The meeting was called to order by Mr.Johnson at 8 p.m.
Mr.Edwards moved that the minutes of the meeting of March 9 be approved as submit
ted,seconded by Mr.Siegert,and passed unanimously.

which recommended that Genco Construction be awarded the bid on Job #062-A0.
Mr.Edwards moved that Genco Construction be awarded the bid on Job #062-A0 in the
amount of $7,446.50,seconded by Mr.Vernier,and passed unanimously.

»'A letter was read from Joseph K.Gavinski,City Manager,which presented three
ordinances dealing with weed control,sidewalk construction,and excavations and
obstructions.
The ordinance repealing Chapter 8.21 of the Moses Lake Municipal Code entitled
"Weed Control Regulations"and enacting a new Chapter 8.20 of the Moses Lake
Municipal Code entitled "Weed Control"was read by title only.
Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by
Mr.Siegert,and passed unanimously.

ORDINANCE -SIDEWALK CONSTRUCTION -2ND READING
The ordinance amending Chapter 12.12 of the Moses Lake Municipal Code entitled
"Sidewalk Construction"was read by title only.
Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by
Mr.Wallenstien,and passed unanimously.
ORDINANCE -EXCAVATIONS AND OBSTRUCTIONS -2ND READING
An ordinance amending Chapter 12.12 of the Moses Lake Municipal Code entitled
"Excavations and Obstructions"was read by title only.
Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by
Mr.Siegert,and passed unanimously.
>L|f ORDINANCE -FRANCHISE -BURLINGTON NORTHERN RAILROAD -1ST READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi
nance granting a franchise to Burlington Northern for the crossing on Alder Street.
The ordinance granting a franchise to Burlington Northern and their successor and
assigns,the right to construct,maintain,and operate a railway track at grade
over and across Alder Street in the City of Moses Lake,Washington was read by
title only.
Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by
Mr.Reese,and passed unanimously.
ORDINANCE -REZONE - WUTZKE - 1ST READING
A letter was read from Rita Perstac,Community Development Director,which stated
that G.P.Wutzke is requesting that approximately 16 acres of his property be
changed from R-l,Single Family Residential,to R-3,Multi-family Residential.The
property is located in Battery Orchard Tracts just south of 1-90 between Lakeshore
Drive on the west,Wanapum on the north,and Wapato on the east.
The ordinance amending Section 18.09.020 of Chapter 18 of the Moses Lake Municipal
Code entitled "Zoning"was read by title only.
Mr.Siegert moved that the first reading of the ordinance be adopted and a public
hearing be set for April 27,1982,seconded by Mr.Edwards,and passed unanimously.
ORDINANCE - AMEND 1982 BUDGET - 1ST READING
A letter was read from Walter Fry,Finance Director,which presented an ordinance
amending the 1982 budget.The change is for projects budgeted in 1981 but not
completed.
The ordinance amending the 1982 Budget for the City of Moses Lake was read by title
only.
Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by
Mr.Wallenstien,and passed unanimously.

VII.REFERRALS FROM COMMISSIONS
VARIANCE REQUEST - COPELAND SHORT PLAT
A letter was read from Rita Perstac,Community Development Director,which stated
that Copeland Lumber Yards is short platting one lot behind their existing site at
Broadway and Yakima,just west of Larson Playfield.Yakima Street is a dedicated
but unimproved right-of-way and Copeland is requesting that the required improve
ment,including utilities,be waived.Copeland is platting their land to build a
storage building that will have access only through the existing Copeland yard.
Mr.Edwards moved that the variance be granted,seconded by Mr.Wallenstien,and
passed unanimously.
SUBDIVISION ORDINANCES

