1982 07 273516 CITY COUNCIL CITY OF MOSES LAKE July 27,1982 Members Present:Harvey Vernier,Charles Edwards,Norm Johnson,Wayne Rimple, Bob Wallenstien,and Dick Siegert Absent: Bill Reese The meeting was called to order by Mayor Norm Johnson at 8 p.m. Mr.Rimple moved that the minutes of the meeting of July 13 be approved as submit ted,seconded by Mr.Edwards,and passed unanimously. I.CITIZEN INPUT CRIME PREVENTION Dan Johnson,525 Grand,stated that he represented the 500 block of Grand Drive. He stated that there have been two burglaries in the area and the residents would like to set up a Block Watch or a Block Patrol.He stated that he was informed there are no funds for either of these programs and the residents would like some financial support for either the Block Watch or a Block Patrol. Randy Akins,531 Grand,wanted to know if there would be some way the residents of the area could obtain a Citizens Band Radio so that they could be touch with the Police Department.He stated that if this is possible the residents have discussed buying one if the city will help purchase it. Joseph K.Gavinski,City Manager,stated that he is not prepared to talk about the Block Watch Program or matching monies.If the Council wishes,he stated that he could prepare a report on the Program as well as the expenditure of time and money involved. It was the consensus of the Council that the City Manager prepare a report. LIBRARY Dr.Thorp wanted to know the status of the agreements between the city and the Northwest Regional Library Board. //7?\ /So"7 Joseph K.Gavinski,City Manager,stated that the city has received the library service agreement,the building maintenance agreement and the book retention agreement.He stated that there are some provisions in the agreements that need to be discussed concerning insurance indemnification and the book retention program if the city was annexed to the library and then decided to pull out after the three year statutory period. II.CONSENT AGENDA None 3517 CITY COUNCIL MINUTES:2 July 27,1982 III.CONSIDERATION OF BIDS None IV.PETITIONS,COMMUNICATIONS,OR PUBIC HEARINGS j COMMUNICATION -BICYCLE TRAILS -PARK AND REC.ADVISORY COMMISSION g)A letter was read from the Park and Recreation Advisory Commission which requested 1 Council to take under advisement the study and adoption of a Master Plan for bicy cle trails for Moses Lake. Mr.Rimple wanted to know if there is a bicycle path design and plan for Moses Lake. Rita Perstac,Community Development Director,stated that she thought there was one in the Park and Recreation Comprehensive Plan as well as the city's Comprehensive Plan. There was some discussion by the Council. Mr.Rimple moved that the Park and Recreation Department be authorized to study and adopt a master plan for bicycle trails for Moses Lake,seconded by Mr.Vernier, and passed unanimously. SIX YEAR STREET PROGRAM - RESOLUTION - PUBLIC HEARING ||1 A letter was read from Robert Townsend,Public Works Director,which stated that the Planning Commission agreed with the staff's proposed priority listing on the Six Year Street Program. The resolution adopting the six-year street construction program for 1983 -1988 was read by title only. The public hearing was opened. Mrs.Joseph Sommerfield wanted to know if Nelson Road from Pioneer to Highway 17 is on the Six-Year Street Program.She stated that it is used quite a bit and is a dusty,rutty road at this time. Mr.Townsend stated that Nelson Road from Balsam to Highway 17 is number 4 on the list.He pointed out that there is only so much money for street improvement and repair and the amount of money available will determine which streets are done. Mr.Edwards moved that the public hearing be closed,seconded by Mr.Wallenstien, and passed unanimously. Mr.Edwards stated that he would like to see Alder (Broadway -Division)moved to #6. After some discussion it was the consensus of the Council that the list remain as presented. Mr.Wallenstien moved that the Six-Year Street Program be accepted as presented and the resolution be adopted,seconded by Mr.Rimple,and passed unanimously. V.ORDINANCES AND RESOLUTIONS ORDINANCE - NOISE CONTROL - 2ND READING A letter was read from Josehp K.Gavinski,City Manager,which presented an ordi nance concerning noise control in the city. The ordinance enacting a new Chapter 8.28 of the Moses Lake Municipal Code entitled "Noise Control"was read by title only. Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by Mr.Rimple,and passed unanimously. n 3518 CITY COUNCIL MINUTES:3 July 27,1982 RESOLUTION - QUIT CLAIM DEED - SCHOOL DISTRICT A letter was read from Robert Townsend,Public Works Director,which presented a resolution accepting a quit claim deed for right-of-way for Yonezawa Boulevard located directly behind the Moses Lake High School.. The resolution accepting the conveyance of real estate to the City of Moses Lake from Moses Lake School District No.161 was read by title only. Mr.Rimple moved that the resolution be accepted,seconded by Mr.Wallenstien,and passed unanimously. '—'VI.REQUESTS TO CALL FOR BIDS None VII. REFERRALS FROM COMMISSIONS WESTLAKE SHORES PRELIMINARY PLAT Rita Perstac,Community Development Director,stated that Glen Corning has submit ted a preliminary plat for 140 lots located west of Laguna Drive and south of Sage Drive in the Westlake area of Moses Lake.The Planning Commission approved the preliminary plat and the 8 variances subject to the corrections requested by the Public Works Department. Mr.Edwards wanted to know why the sidewalks are requested to be omitted in certain areas of the plat.Ms.Perstac stated that the sidewalks requested to be omitted are on the side of the streets adjacent to property owned by the Bureau of Reclama tion or Department of Game except for the sidewalks requested to be omitted in front of Lots 38 and 39 in Phase IV.The developers felt that it was a big expense for only two lots and there would be a sidewalk on the other side of the street. There was some discussion by the Council on whether or not sidewalks should be ,required on Lots 38 and 39. ^J Mr.Edwards moved that the Westlake Shores Preliminary Plat be approved with the following variances: 1.Rolled extruded concrete curb on all internal streets. 2.A covenant to run with the land for Laguna Drive to be improved when the remaining street improvements are made -this involves the re-alignment of the street and the possible reconstruction of the existing brige. 3.Omit curbs,gutters,and sidewalks on the north side of Sage Drive within the subdivision boundaries. 4.Omit sidewalks on the entire west side and on the east side from the Phase IV development to the end of the project on Sand Dunes Road. 5.Omit sidewalks on the north and east sides of Phase I. 6.Rolled extruded concrete curb on the south side of Sage Drive within the subdivision boundaries. 7.Width to depth ratio to be waived on Lot 2 of Block 1;Lots 18,19,and 24 of Block 2;Lots 7,10,11, 12,and 13 of Block 4;Lots 18,20,21,22,27,28, I 29,31,34,and 36 of Block 7;and Tracts B,C,and D. LJ and the corrections requested by the Public Works Department as follows: 1.The building lines shown on Lots 31, 34,and 36 are concurrant with property lines and do not allow for yard setback requirements. 2.Once the surveyor has satisfied the requirement for 100 usable feet on the residential lots,remove the dotted lines from the final plat. 3519 CITY COUNCIL MINUTES:4 July 27,1982 3.Clarification is needed on the final plat regarding Tracts A,B,C,and D. Tract A does not meet requirements for a lot. 4.On Sheet 1 of 2 in Phase III,it shows a Lot 23 which should not be shown since it is part of Tract B. 5.The final plat shall show 20 foot sewer,water,and storm utility easements and shall be centered on a lot line.The water,sewer,or storm drain lines shall be offset 5 feet from the center of the easement. seconded by Mr.Rimple,and passed unanimously. VIII. OTHER ITEMS FOR COUNCIL CONSIDERATION c SWEDBERG POOL -REQUEST TO USE -MANTA RAYS A letter was read from Cecil Lee,Park and Recreation Director,which stated that the Moses Lake Manta Ray Swim Team has requested the use of Swedberg Pool from August 23 through September 30.The Park and Recreation Advisory Commission recommended that the users pay one third of the cost to maintain the facility, plus all heating costs.The estimated cost to maintain the pool for this period would be $1,365.One third of that would be $455 or $11.66 per day plus heat. Mr.Edwards moved that the request be approved,seconded by Mr.Wallenstien. Mr.Rimple wanted to know if the city is recommending a percentage of the cost or a set price.Mr.Lee stated that it would be a percentage of the cost to run the pool plus the heat. The motion was amended to read that the Manta Rays will pay one third of the cost plus heat. ,0° pctf The motion passed unanimously. DOWNTOWN PLANTER PROGRAM p. Cecil Lee,Park and Recreation Director,stated that the city did the watering on ] 12 of the planters in order to find out how much time it would take and the cost. It also helped to bring out some of the problems that would be encountered by watering the planters with the city's water truck.It will the cost the city a minimum of $4,128 per year. Al McFaddin stated that he felt Mr.Lee's observations and budget for the program is correct.He stated that they would like to donate these planters to the city. Mr.Wallenstien wanted to know how much it cost for these planters.Mr.McFaddin stated that they have received donations amounting to $2,550 for this project. Mr.Edwards moved that the city accept ^e-p4eflters-6nd-*ake the responsibility for watering and weeding the plants,but not the plants/themselves,seconded by Mr.Wallenstien./or planters CSEE MINUTES Of 8/11/82 FOR CORRECTION) Mr.Rimple stated that he was in favor of this project but he pointed out that the cost of this is going to increase over the years as labor and equipment costs increase.He wanted to know if perhaps some of the garden clubs in Moses Lake may be able to take on some of'the weeding or planting. Mr.Wallenstien pointed out that the people in the downtown area were