The meeting was called to order at 8 p.m.by Mayor Robert Hill.
Mr.Edwards moved that the minutes of the meeting of October 14 be approved as
submitted,seconded by Mr.Johnson,and passed unanimously.

PERSENTATION OF CERTIFICATE
A letter was read from Helen Stodden,President of the Washington Municipal Clerk's^^
Association,which stated that Jean Burton had earned the title of Certified Wash
ington Municipal Clerk.

„,HOUSING REHABILITATION -BLOCK GRANT
A letter was read from Dean Hagerty,Chairman of the Citizens Advisory Committee,
which recommended that the bid from Leo Richlin Contracting on Job No.030-NI be
accepted.
Mr.Edwards moved that the bid from Leo Richlin Contracting in the amount of
$7,523 be accepted for Job No.030-NI,seconded by Mr.Vernier,and passed unani
mously.

PUBLIC HEARING -ORDINANCE -VACATION OF RIGHT-OF-WAY -2ND READING
yC A letter was read from Joseph K.Gavinski,City Manager,which presented an ordin
ance vacating the 20 foot right-of-way adjacent to the southwest boundary of Lots 1
and 2 of Municipal Tract #4.
The public hearing was opened.There were no comments,so the public response was
closed.
Mr.Swanson moved that the public hearing be closed,seconded by Mr.Ziegler,and
passed unanimously.
The ordinance vacating the twenty foot public right-of-way adjacent to the south
west boundary of Lots 1 and 2 of Municipal Tract #4 was read by title only.
Mr.Shinn moved that the second reading of the ordinance be adopted,seconded by
Mr.Edwards,and passed unanimously.

PUBLIC HEARING -ORDINANCE -AMEND 1980 BUDGET -2ND READING
A letter was read from Robert Gazewood,Finance Director,which presented an ordin
ance amending the 1980 Budget by transferring $98,315.71 from the Local Improvement
Guaranty Fund to the General Fund.
The public hearing was opened.There were no comments,so the public response was
closed.
Mr.Johnson moved that the public hearing be closed,seconded by Mr.Shinn,and
passed unanimously.
The ordinance amending the 1980 Budget,Ordinance No.945,to appropriate revenues
and to provide for the expenditures of funds was read by title only.
Mr.Ziegler moved that the second reading of the ordinance be adopted,seconded by
Mr.Edwards,and passed unanimously.
V.ORDINANCES AND RESOLUTIONS
,ORDINANCES -AMENDING CHAPTER 13.12 AND 13.16 -UNIFORM BILLING -2ND READING
\°A letter was read from Joseph Gavinski,City Manager,which presented ordinances
amending Chapters 13.12 and 13.16 of the Moses Lake Municipal Code.These proposed
ordinances pass through the utilities tax charged customers on the water/sewer bill
in the city proper and the Larson base housing and also amend the water service
termi nati on procedures.
Mr.Gavinski stated that the ordinances presently state the turn-on fee will be $6.
He stated that the approximate actual cost of performing the service is $12.54 and
the Public Works Department has recommended that the fee be increased to $15 to
cover the actual cost of the service.

The ordinance relating to the collection of water and sewer revenues,amending
Moses Lake Municipal Code sections 13.12.060 and 13.12.080 and adding new sections
to Chapter 13.12 of the Moses Lake Municipal Code was read by title only.
Mr.Swanson moved that the ordinance be amended to increase the turn-on fee from $6
to $15 and the second reading of the ordinance be adopted,seconded by Mr.Edwards,
and passed unanimously.