A letter was read from Rita Perstac,Community Development Director,which presented
four ordinances revising and updating the current subdivision ordinance.
The ordinance repealing Chapter 17.08 of Title 17 of the Moses Lake Municipal Code
and establishing a new Chapter 17.09 of Title 17 of the Moses Lake Municipal Code
was read by title only.
Mr.Edwards moved that the ordinance be tabled and a study session be set to
consider the proposed changes,seconded by Mr.Reese,and passed unanimously.
An ordinance repealing Chapter 17.12 of the Moses Lake Municipal Code entitled
"Subdivisions"in its entirety and establishing a new Chapter 17.13 of the Moses
Lake Municipal Code entitled "Short Subdivisions"was read by title only.
Mr.Edwards moved that the ordinance be tabled and a study session be set to
consider the proposed changes,seconded by Mr.Reese,and passed unanimously.
An ordinance repealing Chapters 17.16,17.20,and 17.24 in their entirety and
enacting a new Chapter 17.17 entitled "Major Subdivision"of Title 17 of the Moses
Lake Municipal Code was read by title only.
Mr.Edwards moved that the ordinance be tabled and a study session be set to con
sider the proposed changes,seconded by Mr.Reese,and passed unanimously.
The ordinance enacting a new Chapter 17.26 entitled "Binding Site Improvement Plan"
in Title 17 of the Moses Lake Municipal Code was read by title only.
Mr.Edwards moved that the ordinance be tabled and a study session be set to con
sider the proposed changes,seconded by Mr.Reese,and passed unanimously.
A study session was set for May 4 at 8 p.m.
VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
GAMBLING TAX
Richard Nicks,Regional Manager of the Gambling Commission out of Yakima,stated
that it is the position of the Gambling Commission that if a city allows gambling
that a tax should be imposed.He pointed out that it is the responsibility of the
police to enforce the gambling laws,not the Gambling Commission.He pointed out
that 51%of the total received tax should go for law enforcement purposes and that if
each police officer in Moses Lake spends only one half hour a week on gambling
enforcement it will cost more than 51%of the tax collected on gambling.
ADMISSION TAX
Joseph K.Gavinski,City Manager,presented a report on the city's admission tax.&
He stated that several other cities assess the full 5%admission tax as allowed by
law.Moses Lake assesses a 4%admission tax.
Mr.Edwards moved that the request to delete the admissions tax be denied,seconded
by Mr.Wallenstien,and passed unanimously.

V Joseph K.Gavinski,City Manager,stated that the question of the city's insurance
has come up again and he recommended that it be discussed at the next Council
meeting.

ANNEXATION - BBCC - SOUTH CAMPUS
Joseph K.Gavinski,City Manager,stated that Big Bend Community College has pre
sented a notice of intent to annex property which is commonly called the South
Campus.The request to annex is conditioned upon formal approval by the college's
Board of Trustees at their meeting on April 26.
Mr.Johnson wanted to know why the college wishes to have this property annexed
into the city.
Dr.Howard Fryette,representing BBCC,stated that the potential buyer wishes to be
a part of the community.
Mr.Siegert wanted to know why the annexation is not square with Nelson Road.Kent
Jones,real estate agent for the college,stated that the property adjacent to
Nelson Road is owned by someone else.
Mr.Edwards moved that the proposed annexation request be referred to the Planning
Commission for their review and that staff be directed to try to get the property
adjacent to Nelson Road annexed also,seconded by Mr.Wallenstien,and passed
unanimously.
IX.COUNCIL QUESTIONS AND COMMENTS
CRIME PREVENTION PROGRAM
Mr.Siegert stated that he wished to compliment the Police Department on their work
when he had a burglary at his home.He stated he would like to see people in Moses
Lake become more aware of what is happening in their neighborhood in an effort to
reduce the crime rate in Moses Lake.
Chief Sharp stated that a neighborhood watch program is being considered by the
Police Department but at this time there is no way that an officer can be spared to
get such a program started.
Officer Haynes stated that crime prevention is his specialty and he does have ideas [
on how to establish block watch programs.He explained to the Council how such a |
program is set up and the advantages.'
X.CITY MANAGER REPORTS AND COMMENTS
INVESTMENT REPORT
v The investment report was presented to Council for their review.
FIRE LANES
Joseph K.Gavinski,City Manager,stated that before the city can enforce the laws
relating to fire lanes they must be delineated.The city has been assured of the
cooperation of the people in the shopping centers.
GROWTH MANAGEMENT
j(T Joseph K.Gavinski,City Manager,stated that the deeper the city gets into the
utility question the more apparent it becomes that the city must establish a growth
management program.He requested that a study session be set to discuss the prob
lem.
A study session was set for May 18 at 8 p.m.

