1981 07 283163 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING -REGULAR MEETING July 28,1981 POLICE/COUNCIL FACILITY 8 p.m. Members Present:Charles Edwards,Steve Shinn,Harvey Vernier,Don Swanson, Norm Johnson,and Barry Ziegler Absent: Robert Hill Mr.Swanson moved that Mr.Edwards be appointed Mayor Pro Tern,seconded by Mr. Shinn,and passed unanimously. The meeting was called to order at 8 p.m.by Mayor Pro Tern Charles Edwards. Mr.Ziegler moved that the minutes of the meeting of July 14,1981 be approved as submitted,seconded by Mr.Johnson,and passed unanimously. APPROVAL OF BILLS REGULAR BILLS AMOUNT GENERAL $20,955.87 STREET 3,165.15 BLOCK GRANT 111,025.55 WATER/SEWER 4,788.41 SANITATION 6,802.25 EQUIPMENT RENTAL 17,846.29 FIREMEN'S PENSION 1,597.00 TOTAL $166,180.52 Mr.Johnson moved that the bills be approved as submitted,seconded by Mr.Swanson, and passed unanimously.Warrants in the amount of $166,180.52 were approved for payment. I.CITIZEN INPUT None II.CONSENT AGENDA Mr.Ziegler moved that the following items on the Consent Agenda be approved: 1.Lakeshore Estates Division #2 Preliminary Plat -Set Date to Consider /S<P& 2.Resolution -Declaring Property Surplus /0/7 3.Acceptance of Agreement -Utility Coordination Call Number /o/(s seconded by Mr.Swanson,and passed unanimously. III.CONSIDERATION OF BIDS REROOF OF CITY BUILDINGS „... A letter was read from Robert Townsend,Public Works Director,which stated that the bids came in 28%less than the Engineer's estimate.The alternate roofing bid for the library hyperbolic paraboloid roof is $14,187.60.The work can probably be contracted for less than $5,000 if the city negotiates with local roofing contrac tors who specialize in the application for concrete roofs.The alternate bid for providing additional insulation on the library roof is $7,894.95.The city can expect to save $130 to $190 per year in energy costs with this alternate.Staff recommended that the bid be awarded to Goltz Roofing based on the base biid of $47,916 for work on the bonded roofs.The work for the library hyperbolic para boloid on Alternates A and B may be rebid in 1982 if the Council elects to budget for this improvement. Mr.Swanson moved that the bid from Goltz Roofing Co.in the amount of $47,916 be accepted,and the balance will be let for bids in 1982,seconded by Mr.Vernier, and passed unanimously. 3164 *CITY COUNCIL MINUTES:2 July 28,1981 A BLOCK GRANT -JOB 042-TR &043-TA ^Aletter was read from Dean Hagerty,Chairman of the Citizens Advisory Committee, which stated that the bids on both homes came in over the staff's estimate and over the eligibility amount.After conferring with the home owners,it is the Commit tee's recommendation that no items be eliminated on Job 042-TA but that the follow ing items be subtracted from house 043-TA;all floor coverings,baseboards,dryer plug-in and exhaust deflector,all light covers,and bathroom vent.The homeowner has agreed to this. Mr. Johnson moved that the bid from Fred & Bob's Construction for Job 042-TR in the amount of $9,990 be accepted,and the bid from Fred &Bob's Construction for Job 043-TA in the amount of $10,154.03 be accepted,seconded by Mr.Vernier. Mr.Ziegler stated that the Committee expressed a great deal of concern on Job 042- TR and he was doubtful about expending over the eligibility amount. Mr.Edwards stated that most of the projects lately have come in over their eligi bility requirements. The motion failed with Mr.Edwards,Mr.Shinn,Mr.Ziegler,and Mr.Swanson opposed and Mr.Vernier and Mr.Johnson in favor. Mr.Johnson moved that the bid on Job 043-TA be accepted,seconded by Mr.Shinn, and passed unanimously. Rita Perstac,Community Development Director,stated that the problem with 042-TR is the assessed valuation of the house.It is assessed less than $20,000 and so it is eligible for less than $10,000 worth of work.Houses that are assessed less need as much work if not more than houses assessed more than $20,000.She felt that the solution was to raise the eligibility amounts for houses assessed less than $20,000. Mr.Swanson felt that the city was starting to rebuild houses instead of repairing them.He also stated that the $10,000 limit was set so that more homes could be rehabilitated.. Mr.Swanson moved that Job 042-TR be referred back to the committee,seconded by Mr.Shinn,and passed unanimously. IV.PETITIONS, COMMUNICATIONS, OR PUBLIC HEARINGS None V.ORDINANCES AND RESOLUTIONS ^ORDINANCE -BUSINESS UTILITY OCCUPATION TAX - 2ND READING The ordinance amending Chapter 3.28 of the Moses Lake Municipal Code entitled Utility Occupational Tax was read by title only. Mr.Johnson moved that the second reading of the ordinance be adopted,seconded by Mr.Swanson,and passed unanimously. ,a ORDINANCE -BOATING REGULATIONS - 1ST READING A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance concerning boating regulations on Moses Lake.This ordinance is identical to the one passed by Grant County. Mr.Steve Monek stated that he was opposed to this ordinance as it takes away