1984 07 103736 CITY COUNCIL CITY OF MOSES LAKE July 10,1984 Members Present:Norm Johnson,Bob Wallenstien,Dave Chandler,Chuck Edwards, Wayne Rimple,and Norm Staat,and Bill Reese The meeting was called to order at 8 p.m.by Mayor Norm Johnson. Mr.Chandler moved that the minutes of the meeting of June 26 be approved as submitted,seconded by Mr.Wallenstien,and passed unanimously. I.CITIZEN INPUT None II.CONSENT AGENDA None III.CONSIDERATION OF BIDS None PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS CONDITIONAL USE PERMIT -LESTER -APPEAL A letter was read from Rita Perstac,Municipal Services Director,which stated ^6 ~* that the Planning Commission had approved a conditional use permit for Jerry Lester to operate a home occupation in a Single Family Residential Zone.Mr. Lester plans to operate an ice cream cart business from his home from April through September of each year.Richard Shumate is appealing the granting of the Conditional Use Permit by the Planning Commission to the Council. 3737 |tf° jcfp 101 CITY COUNIL MINUTES:2 July 10,1984 Mr.Johnson stated that Mr.Rimple received a call from Mr.Lester at 4:30 p.m.and stated that he is no longer interested in purchasing this business. Joseph K.Gavinski,City Manager,stated that the Council can either put this item over until the city receives formal notification from Mr.Lester that he no longer wishes the permit or the city can grant the appeal by Mr.Shumate which would effectively deny the permit. Mr.Edwards moved that the appeal by Mr.Shumate be approved,seconded by Mr.r_. Wallenstien,and passed unanimously. PUBLIC HEARING - ORDINANCE - REZONE -CAMPBELL/MICHEL - 2ND READING A letter was read from Rita Perstac,Municipal Services Director,which stated that Viola Michel and Lorene Campbell are requesting a rezone from Agriculture to Single Family Residential,for a 20 acre parcel of presently vacant land located east of Division Street between Baron Estates and 1-90. The ordinance amending Section 18.09.020 of the Moses Lake Municipal Code was read by title only. The public hearing was opened.There were no comments. Mr.Reese moved that the public hearing be closed,seconded by Mr.Wal lenstien,and passed unanimously. Mr.Wallenstien moved that the second reading of the ordinance be adopted, along with the Findings of Fact,seconded by Mr.Chandler,and passed unanimously. V.ORDINANCES AND RESOLUTIONS ORDINANCE -AMEND WATER AND SEWER RATES - 2ND READING A letter was read from Joseph K.Gavinski,City Manager,which stated that the j Council adopted the first reading of an ordinance which would allow for an ! ! extension of time on the payment of water bills.As was discussed,the or dinance has been changed to require a statement on the bill stating that ex tensions of time to allow for payment so that water service will not be termi nated will be handled by the Grant County Community Action Council and the effective date will be October 1,1984. The ordinance amending Moses Lake Municipal Code Section 13.12.053 entitled "Water Service Termination Procedure"was read by title only. Mr.Edwards moved that the second reading of the ordinance be adopted,secon ded by Mr.Reese,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS None VIII. OTHER ITEMS FOR COUNIL CONSIDERATION COMMUNITY SURVEY APPROVAL p"" A letter was read from Joseph K.Gavinski,City Manager,which presented a revised copy of the community survey form. Mr.Rimple felt that in the last section of the survey,items 1,2,and 3 should be eliminated. Mr.Wallenstien moved that the questionnaire be approved as submitted,secon ded by Mr.Reese,and passed with Mr.Edwards opposed. 3738 CITY COUNCIL MINUTES:3 July 10,1984 PARK AND RECREATION ADVISORY COMMISSION -APPOINTMENTS Mr.Johnson requested Council approval of his appointment of Charles D.Cox, Jr.,Clifford B.Hogue,and David DeLeon to the Park and Recreation Advisory Commission. Mr Chandler moved that the appointments be confirmed,seconded by Mr.Wal lenstien,and passed unanimously. IX.COUNCIL QUESTIONS AND COMMENTS COUNCIL ON AGING Mr.Wallenstien stated that he has been attending the meetings of the Council on Aging and the Committee will be making a recommendation on the distribution on $215,000 for aging programs in Grant County. X.CITY MANAGER REPORTS AND COMMENTS SPEED LIMIT/WEST BROADWAY AND ALDER STREET FILL Joseph K.Gaviski,City Manager,stated that the State