MINUTES:Mr.Chapman moved that the minutes of the October 10 meeting be approved as submitted,
seconded by Mr.Pearce, and passed unanimously.
APPROVAL OF BILLS.CHECKS.AND PREPAID CLAIMS
Action Taken:Mr.Jackson moved that the bills,checks,and prepaid claims issued be approved,
seconded by Mr.Collier,and passed with Mr.Rimple abstaining from voting forthat portion of the bills to
Moses Lake Steel Supply.
Vouchers audited and certified by the Finance Director as required by RCW42.24.080,and those expense
reimbursement claims certified as required by RCW42.24.090,have been recorded on a listing which has
been made available to the City Council.
Claims:The vouchers included on the below list as modified by the Council and noted upon said list for
the Council meeting of October 24,1995 for the funds listed below are approved in the amount of
$427,907.51.

The proclamation declaring November 5-11,1995 as Celebrate Kids Week was read in its entirety.

Resolutions (2) - Interfund Loans:Resolutions were presented which authorized interfund loans of
$200,000 to the Central Drive LID Fund and $50,000 to the Building Maintenance Fund fromthe Sanitation
Fund.
Action Taken:Mr.Jackson moved that the Consent Agenda be approved,seconded by Mr.Reese,and
passed unanimously.

IV.CONSIDERATION OF BIDS
Qjl POLICE VEHICLES
Staff requested authorization to purchase the three police vehicles from the state bid.
Action Taken:Mr.Pearce moved that staff be authorized to purchase the three police vehicles from the
state bid,seconded by Mr.Paine,and passed unanimously.
V.PETITIONS.COMMUNICATIONS.OR PUBLIC HEARINGS (~)
Iijj HANDICAPPED PARKING SPACE -COMMUNITY ACTION COUNCIL
Grant County Community Action Council has requested that a handicapped parking space be designated
in front of their office at 604 W.Third Avenue.
Joseph K.Gavinski,City Manager, pointed out that this area is parallel parking and staff is not certain that
a handicapped parking space can be designated because of the signage requirements.
Action Taken:Mr.Jackson moved that this request be tabled,seconded by Mr.Reese,and passed
unanimously.
PUD -STATE OF THE UTILITY
Don Godard, Grant County PUD,reported on the actions of the PUD to meet growing power demands in
the area. He mentioned that the PUD used to have surplus electricity to sell but with the salmon recovery
requirements and growth in the area that is no longer true. He mentioned that the licenses to operate
Wanapum and Priest Rapids Dams will expire in 2005.At the time the PUD constructed the dams,it was
given the rights to 1/3 ofthe power generated with the right to sell the other 2/3 to pay for the cost of the
dams.Idaho Power is already working to obtain 1/3 of the power generated by those dams when the
licenses come up for renewal.He mentioned that the PUD is currently purchasing power from the
Bonneville PowerAdministration and with deregulation oftheelectrical business,the industry must become
more competitive.
^y^RESOLUTION -USS MISSOURI ^
A resolution was presented which supports the proposal by the City of Bremerton and Kitsap County to
permanently moor the USS Missouri at Bremerton.
The resolution ofthe Moses Lake City Council supporting the campaign to keep the USS Missouri in Kitsap
County was read by title only.
Action Taken:Mr.Collier moved that the resolution be adopted,seconded by Mr.Pearce, and passed
unanimously.

^pk AMERICAN RED CROSS
Hosea Phillips, Cultural Diversity Chairman of the American Red Cross,stated that the American Red
Cross would like to open a satellite office in Moses Lake but they have no space and no funding to obtain
space.He mentioned the services the American Red Cross provides and wanted to know ifthe city could
provide space for them.
It was the consensus of the Council that the request be taken under advisement.
VI.ORDINANCES AND RESOLUTIONS
(6 ORDINANCE -TAX LEVY -2ND READING
An ordinance was presented which sets the tax levy rate for 1996.
The ordinance fixing the estimated amount to be received for municipal purposes from taxation on fj
assessed valuations on property within the City of Moses Lake, Washington for 1996 was read by title
only.
ActionTaken:Mr.Pearce moved that the second reading of the ordinancebe adopted,seconded by Mr.
Collier, and passed unanimously.

ORDINANCE -AMEND 1995 BUDGET -1ST READING

f i ORDINANCE -BRYAN ANNEXATION -SINGLE READING ^p
An ordinance was presented which amends the ordinance annexing the property along Wheeler Road and
Highway 17 into the city by correcting the zoning to reflect what was established by the City Council.
The ordinance amending Ordinance No.1689 which annexes certain specified territory to the City of
Moses Lake,Washington,and incorporates the same within the corporate limits ofthe City of Moses Lake,
and which provides for the assumption of existing indebtedness and establishes the zoning was read by
title only.

