1981 09 093191 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING -REGULAR MEETING September S,1981 POLICE/COUNCIL FACILITY 8 p.m. Members Present:Robert Hill,Steve Shinn,Harvey Vernier,and Barry Ziegler Absent:Don Swanson,Charles Edwards,and Norm Johnson The meeting was called to order at 8 p.m.by Mayor Robert Hill. Mr.Shinn requested that the minutes of the meeting of August 25 reflect the fact that he abstained from voting for that portion of the bills to Shinn Irrigation. Mr.Ziegler moved that the minutes of the meeting of August 25,1981 be approved as amended,seconded by Mr.Vernier,and passed unanimously. APPROVAL OF BILLS REGULAR BILLS AMOUNT GENERAL $15,861.17 STREET 10,108.96 ARTERIAL STREET 659.31 STREET REPAIR &RECONSTRUCTION 84,189.12 BLOCK GRANT 10,174.92 WATER/SEWER 16,428.45 SANITATION 24,037.24 WATER/SEWER CONSTRUCTION 2,873.50 , EQUIPMENT RENTAL 15,501.48 TOTAL $179,834.15 Joseph K.Gavinski,City Manager,stated that the payment to McAtee &Heathe had been made with the anticipation that all of the work would be completed and could be accepted.However,there is still approximately $1,000 worth of work to be completed. Mr.Ziegler moved that the bills be approved as presented with the exception of the one to McAtee &Heathe which should be reduced by $1,000,seconded by Mr.Vernier, and passed unanimously.Bills in the amount of $178,834.15 were approved for payment. I.CITIZEN INPUT GARBAGE COLLECTION Dr.Penhallurick stated that he,Dr.Throp,and Drs.Tracy and Castro have a yard 1 and a half container and they are all being charged different amounts for the same container.He stated that he has talked to Superior Refuse about this and all they say is that they will call him back. Fred Danz,McDonalds,wanted to know if he had to pay additional charges for a compactor.He stated that he is being charged an additional $25 per month by the garbage contractor for hooking and unhooking his compactor.He also stated that he was offered a maintenance contract of $100 per month by the garbage contractor but could not get an itemized statement of what the $100 would be for so he refused it. Mr.Hansen of K-Mart stated that he is being charged $100 a month for a maintenance contract on top of his garbage bill.He stated that he is charged for the work done on the compactor if something goes wrong with it on top of the $100 a month. He wanted to know what the $100 per month for maintenance covered. Ivan Jenkins of Buttreys also stated that he pays an extra $100 a month to the garbage contractor for maintenance on his compactor.He stated that last year there was a small fire in the compactor and he was charged an additional $65 for paint and the compactor has not been painted yet. Joseph K.Gavinski,City Manager,stated that he would investigate the problem and report back to the Council at the next meeting. •x 3192 $Aletter was read from Dean S.Hagerty,Chairman of the Citizens Advisry Committee,r-") 1 which recommended that Leo Reichlin Contracting be awarded the bid on Job 046-TD and Job 047-TE.J Mr.Hill moved that the bids be awarded to Leo Reichlin Contracting,seconded by Mr.Shinn,and passed unanimously. IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS COMMUNICATION -NORTH CENTRAL REGIONAL LIBRARY A A letter was read from Mike Lynch,Director of the North Central Regional Library V which stated that he would be available at the meeting of September 8 to answer any questions the Council may have. Joseph K.Gavinski,City Manager,stated that the reason Mr.Lynch was requested to attend the meeting was because of the increase in the city's contract fees. Mr.Lynch stated that he had corresponded with the Council on June 15 and indicated that there will be an increase in the contract fee for 1982.He explained the North Central Regional Library financing to the Council including the city's par ticipation.He explained that the city's charge for 1981 would be approximately $62,000 and in 1982 is not likely to be less than $90,000.He stated that the increase would go for additional staff and a marked improvement in the printed material offered which includes periodicals.^v Mr.Hill wanted to know if the fixtures in the library belong to the city.Mr. Lynch stated that the tables,chairs,bookcases and most of the equipment with the exception of a few minor items belongs to the city. There was some discussion by Council and it was pointed out that if termination of the contract is desired,the Regional Library must be notified by October 1,1981. Mr.Lynch stated that it would cost the city a great deal more to run the library itself than to contract with North Central Regional Library for that service. Mr.Lynch explained how it was possible for the library to raise their levy rate but the city could not.He explained it is a state law that allows the library to do this. Mr.Hill moved that a study session with the entire Council be set,seconded by Mr. Ziegler,and passed unanimously. V.ORDINANCES AND RESOLUTIONS ORDINANCE -AMEND 10.04.040 -TRAFFIC OFFENSES - 1ST READING A letter was read from James A.Whitaker,City Attorney,which presented an ordi nance amending Section 10.04.040 of the Municipal Code. The Ordinance amending Section 10.04.040 of the Moses Lake Municipal Code dealing I with punishment for traffic offenses was read by title only.'