Department of Transpor tation has asked the city to consider changing to 30 mph the existing 25 mph speed limit on Broadway from 500'southwest of Third Avenue to Block Street. Mr.Rimple stated that he felt there is too much traffic on both Alder Street Fill and Broadway for a 25 mph speed limit.He pointed out that most 25 mph speed limits are in residential areas.He felt the Council should consider changing the speed limit on Alder Street to 35 mph from Broadway to the High way 17 overpass. There was some discussion by the Council.It was pointed out that the Development Task Force has recommended that traffic on West Broadway be slowed down.It was also pointed out that the Police Department has a hard time en forcing the 25 mph speed limit on the Alder Street Fill. Mr.Rimple moved that the speed limit on Broadway remain at 25 mph and the speed limit on Alder Street be increased to 35 mph from Broadway to Highway 17,seconded by Mr.Reese. The motion failed with Mr.Staat,Mr.Edwards,Mr.Wallenstien,and Mr.John son opposed. AWC Mr.Johnson stated that a letter had been.received from Judith Boekholder of the City of Toppenish which requested the Council's support in her efforts to be re-elected to the AWC Secretary position. The regular meeting was recessed at 8:35 p.m.and the Council met in an execu tive session to discuss litigation.The executive session was-adjourned at 10:15 p.m.and the regular meeting was reconvened.The regular meeting was adjourned at 10:15 p.m. ;Wormfcn Jollngoru Mayor ATTEST: "City Clerk /0 7/ ///7 /c?oo- 3739-A BEFORE THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON In the Matter of Rezone Request of Viola Michel and Lorene Campbell FINDINGS OF FACT,CONCLUSIONS OF LAW,AND DECISION This matter,having come on before the Moses Lake City Council for action on July 10,1984,now makes the following: FINDINGS OF FACT 1.Viola Michel and Lorene Campbell own approximately 20 acres of land lo cated between Baron Estates and 1-90 and fronting on Division Street le gally described as follows: The south 1/2 of the NW1/4 of the SW1/4 of Section 26,Township 19 North,Range 28,EWM,Grant County,Washington. The property is presently zoned Agriculure and Michel and Campbell are requesting that it be rezoned to R-l,Single Family Residential. The Planning Commission considered an Environmental Checklist for this proposed rezone on May 24,1984 and declared it to have a non-significant adverse impact on the environment.The declaration was forwarded to the Department of Ecology in Olympia for review.No comments have been received from the Department of Ecology. 4.A public hearing before the Planning Commission scheduled upon notice on the issue of rezoning the land in question was held on June 14,1984. 5 There were no comments from the public nor were there any written pro tests by any persons filed with the City of Moses Lake. 6.The Planning Commission recommended approval of the zone change request at the June 14,1984 meeting and forwarded their recommendation to the City Council. CONCLUSIONS 1.The City Council of the City of Moses Lake is vested with the authority and has the jurisdiction under the law to entertain a request to rezone land within the city's corporate limits if the criterion required by law is met. 2.There appears,after the public hearing before the City Council on the issue of rezoning the land owned by Viola Michel and Lorene Campbell,no opposition to rezoning the said land of approximately 20 acres from Agriculture to R-l,Single Family Residential. 3.Since the City of Moses Lake is cognizant of the need to serve the wel fare and best interests of the entire community,the City Council of the City of Moses Lake believes that rezoning the land owned by Viola Michel and Lorene Campbell from Agriculture to R-l,Single Family Residential, would serve the best interests of the residents of the City of Moses Lake and bear a substantial relationship to the public welfare of the entire community. DECISION 1.The approximately 20 acres of land owned by Viola Michel and Lorene Camp bell which is legally described in the herein Findings of Fact and which is presently zoned Agriculture is hereby rezoned R-l,Single Family Residential. 2. 3. 3739-B 2.The rezoning of the land in question is to be or have become effective upon passage and publication of the necessary ordinance as is required by law.
