CITY COUNCIL MEETING -REGULAR MEETING February 9,1982
POLICE/COUNCIL FACILITY 8 p.m.
Members Present:Harvey Vernier,Charles Edwards,Norm Johnson,Wayne Rimple,
Bill Reese,Dick Siegert,and Bob Wallenstien
The meeting was called to order by Mr.Johnson at 8 p.m.
Mr.Edwards moved that the minutes of the meeting of January 26 be approved as
submitted,seconded by Mr.Rimple,and passed unanimously.

Mr.Edwards moved that the bills be approved as submitted,seconded by Mr.Wallen
stien,and passed with Mr.Rimple abstaining from voting for that portion of the
bills to Moses Lake Steel Supply.

II.CONSENT AGENDA
Mr.Edwards moved that the following items on the Consent Agenda be approved:
1.Request for bids on 1982 HUD Street Reconstruction -Block Grant
2.Request for bids on play structure,restroom,and concrete -Block Grant
3.Block Grant Housing bids on Jobs 057-AJ and 058-AK
seconded by Mr.Wallenstien,and passed unanimously.

PUBLIC HEARING -ORDINANCE -AMEND 1981 BUDGET -2ND READING

A letter was read from Walter Fry,Finance Director,which presented an ordinance
amending the 1981 Budget.
The public hearing was opened.There were no comments,so the public response was
closed.
Mr.Rimple moved that the public hearing be closed,seconded by Mr.Edwards,and
passed unanimously.
The ordinance amending the 1981 Budget for the City of Moses Lake,Washington was
read by title only.
Mr.Rimple moved that the second reading of the ordinance be adopted,seconded by
Mr.Edwards,and passed unanimously.

COMMUNICATION -MOSES LAKE SPRING FESTIVAL
7 A letter was read from the Moses Lake Spring Festival which requested support from
V the city for the Spring Festival in the following areas:
1.Permission to use city property for festival activities
2.Free swimming at Swedberg Pool
3.Streets barricaded for parade
4.Streets barricaded for food booths,arts and crafts,sidewalk sale,etc.
5.In-kind services from the city for law enforcement,street sweeping,garbage
pick-up,solid waste dumping,temporary water hook-ups,etc.
6.Use of Municipal Building at Third and Alder
7.City will be named co-insured
8.The use of $2,500 from the Convention/Stadium Fund to be used for outside
promotion.
Joseph K.Gavinski,City Manager,pointed out that under the current resolution,
only the interest from the Convention/Stadium Fund can be used for this purpose and
there is only $1,662 available.He further stated that the Park and Recreation
Advisory Commission recommended that a damage or clean-up deposit be required when
granting permission for the mud race but after speaking with the President of the
Moses Lake Spring Festival Committee,he felt that it would not be necessary this
year.If the area is not cleaned up afterwards,the city would look to the Commit
tee to clean it up,if it is not cleaned up the group sponsoring the race.If
there are problems with the clean-up this year,he stated that the recommendation
from the Park and Recreation Advisory Committee could be considered for the next
year.
Mr.Gavinski stated that last year the Council limited the in-kind services for the
solid waste dump fees to $800.Neither the Fire nor the Police Departments have
any problems with the blocking off of the streets.
Mr.Edwards stated that he thought the Municipal Building was not ready for use by
the public.Mr.Gavinski stated that nothing has been done to the building but he
felt it could be used as long as the activity did not conflict with the require
ments of the Uniform Building Code or the Uniform Fire Code.He also pointed out
that the Council had a set a policy of a $100 a day rent on the building plus the
renter is to pay the utilities,and the renter is to clean up the building after
the activity.
Mr.Rimple wanted to know how much it cost the city last year for this activity.
Mr.Gavinski stated it cost the city approximately $1,800 which was what the city
paid for advertising and the dump fees.
There was some discussion by the Council on the insurance requirements for the
individual exhibiters.It was requested that staff check with other cities who
have activities such as the Spring Festival to see what their insurance require
ments are.Mr.Gavinski stated that the city requires only that the Spring Festi
val be insured not the individual exhibiters.
Mr.Edwards moved that the request be granted except that only $1,662 be granted
for outside promotion,that $100 a day be charged for the use of the Municipal
Building,that in-kind services be limited to $800,and the city check into the
insurance requirements,seconded by Mr.Wallenstien,and passed unanimously.
V.ORDINANCES AND RESOLUTIONS
ORDINANCE -INVESTMENTS/INVESTMENT INCOMES - 2ND READING
^Sr Aletter was read from Joseph K.Gavinski,City Manager,which presented an ordi-
\nance providing for an Investment Officer.
The ordinance adding Section 2.12.040 to the Moses Lake Municipal Code was read by
title only.
Mr.Rimple moved that the second reading of the ordinance be adopted,seconded by
Mr.Siegert,and passed unanimously.

