The meeting was called to order at 8 p.m.by Mayor Norm Johnson.
Mr.Edwards moved that the minutes of the meeting of August 23 be approved as sub
mitted,seconded by Mr.Rimple,and passed unanimously.

Mr.Reese moved that the bills be approved as submitted,seconded by Mr.Wallen-
stien,and passed with Mr.Edwards abstaining from voting for that portion of the
bills to Coast-to-Coast,and Mr.Rimple abstaining from voting for that portion of
the bills to Moses Lake Steel Supply.

IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS
PUBLIC HEARING -RESOLUTION -CDBG PROJECT SELECTION
A letter was read from Rita Perstac,Community Development Director,which stated
that a survey was conducted in the Basin Homes area with excellent returns.She
recommended that a Block Grant application be submitted for the Basin Homes area
with the following elements:
1.Leave the private water system as is.This means no city water will be
extended.
2.Extend city sanitary sewer mains.
3.Full width street improvements with curbs,gutters,sidewalks,catch basins
and storm sewer.
4.Optional sewer hook-up for all houses.The Block Grant will pay for hooking
up properties owned by low/moderate income people.All other property
owners wanting sewer will pay for their own hook-ups.
5.A 2-3 acre neighborhood park on city-owned property.

This will be a two-year project with Block Grant funding at about $1,300,000.
The resolution containing assurances of compliance and authorizing the City Manager
to sign and submit an application to the State of Washington for funds for a
Community Development Block Grant was read by title only.
The public hearing was opened.
Russ Hall wanted to know if Concord Street would be included in the project.Ms.
Perstac stated that the cost of extending city sewer and constructing streets in
the Concord and Malaga area would run about $500,000 and there are only about a
dozen homes in the area;therefore,the costs did not justify the improvements.
Richard Butler wanted to know if the area on top of the hill is also part of Basin
Homes.Ms.Perstac stated that that area is in Grant County.
Mr.Wallenstien moved that the public hearing be closed,seconded by Mr.Rimple,
and passed unanimously.
Mr.Edwards moved that the resolution be adopted,seconded by Mr.Wallenstien,and
passed unanimously.
PUBLIC HEARING -SHORELINE MASTER PLAN REVIEW
A letter was read from Rita Perstac,Community Development Director,which stated
that the city's Shoreline Master Plan is now due for its two year review.No one
appeared during the public hearing conducted by the Planning Commission and staff
suggested no changes in the Plan.The Planning Commission recommended that the
Shoreline Master Plan remain as is for this review period.
The public hearing was opened.There were no comments,so the public response was
closed.
Mr.Edwards moved that the public hearing be closed,seocnded by Mr.Wallenstien,
and passed unanimously.
Mr.Wallenstien moved that the Shoreline Master Plan remain as is,seconded by Mr.
Vernier,and passed unanimously.

V.ORDINANCES AND RESOLUTIONS
ORDINANCE - AMEND 8.04 - FIREWORKS - 2ND READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi
nance prohibiting the discharge of fireworks and pyrotechnics in any city park or
adjacent parking area.
The ordinance amending Chapter 8.04 of the Moses Lake Municipal Code entitled
"Fireworks"by amending certain sections and by adding a new section 8.04.030 was
read by title only.
Mr.Edwards felt that a $100 fine is excessive and moved that the fine be reduced
to $25.The motion failed due to lack of a second.
Mr.Reese moved that the second reading of the ordinance be adopted,seconded by
Mr.Rimple,and passed with Mr.Edwards opposed.
„ORDINANCE -AMEND 5.04 -LICENSING REGULATIONS -2ND READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi
nance amending the licensing regulations.
The ordinance amending Chapter 5.04 of the Moses Lake Municipal Code entitled
"Licensing Regulations"by amending certain sections was read by title only.
Mr.Rimple moved that the second reading of the ordinance be adopted,seconded by
Mr.Wallenstien,and passed unanimously.

ORDINANCE -CHAPTER 5.06 -LICENSE REGULATIONS -TEMPORARY LOCATIONS -2ND READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi
nance creating a new Chapter 5.06 regulating the licensing of business at temporary
locations.
The ordinance creating a new Chapter 5.06 of the Moses Lake Municipal Cdoe entitled
"Licensing Regulations -Temporary Locations"which defines,regulates and licenses
transient merchants,itinerant merchants and itinerant vendors,and providing
penalties for the violation thereof was read by title only.
Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by
Mr.Rimple,and passed unanimously.
ORDINANCE -AMEND 10.04 -STATE MODEL TRAFFIC ORDINANCE -1ST READING
A letter was read from James A.Whitaker,City Attorney,which presented an ordi
nance amending Chapter 10.04 entitled "Washington Model Traffic Ordinance"by
deleting all references to criminal traffic matters.This would mean only traffic
infractions would remain in force throughout the city.
The ordinance amending Sections 10.04.010 and 10.04.020 and repealing Section
10.04.040 of the Moses Lake Municipal Code entitled "State Model Traffic Ordinance"
was read by title only.
Mr.Wallenstien wanted to know the financial impact of this ordinance.
Joseph K.Gavinski,City Manager,stated that the financial aspect is hard to
assess because of the recent changes in the state law.He stated that more jury
trials are being requested and also the expense for jail time has greatly increased.
He also pointed out that Grant County has discussed adding another prosecutor to
their staff and moving the court to Ephrata.He stated that the county is now
planning a remodeling project which would include expanded court facilities.
Mr.Whitaker stated that he had been contacted by the Senate Judiciary Committee on
a 108 page proposed bill which would unify the court system.He stated that
because of the economic pressure caused by the decisions of the Washington Supreme
Court just about every city in the state is doing the same as the city is doing.
Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by
Mr.Vernier,and passed with Mr.Reese opposed.
ORDINANCE -SET 1984 TAX LEVY -1ST READING
A letter was read from Walter Fry,Finance Director,which presented an ordinance
setting the estimated property tax for the 1984 budget year.
The ordinance fixing the estimated amount to be recieved for municipal purposes
from taxations on assessed valuations on property within the City of Moses Lake,
Washington was read by title only.
Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by
Mr.Rimple,and passed unanimously.