AWC CONVENTION
Joseph K.Gavinski,City Manager,stated that the AWC Convention will be held in
June and requested any interested Councilmen to contact him.
MEETINGS
Joseph K.Gavinski,City Manager,stated that a meeting has been scheduled with
Congressman Sid Morrison for Saturday,April 17 at 8:30 a.m.at the Hallmark Inn
for a no-host breakfast.A meeting has also been scheduled for Friday,April 23,
at 2:30 p.m.with Ken Eikenberry,Attorney General,in the Council Chambers.
BLOCK GRANT
Rita Perstac,Community Development Director,stated that the state will be taking
over the Block Grant Program for Washington State.There will be four regional
meetings in the state,one of them in Moses Lake,to outline the new programs and
by June the new regulations should be available.
NORTH CENTRAL REGIONAL LIBRARY
Joseph K.Gavinski,City Manager,stated that the next meeting of the North Central
Regional Library will be held on Thursday,April 15,at 1 p.m.in Moses Lake and
will be considering the city's annexation request.He stated that he plans to
attend the meeting.
LEGISLATURE
Joseph K.Gavinski,City Manager,stated that the Legislature has put a sales tax
on food and extended that to the cities.They also gave the cities authority to
add one half cent to the sales tax as a revenue raising option.He stated,how
ever,that cities will not be able to assess development fees for things like fire,
police,parks,etc.but they can do it for water,sewer,and streets.Also,the
utility tax will have to be reduced to 6%.Also,there was a real estate transfer
tax which was authorized which could be levied in lieu of the sales tax.Authority
was also given to the counties to impose the tax if the city did not and to gain
that revenue.
He stated that the tax on food goes into effect on May 1 and the initiative to
remove the tax would go into effect on February 1,1983.In 1982 the city could
realize approximately $97,000 from May 1 to December 31 on the food tax.The city
anticipates receiving $530,000 from sales tax in 1982 and that could double if the
tax is increased.Also,the city will loose approximately $130,000 in utility
taxes.
INTERNATIONAL CITY MANAGERS MEETING
Joseph K.Gavinski,City Manager,stated that he had received a part scholarship to
attend the International City Managers Meeting in Louisville,Kentucky in October.
He stated that he will come back to the Council at a later date to request permis
sion to attend the meeting at no cost to the city.
CONVENTION CENTER

Mark Fuhriman and Layne Stark presented a proposal that the City Council implement
a design-research study for a convention/civic center in conjunction with the
redevelopment plans for Moses Lake.Mr.Fuhriman and Mr.Stark proposed that the
city send them on a fact finding and concept generating mission to several metro
politan centers such as Los Angeles,Houston,San Francisco,Knoxville,and Phoenix.
A proposed budget for a proposed Houston to Los Angeles trip is approximately
$7,700 and the budget for a proposed Knoxville,Houston,and Los Angeles trip is
$9,950.

Mr.Fuhriman stated that they feel that now is the time for the city to consider
such a convention/civic center complex.He stated that these five cities all have
attractive waterfront areas and have the same general size as Moses Lake.He
stated that Knoxville would be a good place to see because they are having a World
Fair there.He stated that he had talked to the director of the World's Fair and
was told that they could have a tour of the facilities before the opening of the
fair which would give them a good opportunity to see their buildings,their design
concepts,view their waterfront development,see the park areas,etc.He stated
that they would like to go before the end of April.
Mr.Wallenstien moved that the request be considered by staff and a recommendation
be presented at the next Council meeting,seconded by Mr.Reese,and passed unani
mously.
The regular meeting was recessed and the Council met in an executive session to
discuss the Coast to Coast lease and the purchase of Yonezawa Boulevard right-of-
way.The executive session was adjourned at 10:30 and the regular meeting was
reconvened.The regular meeting was adjourned at 10:30 p.m.