one more freedom and is done under the guise of protecting the citizens. Mr.Edwards pointed out that some of the County Commissioners are not happy with their ordinance and are considering making some amendments and changes. Mr.Ziegler pointed out that the ordinance states sailboats are deemed motorboats when being propelled by machinery of any sort.He felt that the portion prohibitng persons from riding on the gunwhales,decking,seat backs,or cabin tops is extreme ly restrictive and he was opposed to it. r*\ n 3165 CITY COUNCIL MINUTES:3 July 28,1981 Mr.Ziegler quoted Section 8.28.570 as follows: 8.28.570 Visual Distress Signal Requirements: A.On boats 16 feet or more in length or carrying six or less passen gers,for hire,certified or approved visual distress signals in the proper number must be carried for both day and night use.For boats 16 feet in length operating at night,only the certified or approved signals for night use must be carried.The three exemp tions are: 1.Boats competing in an organized and approved marine parade, regatta race,or similar event. 2.Manually propelled boats. 3.Sailboats under 26 feet with completely open construction and without propulsion machinery. B.When a vessel is in distress and requires assistance from other vessels or from shore,the following shall apply: 1.Daytime,a continuous sounding with any sound producing device or hand held red or orange smoke flare. 2.Nightime,primary signal shall be a hand held red flare or one propelled skyward,or a sound producing device. 3.The signals must be readily accessible and in serviceable condition. D.All visual distress signals,hand held flares,or flares launched from a pistol launcher must have U.S.Coast Guard approval number on them. Mr.Ziegler stated that he did not understand what this section was requiring a boat to carry in the way of distress signals and the Sheriff's Office could not tell him either. Mr.Ziegler quoted Section 8.28.600 as follows: 8.28.600 Authority of Officers to Board Boats:Moses Lake Police Officers or the city's contractor for enforcement of this chapter are hereby given the authority to board any vessel found occupied on the waters of the city for the purpose of inspection and enforcement of this ordinance. He stated that this gives Police Officers the authority to board a boat and have the owner prove he is innocent. Mr.Johnson stated that if the county is still making amendments,he did not feel the city should pass it. Mr.Johnson moved that the ordinance be tabled until the county finishes amending their ordinance,seconded by Mr.Ziegler,and passed unanimously. ORDINANCE -NOXIOUS WEED CONTROL - 1ST READING A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance concerning noxious weed control. Mr.Shinn stated that he felt the ordinance is a good one. Mr.Ziegler wanted to know the type of weeds the county considers noxious.Daryl Jackson from the Grant County Weed Control Board stated that they are concerned mainly with Candian Thistle,Dalmation Toad Flax,Russian Knapweed,and Diffuse Knapweed.He stated that the county has received 750 complaints so far this year but only 12 have had to go to enforcement,and only 3 of those have refused to do anything.In the city there have been 17 complaints and 3 of those have refused to do anything.He stated that efforts to control the noxious weeds include burning, spraying,cutting,and cultivating. \tf itf> 3166 CITY COUNCIL MINUTES:4 July 28,1981 The ordinance adopting Chapter 8.22 of the Moses Lake Municipal Code entitled Noxious Weed Control was read by title only. Mr.Ziegler moved that the first reading of the ordinance be adopted,seconded by Mr.Johnson,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS y REQUEST FOR ANNEXATION -MIDSTATE LAND CO A letter was read from Rita Perstac,Community Development Director,which stated that Midstate Land Co.has submitted a request for annexation of the property located west of Lagoona Drive adjacent to the lake and included as a portion of the Lakeshore Estates Division #2 Preliminary Plat.The petition calls for the property to be annexed and to be assessed and taxed at the same rate and on the same basis as other property within the city.The petitioner also agrees to pay for any outstanding indebtedness of the city contracted prior to or existing at the date of annexation and the area is proposed to be zoned R-l. Mr.Ziegler moved that an ordinance be brought back to Council on August 11 and that the annexation be referred to the Planning Commission to consider the zoning at their July 30 meeting,seconded by Mr.Johnson,and passed unanimously. l EAST BROADWAY INDUSTRIAL PRELIMINARY PLAT - REQUEST FOR TIME EXTENSION 1 A letter was read from Rita Perstac,Community Development Director,which stated that Robert Bumgardner has requested a one year extension for the East Broadway Industrial Preliminary Plat.Mr.Bumgardner plans to final plat the four lots between East Broadway and the railroad tracks.If an agreement can be worked out with the railroad,the four lots between the railroad and the lake will also be final platted.The Public Works Department has requested the request be denied unless the following requirements are attached: 1.The improvement plans should be revised to include full street improvements along East Broadway to bring it up to city standards. 