A letter was read from Joseph K.Gavinski,City Manager,which presented ordinances
referring to LID's 43, 44,45,46, 47,and 48.These ordinances delete all refer
ences to interest and penalty rates and repeal ordinances 926,928,931,933,936,
and 937.
The ordinance ordering the improvement in the Lower Peninsula area by constructing
and installing a sanitary sewer system and connecting to existing sewer facilities
at Peninsula Drive and Wanapum Drive in accordance with Resolution No.926 of the
City Council of the City of Moses Lake,Washington;establishing Local Improvement
District No.43;providing the method of assessment in said district payable by
mode of "Payment by Bonds";and providing for the issuance for sale of Local Im
provement District warrants redeemable in cash and Local Improvement District
Bonds;and repealing Ordinance No.926 was read by title only.
Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by
Mr.Shinn,and passed with Mr.Ziegler abstaining.
The ordinance ordering the improvement in the Penn Street area on Fig Street between
Wheeler Road and Fifth Avenue and on Fifth Avenue between Fig Street and Elder
Street by grading,graveling,constructing,and installing storm drainage,curbs,
sidewalks,and asphalt concrete pavement in accordance with Resolution 927 of the
City Council of the City of Moses Lake,Washington,establishing Local Improvement
District No.44;providing the method of assessment in said district payable by
mode of "Payment by Bonds";and providing for the issuance for sale of Local Im
provement District warrants redeemable in cash and Local Improvement District
bonds;and repealing Ordinance No.928 was read by title only.
Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by
Mr.Swanson,and passed unanimously.
The ordinance ordering the improvement of Coolidge Drive from Plum Street to Terrace
Avenue and Plum Street from Coolidge Drive to Ironwood Street by grading,graveling,
constructing and installing curbs,sidewalks,sewer side laterals,asphalt concrete
pavement and storm drainage in accordance with Resolution No.932 of the City
Council of the City of Moses Lake,Washington;establishing Local Improvement
District No.45;providing the method of assessment in said district;providing
that payment for said improvement be made by special assessments upon property in
said district payable by mode of "Payment by Bonds";and providing for the issuance
for sale of Local Improvement District warrants redeemable in cash and Local Im

Range 28 EWM by constructing and installing a sanitary sewer and water system and
connecting to existing facilities at Sharon Avenue and Pioneer Way in accordance
with Resolution No.937 of the City Council of the City of Moses Lake,Washington;
establishing Local Improvement District No.46;providing the method of assessment
in said district;providing that payment for said improvement be made by special
assessments upon property in said district payable by mode of "Payment by Bonds";
and providing for the issuance for sale of Local Improvement District warrants
redeemable in cash and Local Improvement District bonds;and repealing Ordinance

concrete pavement,and storm drainage in accordance with Resolution No.943 of the
City Council of the City of Moses Lake,Washington;establishing Local Improvement
District No.47;providing the method of assessment in said district;providing
that payment for said improvement be made by special assessments upon property in
said district payable by mode of "Payment by Bonds";and providing for the issuance
for sale of Local Improvement District warrants redeemable in cash and Local Im

feet south on the westerly side portion of Ironwood by grading,graveling,con

storm drainage in accordance with Resolution No.944 of the City Council of the
City of Moses Lake,Washington;establishing Local Improvement District No.48;
providing the method of assessment in said district;providing that payment for
said improvement be made by special assessments upon property in said district
payable by mode of "Payment by Bonds";and providing for the issuance for sale of
Local Improvement District warrants redeemable in cash and Local Improvement Dis
trict bonds;and repealing Ordinance No.937 was read by title only.

--ORDINANCE - AMEND CHAPTER 5.12 - CARD ROOMS & POOL HALLS - 1ST READING
A letter was read from Dennis Wetmore,Police Chief,which presented an ordinance
repealing Chapter 5.12 of the Moses Lake Municipal Code.
The ordinance repealing Chapter 5.12 of the Moses Lake Municipal Code entitled Card
Rooms and Pool Halls was read by title only.
Mr.Swanson moved that the first reading of the ordinance be adopted,seconded by
Mr.Johnson,and passed unanimously.
ORDINANCE -AMEND CHAPTER 5.16 -CIRCUSES &CARNIVALS -1ST READING
A letter was read from Dennis Wetmore,Police Chief,which presented an ordinance
amending Chapter 5.16 of the Moses Lake Municipal Code by deleting references to
games of shooting,throwing,and pitching in the definitions.
The ordinance amending Chapter 5.16 of the Moses Lake Municipal Code entitled
Circuses and Carnivals was read by title only.

