undergrounding of utilities. Kraig Jorgenson, 2226 Beaumont, stated that he contacted Puget Powerand was informedthat they are putting most of their new construction underground at a cost of about $5.25 per foot. The underground transmission line in Tukwila was constructed in 1975 at a cost of $121 per foot They have crews that specialize In underground and overhead facilities. Dick Ross,2142 Belair,pointed out that it takes longer to repaira line fault in an underground linethan in an overhead line. Shirley Kvamme,3107 Lakeside,stated that an increase in rates will affect those on fixed incomes.She wanted to know who would pay forthe undergrounding of existing overhead lines.She feltthat having to dig up parkinglots and alleys to place lines underground would be very disruptive and costly. LeRoy Ledeboer, 2250 Beaumont,was opposed to the transmission line proposed to be placed along the lake shore inthe back of the Montlake residential subdivision. He pointed out that undergrounding existing lines would take place over many years. LeRoy Johnson,2214 Beaumont, wanted to know what would happen to propertyvalues ifa 90' power pole is placed in front of his picture window. George Knauss,1215 Lakeside,stated that peoplewho own rentalsare upsetabout this proposed ordinance as it could causeadditional expense through higher electrical rates. He feltthat the ordinance wastoo strict and it should be studied further. KarenWagner,Chamber of Commerce,stated that this issue has been discussed at different times since 1978 and the Board of Directors endorses the undergrounding of utilitiesbut requested that this ordinance K^J be tabled atthistimeinorder to provide for additional studyofthe issue. Steve Strite,1242 Skyline, feltthat the PUD is inthe process of cleaning up their lines and using low profile poles and did not feel an ordinance was necessary. Bob Zuppe,2140 Beaumont,stated that this area has very low rates and would still have low rates even if they are increased to provide for undergrounding of utilities. He was in favor of the ordinance. Tom Twede,2040 Beaumont,owner of two homes in the Montlake area,stated that he is in favor of the ordinance.He felt that the electromagnetic fields generated.by high voltage wires are a health hazard. Tamara Soriien,1602 W. Peninsula,was opposed to the passage of the ordinance. Dawn Nielson,Sammons Communications,stated that any costs associated with undergrounding cable television lines would be billed to the City of Moses Lake and, if the city choose not to pay,the cost would be passed on to the subscribers.She mentioned that it would cost about $2,000,000 to put everything underground and the cost would be paid for at a rate of $9 a month for 5 years. Ken Buley,Star Rt. 1, Royal City,wanted to know the benefits of putting the lines underground and suggested the ordinance be delayed and the costs be investigated. Jim Denton,representing the local rental association,pointed out that a major consideration to placing transmission lines underground is cost and the rental association would like to see the ordinance tabled. Jack Bonet,PUD,stated that it is important to note that there is no designed line for the transmission \)facilities In the Montlake area.It is simplya proposed routeatthistime. The PUD isworkingwiththe city and Council to find the best possible route for this transmission line. He also pointed out that burying transmission lines will not eliminte the electromagnetic fields. Mr.Johnson felt that the proposed ordinance is very liberal as it contains provisions allowing variances. Mr.Chandler stated that cities he has talked to have never received a bill from U. S.West for the required undergrounding of utilities.He pointed out that there has been discussions with the PUD about the undergroundingoftransmission linesfora number of years. The ordinance does not requirethe immediate undergrounding of any lines. He pointed out that the ordinancewould not raisethe electrical rates. ,0! }0\0 |0|0 lQb£ 4484 CITY COUNCIL MINUTES:4 November 27,1990 Mrs.Brown was inagreementwith Mr.Chandler and felt thatthe ordinance was a good one. Mr.Biallas stated that the ordinance will not cause an increase in rates because until actual costs are incurred there is no way to determine a rate increase.He felt that ifthe PUD would like a county-wide standard policy on undergrounding utilities,the PUD should develop such a policy and present itto the cities. He felt this ordinance should be passed at this time. Mr.Reese was in favor of undergrounding the utilities but felt that itshould be studied further. Mr.Edwards felt that the ordinance should be passed./^ Mr.Rimple was in favor of further study on the impactsthat couldbe caused by this ordinance. Action Taken:Mr.Rimple movedthatthe ordinance betabled until the first meetingin February,seconded by Mr.Reese, and failed with Mr.Edwards,Mr.Reese, and Mr.Rimple in favor and Mrs.Brown,Mr. Chandler,Mr.Biallas, and Mr.Johnson opposed. The ordinance creating a new chapter 16.56 of the Moses Lake Municipal Code entitled "Undergrounding of Utilities"was read by title only. Action Taken:Mr.Reese moved that the second reading of the ordinance be adopted and