MINUTES: Mr. Collier moved that the minutes of the October 11 meeting be approved as submitted,
seconded by Mr.Pearce,and passed unanimously.
APPROVAL OF BILLS.CHECKS.AND PREPAID CLAIMS
Action Taken:Mr.Reese moved that the bills,checks,and prepaid claims issued be approved,seconded
by Mr.Paine,and passed unanimously.
Vouchers audited and certified by the Finance Director as required by RCW42.24.080,and those expense
reimbursement claims certified as required by RCW42.24.090,have been recorded on a listing which has
been made available to the City Council.
Claims:The vouchers included on the below list as modified by the Council and noted upon said list for
the Council meeting of October 25,1994 for the funds listed below are approved in the amount of
$238,425.52.

Prepaid Claims: Prepaid claims approved by the City Manager according to the process established by
Moses Lake Municipal Code 3.42.030 and the internal control policy approved by the City Council have
been recorded on a listing which has been made available to the City Council.The claims listed below
are approved in the amount of $3,204.45 for all funds.

Council set forth in Moses Lake Municipal Code 3.42.040,was paid by checks 86168 through 86385 in
the amount of $238,167.94.

COMMUNITY SURVEY OVERVIEW
Dorothy Baroch stated that she has been working with the Park and Recreation Department to develop /03y
and administer a community wide survey in relationship to the Comprehensive Plan.She distributed a
copy of the survey to the Council.
II.EMPLOYEE PRESENTATIONS -None
III.CONSENT AGENDA
Accept Work -Fire Station No.2: Staff recommended that the work on the satellite fire station be y/J y
accepted and the 30 day lien period entered into.
Resolution - Accept Easement -Bamev:A resolution was presented which accepts an easement from /Q/3
Jim Barney for municipal purposes inthe J. Barney Industrial Plat.
Action Taken:Mr.Pearce moved that the Consent Agenda be approved,seconded by Mr.Collier,and
passed unanimously.

IV.CONSIDERATION OF BIDS

Staff recommended that the bid for the Well 17 pumphouse project be awarded to Irrigator's Inc.
Action Taken:Mr.Paine moved that the bid be awarded to Irrigator's Inc.,seconded by Mr.Pearce,and
passed unanimously.

An ordinance was presented which fixes the estimated amount to be received from municipal purposes
from assessed valuations on property within the city.
The ordinance fixing the estimated amount to be received for municipal purposes from taxations on
assessed valuations on property within the City of Moses Lake,Washington for 1995 was read by title
only.
Action Taken:Mr.Chapman moved that the second reading of the ordinance be adopted,seconded by
Mr.Reese,and passed unanimously.
ORDINANCE -GENERAL PENALTY -1ST READING
An ordinance was presented which increases all general penalties by $10 to allow for the state to obtain
its funds without reducing the funds allotted to the city for violations of its code.
The ordinance amending Chapter 1.08 of the Moses Lake Municipal Code entitled "General Penalty" by
amending Section 1.08.030 was read by title only.
Action Taken:Mr.Collier moved that the first reading of the ordinance be adopted,seconded by Mr.
Reese,and passed unanimously.
ORDINANCE -SOLICITORS -1ST READING
An ordinance was presented which provides for the correct chapter under which a solicitor must obtain a
business license.
The ordinance amending Chapter 5.36 of the Moses Lake Municipal Code entitled "Solicitors"was read
by title only.
Action Taken:Mr.Chapman moved that the first reading ofthe ordinance be adopted,seconded by Mr.
Paine,and passed unanimously.
ORDINANCE -BURGLAR ALARM SYSTEMS -1ST READING
An ordinance was presented which amends the burglar alarm ordinance to make the penalty for a violation
of the chapter a civil penalty.
The ordinance amending Chapter 8.24 ofthe Moses Lake Municipal Code entitled "Burglar Alarm Systems"
was read by title only.
Action Taken:Mr.Jackson moved that the first reading of the ordinance be adopted,seconded by Mr.
Reese,and passed unanimously.
ORDINANCE -PARKING REGULATIONS -1ST READING
An ordinance was presented which repeals the section ofthe parking regulations allowing the Police Chief
to dismiss parking infractions since only a judge of the municipal court can dismiss an infraction.
The ordinance amending Chapter 10.12 ofthe Moses Lake Municipal Code entitled "Parking Regulations"
by repealing Section 10.12.050 was read by title only.
Action Taken:Mr.Jackson moved that the first reading of the ordinance be adopted,seconded by Mr.
Paine, and passed unanimously.