Action Taken:Mr.Paine moved that the ordinance be adopted,seconded by Mr.Jackson,and passed
unanimously.
ORDINANCE -MOBILE HOME SUBDIVISION ZONE -1ST READING y£p
An ordinance was presented which amends the Mobile Home Subdivision Zone.
There was some discussion and it was the consensus of the Council that the ordinance not be brought
off the table until after the study session with the Planning Commission on manufactured homes.
RESOLUTION -DRUG AND ALCOHOL TESTING PROGRAM

A resolution was presented which establishes a drug and alcohol program for safety sensitive positions
in the Police Department.
The resolution establishing a drug and alcohol program for safety sensitive functions was read by title only.
Action Taken:Mr.Chapman moved that the resolution be adopted,seconded by Mr.Reese,and passed
with Mr.Jackson abstaining.

VII.REQUESTS TO CALL FOR BIDS
PICKUP REPLACEMENT
Staff requested authorization to call for bids for two 3/4 ton regular cab pickups and one small-extended
cab pickup.
Action Taken:Mr. Collier moved that staff be authorized to call for bids,seconded by Mr.Chapman,and
passed unanimously.
VIM.REFERRALS FROM COMMISSIONS
FIRE STATION SHORT PLAT -VARIANCE REQUESTS
The City of Moses Lake has requested a subdivision variance fora one (1) lot short plat to be located off
Block and Fig Streets in order to defer the following plat improvements:
1.Extension of sewer the length of the proposed subdivision through Fig Street.No sewer main
installation is necessary to serve any properties.Sewer will be extended along Block Street.
2.Construction of full width street improvements the length of the subdivision through Block Street.
[^_J Curbs and sidewalks will be constructed along the plat boundary.
The subdivision will be served with city water and sanitary sewer.Full width street improvements and
utility improvements are not proposed to be constructed to serve the proposed subdivision. The Planning
Commission recommended that the variances be granted with the stipulation that a covenant be required
to run with the land for the improvements at a later date.
Action Taken:Mr.Jackson moved that the variances be granted with the stipulation that a covenant be

LARSON PLAYFIELD SHORT PLAT -VARIANCE REQUEST
The City of Moses Lake has requested a subdivision variance fora one (1) lot short platto be located off
West Broadway in order to defer the following plat improvements:
1.Construction of full width street improvements on Yakima Avenue the length of the plat.The street
has been constructed as far as is needed at this time and the final configuration will depend on how
the surrounding area develops.
2.Extension of sewer the length of the proposed subdivision along West Broadway.All buildings along f~}
this street are presently served by sewer.
3.Construction of a cul-de-sac on Russell Avenue.A paved parking lot exists at the end of Russell
which would have to be torn out to construct the cul-de-sac.Russell has existed since the 1960's
and only serves a single duplex and the parking lot.
The subdivision will be served with city water and sanitary sewer.The Planning Commission recommend
ed that the variances be granted with the stipulation that a covenant be required to run with the land for
the improvements at a later date.

IX.OTHER ITEMS FOR COUNCIL CONSIDERATION
ADVANTAGE HOMES -APPEAL OF CONDITIONAL USE PERMIT DENIAL
James Reuter,Advantage Homes,is appealing the denial of a conditional use permit for the placement
of a manufactured home at 1125 Cascade.
Action Taken:Mr.Chapman moved that this item be removed from the table,seconded by Mr.Pearce,
and passed with Mr.Reese opposed.
Mr.Reuter distributed a picture of the manufactured home proposed to be placed on this lot and
mentioned that they would meet all the conditions in the ordinance.It was also agreed to provide hard
surfaced parking. He also presented pictures of the structures on both sides of the vacant lot where the
manufactured home would be placed.
Mr.Rimple pointed out that many homes in this area have garages.
Mr.Reuter stated that there is an alley in the rear of the property and the owner is proposing to construct
a garage with access from the alley.
Mr.Chapman felt that the manufactured home would upgrade the neighborhood and mentioned that many
garages are not built at the same time as a home.
Mr.Reese pointed out that the Planning Commission found that the manufactured home would not be
harmonious to the surrounding residential properties.
There was some discussion by the Council concerning the harmonious aspects of the manufactured home
in this area.
Action Taken:Mr.Pearce moved that the denial of the conditional use permit be overturned and the
conditional use permit be granted with the following conditions:
1.Provide two hard surfaced off street parking spaces
2. Provide a hard surfaced walkway to the front door
3.Provide a permanent porch at the front and back doors i)
4. The home must be pit set with the entry not more than 18"above average grade level with a
permanent masonry or concrete perimeter foundation
5. The home to be placed on the lot shall be as shown on the submitted picture including a recessed
entry
seconded by Mr.Chapman, and passed with Mr.Reese and Mr.Collier opposed.
Findings of Fact:
1.The manufactured home will be harmonious to the neighborhood.

