The meeting was called to order at 8 p.m.by Mayor Johnson.
Mr.Reese moved that the minutes of the meeting of February 26 be approved as
submitted,seconded by Mr.Wallenstien,and passed unanimously.

SPRING FESTIVAL
A letter was read from Dale Bjork,Chairman of the Grant County Fire District
No.5 Beer Garden,which requested the use of the tennis courts at McCosh Park
to sponsor the beer garden at the 1985 Moss Lake Spring Festival.
Mr.Edwards stated that he is opposed to the sale of liquor on city property.
Action Taken:Mr.Reese moved that the request be granted,seconded by Mr.
Wallenstien,and passed with Mr.Edwards opposed.

V.ORDINANCES AND RESOLUTIONS
ORDINANCE - CLOVER DRIVE ANNEXATION - 2ND READINGrf
1^A letter was read from Rita Perstac,Municipal Services Director,which pres
ented an ordinance annexing a mile long 30'wide strip right-of-way along the
eastern boundary of Clover Drive,between Clover Drive and Highway 17.This
annexation involves only right-of-way which is not zoned.
The ordinance providing for the annexation of certain territory to the City of
Moses Lake,Washington and incorporating the same within the corporate limits
thereof and providing for the assumption of existing indebtedness was read by
title only.
Action Taken:Mr.Edwards moved that the second reading of the ordinance be
adopted,seconded by Mr.Rimple,and passed unanimously.
^ORDINANCE -GARBAGE ONLY ACCOUNTS -1ST READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an
ordinance which provides that all garbage only utility accounts shall post a
deposit,equaling three months service,prior to service being initiated.
The ordinance amending Moses Lake Municipal Code Chapter 8.08 entitled "Gar
bage Collection"was read by title only.
Bob Bernd,owner of Lakeside Disposal,stated that he was opposed to this or
dinance as it could cost a business $1,000 up front with no guarantee of this
deposit ever being returned,especially if the business is a continuing one.
He stated that business might tend to ask for less garbage service than actu
ally needed to try to reduce this cost.He stated that there is no time limit
on how long the city will keep the deposit.
Mr.Gavinski stated that there could be an alternative possible and requested
the Council delay any action on the ordinance till the next meeting.
Action Taken:Mr.Wallenstien moved that the ordinance be tabled until the
next meeting,seconded by Mr.Reese,and passed unanimously.
RESOLUTION - OPPOSING HAZARDOUS WASTE DUMPING FACILITY
$A letter was read from Joseph K.Gavinski,City Manager,which presented a
resolution in opposition to the development of a hazardous waste dumping
facility in Grant County.
The resolution stating the City Council's opposition to Grant County's pro
posed siting of a hazardous waste disposal facility in Grant County was read
by title only.
Mr.Gavinski stated that he drafted the ordinance based on Steve Frazier's
letter.He stated that he was subsequently informed that Grant County is pro
posing a dangerous waste facility and not a hazardous waste facility.
Steve Frazier,Steering Group Spokesman for the Grant County Public Involve
ment Committee,stated that the problem with the hazardous and dangerous ter
minology is a problem in legislation and the difference between the federal,
state,and county decisions on what is dangerous and hazardous materials.
Mr.Edwards stated that he did not feel this was the business of the City of
Moses Lake and did not feel the city should act on it.
Ken Green,Tru-Step Shoe Repair,stated that this issue could effect the busi
nesses in town.He stated that if this facility affects the quality of the
environment in the county it will affect the city.He pointed out that the
resolution objects to the site of the facility not the facility itself.
James A.Whitaker,City Attorney,stated that there is no uniformity of defi
nition of hazardous and dangerous and if the Council wishes the resolution
could include dangerous and/or hazardous in its terminology.

Action Taken:Mr.Wallenstien moved that the resolution be amended to include
dangerous and/or hazardous and be adopted,seconded by Mr.Chandler,and
passed with Mr.Edwards opposed.

VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
REQUEST FOR ADDITIONAL EMPLOYEE -ENGINEERING
Joseph K.Gavinski,City Manager,stated that the city is requesting another
employee in the Engineering Division to cover the engineering projects which
the city has for 1985 and beyond.Because of the lack of engineering time
some projects may have to wait.The temporary person the city was employing
has found a permanent job elsewhere.
Mr.Wallenstien wanted to know why this was not brought out during the budget
sessions.Rita Perstac,Municipal Services Director,stated that at that time
the Engineering Division had a temporary employee which was funded through the
first six months of 1985.In November the City Engineer figured up how much
time it would take to do the engineering projects designated for 1985 and
realized there was not enough employees to the job.Since that time the tem
porary employee has left and the position will probably not be filled for at
least six weeks which will be into the construction season.
Mr.Gavinski stated that the city may also add Garden Drive to its projects
this year but its is unknown how extensive the project will be due to the
drainage problem.
Ms.Perstac stated that several projects that were planned to be completed in
1984 have not yet been finished and this adds to the workload of the engineer
ing staff.
Action Taken:Mr.Edwards moved that a full-time temporary position be funded
in the Engineering Department for 1985,seconded by Mr.Rimple,and passed
with Mr.Wallenstien and Mr.Reese opposed.
CLEAN-UP
A letter was read from Rita Perstac,Municipal Services Director,which stated /^
that the the city and county have designated several days in April as free
dumping days at the 1-90 landfill to encourage local residents to clean up
their properties.This year the Department of Ecology has designated April 20
-28 as their Spring Rally and the county would like to coordinate efforts
with the DOE and designate Saturday and Sunday,April 20 and 21 as free dump
ing days.
Action Taken:Mr.Edwards moved that April 20 and 21 be designated as free
dumping at the 1-90 landfill,seconded by Mr.Reese,and passed unanimously.
SOLID WASTE PLAN
A letter was read from Rita Perstac,Municipal Services Director,which stated /£?//
that the city has filed a Comprehensive Solid Waste Management Plan with the
Grant County Auditor to be included as part of the Grant County Solid Waste
Management Plan Update which is in progress at this time.The city has ap
plied to the Department of Ecology for grant money to assist in the project.
The DOE has given the city a grant offer of $200,000,which is a 50/50 grant.
After reviewing the county's adopted budget for 1985 it appears feasible for
the city to own and operate its own landfill.
Steve Frazier stated that he is not adverse to the city having its own land
fill but he is opposed to the site.
Joseph K.Gavinski,City Manager,stated that he has requested the Municipal
Services Department to look at some alternatives but felt the initial stage of
an Environmental Impact Statement is a good idea because of the tie-in with
the wastewater treatment facility and some of the types of discharges accepted
there.At a meeting with the Department of Ecology,ITI,Union Carbide,Port

of Moses Lake,and Pool Engineering there was discussion on how to pin down
how much of a particular type of discharge the wastewater facility can accept.
The DOE pointed out that the types of considerations being studied for the
proposed landfill are the same types that would be looked at for the wastewa
ter treatment plant.
Action Taken:Mr.Edwards moved that the City Manager be authorized to sign
the contract,seconded by Mr.Wallenstien,and passed unanimously.
^DRAINAGE PROBLEM -GARDEN DRIVE
A letter was read from Joseph K.GAvinski,City Manager,which requested au
thorization to sign a contract with George Maddox and Associates,Inc.for
professional services.Under the agreement Mr.Maddox will drill 9 observa
tion wells and gather data to determine how the drainage problem on Garden
Drive can be solved so that the city can repair the street,curb and gutter,
and sidewalk and to determine if the city has a valid claim against the
federal government because of the drainage problem.
Action Taken:Mr.Wallenstien moved that the City Manager be authorized to
sign the contract,seconded by Mr.Edwards,and passed unanimously.

IX.COUNCIL QUESTIONS AND COMMENTS
TRAFFIC CONTROL
Mr.Wallenstien stated that people are not obeying the traffic laws on Valley
Road when the lights are blinking.He further stated that Marina Drive is
becoming a motorcycle racetrack.
X.CITY MANAGER REPORTS AND COMMENTS
WASTEWATER TREATMENT PLANT
Joseph K.Gavinski,City Manager,stated that the dedication and open house
for the wastewater treatment plant and the Central Operations Facility has
been tentatively set for Wednesday,May 29 at 2 p.m.The dedication will take
place at the Central Operations Facility.
CITY HALL REMODEL
Joseph K.Gavinski,City Manager,stated that staff recommendations on the
remodel of city hall have been gather and will be presented to the architect.
A meeting between the Architectural Review Committee and the architect was
scheduled for Friday,March 22.
PUD STUDY SESSION
Joseph K.Gavinski,City Manager,stated that the PUD has requested a study
session with the County Commissioners and City Council possibly to discuss the
proposed transmission line.A meeting is scheduled for 8 p.m.on Tuesday
March 19 in the Council Chambers.

Joseph K.Gavinski,City Manager,stated that Commissioner Weitzel has re
quested a study session on 911 on Tuesday,April 2 at 8 p.m.
SANITATION CONTRACT REPORT
Joseph K.Gavinski,City Manager,stated that Lakeside Disposal has been
operating for about six months now.He stated that Lakeside is receiving
about $1,000 per month less than the former contractor and the city is receiv
ing approximately $500 a month less and the amount of garbage being produced
is the same.
The regular meeting was adjourned at 8:55 p.m.
