Mr. Edwards moved that the minutes of the meeting of October 25 be approved as submitted,seconded by Mr.Wallenstien,and passed unanimously. I.CITIZEN INPUT WEED CONTROL J/97DickWhaleyoftheGrantCountyNoxiousWeedControlBoardstatedthattheywere willing to offer their assistance to the city in its weed control program.He stated that they could save the city money in the purchase of chemicals and the application of the chemicals by using competitive bidding and private applicators instead of city or county crews.He stated that the county needs some funds to pursue this weed control program. Joseph K.Gavinski,City Manager,stated that the Council could discuss this during the budget study session after the regular meeting. The ordinance amending the 1983 Budget for the City of Moses Lake was read bv title only.J Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by Mr.Wallenstien,and passed unanimously. 3666 CITY COUNCIL MINUTES:2 November 8,1983 £ORDINANCES -AMEND CHAPER 5 -1ST READINGS A letter was read from Joseph K.Gavinski,City Manager,which presented four ordinances relating to the costs of screening or investigating individuals for a private detective,solicitor,taxi cab,or private security business license. Private Detectives -The ordinance amending Chapter 5.24 of the Moses Lake Municipal Code entitled "Private Detectives"was read by title only. Mr.Wallenstien moved that the first reading of the ordinance be adopted,seconded by Mr.Edwards,and passed unanimously. Solicitors -The ordinance amending Chapter 5.36 of the Moses Lake Municipal Code entitled "Solicitors"was read by title only. Mr.Reese moved that the first reading of the ordinance be adopted,seconded by Mr. Rimple,and passed unanimously. Taxicabs -The ordinance amending Chapter 5.40 of the Moses Lake Municipal Code entitled "Taxicabs"was read by title only. Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by Mr.Reese,and passed unanimously. Private Security Business -The ordinance amending Chapter 5.44 of the Moses Lake Municipal Code entitled "Private Security Business"was read by title only. Mr.Wallenstien moved that the first reading of the ordinance be adopted,seconded by Mr.Reese,and passed unanimously. o RESOLUTION - MOSES LAKE SPRING FESTIVAL A letter was read from Joseph K.Gavinski,City Manager,which presented a resolu tion which varies the city's participation in the Spring Festival by moving the food booths from downtown to McCosh Park,the city absorb the cost for police and security service,and the city absorb all costs for garbage pick-up and the land fill dumping.The city has previously paid up to $800.The Council has passed a resolution limiting the amount of money spent on tourist promotion to either $2,500 or the interest on the funds collected in the year previous,whichever is less. The resolution regarding the Moses Lake Spring Festival to be held in May 1984 was read by title only. Pat Lightel wanted to know if the city or the Spring Festival Committee is putting on the festival.She stated that they wish the city to provide police protection, advertising,water,sewer,garbage,swimming pool,and park facilities.She pointed out that the Festival has made no money in the last three years and was $10,000 in the hole this last year.She felt the city was being asked to foot the bill,which means the people of Moses Lake.She felt the citizens of Moses Lake should be asked if they want a Spring Festival if it is going to cost them so much money. Howard Wagner,Spring Festival Committee,stated that the Festival was for the citizens of the City of Moses Lake.He stated the Committee would request that the swimming pool be opened on Saturday and Sunday during the Festival and also the $2,500 for the promotion of tourism and advertising. Mr.Gavinski stated that costs for police protection have been estimated at between $2,500 and $3,500 and the total cost for garbage pick-up last year was $1,200.He stated that if McCosh Park is used the city would work with the Spring Festival Committee on the placement of the booths,etc.to minimize possible damage to the park. Mr.Wagner stated that it was felt that holding the Festival in the park would create a much better festival atmosphere and would help alleviate some of the garbage and security problems. There was some discussion by the Council and it was pointed out that this request would have an impact on the budget. Mr.Rimple moved that the resolution be tabled,seconded by Mr.Wallenstien,and passed unanimously. I 3667 CITY COUNCIL MINUTES:3 November 8, 1983 VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS WATER THEME PARK PRELIMINARY PLAT -SET DATE TO CONSIDER /y^A. A letter was read from Rita Perstac,Municipal Services Director,which presented the preliminary plat for a 10-acre water theme park located at the intersection of Hansen Road and the State Frontage Road in the Westlake area.The area is zoned C- 4,Highway Commercial,and the developer will extend city water and sewer to this site. Mr.Edwards moved that November 22 be set as the date to consider this preliminary plat,seconded by Mr.Reese,and passed unanimously. PIONEER WAY COMMERCIAL PARK PRELIMINARY PLAT A letter was read from Rita Perstac,Municipal Services Director,which presented the Pioneer Way Commercial Park Preliminary Plat which consists of approximately 60 lots to be final platted in three phases located on Pioneer Way south of Sharon Avenue.The area is zoned C-4,Highway Commercial,and the developer will extend city water and sewer and install a portion of Yonezawa Boulevard plus two new streets.A letter has been received from Harry Dano,President of the Moses Lake Development Task Force,which implied that the plat should not be approved because it threatens the strength of the downtown area as the central business district of Moses Lake.The Planning Commission recommended that the preliminary plat be approved with the stipulation that a solution satisfactory to the State Department of Transportation,the city,and Wheatland Development be worked out on the inter section of Clover Drive,Pioneer Way,and Yonezawa Boulevard. Mr.Edwards wanted to know if the plat was for the purpose of constructing a shop ping center.Hal Raynard,representing Wheatland Development,stated that it is proposed for professional offices and service related businesses. Mr.Wallenstien moved that the Pioneer Way Commercial Park Preliminary Plat be approved with the stipulation that a solution satisfactory to the State Department of