ORDINANCE -AMEND CHAPTER 5.40 -TAXICABS -1ST READING
A letter was read from Dennis Wetmore,Police Chief,which presented an ordinance
amending the taxicab ordinance.
The ordinance repealing Chapter 5.40 of the Moses Lake Municipal Code entitled
Taxicabs and establishing a new Chapter 5.40 entitled Taxicabs was read by title
only.
Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by
Mr.Shinn,and passed unanimously.
ORDINANCES - UNIFORM BUILDING CODES - 1ST READING
A letter was read from Joseph Gavinski,City Manager which presented ordinances /^
repealing those ordinances which relate to the Uniform Building Code,Uniform Fire
Code,National Electrical Code,and Uniform Plumbing Code since these codes are
enforced in the city even if not adopted by ordinance.
The ordinance relating to the Uniform Building Code and repealing certain sec
tions of the Moses Lake Municipal Code was read by title only.
Mr.Swanson moved that the first reading of the ordinance be adopted,seconded by
Mr.Ziegler,and passed unanimously.
The ordinance relating to the Uniform Plumbing Code and repealing certain sections
of the Moses Lake Municipal Code was read by title only.
Mr.Shinn moved that the first reading of the ordinance be adopted,seconded by Mr.
Edwards,and passed unanimously.
The ordinance relating to the National Electrical Code and repealing certain sec
tions of the Moses Lake Municipal Code was read by title only.
Mr.Johnson moved that the.first reading of the ordinance be adopted,seconded by
Mr.Edwards,and passed unanimously.
The ordinance relating to the Uniform Fire Code and repealing certain sections of
the Moses Lake Municipal Code was read by title only.
Mr.Swanson moved that the first reading of the ordinance be adopted,seconded by
Mr.Edwards,and passed unanimously.
The ordinance relating to swimming pools was read by title only.
Mr.Edwards wanted to know who would define a non-climbable fence.Jim Whitaker,
City Attorney,stated that this is an ordinance from 1948 which previously was a
part of the Zoning Code and this is what the Building Official is using to regulate
swimming pools.
There was some discussion by Council and the staff was requested to obtain sample
ordinances from other cities.
Mr.Edwards moved that the ordinance be tabled until sample ordinances from other
cities are obtained,seconded by Mr.Johnson,and passed with Mr.Ziegler opposed.
ORDINANCE -AMEND ZONING ORDINANCE -FLOOD PLAIN - 1ST READING /c?3-
A letter was read from Shirley Kvamme,Planning Commission Chairman,which rquested
that the Council adopt the Flood Damage Prevention ordinance.
The ordinance amending Title 18 of the Moses Lake Municipal Code entitled Zoning by
establishing a new Chapter 18.53 creating flood damage prevention control regulations
was read by title only.
There was some discussion by Council.

Mr.Edwards moved that the section beginning with Whereas be deleted and the word
Therefore,be deleted and the first reading of the ordinance be adopted,and a
public hearing be set for November 10,1980,seconded by Mr.Swanson,and passed
with Mr.Shinn,Mr.Ziegler,and Mr.Johnson opposed.

RESOLUTION -INSTALLATION OF SEPTIC TANKS
I A letter was read from James A.Whitaker,City Attorney,which presented a resolu
tion which would allow Moses Lake to continue regulating the installation of
septic tanks within the City of Moses Lake upon entering into an agreement with the
Health District.
The resolution authorizing participation with the Grant County Health District in
a septic tank installation designer program was read by title only.
Mr.Edwards moved that the resolution be adopted,seconded by Mr.Swanson,and
passed unanimously.
VI.REQUESTS TO CALL FOR BIDS
HOUSING REHAB -BLOCK GRANT
(f A letter was read from Dean Hagerty,Chairman of the Citizens Advisory Committee,
which requested authorization to call for bids on Job 035-V and Job 018-T.Job
018-T is being presented as a hardship case as the foundation needs to be repaired
and the committee is recommending that up to $10,000 be allocated for repairs.
Mr.Ziegler moved that staff be authorized to call for bids,seconded by Mr.
Swanson,and passed unanimously.
VII.REFERRALS FROM COMMISSIONS
COMPREHENSIVE PLAN LAND USE MAP
Mr.Hill stated that because the Council is involved in Budget at this time,that
this item will be deferred for 30 days.

IX.COUNCIL QUESTIONS AND COMMENTS
PENINSULA DRIVE
Mr.Ziegler stated that the bicycle path along Peninsula Drive is unusable and when
it was constructed the equipment used smashed fences,shrubbery,etc.M.G.
McLanahan,Assistant Public Works Director,stated that it would have to be repaired
before the contractor will be paid.

BUDGET
Mr.Edwards suggested that the cost of the business license be raised from $35 to
perhaps $50 or $75.

The Council recessed to an executive session at 9:15 to discuss labor negotiations
The executive session concluded at 10:00 p.m.and the regular session adjourned
at 10:00 p.m.
