1994 11 22u u V 4932 MOSES LAKE CITY COUNCIL November 22,1994 Council Present:Wayne Rimple,Dick Collier,Chet Paine, Bob Chapman,Richard Pearce,Bill Reese,and Daryl Jackson MINUTES: Mr.Pearce moved that the minutes of the November 8 meeting be approved as submitted, seconded by Mr.Collier,and passed unanimously. APPROVAL OF BILLS.CHECKS.AND PREPAID CLAIMS Action Taken:Mr.Reese moved that the bills,checks,and prepaid claims issued be approved,seconded by Mr.Paine, and passed unanimously. Vouchers audited and certifiedby the Finance Director as requiredby RCW42.24.080,and those expense reimbursement claims certified as requiredby RCW 42.24.090, have been recorded on a listing which has been made available to the City Council. Claims:The vouchers included on the below list as modified by the Council and noted upon said list for the Council meeting of November 22, 1994 for the funds listed below are approved in the amount of $223,242.71. Payroll:The payroll issued on November 4,1994 having been approved pursuant to the rule ofthe City Council set forth in Moses Lake Municipal Code 3.42.040, was paid by checks 86400 through 86566 in the amount of $191,825.51. Payroll:The payroll issuedon November 18,1994 having been approved pursuant tothe rule ofthe City Council set forth in Moses Lake Municipal Code 3.42.040,was paid by checks 86567 through 86733 in the amount of $226,820.00. I.CITIZEN INPUT -None II.EMPLOYEE PRESENTATIONS Municipal Services - Public Works Division:Wade VanDoren was presented with a Certificate of /O/'A Competency as a Water Distribution Manager 2. III.CONSENT AGENDA -None IV.CONSIDERATION OF BIDS -None V.PETITIONS.COMMUNICATIONS.OR PUBLIC HEARINGS HANSEN CONDITIONAL USE PERMIT Mick Hansen has requested time before the Council to discuss the revocation of the conditional use permit for the mobile home placed on the Municipal Airport property. JOU 4933 CITY COUNCIL MINUTES:2 November 22, 1994 Mr.Hansen pointed outthat he has two large buildings at the Municipal Airport and felt thatthe people occupyingthe mobile home did offersecurity. He mentioned that he has paid rent on his two commercial buildings but not on the mobile home as he felt the size of the lot assigned to this building was incorrect and that matter has not yet been resolved. He requested that the issue of this mobile home be turned over to the Airport Commission for their review. Mr. Paine felt that the Airport Commission should review this issue. Mr.Jackson also felt thatthe Airport Commission should have input into the question. Action Taken:Mr.Collier movedthatthis item be tabled and referred tothe Airport Commission for their review and recommendation,seconded by Mr.Reese. James A.Whitaker,City Attorney,pointed outthat the Airport Commission doesnothave a legal interest in the mobile home. He mentioned that Mr.Hansen does not have a legal interest in the land andthe conditional use permit expired with the expiration of his legal interest asthe tenant ofthat portion ofthe airport.Ifthe mobile home is to stay for any reason,the Airport Commission would need to have some legal interest in the mobile home and then make application for another conditional use permit to locate the mobile home in that location. There was some discussion by the Council. The motion passed unanimously. r,)Q ORDINANCE -1995 BUDGET -1ST READING/PUBLIC HEARING An ordinance was presented which adopts the budget for 1995. The ordinance adoptingthe budget forthe City of Moses Lake, Washington forthe year of 1995 was read by title only. The public hearing was opened. Dave Perrault,1612 Fern Drive,presented a petition which requested that Fern Drive and Crouse Street be paved in 1995 instead of in 1997.He mentioned that traffic is increasing in this area and dust and speeding cars are becoming a problem. Jeff Schwab,1908 Crouse,also requested that Fern and Crouse be paved in 1995. Thomas McFarland,1712 Fern Drive,stated that the dust from the streets is creating health problems for members of his family and he would like to see the streets paved as soon as possible. Wesley Ulbright,1808 W. Crouse,stated that the dust is becoming a real problem and requested that the improvements to Crouse and Fern be constructed in 1995 ratherthan in 1997 as currently scheduled. Action Taken:Mr.Jackson moved that the public hearing be closed,seconded by Mr.Chapman, and passed unanimously. There was some discussion by the Council and staff was requested to look intothe problem. Action Taken:Mr.Jackson moved that the first reading of the ordinance be adopted,seconded by Mr. Pearce. Mr.Chapman statedthathewas concerned thatthe fund balances seem to be eroding andhe suggested that the interest on the fund balances be putback intothe appropriate funds instead of being putintothe General Fund. The motion passed with Mr.Chapman opposed. VI.ORDINANCES AND RESOLUTIONS ORDINANCE -ULID #6 -2ND READINGi\>\0 An ordinance was presented which provides for the construction of city sewer in Monroe Street between Nelson Road and Sharon Avenue. The ordinance orderingthe improvement of Monroe Street between Nelson Road and Sharon Avenue by constructing and installinga sanitary sewer system and connecting the sanitary sewersystemto the exist ing sanitary sewer in accordance with Resolution No.1856 of the City Council of the City of Moses Lake, Washington and establishing Utility Local Improvement DistrictNo. 