1994 07 264896 MOSES LAKE CITY COUNCIL July 26,1994 Council Present:Wayne Rimple,Dick Collier,Richard Pearce,Daryl Jackson, Chet Paine,Bill Reese, and Bob Chapman MINUTES:Mr.Jackson moved that the minutes of the July 12 meeting be amended to show that no fence is required around the park in the Hayden Estates Second Addition and the minutes be approved as corrected,seconded by Mr.Pearce, and passed unanimously. _APPROVAL OF BILLS. The ordinance exempting theCity of Moses Lake,Washington from theprohibition ofRCW 9.41.050(4)and creating Moses Lake Municipal Code Chapter 9.05 entitled "Firearms"was read bytitle only. Action Taken:Mr.Reese moved that the 1st reading oftheordinance beadopted,seconded by Mr.Collier, and passed unanimously. VII.REQUESTS TO CALL FOR BIDS -None VIII.REFERRALS FROM COMMISSIONS QQ ORDINANCE -SUN CITY/PARK PLACE INVESTORS ZONE CHANGE -1ST READING n \" /*" \0l° 0$' Sun City Properties and Park Place Investors have requested a zone change of approximately 77acres along Highway 17 from the intersection of Grape Drive and Highway 17tothe bluff overlooking Vista Village Shopping Center,from R-3,Multi-family Residential,and R-1,Single Family Residential,to C-2,General Com mercial and Business.Thezone change issought to facilitate the commercial development ofthe property. Extension of citywaterand sanitary sewer would be required to serve the area.City street and state highway improvements may be required to serve the area in the future.The Planning Commission recommended tothe City Council that the zone change request be approved.{***) The ordinance amendingSection 18.09.020 ofthe Moses Lake Municipal Code was read by title only. ActionTaken:Mr.Pearce moved thatthe first reading of the ordinance be adopted, a second reading and publichearing be set forAugust 9,1994,and the Findings of Fact be accepted,seconded by Mr.Collier, and passed unanimously. MONTLAKE EAST #8 PRELIMINARY PLAT Fred Skinner,Western Pacific Engineering, has submitted a preliminary plat for a 10 lot major subdivision described as Montlake East #8 Addition.The proposed plat is adjacent to the Montlake East #7 Plat located off of Tumagin Place.The area is zoned R-1,Single Family Residential.The subdivision will be served with city water and sanitary sewer. The Planning Commission recommended that the preliminary plat for this major subdivision be approved. Action Taken:Mr.Collier moved that the Montlake East #8 Preliminary Platbe approved and the Findings of Fact be accepted,seconded by Mr.Jackson,and passed unanimously. IX.OTHER ITEMS FOR COUNCIL CONSIDERATION -None X.COUNCIL QUESTIONS AND COMMENTS -None XI.CITY MANAGER REPORTS AND COMMENTS 1995 BUDGET CALENDAR O Joseph K.Gavinski,City Manager,distributed the 1995 Budget Calendar. SEWER HOOK-UPS Joseph K.Gavinski,City Manager,stated that under the current Municipal Code regulations,a property owner isrequired to hook to city sewer when thesewer line islocated within 200'ofthe property,provided the connection will not cost morethan $1,500.Since the ordinance was lastamended in 1987,itmay be time to review this requirement. There wassome discussion bytheCouncil andstaff wasrequested to bring backinformation onthe average cost of a 200'sewer hook up. w \-> CITY COUNCIL MINUTES:3 NATIONAL GUARD ARMORY 4898 July 26,1994 Joseph K.Gavinski,City Manager,stated that openingceremonies forthe new National Guard Armory have been scheduled for Saturday,August 13,1994 at 2 p.m. SALES TAX/TRANSIENT RENTAL INCOME REPORTS Joseph K.Gavinski,City Manager,stated that the citywill receive $232,153.80 on August 1 in sales tax. Joseph K.Gavinski,City Manager,stated thatthe city will receive $14,263.22 on August 1 in transient rental income. AQUATIC CENTER Joseph K.Gavinski,City Manager,distributed a report