1984 03 133695 CITY COUNCIL CITY OF MOSES LAKE March 13,1984 Members Present:Norm Johnson,Wayne Rimple,Bob Wallenstien,Dave Chandler, and Bill Reese Absent: Chuck Edwards and Norm Staat The meeting was called to order at 8 p.m.by Mayor Norm Johnson. Mr.Rimple moved that the minutes of the meeting of February 29 be approved as submitted,seconded by Mr.Wallenstien,and passed unanimously. APPROVAL OF BILLS REGULAR BILLS AMOUNT GENERAL FUND $16,660.34 STREET 538.48 WATER/SEWER FUND 3,568.67 WATER/SEWER CONSTRUCTION 307,151.72 SANITATION FUND 22,278.74 CENTRAL SERVICES 1,795.13 BUILDING MAINTENANCE 214.77 EQUIPMENT RENTAL 2,915.23 TOTAL $355,133.08 Mr.Reese moved that the bills be approved as submitted,seconded by Mr.Rimple, and passed with Mr.Chandler abstaining from voting for that portion of the bills to Grant County Tractor and Mr.Rimple abstaining from voting for that portion of the bills to Moses Lake Steel Supply. I.CITIZEN INPUT SAMMONS COMMUNICATIONS /oo/ Bill Bryant of Sammons Communications stated that a new television station will be going on the air in Wenatchee about April 1.He stated that under FCC rules Sammons will have to put it on the air and it has been decided to put it on Channel 9,the Canadian station.This station will be covering local news and will have a reporter in Moses Lake. PROCLAMATION - GIRL SCOUT WEEK The proclamation declaring March 10 to 16,1984 as Girl Scout Week was read in its entirety and presented to the Girl Scouts. II.CONSENT AGENDA None III.CONSIDERATION OF BIDS VEHICLE BIDS /o/y A letter was read from Rita Perstac,Municipal Services Director,which presented the bids received on the 8-cylinder police car and the 4-cylinder car for the Municipal Services Department. Joseph K.Gavinski,City Manager,recommended that the bid on the police car be awarded to Moses Lake Ford since their bid was within 10% of the state contract amount.He pointed out that the city tries to buy locally if the price is within 10% of an out-of-town lower bid. Mr..Gavinski stated that the bids received for the car for the Municipal Services Department are on two different cars.The state bid is on the Chevy Citation and the Shaffo bid is on the Chevy Celebrity.He stated that either car would meet the specifications. 3696 CITY COUNCIL MINUTES:2 March 13,1984 Mr.Reese moved that the police car bid be awarded to Moses Lake Ford and the Municipal Services Department car bid be awarded to the state contract,seconded by Mr.Wallenstien. There was some discussion on the possible problems with the warranty if the car is purchased through the state bid. The motion failed with Mr.Reese and Mr.Wallenstien in favor and Mr.Rimple,Mr. Johnson,and Mr.Chandler opposed. Mr.Rimple moved that the police car bid be awarded to Moses Lake Ford and the Municipal Services Department car bid be awarded to Bob Shaffo Chevrolet,seconded by Mr.Chandler,and passed with Mr.Wallenstien opposed. A STREET SWEEPER AND ASPHALT PATCHER |i ]°A letter was read from Joseph K.Gavinski,City Manager,which recommended that the bid on the asphalt patcher be awarded to Critzer Equipment and the bid on the street sweeper be awarded to Sahlberg Equipment. Mr.Wallenstien moved that the bid on the asphalt patcher be awarded to Critzer Equipment and the bid on the street sweeper be awarded to Sahlberg Equipment, seconded by Mr.Chandler. There was some discussion by Council. The motion passed with Mr.Rimple and Mr.Reese opposed. i1 STREET SWEEPER AND ASPHALT PATCHER FINANCING iO \0] \0* \&. Walter Fry,Finance Director,recommended that the city accept the bid from Rauscher Pierce Refsnes Leasing,Inc.of Phoenix,Arizona for the financing of the street sweeper and asphalt patcher. Mr.Rimple moved that staff accept the Finance Director's recommendation,seconded \—ibyMr.Reese,and passed unanimously.j GASOLINE AND OIL A letter was read from Rita Perstac,Municipal Services Director,which recommended that the city accept the gasoline and oil bid amounts from Cenex and the #2 Diesel fuel bid from Whitney Distributing. Mr.Chandler moved that the recommendation from staff be accepted,seconded by Mr. Reese,and passed unanimously. IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS None V.ORDINANCES AND RESOLUTIONS 7 ORDINANCE -REPEAL MODEL TRAFFIC ORDINANCE - 2ND READING Joseph K.Gavinski,City Manager,stated that he has not yet received the necessary information from Grant County on court costs involved if the city should repeal its criminal traffic and traffic infractions.He is requesting that the Council table the ordinance for four weeks until the information can be received and analyzed. Mr.Rimple moved that the ordinance be tabled until April 10,seconded by Mr.\— Wallenstien,and passed unanimously.j ORDINANCE - GARBAGE COLLECTION - 2ND READING A letter was read from Joseph K.Gavinski,City Manager,which presented an ordi nance amending the garbage ordinance.If this ordinance is passed it will become effective at such time as the new garbage collection contract becomes effective. He stated that the ordinance has been revised as suggested at the Council's last meeting.He further stated that he would recommend the following changes:under MLMC 8.08.150(E),change the word "entrance"in the first line to "business"and at the end of the first sentence the words "or complex"be added. 