MOSES LAKE CITY COUNCIL

Council Present:Wayne Rimple,Chet Paine, Bob Chapman,Bill Reese,Daryl Jackson, Dick Collier,and

MINUTES:Mr.Jackson moved that the minutes of the June 13 meeting be approved as submitted,
seconded by Mr.Pearce, and passed unanimously.
APPROVAL OF BILLS.CHECKS.AND PREPAID CLAIMS
Action Taken:Mr.Reese moved that the bills,checks,and prepaid claims issued be approved,seconded
by Mr.Paine, and passed unanimously.
Vouchers audited and certified by the Finance Directoras required by RCW42.24.080,and those expense
reimbursement claims certified as required by RCW42.24.090, have been recorded on a listing which has
been made available to the City Council.
Claims:The vouchers included on the below list as modified by the Council and noted upon said list for
the Council meeting of June 27, 1995 for the funds listed below are approved in the amount of
$145,024.26.

Fireworks:The American Little League and the Moses Lake High School Booster Club have requested

at public auction.
Resolution -Accept Street &Utility Improvements -Havden Estates Third Add.:A resolution was jjj^

Third Addition.

IV.CONSIDERATION OF BIDS
1995 STREET RESURFACING PROJECT
Staff recommended that the bidon the 1995 Street Resurfacing Projectbe awarded to Central Washington
Asphalt.
Action Taken:Mr.Collier moved that the bid be awarded to Central Washington Asphalt,seconded by
Mr.Paine,and passed unanimously.

VI.ORDINANCES AND RESOLUTIONS
ORDINANCE -ANNEX UNINCORPORATED ISLAND -2ND READING
An ordinance was presented which provides forthe annexation of an unincorporated island of territory in
the Longview Tracts area.
The ordinance annexing certain specified territory to the City of Moses Lake,Washington,and incorporat
ingthe same within the corporate limits of the Cityof Moses Lake, and which provides for the assumption
of existing indebtedness and establishes the zoning was read by title only.
Action Taken:Mr.Pearce moved that the second reading of the ordinance be adopted,seconded by Mr.
Collier,and passed unanimously.
ORDINANCE -UTILITY SYSTEM DEVELOPMENT CHARGES -2ND READING
An ordinance was presented which providesthat applications forcity services received prior to the effective
date of Chapter 3.62 will only be effective for 2 years.
There was some discussion by the Council and it was determined to amend the ordinance by changing
"prior or subsequent to" to "on or before".
The ordinance amending Chapter 3.62 of the Moses Lake Municipal Code entitled "Utility System
Development Charges"was read by title only.
Action Taken:Mr.Chapman moved that the ordinance be amended and the second reading of the
ordinance be adopted,seconded by Mr.Jackson,and passed unanimously.
ORDINANCE -STREET NAMES -2ND READING
An ordinance was presented which clarifies street names and their defined points of beginning.
The ordinance amending Chapter 12.32 of the Moses Lake Municipal Code entitled "Addresses and Street
Names"was read by title only.
Action Taken:Mr.Chapman moved that the second reading of the ordinance be adopted,seconded by
Mr.Reese,and passed unanimously.
VII.REQUESTS TO CALL FOR BIDS
WELL 7 PUMP AND PACKER PROJECT
Staff requested authorization to call for bids for the Well #7 Pump and Packer Project.
Action Taken:Mr.Jackson moved that staff be authorized to call for bids,seconded by Mr.Paine,and
passed unanimously.
VIII.REFERRALS FROM COMMISSIONS
ORDINANCE -THORNTON ZONE CHANGE -1ST READING
Jolene Thornton has requested azone change of Block 1,Pleasant View Addition from R-1,Single Family f~\
Residential,to R-2,Single Family and Two Family Residential.The Planning Commission recommended
that the zone change request be approved.
Jolene Thornton mentioned that there is an existing manufactured home on property across Peninsula
Drive from the proposed zone change and that all the property owners in the block have agreed to the
zone change.
Mr.Rimple pointed out that this zone change would allow the R-2 Zone to encroach into the R-1 zone,
which both the Council and Planning Commission have tried to protect. He mentioned that traditionally
arterials have been used as a boundary between zones.