on the income and expenses ofthe aquatic center through July 1994. The regular meeting was recessed at 7:45 p.m.and the Council met in an executive session to discuss real estate. The executive session was adjourned at 8 p.m.and the regular meeting was reconvened. The regular meeting was adjourned at 8 p.m. //?f u BEFORE THE PLANNING COMMISSION/CITYCOUNCIL OFTHE CITY OF MOSES LAKE,WASHINGTON IN THE MATTER OF THE MONTLAKE EAST #8 PRELIMINARY PLAT MONTLAKE EAST #8 PRELIMINARY PLAT FINDINGS OF FACT,CONCLUSIONS, AND DECISION 1.HEARING BEFORE THE PLANNING COMMISSION. 1.1 Date.A public meeting washeldupon proper noticebeforethe Commission onJuly 14,1994. 1.2 Proponent.Desert Development,Inc.isthe proponent ofthis plat. 1.3 Purpose.The proponent hassubmitted a plat for property which is legally described upon the plat.City staff has confirmed the property described onthe plat isthe property submitted for platting. 1.4 Evidence. The Commission considered the following materials in reaching its decision: A.The submitted plat. B.Testimony from the proponent. C. Written comments from various parties. 2.FINDINGS OF FACT BY THE PLANNING COMMISSION. Based uponthe evidence presentedto them, the Commission makes the following findings of fact: 2.1 The proponent is the owner of the property. 2.2 The property is currently zoned R-1, Single Family Residential. ^_J 2.3 The development is consistent with existing developments. 2.4 It is a continuation of residential development. 2.5 Consistent with the Comprehensive Plan. 2.6 Zoning is appropriate. 2.7 Concern over low water pressure will be addressed. 3.CONCLUSIONS BY THE PLANNING COMMISSION. From the foregoing findings of fact the Commission makes the following conclusions: 3.1 The Planning Commission of the City of Moses Lake is vested with the authority to recom mend to the City Council the advisability of approving a plat. 3.2 The plat is properly before the Commission for its recommendation. 3.3 It is proper atthistime for the Planning Commission to makea recommendation onthis plat. 3.4 It is inthe best interests and welfare ofthe city's citizens to plat the property as proposed. 4.RECOMMENDATION OF THE PLANNING COMMISSION. L-/On the basis of the foregoing findings of fact and conclusions,it is the recommendation of the Planning Commission ofthe City of Moses Lake tothe City Council ofthe City of Moses Lake that the plat be approved. 5.FURTHER HEARING BEFORE THE CITY COUNCIL 5.1 Date.A public meeting was held upon proper notice before theCouncil on July 26,1994. 5.2 Proponent,desert Development,Inc.isthe proponent ofthis plat. 5.3 Purpose.The proponent has submitted a final plat for property legally described above. 5.4 Evidence. The Council considered the following materials in reaching its decision: A. The submitted plat. B. Testimony from the proponent. C.Written comments from various parties. 6.FURTHER FINDINGS OF FACT BY THE CITY COUNCIL. Based upon the evidence presented to them,the Council makes the following findings offact: 6.1 The proponent is the owner of the property. 6.2 The property is currently zoned R-1,Single Family Residential. 6.3 The development is consistent with existing developments. 6.4 It is a continuation of residential development. 6.5 Consistent with the Comprehensive Plan. 6.6 Zoning is appropriate. 6.7 Concern over low water pressure will be addressed. 7.FURTHER CONCLUSIONS BY THE CITY COUNCIL Fromthe foregoing findings offact the Council makes the following conclusions: 7.1 The City Council ofthe City of Moses Lake isvested with the authority to make a decision on a preliminary plat. 7.2 The plat is properly before the Council for its decision. 7.3 It is proper at this timeforthe City Council to make a decision on this preliminary plat.>*-v 8.DECISION.