2.Submit a grade and elevation for the storm drain pipe which would also include pipe size for review and approval. 3.Submit a detail showing the recommended protection of the shoreline on the storm drain discharge to the lake. It was the Planning Commission's recommendation that the time extension be granted without the additional requirements due to the extenuating circumstances. Mr.Ziegler moved that preliminary plat approval period be extended to June 24, 1982 without the additional conditions,seconded by Mr.Johnson,and passed with Mr.Vernier and Mr.Shinn abstaining. VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION REQUEST FOR RATE INCREASE - SAMMONS COMMUNICATION A letter was read from David Garrett,Manager of Sammons Communications,Inc., which requested consideration by the Council for a rate increase. Mr.Garrett stated that they had received a rate increase in Othello and there will be an engineering crew coming in the second week of August to do the preliminary mapping on the complete rebuild in Othello and Moses Lake. Mr.Edwards stated that the city has no way to verify the fact that Sammons needs a rate increase. Mr.Garrett stated that he has financial information for the year 1979,1980 and projected 1981 with the increase. -* 3167 CITY COUNCIL MINUTES:5 July 28,1981 Mr.Ziegler stated that at the meeting of February 24 Mr.Garrett said Sammons would be putting on four new stations,WGN,KOMO,KIRO,and WOR,and after they were operating on a steady basis and of good quality,Sammons would come back for a rate increase. Mr.Ziegler stated that Sammons stated they would improve the quality of the system and eliminate problems.Now you are saying that if the city gives Sammons the rate increase these things will be done. Mr.Garrett stated that the city has received four new channels which are of much better quality than previous stations.He stated that to redo the system in the city it has to be completely remapped and re-engineered and redesigned for the new system.The maps are approximately 10 years old at this time.To put in the 35 channel system,the cable has to be taken down and all the electronics have to be replaced.It will take almost a year to redo the 150 miles of plant. Mr.Swanson stated that Sammons has stated they would rebuild the system before the rate increase goes into effect if the Council would approve the rate increase subject to the rebuild. Mr.Ziegler moved that this be tabled until August 11,seconded by Mr.Shinn,and passed with Mr.Johnson and Mr.Swanson opposed. IX.COUNCIL QUESTIONS AND COMMENTS None X.CITY MANAGER REPORTS AND COMMENTS REQUEST FOR STUDY SESSION -1-90 LANDFILL A study session was set for August 6,1981 at 8 p.m. ANIMAL CONTROL SHELTER I Joseph K.Gavinski,City Manager,stated that the Mayor would like the Council to ^^ I J consider the possibility of putting the construction of the animal shelter back K—J into the hands of the city and have it done in 1982 with Revenue Sharing monies.* He stated that there will not be much of a fund balance going into 1982 and there may not be the funds available to do this. Mr.Ziegler did not feel the city should expend funds at this time. Mr.Swanson also felt that the city is not in shape at this time to fund this project. It was the consensus of Council that nothing be done at this time. The regular meeting was adjourned at 9:30 and the Council met in an executive session to discuss real estate matters. The executive session was adjourned at 10 p.m.and the regular meeting was recon vened . RENTAL OF FORMER COAST TO COAST BUILDING It was the consensus of City Council that the building be rented to any individual or group except those groups where certain improvements would have to be made to the building in order to meet code requirements.An example of this would be if the facility would be used in such a manner so that restroom facilities would have to be available to the general public. If the building could then be rented by an individual or group without having to make improvements to the building,the building could be rented on the following basis: 1.Payment of a rental fee of $100 per day or any portion of a day. 3168 CITY COUNCIL MINUTES:6 July 28,1981 2.Providing public liability and property damage insurance with a certificate of insurance being provided by individual or group using the facility in a sum to be decided by the City of Moses Lake. 3.Pay all electrical,gas,and garbage costs with the city paying for water and sewer. 4.Cleaning up before and after the activity. It was then the consensus of the City Council that the building be rented to the Retail Trades Committee of the Moses Lake Area Chamber of Commerce on those conditions.