_ Mr.Shinn moved that the first reading of the ordinance be adopted,seconded by Mr. Hill,and passed unanimously. 1fi% CITY COUNCIL MINUTES:2 September 8,1981 II.CONSENT AGENDA None III.CONSIDERATION OF BIDS BLOCK GRANT - HOUSING 3193 CITY COUNCIL MINUTES:3 September 8,1981 ORDINANCE -AMEND 10.120.35 LOADING ZONE - 2ND READING A letter was read from Robert Townsend,Public Works Director,which presented an ordinance which would establish a loading zone on Beech Street. /OJ>7 The ordinance designating certain street areas where stopping, standing,and/or parking is regulated,restricted,or prohibited thereon by amending Section 10.12.035 was read by title only. Mr.Ziegler moved that the second reading of the ordinance be adopted,seconded by Mr.Shinn,and passed unanimously. ORDINANCE -AMEND 1981 BUDGET -BLOCK GRANT -1ST READING /o/0 A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance amending the 1981 Budget. The ordinance amending the 1981 Budget,Ordinance 992,to appropriate unanticipated revenues and to provide for the expenditures of these same funds was read by title only. Mr.Ziegler moved that the first reading of the ordinance be adopted,and a public hearing be set for September 22,seconded by Mr.Vernier,and passed unanimously. ORDINANCE - 1982 TAX LEVY - 1ST READING A letter was read from Walter Fry,Finance Director,which presented an ordinance setting the estimated property tax rate for the 1982 budget year. The ordinance fixing the estimated amount to be received for municipal purposes from taxations on assessed valuations on property within the City of Moses Lake, Washington,for the year of 1982 was read by title only. Mr.Ziegler moved that the first reading of the ordinance be adopted,seconded by Mr.Vernier,and passed unanimously. ORDINANCE -AMEND 8.08 GARBAGE COLLECTION - 2ND READING A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance amending garbage rates charged in the city. •J/o& MS3 The ordinance amending Chapter 8.08 of the Moses Lake Municipal Code entitled "Garbage Collection"by changing the rate schedule incorporated by reference within Section 8.08.140 was read by title only. Mr.Shinn moved that the second reading of the ordinance be adopted,seconded by Mr.Ziegler,and passed unanimously. ORDINANCE -AMEND 3.28 -UTILITY OCCUPATIONAL TAX -2ND READING //' A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance amending Chapter 3.28 to provide for the collection of utility occupational tax from cable TV service in the same manner as other utilities. The ordinance amending Chapter 3.28 of the Moses Lake Municipal Code entitled Utility Occupational Tax was read by title only. Mr.Ziegler moved that the second reading of the ordinance be adopted,seconded by Mr.Shinn,and passed unanimously. ORDINANCE -AMEND ORD.901 VACATION - 2ND READING A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance at the request of Mr.Ziegler amending Ordinance 901 by deleting Section 3 which would allow signs to remain in the city's right-of-way. The ordinance amending Ordinance 901 which vacated a 30-foot portion of land adja cent to Stratford Road was read by title only. 3194 CITY COUNCIL MINUTES:4 September 8,1981 Mr.Ziegler moved that the second reading of the ordinance be adopted,seconded by Mr.Vernier. Mr.Shinn stated that the sign would be placed right next to a light standard and near a power line and he felt the light standards and sign should be placed back of the city's right-of-way. James A.Whitaker,City Attorney,pointed out that the ordinance as written would allow the signs to remain until the sidewalk is constructed no matter what business locates there. The motion failed with Mr.Hill and Mr.Shinn opposed and Mr.Ziegler and Mr. Vernier in favor. RESOLUTION -ACCEPT EASEMENT -1ST BAPTIST CHURCH A letter was read from Robert Townsend,Public Works Director,which presented a resolution accepting a utility easement from the First Baptist Church on Grape Drive. The resolution accepting an easement to the City of Moses Lake,Washington was read by title only. Mr.Shinn moved that the resolution be adopted,seconded by Mr.Ziegler,and passed unanimously. RESOLUTION -ANNEXATION POLICY/ A letter was read from Joseph K.Gavinski,City Manager,which presented a resolu tion which sets forth an annexation policy for the City of Moses Lake. The resolution setting forth an annexation policy in the City of Moses Lake,Wash ington was read by title only. Mr.Gavinski stated that if the resolution is adopted,an ordinance would be drafted reflecting Council's wishes concerning the sewer utility vs the septic tanks. Mr.Shinn moved that the resolution be adopted,seconded by Mr.Vernier,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS BLOCK GRANT -HOUSING - JOBS 049-AB AND 050-AC — A letter was read from Dean S.Hagerty,Chairman of the Citizens Advisory Committee, which requested authorization