ORDINANCE -AMEND FINANCE DEPARTMENT HOURS -2ND READING Q,.„
A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi
nance which changed the office hours of the Finance Department from 8 a.m.to 5
p.m.to 9 a.m.to 5 p.m.
The ordinance adding a new Chapter 2.90 of the Moses Lake Municipal Code entitled
"Office Hours"was read by title only.
Mr.Edwards requested that the phrase "except holidays"be placed at the end of the
last sentence in Section 2.90.010.
Mr.Edwards moved that the second reading of the ordinance be approved as amended,
seconded by Mr.Wallenstien,and passed unanimously.
ORDINANCE -PARK AND RECREATION USE FEES -1ST READING /A/
A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi
nance giving the Park and Recreation Advisory Commission the authority to establish
all Park and Recreation Department use fees.The City Council may review the fees
as set by the Park and Recreation Advisory Commission.
There was some discussion by Council.
The ordinance adopting a new Chapter 3.30 of the Moses Lake Municipal Code entitled
"Park and Recreation Department Use Fees"was read by title only.
Mr.Wallenstien moved that the first reading of the ordinance be adopted,seconded
by Mr.Reese,and passed unanimously.
ORDINANCE -AMEND CHAPTER 3.30 -1ST READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi
nance repealing Section 3.30.040.
The ordinance amending Chapter 3.30 of the Moses Lake Municipal Cdoe entitled
"Utility Occupational Tax"was read by title only.
Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by
Mr.Rimple,and passed unanimously.

AIRPORT INSURANCE -HANSEN AIR WEST
A letter was read from Joseph K.Gavinski,City Manager, which stated that the city
has been contributing $2,800 toward the acquisition of insurance for the Moses Lake
Municipal Airport which is being operated by Hansen Air West,Inc.under a 15 year
lease beginning April 1, 1977. This contribution was only for a period of 5 years.
The five years has expired and Hansen Air West,Inc.has requested that the city's
contribution of $2,800 per year be continued for another 5 years.
Mick Hansen,President of Hansen Air West,Inc.,stated that the cost of insurance
has run from $1,190 to $2,900.Apart of this cost comes from naming the city as
an additional insured.
Mr.Gavinski stated that money has been budgeted in the 1982 Budget for this insur
ance.

Mr.Hansen stated that clean-up of the ash was not covered by his insurance as they
felt it was the city's responsibility and the city did not have the funds to do it.
Therefore,he had to clean it up with the help of some of the pilots using the
airport.He stated that it cost him close to $10,000 for this clean-up.
There was some discussion by the Council.
Mr.Wallenstien moved that the city contribute up to $2,800 for insurance for the
next 5 years,seconded by Mr.Vernier,and passed with Mr.Rimple and Mr.Siegert
opposed.
Mr.Gavinski stated that the city would provide the $2,800 for insurance but would
like to see the bill.
IX.COUNCIL QUESTIONS AND ANSWERS
USE ORDINANCE
Mr.Rimple wanted to know if anything could be done about loud record playing or
parties late at night.
Jim Whitaker,City Attorney,stated that any noise regulatory legislation must be
cleared through the Department of Ecology and must have decible reading standards
and a decible reader to enforce it and must be in compliance with 3 chapters of the
RCW passed last year.He stated that the city is working on a noise ordinance at
this time which will conform to all necessary requirements.
X.CITY MANAGER REPORTS AND COMMENTS
PURCHASE OF PROPERTY -MILWAUKEE ROAD
Joseph K.Gavinski,City Manager,stated that Milwaukee Road has requested that the
city finish paying for the property known as Little Peninsula within the next 30 to
45 days.To close the deal the city will have to come up with $29,000.
AWC LEGISLATIVE CONFERENCE
Joseph K.Gavinski,City Manager,stated that it looks like the legislation will
pass on the additional h%sales tax with no non-related development fees and the
city would get an increase in the real estate transfer tax and a lid placed on the
amount of the utility tax the city can impose.
LIBRARY
Joseph K.Gavinski,City Manager,stated that the city received a letter from the
North Central Regional Library stating that the preliminary fee will be approxi
mately $88,500 for 1982.