the summary for publication be approved,seconded by Mr.Biallas,and passedwith Mr.Reese and Mr.Rimple opposed. ORDINANCE -AMEND 1990 BUDGET -2ND READING An ordinance was presented which amends the 1990 budget. Also attached for Council approval is the summary for publication. The ordinance amending the 1990 budget forthe Cityof Moses Lake,Washington was read by titleonly. Action Taken:Mr.Chandler moved that the first reading of the ordinance be adopted and the summary for publication be approved,seconded by Mrs.Brown,and passed unanimously. ORDINANCE -ADOPT 1991 BUDGET -2ND READING An ordinance was presented whichadoptsthe 1991 Budget.f] The ordinance adopting the budget forthe City of Moses Lake,Washington forthe year of 1991 was read by title only. ORDINANCE -AMEND LICENSING REGULATIONS -1ST READING Ordinances were presented which amend the business licensing regulations in the city. The ordinance amending Chapter 5.04 of the Moses Lake Municipal Code entitled "Licensing Regulations" was read by title only. Action Taken:Mr.Biallas moved that the first reading of the ordinance be adopted,seconded by Mr. Chandler, and passed unanimously. The ordinance amending Chapter 5.06 oftheMoses Lake Municipal Code entitled "Licensing Regulations -f*) Temporary Locations"was read by title only. Action Taken:Mr.Chandler moved that the first reading of the ordinance be adopted,seconded by Mr. Biallas,and passed unanimously. The ordinance amending Chapter 5.22 of the Moses Lake Municipal Code entitled "Pawnbrokers and Secondhand Dealers"was read by title only. The ordinanceamending Chapter5.40 of the Moses Lake Municipal Code entitled Taxicabs"was read by title only. ActionTaken:Mr.Johnson moved that the first reading of the ordinance be adopted,seconded by Mr. Chandler, and passed unanimously. The ordinanceamending Chapter5.44ofthe Moses Lake Municipal Code entitled"Private Security Business" was read by title only. Action Taken:Mrs.Brown moved that the first reading of the ordinance be adopted,seconded by Mr. Edwards, and passed unanimously. Council directed staff to draft an ordinance allowing the placement of housekeeping ordinances under the /0(fJ Consent Agenda. ORDINANCE -SAMMONS COMMUNICATION FRANCHISE -1ST READING An ordinance was presented which grants a franchise to Sammons Communication for cable television service to the city. This is the first reading of the ordinance. The ordinance granting a franchise to Sammons Communications of Washington,Inc., a Delaware Corporation, its successors or assigns,to own and operate and maintain a cable television system in the City of Moses Lake,State of Washington,setting forth conditions accompanying the grant of franchise; and \^J providing for the regulation and useof said system was read bytitle only. There was some discussion by the Council on the ordinance which provides for a one year franchise. Action Taken:Mr.Chandler moved that the first reading of the ordinance be adopted,seconded by Mrs. Brown,and passed unanimously. RESOLUTION -UNCLAIMED CHECKS A resolution was presented which cancels claims warrants and claims checks that have not been returned to the city. The resolution to cancel claims warrants and claims checks and distribute the cancelled amounts as required by law was read by title only. Action Taken:Mr.Johnson moved that the resolution be adopted,seconded by Mrs. Brown,and passed unanimously. RESOLUTION -BUILD ON UNPLATTED PROPERTY -KELLY'S TAVERN A resolution was presentedwhich grants permission to Bill Rigsby,owner of Kelly'sTavern,to erect a reader board sign on unplatted property.The property is Tax #704,the site of Kelly's Tavern. The resolution allowing Floyd and Gisela Rigsby to build on unplatted property was read by title only. \^_J Action Taken:Mrs.Brown moved thatthe resolution be adopted,seconded by Mr.Reese,and passed unanimously. VII.REQUESTS TO CALL FOR BIDS -None VIII.REFERRALS FROM COMMISSIONS -None //</# {J \oii 4486 CITY COUNCIL MINUTES: 6 November 27, 1990 IX.OTHER ITEMS FOR COUNCIL CONSIDERATION ORDINANCE -DRIVEWAY SET BACK STANDARDS -1ST READING A proposed ordinance was presented which establishes set back standards for driveways inall zones ofthe city. There was some discussion by the Council on the effect of this ordinance. The ordinance creating a new Chapter 12.10 of the Moses Lake Municipal Code entitled "Driveway Construction Standards"was read by title only. ActionTaken:Mr.Reese moved that the first readingofthe ordinance be adopted,seconded by Mr.Biallas, and passed unanimously. LAKESIDE DISPOSAL Due to the increase in fuel prices caused by the Persian Gulfcrises, Lakeside Disposal has requested a surcharge of 3.85% for 90 days, at which time city staff and Lakeside Disposal would re-evaluate the situationand establish a new figure forthe next 90 days. At the end of a yearthe surcharge would either be abolished or reconsidered. There was some discussion and it was the consensus of the Council that an ordinance be drafted incorporating the requested increase. X.COUNCIL QUESTIONS AND COMMENTS -None XI.CITY MANAGER REPORTS AND COMMENTS AGCT MEETING The AGCT meeting will be in Quincy on Thursday,November 29, at 7 p.m. in the Quincy City Hall.