3697 CITY COUNCIL MINUTES:3 March 13,1984 Mr.Gavinski stated that he has talked with Rogers and Norman regarding their position on the provision about going on to private property.He distributed to the Council letters dated March 7 and 9 concerning this situation and the liability. It is the opinion of Rogers and Norman that entering private property would not increase the city's liability. The ordinance amending Chapter 8.08 of the Moses Lake Municipal Code entitled "Garbage Collection"by amending and adding certain sections was read by title only. Mr.Wallenstien moved that the ordinance be amended as recommended by staff and the second reading of the ordinance be approved,seconded by Mr.Chandler,and passed >—'unanimously. VI.REQUESTS TO CALL FOR BIDS DIVISION STREET RECONSTRUCTION /o/9- A letter was read from Rita Perstac,Municipal Services Director,which requested authorization to call for bids on the Division Street project. Mr.Reese moved that staff be authorized to call for bids,seconded by Mr.Rimple, and passed unanimously. GARBAGE COLLECTION CONTRACT Joseph K.Gavinski,City Manager,explained the differences in the proposed con-Q tract and the existing contract.He stated that there has been some discussion on 6th day or Saturday service.He stated that it could be eliminated by providing larger containers or an extra container which would be picked up on Monday.He recommended that the city go with a 5-day service and try to work out the extra day service for those business now using Saturday pickup. There was some discussion by the Council on the Saturday pickup. He also suggested that the contract be changed so that accounts with drop boxes or I j compactor service be charged for once a month pickup at a minimum on a week day. He also suggested a change in the contract which would eliminate reference to 1978 services and the 8 can limit for duplexes in residential neighborhoods since there is no limit on the number of cans a residence can have. Mr.Wallenstien moved that staff be authorized to call for bids,seconded by Mr. Chandler,and passed unanimously. VII.REFERRALS FROM COMMISSIONS LPS FIRST ADDITION PRELIMINARY PLAT Rita Perstac,Municipal Services Director,stated that the Church of Jesus Christ of Latter Day Saints submitted a one lot subdivision on Valley Road,across from the Grant County Fairgrounds.The lot is five acres in size and is zoned R-l, Single Family Residential.The church plans to construct and operate a 14,760 square foot building with landscaping and parking on 2.3 acres of the lot.City water is available.City sewer is about h mile away near Valley and Grape.The church wishes to install an on-site sewer system and requests a covenant to defer city sewer installation.The Planning Commission recommended that the variance request be denied and this preliminary plat be approved with the provision that city sanitary sewer be extended now to serve the lot,comments from the City Engi neer be addressed,and the plat be allowed to have two ingresses and egresses to the property. uJ The Planning Commission's decision to deny the church's variance request to delay installing city sewer was based on the following reasons: 1.The area's porous soil quality. 2.Grant County Health District's position on groundwater contamination. (Ki°v 3698 CITY COUNCIL MINUTES:4 March 13,1984 3.The thinking that the city should no longer allow new septic tanks anywhere in the city. 4.Lake clean-up efforts are frustrated with septic tank effluent seeping into the lake. 5.Platter installed utilities can be reimbursed to the installer for a 15-year period. A letter from Western Pacific Engineering to the Grant County Health District and a letter from the Grant County Health District to Western Pacific Engineering jj] concerning the sewer problem for this property was distributed to Council.I I Mr.Rimple moved that the preliminary plat be tabled until March 27 so that the information in the letters can be studied,seconded by Mr.Reese,and passed unani mously. VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION DIVISION/POTATO HILL ROAD BRIDGE ACROSS 1-90 A letter was read from Rita Perstac,Municipal Services Director,which stated that the state Department of Transportation is beginning design work on six existing bridges across 1-90 between Kittleson's Corner and George.These bridges are too low for federal highway standards and solutions being studied are to either raise the bridges or lower the roadway on 1-90.The Division Street overpass is one of the bridges being studied.The reconstruction of Division Street to four lanes will necessitate a transition for southbound traffic from four lanes to the exist ing two lane bridge at the city limits.Since this bridge will probably be recon structed to solve the clearance problem,the state,the county,and the city have been discussing improving the bridge for future needs.The county endorses an interchange at the Division/I-90 bridge location.Staff is requesting direction regarding the following: 1.Should the city continue discussing this bridge problem with the state and j—\ county and work towards a long term solution?1 \ 2.Does the city wish to take a position on whether or not the bridge should be four-laned,converted to an interchange,or left as it is? 3.Does the city wish to more actively solicit community opinion about the bridge and solutions? 