informed that public funds for the improvements would have to come from an LID.He felt that if the city accepted these planters,a time limit should be set. Joseph K.Gavinski,City Manager,stated that this would be included in the Park and Recreation budget.He pointed out that every responsibility the city takes on has a cost associated with it.He felt that it should be made clear that the city is not taking on the responsiblity of repairing the planters or the planters themselves.The city has acquired some liability since it approved the placement of the planters but it has no control over where the planters were placed. CITY MANAGER REPORTS AND COMMENTS BUDGET /O'G Joseph K.Gavinski,City Manager,stated that,according to the Budget Calendar for the 1983 Budget,a study session should be set for August 17. He also distributed the capital expenditures proposed by each department. BLOCK GRANT 7fe?y Joseph K.Gavinski,City Manager,stated that a meeting was held between the PCAA,^0^ the State of Washington,the Community Development Director,and himself.If the ' Council decides to go with the new wastewater treatment facility as the next Block Grant Program,the following is a tenative schedule for the project: Aug.10 Regular Meeting -Public Hearing -Block Grant Aug.17 Study Session -Budget Pre-Planning Aug.19 Study Session -Overview -Wastewater Treatment Facility Aug.24 Regular Meeting -Resolution -Selection of Block Grant Project. Sept.7 Study Session -Introduction of Planned Financing of Wastewater Treatment Facility Sept.14 Regular Meetings -Approve financing plan for Wastewater Treatment Facility Sept.28 Study Session? Oct.1 Acceptance of DOE Ref.39 Grant -Wastewater Treatment Facility -Block Grant Application Mid Dec.Block Grant Funding Jan.1 Block Grant Money Available Mr.Gavinski pointed out that four projects have been presented to the Council for a possible Block Grant project:Milwaukee Wasteway;Downtown Revitalization; Basin Homes Improvement;and the Wastewater Treatment Facility.He stated that at the meeting with PCAA the Watewater Treatment Facility and the Basin Homes Im provement project were presented,but telling them that no actual project has been decided upon.They did not indicate which project would be more readily funded but it was his feeling that both projects have a good possiblity of being funded. He stated that there would probably be a lot of competition for the improvement project.He pointed out that the Wastewater Treatment Facility would not have a lot of competition but that it is outside the traditional scope of the Block Grants but falls within a category of economic development. It was the consensus of the Council that the schedule stand. The regular meeting was recessed at 9:15 p.m.and the Council met in an executive session to discuss labor relations.The executive session adjourned at 10:15 p.m.and the regular meeting was reconvened.The regular meeting was adjourned at 10:15 p.m. 'Norman Johnson,Mayor ATTEST: •0/IP ^ BEFORE THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON ) In the matter of: Preliminary Plat for Westlake Shores )Findings of Fact,Conclusions, )and Decision ) This matter,having come on before the Moses Lake City Council for action on the 27th day of July,1982,now makes the following: Findings of Fact 1.Glen and Elizabeth F.Corning,P.0.Box 1414,Moses Lake,Washington,own approximately 110 acres of land located west of Laguna Drive and south of Sage Drive in the Westlake area of Moses Lake,Washington,legally described as: The east half of the NW%and NE%of the SW%of Section 32,Township 19 North,Range 28 EWM,Grant County,Washington.EXCEPT the east half of the east half of the NE%of the SW%of Section 32,Township 19 North, Range 28 EWM,Grant County,Washington.Situate in the County of Grant, State of Washington. 2.On October 22,1981 the Comings submitted to the City of Moses Lake a letter of intent to begin annexation proceedings by the petition method for the above described property.The Moses Lake City Council accepted the Corning notice of intent and approved Ordinance #1042 on December 8,1981,providing for the annexation of the above described property with the zoning to be R-l, Single Family Residential. 3.On December 3,1981 Glen Corning submitted an Environmental Checklist to the City of Moses Lake for his proposed development of 140 single family residen tial lots on the above described property.The Planning Commission,at their December 10,1981 meeting,reviewed the Environmental Checklist and found the Corning development to have a non-significant impact on the environment. 