X.COUNCIL QUESTIONS AND COMMENTS
PIONEER WAY/NELSON ROAD SIGNAL PROJECT

McCandlish Electric has completed work on the Pioneer Way/Nelson Road Signal Project. The work
should be accepted and the 30 day lien period entered into.
Mr.Chapman stated that the left hand turn going south has not been completed,there is no arrow in the
street,and the previous street markings are still in the left turn lane.
Gary Harer, Municipal Services Director,stated that those items are the responsibility of the city's Street
Division.
Action Taken:Mr.Chapman moved that the work be accepted and the 30-day lien period be entered into,
seconded by Mr.Jackson,and passed unanimously.
XI.CITY MANAGER REPORTS AND COMMENTS
SAMMONS COMMUNICATIONS -RATE ADJUSTMENT
Joseph K.Gavinski,City Manager,stated that Sammons Communications has informed the city that rates
for cable television service will be adjusted as of November 4,1995.The Lifeline rate will increase $.29
to $10.34 and the Tier rate will decrease $.10 to $10.18.
The regular meeting was recessed at 8:45 p.m.and the Council met in an executive session to discuss
labor relations.The executive session was adjourned at 9 p.m.and the regular meeting was reconvened.

1.HEARING.
*w 1.1 Date.A public hearing was held upon proper notice before the Commission on September
28,1995.
1.2 Proponent.Advantage Homes isthe proponent of this conditional use permit.
1.3 Purpose.The proponent has requested a conditional use permit for the placement of a
manufactured home upon property legally described as Lot 6,Block 9,Guffin Eccles Addition
(1125 Cascade).
1.4 Evidence.The Commission considered the following materials in reaching its decision.
A. The application ofthe proponent for the conditional use permit.
B.Testimony from the proponent.
C.The absence of written comments from the public.
D.Testimony from the public.
2.FINDINGS OF FACT.
Based upon the evidence presented to them,the Commission makesthe following findings of fact:
2.1 The proponent is the purchaser of the property legally described above.
2.2 The property is currently platted.
2.3 The property is currently zoned R-2, Single Family and Two Family Residential.
2.4 The use is not harmonious with the surrounding residential properties.

From the foregoing findings of fact the Commission makes the following conclusions:
3.1 The Planning Commission of the City of Moses Lake is vested with the authority to consider
this conditional use permit.
3.2 The conditional use permit of the proponent is properly before the Commission for consider
ation.
3.3 It is proper at this time forthe Commission to reach a decision on this conditional use permit.
3.4 The conditional use request of the proponent meets the criteria forthe grantingof a condition
al use permit pursuant to the Moses Lake Municipal Code in that manufactured homes are
permitted as a conditional use in the R-2 Zone.
3.5 The proposed conditional use conforms to the city's general plan,itwill not cause undesirable
traffic congestion or parking problems,itwill notbe detrimental to surrounding properties or
their uses,there should be no undesirable uses which are inconsistent with the surrounding
properties.
3.6 The proposed manufactured home is not harmonious tothesurrounding residential properties.
4.DECISION.
U 0n tne basis of the foregoing findings of fact and conclusions,it is the decision of the Planning
*Commission of the City of Moses Lake that the request for a conditional use be denied for the
placement ofa manufactured home onthe property designated above.
FURTHER HEARING BY THE CITY COUNCIL
1.HEARING.
1.1 Date.The proponent appealed the deciaion of the Planning Commission and the Council
considered the appeal on October 24,1995.
1.2 Evidence.The City Council considered the following materials in reaching its decision.
A. The application ofthe proponent for the conditional use permit.
B.Additional information and testimony from the proponent.
2.FINDINGS OF FACT.
Based upon the evidence presented tothem,the City Council makes the following findings of fact:
2.1 The manufactured home will be harmonious with the surrounding residential properties.
3.CONCLUSIONS.
From the foregoing findings of fact the Commission makes the following conclusions:
3.1 The City Council ofthe City ofMoses Lake is vested with the authority to consider an appeal
from a decision by the Planning Commission.
4.DECISION.
On the basis ofthe foregoing findings of fact and conclusions,it isthe decision of the City Council
ofthe City of Moses Lake that the request for a conditional usebe granted for the placement ofa
manufactured home onthe property designated above and that the Planning Commission's decision
in not granting a permit be reversed.