4.Is the city willing to financially participate in the bridge reconstruction? The city has not been asked to participate but a letter from the county indicates the Commissioners offer assistance of some type toward the inter change. Joseph K.Gavinski,City Manager,stated that he had received a call from someone in the county stating they are not in favor of an interchange at that location. Layne Stark stated that he was in favor of a four-lane interchange at this loca tion.He felt that Division is a major arterial of Moses Lake and improving it would benefit both the county and city. Karl Goodrich,7 Pelican Place,stated that he was in favor of this interchange. He also pointed out that there is a lot of empty ground out Division Road that is unsuitable for farming but is ideal for residential development.He felt develop ment would take place in this area which would create a great deal of traffic and now would be a good time to upgrade and reconstruct the interchange and Division '\Road.j George Oliver,11 Pelican Place,stated he was in favor of the interchange. Carl Thompson,9 Pelican Place,stated that he had called many people in the area and most of them were in favor of the interchange.He felt that since Division would be 4-1ane out to the bridge anyway it would be a good idea to go ahead with the interchange since he felt it would be needed in the future. u 3699 CITY COUNCIL MINUTES:5 March 13,1984 Ron Covey,property owner in Montiake,stated that he was also in favor of the interchange. Mr.Rimple stated that he lived in the Montiake area and he felt an interchange in the area would completely destroy the residential environment.He stated that freeway interchanges are commercial in nature,not residential. There was some discussion by the Council.It was decided to hold a public meeting on March 27 to discuss this project. COPY MACHINE BID SPECIFICATIONS /o/y A letter was read from Joseph K.Gavinski,City Manager,which stated that staff would like to discuss the bid specifications for the copy machines for the Police Department and the Municipal Services Department. Mr.Gavinski stated that the Municipal Services Department is justified in requir ing a programmable lens.They are also requesting a copier with a speed of 25 copies per minute and a service time of between 3 and 6 hours. He stated that the Police Department's feeling was that a programmable lens is state-of-the-art in copiers and would not be quickly outdated and could be used to prepare some forms in-house.Copy speed and response time was also an issue with the Police Department. Mr.Gavinski stated that he would recommend a programmable lens for the Municipal Services Department and increase the response time to four hours.He did not feel the progammable lens for the Police Department was absolutely necessary but would be nice.The copy speed is an issue and the response time of two to four hours is reasonable. Mr.Rimple stated that he was under the impression that the programmable lens was not that big a cost item on the copier.If this is true,allowing the Police Department to have a programmable lens would allow for a backup for the Municipal Services Department.He stated that he would like to see the bidders be specific in what they provide in their maintenance agreements. After some discussion by the Council,it was decided to go with a copier with a programmable lens in both the Police and Municipal Services Departments and a four hour response time. IX.COUNCIL QUESTIONS AND COMMENTS None X. CITY MANAGER REPORTS AND COMMENTS JAIL SERVICES AGREEMENT Joseph K.Gavinski,City Manager,stated that he had received a letter from the Corrections Standards Board stating that they rescinded their earlier requirement of supporting a 10-year contract with the cities of Moses Lake,Ephrata,and Quincy. That means there is no necessity for an agreement between the city and county in order for the county to receive jail construction funding. CLEAN-UP DAY Joseph K.Gavinski,City Manager,stated that April 7 and 8 is acceptable to the county as the days for free dumping. MEETING Joseph K.Gavinski,City Manager,stated that he had received a letter from the County Commissioners to the Port of Moses Lake concerning a meeting to be held on March 14 at 7 p.m.at the PUD auditorium concerning problems of industrial growth in the Moses Lake area.He stated that he is planning to attend this meeting. 3700 CITY COUNCIL MINUTES:6 March 13,1984 NEW WASTE WATER TREATMENT PLANT Joseph K.Gavinski,City Manager,distributed the latest Construction Change Order Summary from Pool Engineering.The Central Operation Facility is 92%complete and has 7.7%in change orders.The force main project is 100%complete and had 4.8%of change orders.The waste water treatment facility is 92%complete and has .6%of change orders.The pump station modifications are 91%complete and has 3.3%of change orders. COUNCIL WORKSHOP Joseph K.Gavinski,City Manager,stated that the Council Workshop in Kennewick is set for June 1,2,and 3 and all arrangements have been made.