6; providingthe method of assessment ^ n n u u 4934 CITY COUNCIL MINUTES:3 November 22,1994 for improvements made in said district;assessments upon property in said district;and providing for paymentofsuch assessments into a bond fund to payandsecurethe paymentofwaterandsewer bonds issued for the costs of the improvements was read by title only. Action Taken:Mr.Collier moved that the second reading of the ordinance be adopted,seconded by Mr. Paine, and passed unanimously. ORDINANCE -AMEND 1994 BUDGET -1ST READING An ordinance was presented which amends the 1994 budget. The ordinance amendingthe 1994 budget for the Cityof Moses Lake,Washington was readby title only. Action Taken:Mr.Pearce moved that the first reading of the ordinance be adopted,seconded by Mr. Collier, and passed unanimously. ORDINANCE -AMEND COMMUNITY STREET AND UTILITY STANDARDS -1ST READING An ordinance was presentedwhich provides for the violation ofthe CommunityStreet andUtility Standards to be a civil penalty and establishes a penalty amount. The ordinanceamending Moses Lake Municipal Code Chapter12.08entitled"Community Street and Utility Standards"and Section 12.08.040 was read by title only. Action Taken:Mr.Jackson moved that the first reading of the ordinance be adopted,seconded by Mr. Chapman,and passed unanimously. ORDINANCE -AMEND MOVING BUILDINGS -1ST READING An ordinance was presented which provides that a violation of the regulations for moving a building will be a civil penalty and establishes a penalty amount. The ordinance amending Moses Lake Municipal Code Chapter 16.16 entitled "Moving Buildings" and section 16.16.090 was read by title only. {^J Action Taken:Mr.Chapman moved that the first reading ofthe ordinance be adopted,seconded by Mr. Pearce,and passed unanimously. ORDINANCE -AMEND FIRE HYDRANTS -1ST READING JO 36? An ordinance was presented which provides that a violation ofthe fire hydrant ordinance is a civil penalty and establishes a penalty amount. The ordinance amending Moses Lake Municipal Code Chapter 16.48 entitled "Fire Hydrants"and section 16.48.120 was read by title only. Action Taken:Mr.Chapman moved that the first reading ofthe ordinance be adopted,seconded by Mr. Pearce,and passed unanimously. ORDINANCE -AMEND VIOLATIONS -1ST READING /Of I An ordinance was presented which provides that a violation of Chapters 17.04 through 17.40 is a civil penalty and establishes a penalty amount. The ordinance amending Moses Lake Municipal Code Chapter 17.44 entitled "Violations" and section 17.44.010 was read by title only. ActionTaken:Mr.Collier moved that the first reading of the ordinance be adopted, seconded by Mr. Jackson,and passed unanimously. VII.REQUESTS TO CALL FOR BIDS -None VIII.REFERRALS FROM COMMISSIONS -None IX.OTHER ITEMS FOR COUNCIL CONSIDERATION FUEL PROCUREMENT CONTRACT EXTENSION Cenex has proposed to honor theexisting five cent per gallon discount for all fuels for the next three years IOn and staffis requesting authorization toexecutean addendum tothe existing fuel procurement contract for a three year extension based on the five cent discount. Action Taken:Mr.Pearce moved that the City Manager be authorized to execute an addendum to the existing contract for a three yearextension,seconded by Mr.Collier,and passed unanimously. /0/£ //<>/ /•o3& 00^ irf 4935 CITY COUNCIL MINUTES:4 November22,1994 X.COUNCIL QUESTIONS AND COMMENTS RC MODELERS Mr.Pearce stated that the Airport Commission would like a recommendation from city staffon a location that would be appropriate for the RC Modelers. Gary Harer,Municipal Services Director,statedthatthere is no city property that would be appropriate for the use ofthe RC Modelers.He mentioned that American Potato has 180 acres adjacent to the sand dunes that may be a possibility and staff will be contactingthem in the near future. TOURISM COMMISSION With the concurrenceofthe Council,Mary Perrywas appointed to the Tourism Commission. IMPACT FEES Astudy session was set for December 6 at 7 p.m.in the Council Chambers to discuss impact fees. XI.
