1982 10 123540 CITY COUNCIL CITY OF MOSES LAKE OCOBER 12,1982 Members Present:Norm Johnson,Wayne Rimple,Charles Edwards,Norm Staat,and Bill Reese Absent:Harvey Vernier and Bob Wallenstien The meeting was called to order by Mayor Norm Johnson at 8 p.m. Mr.Reese moved that the minutes of the meeting of September 28 be approved as submitted,seconded by Mr.Edwards,and passed unanimously. CERTIFICATES OF APPRECIATION Mr.Johnson stated that the Block Grant Program has been concluded and /0/3 expressed the thanks of the Council to the people who made it a success. He presented certificates of appreciation to the members of the Citi zens Advisory Committee,to the members of the Job Corps who did the work on the Peninsula Park improvements,and to Harvey Vernier who did the architectural work for the park. I.CITIZENS INPUT None II.CONSENT AGENDA None III.CONSIDERATION OF BIDS None IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS None V.ORDINANCES AND RESOLUTIONS ORDINANCE -PARKING REGULATIONS -1ST READING A letter was read from Robert Townsend,Public Works Director,which /0£y presented an ordinance amending the parking regulations to prohibit parking on Beech Street from Third Avenue to Fourth Avenue between the hours of 9 a.m.and 5 p.m.and to prohibit parking during school hours except for school buses on Ivy Avenue beginning 245 feet south of the Intersection of C Street and extending 445 feet south of C Street on the west side of the street. 3541 ,ft* 1* CITY COUNCIL MINUTES:2 October 12,1982 James A.Whitaker,City Attorney,also requested that the penalty provision of the ordinance be amended so that persons who do not pay their $5 parking fine on time will be required to pay $25. The ordinance designating certain street areas where stopping,stand ing,and/or parking is regulated,restricted,or prohibited thereon by amending Section 10.12.035 was read by title only. Mr.Edwards moved that the first reading of the ordinance be approved with the proposed change to the penalty provision,seconded by Mr. Reese,and passed unanimously. ORDINANCE -SALES USE TAX -1ST READING Bob West,Assistant to the City Manager,stated that if the.Council enacts the ordinance assessing the additional h%in sales tax,it can only take effect at the beginning of a quarter;this being January 1, April 1,July 1,or October 1.He stated that if the Council passes the ordinance in October,it will take effect January 1,1983.He stated that if the additional sales tax is implemented it is the staff's suggestion that a portion of the money be used to increase the city's Fund balance,a portion be used to fund a street reconstruction pro gram,a portion be used to increase the Equipment Fund Fund Balance, and a portion be set aside for future capital replacement or improve ments. Mr.Edwards stated that he realized the city could use the extra money but was not in favor of passing additional taxes at this time. Mr.Rimple pointed out that if the county should pass a similar ordi nance,the county would collect the tax from the citizens of Moses Lake as well as the county and the city would receive none of those funds. He felt that the first reading of the ordinance should be passed and then it could be brought up for second reading when necessary. The ordinance enacting a new Chapter 3.25 of the Moses Lake Municipal Code entitled "Sales:Use Tax 1982"which imposes a sales or use tax upon which is to be collected from those persons whom the state sales or use tax is collected,fixing the rate of tax,providing for the administration and collection thereof,consenting to the inspection of records and providing penalties for the violation thereof was read by title only. Mr.Rimple moved that the first reading of the ordinance be adopted, seconded by Mr.Johnson. The motion failed with Mr.Rimple,Mr.Johnson,and Mr.Staat in favor and Mr.Edwards and Mr.Reese opposed. RESOLUTION -DESIGNATE HALLOWEEN ON SATURDAY A letter was read from Gerrit Van Brandwijk,President of the Minis terial Association,requesting that the Council designate Saturday, October 30,as the day to observe Halloween instead of Sunday,October 31. The resolution designating Saturday,October 30,1982,instead of Sunday,October 31,1982,as the day for children to celebrate Hallo ween activities was read by title only. Mr.Rimple moved that the resolution be adopted,seconded by Mr.Staat, and passed unanimously. VII.REFERRALS FROM COMMISSIONS None 3542( CITY COUNCIL MINUTES: 3 October 12, 1982 VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION COMPREHENSIVE WATER SYSTEM PLAN A letter was read from Robert Townsend,Public Works Director,which stated that the city has completed the technical data and compiled the Comprehensive Water System Plan as directed by the Department of Social and Health Services.A public hearing must be held on October 26 in order to meet the October 31,1982 deadline set by the DSHS for the completion of the Plan. Mr.Rimple moved that a public hearing be set for October 26,seconded by Mr.Edwards,and passed unanimously. IX.COUNCIL QUESTIONS AND COMMENTS None X.CITY MANAGER REPORTS AND COMMENTS INVESTMENT REPORTS Investment reports for August and September 1982 were presented to Council. ASPHALT PATCHING PROGRAM Robert Townsend,Public Works Director,explained the city's asphalt patching program to the Council. BUDGET Walter Fry,Finance Director,stated that the preliminary 1982 budget would be ready for distribution to the Council on October 19.
