1980 11 10t I LJ 3053 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING - REGULAR MEETING November 10,1980 POLICE/COUNCIL FACILITY 8 p.m. Members Present:Barry Ziegler,Bob Hill,Charles Edwards,Steve Shinn,Harvey Vernier,Don Swanson,and Norm Johnson The meeting was called to order at 8 p.m.by Mayor Robert Hill. Mr.Johnson moved that the minutes of the meeting of October 28 be approved as submitted,seconded by Mr.Edwards,and passed unanimously. DISASTER BILLS $1,400.50 Mr.Swanson moved that the disaster bills be approved as submitted,seconded by Mr. Edwards,and passed unanimously.Warrants in the amount of $1,400.50 were approved for payment. I.CITIZEN INPUT None II.CONSENT AGENDA None III.CONSIDERATION OF BIDS None IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS PUBLIC HEARING -ORDINANCE -AMEND 1980 BUDGET - 2ND READING A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance amending the 1980 Budget to provide for the increase in the General Fund and Street Overlay Reserve Fund and the establishment of the Street Repair and Recon struction Fund. The public hearing was opened.There were no comments so the public response was closed. Mr.Swanson moved that the public hearing be closed,seconded by Mr.Edwards,and passed unanimously. /o/o M 3054 CITY COUNCIL MINUTES:2 November 10,1980 The ordinance amending the 1980 Budget,Ordinance No.945,to appropriate revenues and to provide for the expenditures of funds was read by title only. Mr.Swanson moved that the second reading of the ordinance be adopted,seconded by Mr.Edwards,and passed unanimously. PUBLIC HEARING -ORDINANCE -FLOOD DAMAGE PREVENTION -2ND READING ]fl Aletter was read from Shirley Kvamme,Planning Commission Chairman,which presented an ordinance which would enable citizens to participate in the National Flood Insurance Program. The public hearing was opened.There were no comments so the public response was closed. Mr.Johnson moved that the public hearing be closed,seconded by Mr.Swanson,and passed unanimously. The ordinance amending Title 18 of the Moses Lake Municipal Code entitled Zoning by establishing a new Chapter 18.53 creating flood damage prevention control regula tions was read by title only. Mr.Ziegler stated that he was opposed to the ordinance as it is written. Mr.Swanson stated that this ordinance pertains to property below a certain elevation and in the flood plain. Mr.Johnson wanted to know who would be enforcing this ordinance.Joseph K.Gavinski, City Manager,stated that it would be up to the city to enforce it. Mr.Vernier stated that he felt the ordinance is quite broad and vague and wanted to know if there might be any legal problems.James A.Whitaker,City Attorney, stated that if a decision by the Community Development Department were challenged, a judge would decide what is reasonable.He further stated that the whole idea of this ordinance is to discourage building in the Crab Creek flood plain area. Mr.Swanson moved that the second reading of the ordinance be adopted,seconded by Mr. Vernier. Mr.Shinn stated that he had talked with Mr.Bumgardner,who has a preliminary plat in this area,and he is quite concerned about the restrictions he would have to meet in order to build in this area. The motion failed with Mr.Swanson and Mr.Edwards in favor and Mr.Ziegler,Mr. Hill,Mr.Shinn,and Mr.Johnson opposed,and Mr.Vernier abstaining. Mr.Swanson pointed out that the defeat of this ordinance will keep people from purchasing flood damage insurance. V.ORDINANCES AND RESOLUTIONS ORDINANCE - PASS THROUGH - GARBAGE CONTRACT - 1ST READING A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance which passes through the utility tax charged customers on the garbage service bill in the city. The ordinance relating to collection of sanitary service revenues amending Moses Lake Municipal Code Section 8.08.130 and adding a new section 8.08.135 to the Moses Lake Municipal Code was read by title only. Mr.Ziegler moved that the first reading of the ordinance be adopted,seconded by Mr.Johnson,and passed unanimously. 3055 CITY COUNCIL MINUTES:3 November 10, 1980 ORDINANCES -UNIFORM CODES -2ND READING /c A letter was read from Joseph K.Gavinski,City Manager,which presented ordinances relating to the Uniform Building Code,Uniform Fire Code,National Electrical Code, and Uniform Plumbing Code.They repeal those portions of the Municipal Code which have adopted these uniform codes by reference. The ordinance relating to the Uniform Building Code and repealing certain sections of the Moses Lake Municipal Code was read by title only. Mr.Shinn moved that the second reading of the ordinance be adopted,seconded by Mr.Edwards,and passed unanimously. The ordinance relating to the Uniform Fire Code and repealing certain sections of the Moses Lake Municipal Code was read by title only. Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by Mr.Shinn,and passed unanimously. The ordinance relating to the National Eelectrical Code and repealing certain sections of the Moses Lake Municipal Code was read by title only. Mr.Ziegler moved that the second reading of the ordinance be adopted,seconded by Mr.Johnson,and passed unanimously. The ordinance relating to the Uniform Plumbing Code and repealing certain sections of the Moses Lake Municipal Code was read by title only. Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by Mr.Shinn,and passed unanimously. ORDINANCE -TAXICAB - 2ND READING A letter was read from Dennis Wetmore,Police Chief,which presented an ordinance concerning taxicabs. The ordinance repealing Chapter 5.40 of the Moses Lake Municipal Code entitled Taxicabs and establishing a new Chapter 5.40 entitled taxicabs was read by title only. Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by Mr.Johnson,and passed unanimously. ORDINANCE -CARD ROOMS AND POOL HALLS -2ND READING A letter was read from Dennis Wetmore,Police Chief,which presented an ordinance repealing the ordinance on card rooms and pool halls. The ordinance repealing Chapter 5.12 of the Moses Lake Municipal Code entitled Card Rooms and Pool Halls was read by title only. Mr.Johnson moved that the second reading of the ordinance be adopted,seconded by Mr.Swanson,and passed unanimously. ORDINANCE -CIRCUSES AND CARNIVALS - 2ND READING A letter was read from Dennis Wetmore,Police Chief,which presented an ordinance deleting games of shooting,throwing,pitching,from the Circuses and Carnivals ordinance. /OC2 The ordinance amending Chapter 5.16 of the Moses Lake Municipal Code entitled Circuses and Carnivals was read by title only. Mr.Ziegler moved that the second reading of the ordinance be adopted,seconded by Mr.Johnson,and passed unanimously. /0(*2 3056 CITY COUNCIL MINUTES:4 November 10,1980 RESOLUTION - ACCEPTING GIFT -B.E.Hill A letter was read from Dennis Wetmore,Police Chief,which presented a resolution accepting a gift from B.E.Hill of a chair and footstool valued at $186. The resolution accepting a gift from Mr.B.E.Hill,owner of Hill's Wholesale Furniture in the form of one chair and footstool to be used by members of the Police Department was read by title only. Mr.Johnson moved that the resolution be adopted,seconded by Mr.Shinn,and passed uannimously. RESOLUTION - LID #48 -IR0NW00D DRIVE A letter was read from Robert Townsend,Public Works Director,which stated that the Public Works Department has prepared a final assessment roll for LID 48,Ironwood Drive and requesting the Council set a public hearing date for December 9. The resolution of the City Council of the City of Moses Lake,Washington,establishing a hearing assessment roll for the Local Improvement District No.48 fixing the time and place for hearing upon said roll and providing for the giving of notice in the matter provided by law was read by title only. Mr.Ziegler moved that the resolution be adopted and a public hearing be set for December 9,1980,seconded by Mr.Johnson,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS None VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION PENINSULA DRIVE - HUD GRANT PROJECT A letter was read from Robert Townsend,Public Works Director,which stated that the completion date for the Peninsula Drive project is November 5,1980. Mr.Townsend stated that the contractor still has a few minor items to complete on this project but he would recommend that the work be conditionally accepted so that it could be processed as the Block Grant year ends on November 11,1980. Mr.Hill wanted to know what is being done about the damage done to private property during construction.Mr.Townsend stated that those that are directly tied into the project would be repaired and those concerned with private property have been given to the contractor. Mr.Ziegler stated that several months ago the City Attorney warned the Council about not entering into the 30-day lien period if recommended to do so by the Public Works Department,but the work on this project has not been completed. Mr.Ziegler moved that this be tabled until the meeting of November 25,seconded by Mr.Hill,and passed with Mr.Ziegler,Mr.Shinn,Mr.Hill,and Mr.Edwards in favor and Mr.Johnson,Mr.Vernier,and Mr.Swanson opposed. Mr.Swanson stated that he was opposed to this motion because it is just what Mr. Whitaker advised the Council not to do with regard to withholding payment because of damage claims of adjacent property owners. UJ 3057 CITY COUNCIL MINUTES:5 November 10,1980 IX.COUNCIL QUESTIONS AND COMMENTS SECOND LAKE CROSSING Mr. Vernier stated that he was concerned about the route of Yonezawa Boulevard between Valley Road and Highway 17 and felt that staff should discuss this route with the county Public Works Department.A study session will be scheduled after the budget is adopted. BUDGET Mr.Hill stated that study sessions on the budget have been set for November 12 and November 13. JOB CORPS Mr.Hill stated that he met with the Job Corps along with Mr.Shinn,Mr.Ziegler,/<POJ and Mr.Gavinski and the question of a co-ed center in Moses Lake was discussed. He stated that back in the 1960's there were quite a few problems concerned with the co-ed center here in Moses Lake.Mr.Hill stated that he,Mr.Edwards,and Chief Wetmore visited the town of Walport which has a co-ed Job Corps center and talked to the people there and they had had no problems that they could mention. Mr.Edwards stated that Moses Lake does not have the facilities as this co-ed Job Corps center does as it has beautiful buildings and is near a beach.He stated that he would be concerned about controlling the young people.He stated that this is a different set-up than what is currently in Moses Lake with young people from the northwest . X. CITY MANAGER REPORTS AND COMMENTS FACILITIES PLAN -STEP II COMMITTEE A letter was read from Robert Townsend,Public Works Director,which stated that //?J* the city has received and accepted the Step II grant offer for the design phase of our new wastewater facilities plant and requesting that two members of the Council be appointed to serve on a committee to review the general design layout at various stages of design.