Transportation,the city,and Wheatland Development be worked out on the inter section of Clover Drive,Pioneer Way,and Yonezawa Boulevard,seconded by Mr. Johnson and passed with Mr.Edwards opposed and Mr.Vernier abstaining. IX.COUNCIL QUESTIONS AND COMMENTS None X.CITY MANAGER REPORTS AND COMMENTS WASTE WATER TREATMENT PLANT - FORCE MAIN Joseph K.Gavinski,City Manager,stated that the main concern with the force main seems to be when it is finished and the waste water starts to flow into it.He stated that there is pressure sensitive valve on either end of the Pelican Horn force main which will detect any leak in that portion.There is a measuring device located in the Central Operations Facility and one at the waste water treatment plant.Readings will be taken monthly and weekly and if there is more water going in than is coming out they will know there is a leak. Mr.Gavinski stated that the change orders are coming in at about 3.4%which is y/ery good but there are still some items that are not yet resolved. OFF-ROAD VEHICLES ORDINANCE //</6- Joseph K.Gavinski,City Manager,stated that there is an ordinance which expires December 31,1983 concerning the operation of off-road vehicles on vacant lots which was put into effect during the time when there was ash from the Mount St. Helens eruption which could have been disturbed.The object of the ordinance was to keep the dust down. There was some discussion by the Council and it was decided to have the ordinance brought back. 3668 CITY COUNCIL MINUTES:4 November 8,1983 COURT/JAIL SERVICES CONTRACT Joseph K.Gavinski,City Manager,stated that a meeting was held with the County Commissioners,City Council,and the Town of Quincy to discuss the Municipal Court and Jail Services Contract. He presented the Jail Services Contract to the Council and it was pointed out the cost was reduced from $24 to $22. Mr.Edwards moved that the City Manager be authorized to sign the agreement and to make the necessary typographical and grammatical changes and to change the $24 to $22,seconded by Mr.Reese,and passed unanimously. Mr.Gavinski stated that the municipal court system was discussed with the County Commissioners and the Town of Quincy.He stated that the Town of Quincy will eliminate from their books all matters relating to criminal traffic,traffic infractions,and criminal misdemeanors.They will turn the revenue over to the county and also discuss the possibility of adding some money to reduce the impact of the change. Mr.Gavinski distributed to the Council some figures on the costs and income of the city's Municipal Court. There was some discussion by the Council. James A.Whitaker,City Attorney,stated that Quincy has had a different system than Moses Lake as they have had a Police Judge and no trials until the changes were made in the law this past year.As a consequence,they were hit with con siderable unanticipated costs.He stated that Quincy wanted to keep the court, judge,and prosecutor coming to Quincy to save the police the travel time and to have a court to handle the infractions that will remain.Quincy is willing to pay the county some portions of the money they would have spent if they kept their court. After some discussion by the Council,Mr.Gavinski recommended that if the city does not wish to keep the court that the responsibility can be transferred to the county which might result in the court being moved to Ephrata.If the city wishes to keep the court,don't do anything. It was the consensus of the Council that the city take no action at this time. The meeting was adjourned at 9:30 p.m.and the Council meet in a budget study session. area.She stated that no left turn is permitted onto Pioneer Way when exiting from the building.There are approximately 60 employees and between 3,000 and 4,000 people a month visiting the building,most of whom wish to turn left.With this proposed development she felt the frontage road should be reconsidered or another access developed for this building. 5.Cecil Lee,Park and Recreation Director,appeared during the public hear ing and stated that the Park and Recreation Advisory Commission would like to see provision made for pedestrian and bicycle traffic when Yonezawa Boulevard is developed. 6.Rita Perstac,Municipal Services Director,stated that the problem with the intersection of Clover Drive,Pioneer Way,and Yonezawa Boulevard is still being discussed.This intersection problem has not yet been re solved because plans have not yet been developed far enough. 7.Hal Raynard,representing Wheatland Development Co.,stated that they are willing to work with the city in placing bicycle paths of some type on Yonezawa Boulevard.He further stated that Wheatland Development is willing to sell Tract B to Capital Development Company for use as an ac cess for the DSHS building onto Yonezawa Boulevard. 8.Ms.Dunhaver stated that Capital Development Company is not interested in purchasing Tract B for an access for the DSHS building. 9.No other person appeared during the public hearing nor were there any written protests filed with the City of Moses Lake. 10.The Planning Commission recommended to the City Council that the Pioneer Way Commercial Park Preliminary CONCLUSIONS 1.The City Council of the City of Moses Lake is vested with the authority and has the jurisdiction under the law to entertain and grant a request for a preliminary plat approval within the city's corporate limits if the criterion required by law is met. 2 There appears,after the public hearing before the Planning Commission and after the public meeting before the City Council on the issue of the Pioneer Way Commercial Park Preliminary Plat,no opposition to approving the preliminary plat. 3.Since the area is zoned C-4,Highway Commercial,and the City of Moses Lake is cognizant of the need for the orderly development of land within its corporate limits so as to serve the welfare and best interests of the entire community,the City Council of the City of Moses Lake believes that approving the Pioneer Way Commercial Park Preliminary Plat would serve the best interests of the residents of the City of Moses Lake and bear a substantial relationship to the public welfare of the entire community. DECISION 1.The Pioneer Way Commercial Park Preliminary Plat is hereby approved with the stipulation that a solution satisfactory to the State Department of Transportation,the city,and Wheatland Development be worked out on the intersection of Clover Drive,Pioneer Way,and Yonezawa Boulevard.