to call for bids on Job 049-AB and Job 050-AC.If the bids are over the eligibility amounts,priority items will be subtracted until costs are under the eligibility amounts. Mr.Hill felt that the house reflected in Job 049-AB should be painted instead of installing vinyl siding. Mr.Hill moved that Job 050-AC be approved for bids and Job 049-AB be amended,and that painting be bid instead of siding,seconded by Mr.Ziegler,and passed unanimously. VII.REFERRALS FROM COMMISSIONS REQUEST FOR VARIANCE -LAKESHORE ESTATES #1 -KALAMAKIS A letter was read from Rita Perstac,Community Development Director,which stated that the Planning Commission recommended that Steve Kalamakis be granted a variance on Lakeshore Estates #1 for when the street improvements required for his one-lot plat are actually installed.This variance would be granted subject to a covenant being drafted and agreed to by Mr.Kalamakis which would run with the land and providing that the street be brought up to standard when the street on either side is brought up to standard. Mr.Hill moved that the variance be granted,subject to a covenant being drafted, seconded by Mr.Ziegler,and passed unanimously. u u u 3195 CITY COUNCIL MINUTES:5 September 8,1981 COORDINATED WATER SUPPLY SYSTEM -10-YEAR MAP A letter was read from Rita Perstac,Community Development Director,which presented a 10-year map for the Coordinated Water Supply System as requested by the Grant County Commissioners. Joseph K.Gavinski,City Manager,stated that this 10-year map is a supplement to the 50-year map that the Council has already approved and which was forwarded to the Grant County Commissioners. There was some explanation by staff and some discussion by the Council.Mr.Ziegler stated that he was concerned that the city may be required to supply water to an area which would not be economically feasible.Mr.Gavinski stated that this is only one portion of the plan which would also include design standards and specifi cations.He stated that the plan could be drawn up to disallow the requirement of the city to provide water to an area.He pointed out that participating in this plan would be advantageous to the city in that it would require developers to build to city standards even if the city does not supply the water.Also,in order to reserve water rights for the future,the city has to participate in a plan of this nature. James A.Whitaker,City Attorney,pointed out that a larger government agency can not tell the city what to do with its water.He pointed out that the interest of DSHS in this plan is only water quality.DSHS will not tell the city how to manage its system. Mr.Shinn moved that the 10 year map be accepted and forwarded to the County, seconded by Mr.Hill,and passed unanimously. VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION HOUSING ASSISTANCE PLAN A letter was read from Joseph K.Gavinski,City Manager,which requested Council direction on the proposal from HUD to provide housing between Fifth and Sixth Avenues on Beech Street. The letter from Julian Agranoff,Executive Director of the Conference of Govern ments,to HUD was read.His letter stated that perhaps it would be better to expend the money for rehabilitation of existing housing instead of new construction. Mr.Ziegler moved that the City Council endorse the Council of Governments plans as outlined in the letter from Julian Agranoff,seconded by Mr.Hill,and passed unanimously. IX.COUNCIL QUESTIONS AND COMMENTS CITY GOVERNMENT Mr.Hill pointed out that the next regularly scheduled City Council meeting is on September 22,which is the same night as the Chamber of Commerce meeting. The next meeting was set for September 21,1981 at 8 p.m. A study session was set for September 23 at 8 p.m.to discuss the North Central Regional Library. A special meeting was set for September 29,1981 to take action on the library question if necessary. X.CITY MANAGER REPORTS AND COMMENTS 911 SYSTEM Joseph K.Gavinski,City Manager,stated that the city is progressing with the //V^ implementation of an area-wide 911 system which would include Fire District #5. This will take a couple of years because of problems of getting lines into the system from the Fire District and because of equipment needs of the city.The 1982 budget will include some requests for equipment to implement this system. 3196 CITY COUNCIL MINUTES:6 September 8,1981 /AWC V Joseph K.Gavinski,City Manager,stated that there is a one-day convention on October 9 in Spokane.He stated that Mr.Johnson has indicated he would be inter ested in going.He stated that there is one in Bellevue on September 25,Kelso on September 26,and Ellensburg on October 10.Mr.Hill indicated that he may be interested in going. JAL FLIGHT Joseph K.Gavinski,City Manager,stated that the city has received the annual invitation to the sixth grade flight on the DC 10.The flight is scheduled for September 25 and there are 5 seats reserved on the second flight.Check-in time is at 12:15 and the flight is scheduled to depart at 12:45 and return at 1:45.Mr. Shinn indicated that he would be interested in attending.