VII. REFERRALS FROM COMMISSIONS
PRUKA SHORT PLAT - VARIANCE

A letter was read from Rita Perstac,Community Development Director,which stated
that John Pruka is short platting one lot located at the end of Laguna Drive,two
lots north of the Kalamakis lot.The lot is zoned R-l,Single Family Residential.
Mr.Pruka is requesting that the north lot line minimum standard be waived and the
map scale be 50'=1"instead of 100'=1".
Mr.Edwards moved that the two variances be approved,seconded by Mr.Rimple,and
passed unanimously.

VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
Cj RESERVOIR #6 -CERB CONTRACT
A letter was read from Joseph K.Gavinski,City Manager,which requested authoriza
tion to sign the Final Contract between the Washington State Community Economic
Revitalization Board and the City of Moses Lake for $222,445 for Reservoir #6.
Mr.Wallenstien moved that the City Manager be authorized to sign the contract,
seconded by Mr.Rimple,and passed unanimously.

X.CITY MANAGER REPORTS AND COMMENTS
\3&WASTE WATER TREATMENT PLANT -STATUS REPORT
i£l George Nordby,Pool Engineering,distributed a summary of the change orders in the
/project and reported on the progress of the project.He also distributed some
pictures showing the project.
jjCj OPERATION ID -POLICE
Joseph K.Gavinski,City Manager,gave the Council some information on the Little
Pepper Fingerprinting Program being conducted in the city.

SALES TAX
Joseph K.Gavinski,City Manager,stated that the city has recieved $238,000 for
the months of May and June.
CRESTVIEW DRIVE - KENISON
L
a\Joseph K.Gavinski,City Manager,stated that Lois Kenison had questioned the
parking of some vehicles on right-of-way across from her home on Crestview Drive.
On July 1,1981 a letter was sent to Mr.McMains stating that he could make im
provements on the property with the understanding that the city would not reimburse
him for any costs,the city would assume no liability to him,and the city could be
required to use the lot in the future.City staff did not feel there was any harm
in the adjacent property owner improving the lot and placing his camper,pick-up,
and boat on the lot.
There was some discussion by the Council.
Mr.Rimple moved that a letter be sent to the property owner stating that the city
is revoking the permission to park on city right-of-way and the ordinance will be
enforced as written,seconded by Mr.Reese,and passed unanimously.
N MUNICIPAL BUILDING
IT Joseph K.Gavinski,City Manager,stated that the city had received a letter from
Atwood Hinzman Consulting Engineers discussing the problem of the broken roof
trusses in the Municipal Building located at Broadway and Alder.He pointed out
that new buildings in Moses Lake are required to have a roof capable of carrying a
load of 35 lbs.per sq.ft.and the building at this time is only capable of carry
ing a load of 15 lbs.per sq.ft.They recommended that the trusses either be
repaired or the roof replaced.
Mr.Edwards felt the heaviest load was during the Mount St.Helens ashfall since
the ash was extremely heavy when it got wet.
Jeffery Michael Scott,renter of the building,stated that he wisheet the Council to
realize that everything he owns is tied up in this business venture and because of
the closing down of the business there is no income coming in.He felt that the
city may have a moral obligation to help him out.

Mr.Gavinski stated that the city could understand Mr.Scott's position but the
city cannot give money away unless there is a legal obligation to do so.He
stated that he had informed Mr.Scott that he could submit a claim to the city and
it would be processed.Also,he stated that he had informed the city's insurance
broker of the situation and there is a question as to whether the city has any
liability.
There was some discussion by Council and Mr.Gavinski stated that the allowable
limit is $15,000 for Public Works contracts without bidding.
Kerry Montague stated that he was concerned about the Scotts and the roller skating
rink and did not feel taking a month to get the engineers report was expediting the
manner.
The regular meeting was recessed at 9:10 p.m.and the Council met in an executive
session to discuss labor relations and personnel matters.The executive session
was adjourned at 10:30 p.m.and the regular meeting was reconvened.The regular