There was some discussion by the Council over changing an R-1 zone to an R-2 zone in order to allow
the placement of a manufactured home in this area. It was pointed out that the block was previously
zoned R-2 and that there is existing an unoccupied commercial building,apartments,and duplexes.
The ordinance amending Section 18.09.020 of the Moses Lake Municipal Code was read by title only.
Action Taken:Mr.Collier moved that the first reading of the ordinance changing the property from R-1
to R-2 be adopted and a public hearing be set for July 11,seconded by Mr.Paine, and passed with Mr.
Chapman,Mr.Pearce,Mr.Collier,and Mr.Paine in favor.
ORDINANCE -BELL GROUP #2 ZONE CHANGE/PRELIMINARY PLAT -1ST READING
The Bell Group has submitted a 10 lot preliminarymajor platto be located off of Sycamore Lane and Basin
Street.A zone change has also been requested for a portion of the plat and property under the same
ownership abutting the plat.The request is to rezone property from R-3,Multi-family Residential, to C-2,
General Commercial and Business.The Planning Commission recommended that the preliminary platand
the zone change request be approved.
The ordinance amending Section 18.09.020 of the Moses Lake Municipal Code was read by title only.
Action Taken:Mr.Jackson moved that the preliminary plat be considered on July 11,the first reading of
the ordinance be adopted,and a public hearing and the second reading of the ordinance be scheduled
for July 11,seconded by Mr.Reese,and passed unanimously.
UNITED VILLAGE PARK PRELIMINARY PLAT
United Home Corporation has submitted a 9.3 acre preliminary plat to be located on the west side of
Grape Drive and north of Valley Road.The proposed plat would accommodate manufactured home
development.The developer will be required to participate in the traffic signal at the Grape and Valley
intersection.The Planning Commission recommended that the preliminary plat be approved.
There was some discussion by the Council.
Action Taken:Mr.Jackson moved that the preliminary platbe considered on July 11,seconded by Mr.
Collier, and passed unanimously.
LONGVIEW TRACTS ISLAND ANNEXATION -ZONING
The Planning Commission recommended to the Council thatthe zoning ofthe Longview Tracts Island be
C-2,General Commercial and Business.
Action Taken:Mr.Chapman moved that therecommendation from thePlanning Commission beaccepted,
seconded by Mr.Paine,and passed unanimously.
DILLON SHORT PLAT -VARIANCE REQUEST
Boundary Engineering has requested a variance from the Dillon Short Plat in order to defer street
improvements toWapato Drive.The Planning Commission recommended that the variance request be
granted provided a covenant run with the land for the street improvements to Wapato Drive ata future
date.

Planning Commission,seconded by Mr.Jackson,and passed unanimously.
IX.OTHER ITEMS FOR COUNCIL CONSIDERATION
HAYDEN ESTATES THIRD ADDITION FINAL PLAT

The Hayden Estates Third Addition Final Plat was presented for approval.The plat is located along
Evergreen Drive.
,,Action Taken:Mr.Reese moved that the final plat be approved and the Findings of Fact be accepted,
>—'seconded by Mr.Pearce,and passed unanimously.
ADVANTAGE HOMES/FUENTES CONDITION USE PERMITS -APPEAL
James Rueter,on behalf of Advantage Homes and Victor Fuentes,has appealed the conditional use ^®5'^
permits approved by the Planning Commission for the placement ofmanufactured homes on Lot 5,Block
12,Capistrano Park 1st Addition and Lot 1,Block 8,Capistrano Park located in an R-2 Zone,Single
Family and Two Family Residential.Mr.Rueter is appealing the following conditions required by the
Planning Commission on both lots:requirement for a garage or carport for at least one vehicle,
requirement for a concrete porch of not less than 50 square feet with a railing,concrete walk from off-
street parking area to front entry,requirement for a recessed entry on the manufactured homes,and
requirement for completion of concrete parking to be completed prior to occupancy of manufactured
homes.

James Reuter, Advantage Homes, was concerned about the increase in conditions being put on
manufactured homes being placed within the city limits.He feltthat the manufactured homes are being
held to a higherstandard than a stick built homes. He mentioned that additional conditions are being
placed on each conditional use permit requested.
There was discussion by the Council on the conditions imposed on the manufactured homes by the
Planning Commission.
Mr.Chapman feltthat the conditions imposed should be amended to requireonly that the home shall be
pit setwith the floor level not more than 18"above average grade,the home shall have aconcrete or block (T**)
perimeter foundation,the home shall have off-street paved parking for2 vehicles, a concrete walk from
off-street parking areato front entry,andthatthe homes be substantially similar to those presentedatthe
Planning Commission meeting.
Mr.Reese felt that a carportor garage should also be required.
Mr.Pearcealso felt that a carport or garageshould be required since property owners need a place to
store things.
Mr.Collier stated that he was inagreement with the requirement for the garage but the ordinance does
not require one.He felt thatthe ordinance shouldbe amended to include the requirements desiredbythe
Commission so that those conditions apply to everyone.
Mr.Rimple stated that it is a high priority for the Commission to amend the ordinances dealing with
manufactured homes since Grant County has the highest sale of manufactured homes in the State of
Washington and 48% of all manufactured homes sold in the state are located in GrantCounty.
Action Taken:Mr.Chapman moved that the conditions imposed be amended to require that the homes
shall be pit set with the floor level not more than 18"above average grade, the homes shall have a
concrete or block perimeter foundation,the homes shall have off-street paved parking for 2 vehicles,the
homes shall have a paved walk from the off-street parking area to the front entry, and the homes shall be
substantially similar to those presented at the Planning Commission meeting,seconded by Mr. Paine, and
passed with Mr.Jackson and Mr.Reese opposed.
X.COUNCIL QUESTIONS AND COMMENTS
^y MANUFACTURED HOMES
Mr.Jackson wanted to know how long itwould take forthe proposed ordinance changes on manufactured
homes to take effect.
James A. Whitaker, City Attorney, stated that the issues that Council wants to be resolved may not be
what the Planning Commission is considering at this time and the Council may wish to give the Planning
Commission direction.
Mr.Chapman was concerned thatthe Planning Commission seems to be leaning toward trying to keep
manufactured homes out of any zone in the city.
Mr.Pearce felt thatthe Planning Commission are trying to do their job butthe ordinances are making it
difficult.
Mr.Rimple felt thatit would be bestto change the ordinances at this time and oneofthe most important
itemsis the definition of dwelling unit.He stated thatthis matter should be addressed and resolved as
soon as possible.
Staff wasrequested to determine whether or not the Planning Commission would like ajoint study session
with the Council to discuss manufactured homes.