VII.REQUESTS TO CALL FOR BIDS
POLICE CARS
Staffrequested authorization to call forbids for three new 1995 police cars in orderto have them delivered
as early as possible in 1995.
Action Taken:Mr.Collier moved that staff be authorized to call for bids,seconded by Mr.Jackson,and
passed unanimously.
VIII.REFERRALS FROM COMMISSIONS
ORDINANCE -ZONE CHANGE -MOSES LAKE SCHOOL DISTRICT -1ST READING
An ordinance was presented which changes the zoning from Agriculture to Public for 20 acres of property
owned by the Moses Lake School District south of the existing high school.The Planning Commission
recommended that the zone change request be granted.
The ordinance amending Section 18.09.020 of the Moses Lake Municipal Code was read by title only.
Action Taken:Mr.Reese moved that the first reading ofthe ordinance be adopted and the second reading
and a public hearing be set for November 25,seconded by Mr.Jackson,and passed unanimously.
ERNIE'S SECOND ADDITION PRELIMINARY PLAT
Boundary Engineering has submitted the Ernie's Second Addition Major Plat located on 12.37 acres ofland
on Kittleson Road.The area is zoned C-2,General Commercial and Business.The subdivision will be
servedwith city waterand sanitary sewer.The proposed plat is currently improved to city standards.Staff
has considered the SEPA Checklist for the proposed plat and has issued a Mitigated Determination of
Non-Significance.The mitigation stipulates that the developer shall contribute a proportionate share
towards traffic signalization at the SR-17 and Kittleson Road intersection.The Planning Commission
recommended the preliminary plat be approved.
Action Taken:Mr.Reese moved that the preliminary plat be approved and the Findings of Fact be
accepted,seconded by Mr. Paine, and passed unanimously.
MOSES LAKE OUTLET MALL PRELIMINARY PLAT /J$(p
Phil Bloom,Columbia Northwest Engineering,has submitted a preliminary plat for a one (1) lot major plat
11.99 acres in size and located west of SR-17 on Kittleson Road.The area is zoned C-2,General
Commercial and Business.The subdivision will be served with city water and sanitary sewer.Staff has
considered the SEPA Checklist for the proposed plat and has issued a Mitigated Determination of Non-
Significance. The mitigation stipulates that the developer shall contribute a proportionateshare towards
traffic signalization and a right hand turn pocket at the SR-17 and Kittleson Road intersection. The
Planning Commission recommended to the CityCouncilthat the preliminary platbe approved and that the
Council consider providing adequate right-of-way on Kittleson to allow for 4 lanes of traffic in the future
and the City Engineer's comments be addressed,with specific attention to item 1.
Gary Harer,Municipal Services Director,described 3 possible options for the 4 laning of Kittleson Road.
Mr.Jackson felt it may not be to the city's advantage to make Kittleson Road a 4 lane as it could create
the same problems that exist on Stratford Road. He did not feel it was a good idea to mix cross town
traffic and general shopping traffic.
Mr.Bloom did not believe that Kittleson should try to be both a cross town arterial and a commercial
street.He discussed various options for the future location ofYonezawa.
Mr.Chapman was opposed to making Kittleson an arterial road.
There was some discussion by the Council.
Action Taken:Mr.Pearce moved that the preliminary plat be approved with the stipulation that he City
Engineer's comments be addressed and that Kittleson Road remain a 60'right-of-way with turn pockets
atthe ingress andegress points othe plat,and the findings of fact be accepted,secondedby Mr.Reese,
and passed unanimously.

IX.OTHER ITEMS FOR COUNCIL CONSIDERATION
^KENNEDY CONDITIONAL USE PERMIT -APPEAL
The Planning Commission granted William Kennedy,Jr. a conditional use permit for the placement of a
manufactured home at 1463 Marina Drive with the following conditions:
1.The manufactured home is a super good sense home with a pitched roof and eaves.
2.The manufactured home shall be placed on a concrete or block foundation (^)
3. At least a 1 car garage shall be constructed priorto the issuance of an occupancy permit
The area is zoned R-2,Single Family and Two Family Residential.The city has received an appeal from
Richard and Osako Roybal concerning the placement of a manufactured home at this location.The appeal
was not received within the time period set by ordinance.
Jim Whitaker,City Attorney,pointed out that the appeal was not received within the required time limit and
the Council needs to determine whether or not the appeal can be considered.
After some discussion the Council determined that the appeal could not be considered.
Action Taken:Mr.Pearce moved that the appeal request be denied since itwas submitted after the time
limit as defined by ordinance,seconded by Mr. Collier, and passed unanimously.
(j,JANITORIAL SERVICES CONTRACT - EXTENSION
Staff requested authorization to extend the existing contract with American Building Maintenance for six
months.This extension will allow staffto call for bids forjanitorial services in June rather than December.
Action Taken:Mr. Collier moved that the six month extension of the janitorial contract with American
Building Maintenance be granted,seconded by Mr.Jackson,and passed unanimously.
X.COUNCIL QUESTIONS AND COMMENTS
TOURISM COMMISSION
Mr.Rimple stated that there is an opening on the Tourism Commission and requested anyone interested
to submit their names to the city.

BUDGET STUDY SESSIONS
A study session on the 1995 preliminary budget was set for November 1 at 7 p.m.in the Council
Chambers.
The regular meeting was adjourned at 10:45 p.m.