4.On December 3,1981 Glen Corning applied to the City of Moses Lake for a Shoreline Management Substantial Development Permit for residential develop ment of the above described property and a Shoreline Conditional Use Permit for the leveling of three active sand dunes in the same area. 5.The Moses Lake Planning Commission,at their January 14,1982 meeting,after conducting a public hearing scheduled upon notice,approved the Shoreline Substantial Development and Conditional Use Permits with the conditions attached to the property by the Department of Ecology.Those conditions are: a.No subdivided lot will be less than 12,500 square feet. b.No subdivided shoreline lot will have less than 115 feet of shoreline frontage. c.The proposed subdivision will allow 300 feet of shoreline frontage for community access. d.A 20-foot buffer strip will be maintained between any proposed subdivi sions and the Washington State Department of Game public lands. e. Sewer and water will be available for all subdivided lots. 6.Beginning April 9,1982,the Washington State Department of Ecology approved the Shoreline Permits as issued by the City of Moses Lake. 7.On June 7,1982,Glen Corning submitted the Westlake Shores Preliminary Plat of 140 single family lots to the City of Moses Lake for the above described property. 8.A public hearing before the Moses Lake Planning Commission scheduled upon notice on the issue of re-zoning the land in question was held June 24,1982. 3521 3522 WESTLAKE SHORES PRELIMINARY PLAT -Findings of Fact:2 9.Jessica Longston of Midstate Land Company,2939 Fourth Avenue South,Seattle, WA 98134,appeared during the public hearing and stated she wanted to know the width of the lots. 10.John Repass,land surveyor with John Repass &Co.,P.0.Box 2041,E.Wenat- chee,WA 98801,appeared during the public hearing and stated that on the average the lots are between 80 feet and 90 feet wide on the street side and each lot is a minimum of 115 feet wide on the lake side. 11.No other person appeared during the public hearing other than Ms.Longston nor were there any written protests filed with the City of Moses Lake. 12.The area proposed to be platted is presently vacant land,consisting mostly of blow sand and sagebrush.The area to the east is somewhat developed along Laguna Drive with approximately 20 single family homes.The area to the north,south,and west is presently vacant land,with the land to the north being owned by the Bureau of Reclamation and the land to the west being owned by the Washington State Department of Game. 13.A 22 lot preliminary plat,Lakeshore Estates #2,adjacent to the property in question on the northeast boundary,proposed by Midstate Land Co.,was ap proved by City Council on August 11,1981.No development has yet taken place on this plat and the preliminary plat is due to expire August 12,1982. 14.The Westlake Shores Preliminary Plat will be served by city water and sewer, with the sewer being a pressure system that is powered by individual pumps on individual lots.Full street improvements to current city standards are required except where a variance is approved. 15.The Planning Commission,at their June 24,1982 meeting,gave considerable attention to the eight variance requests associated with the plat,especially the variance request concerning half-width street improvements on the west side of Laguna Drive.It was pointed out that the Lakeshore Estates #2 Preliminary Plat approval included the requirement to improve the bridge on Laguna Drive that will require re-alignment and probably ripping up any street improvements done on Laguna Drive before the bridge is improved. 16.The Planning Commission also reviewed the 15 plat comments submitted by the City of Moses Lake's Public Works Department. 17.The Planning Commission,at their June 24,1982 meeting,recommended approval of the Westlake Shores Preliminary Plat with the stipulation that the items from the Public Works Department be addressed on the final plat and the eight variances be granted,with variance #2 being amended by allowing a covenant to run with the land to develop the street when the remaining street improve ments are made.The Planning Commission forwarded this recommendation to the City Council. Conclusions 1.The City Council of the City of Moses Lake is vested with the authority and has the jurisdiction under the law to entertain and grant a request for preliminary plat approval within the city's corporate limits if the criterion required by law is met. 2.There appears,after the public hearing before the Planning Commission and after the public meeting before the City Council on the issue of the Westlake Shores Preliminary Plat,no opposition to approving the preliminary plat. 3.Since the area is proposed to be single family residential,and since the conditions set by the Department of Ecology have been met,and since the immediate area is single family residential in nature,and since the City of Moses Lake is cognizant of the need for the orderly development of land within its corporate limits so as to serve the welfare and best interests of the entire community,the City Council of the City of Moses Lake believes that approving the Westlake Shores Preliminary Plat would serve the best interests of the residents of the City of Moses Lake and bear a substantial relationship to the public welfare of the entire community. 3523 WESTLAKE SHORES PRELIMINARY PLAT -Findings of Fact:3 Decision 1.The Westlake Shores Preliminary Plat is hereby approved with the following variances: a.
