The meeting was called to order at 8 p.m.by Mayor Johnson.
Mr.Edwards moved that the minutes of the meeting of April 9 be approved as
submitted,seconded by Mr.Reese,and passed unanimously.

PROCLAMATION
A proclamation was read in its entirety declaring the week of April 28 to May
4,1985 as Private Property Week.

III.CONSIDERATION OF BIDS
COMPUTER EQUIPMENT
Walter Fry,Finance Director,stated that the city has received only one bid /o/7
on the hardware,police software,and engineering software.This is due to
the fact that the hardware and software must be compatible with the existing
Hewlett Packard hardware.It is recommended that the bid for hardware be
awarded to Hewlett Packard,the bid for police software be awarded to Idaho
Computer Services,and the bid for engineering software be awarded to Holguin.
Action Taken:Mr.Edwards moved that the bids be accepted,seconded by Mr.
Rimple,and passed unanimously.

IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS
COMMUNICATION -IRRIGATION &REHABILITATION DISTRICT -BOATING ORDINANCE
A letter was read from Clinton Connelly,Chairman of the Moses Lake Irrigation
and Rehabilitation District,which requested time before the Council to dis
cuss boating ordinances within the city limits.
Mr.Connelly stated that there is a problem on Moses Lake since part of the
lake is under the control of the county and part is under the control of the
city.He felt that because of the heavy usage the lake is receiving,there
should be set up rules and regulations that would be acceptable to both the
city and the county.He pointed out that the Sheriff's Department cannot
police the waters inside the city limits and that needs to be worked out since
the city has no rules or regulations for boats.
Jim Gantenbein,Grant County Sheriff's Department,stated that the majority of
the complaints he receives is because of noise and if the boat is in city
waters he cannot issue a ticket. He stated that 80%of the calls he receives
are from city residents and concern boats inside city waters.
Joseph K.Gavinski,City Manager,stated that since the city does not have the
ability to patrol the lake,arrangements would have to be made with the county
to enforce the city's noise ordinance on the lake.If the Council decides to
have other boating provisions enforced,a boating ordinance would have to be
adopted and arrangements made with Grant County to enforce that ordinance
also.
James A.Whitaker,City Attorney,explained the problems of enforcement of an
ordinance.
There was some discussion by the Council.
It was the consensus of the Council that the county boating ordinance be con
sidered for adoption as a city ordinance and the county ordinance be rewritten
appropriately with violations being infractions rather than misdemeanors,
seconded by Mr.Chandler,and passed unanimously
V.ORDINANCES AND RESOLUTIONS
ORDINANCE -MONEY FOR CITY HALL/COMPUTER EQUIPMENT - 1ST READING
A letter was read from Joseph K.Gavinski,City Manager,which stated that the
city is preparing an ordinance which would allow the city to borrow $500,000
at \/ery favorable rates.This money would be used by the city for the
remodeling of City Hall and the purchase of the new computer equipment and
vehicles.
The ordinance authorizing the issuance of short term obligations in anticipa
tion of taxes or other revenue was read by title only.
Action Taken:Mr.Edwards moved that an emergency be declared since Rainier
National Bank's offer to loan the money at the terms considered was good until
May 1 and the next regular Council meeting would be after that date when a
second reading of the ordinance could be considered and the ordinance be
passed on its first reading,seconded by Mr.Chandler,and passed unanimously.
RESOLUTION - DECLARING PROPERTY SURPLUS
A letter was read from Rita Perstac,Municipal Services Director,which pres
ented a resolution declaring city-owned property surplus and unclaimed proper
ty in the possession of the Police Department.
The resolution declaring city-owned property as surplus and authorizing its
sale and authorizing sale at public auction of unclaimed property in the pos
session of the Police Department was read by title only.
Action Taken:Mr.Rimple moved that the resolution be adopted,seconded by
Mr.Reese,and passed unanimously.

VI.REQUESTS TO CALL FOR BIDS
BANKING SERVICES
A letter was read from Walter Fry,Finance Director,which requested au
thorization to call for bids for a new banking contract.
Action Taken:Mr.Rimple moved that staff be authorized to call for bids,
seconded by Mr.Reese,and passed unanimously.
NELSON ROAD RECONSTRUCTION
A letter was read from Rita Perstac,Municipal Services Director,which re-/o/<?
quested authorization to call for bids for the Nelson Road Reconstruction
Project.This project includes two 11*travel lanes and two 8'on-street
parking lanes west of Pioneer Way;two 12'travel lanes and two 9'parking
lanes east of Pioneer Way;5'concrete sidewalks on the north side;and a con
crete combination bike path/sidewalk on the south side.An asphalt bike path
is bid as an alternate east of Balsam and will extend from Balsam to Division.
An existing sidewalk on the south side will be saved where possible and the
parking strip filled in with concrete to create the bike path/sidewalk.From
Pioneer and Highway 17 curb-to-curb pavement will be 44'wide to provide two
more travel lanes without on-street parking in the future when traffic
increases.
Action Taken:Mr.Reese moved that staff be authorized to call for bids,
seconded by Mr.Rimple,and passed unanimously.
VII.REFERRALS FROM COMMISSIONS
MONTLAKE ADDITION #6 PRELIMINARY PLAT
A letter was read from Rita Perstac,Municipal Services Director,which stated /^^
that Columbia Federal Bank has submitted a major plat for a 13.6 acre,46 lot
subdivision located west of Division Street and north of 1-90.Lots range in
size from about 7,100 square feet to 18,000 square feet.The area is zoned
R-l,Single Family Residential,and lots will be served with city water,
sewer,and street improvements.The Planning Commission recommended that this
preliminary plat be approved with the condition the City Engineer's comments
are addressed on the final plat.
Action Taken:Mr.Rimple moved that the preliminary plat be approved with the
stipulation that the comments of the City Engineer be addressed on the final
plat and the Findings of Fact be accepted,seconded by Mr.Edwards,and passed
unanimously.
VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
STRATFORD ROAD/KNOLLS VISTA INTERSECTION
A letter was read from Rita Perstac,Municipal Services Director,which re-///'7
quested Council direction for traffic/pedestrian control at the intersection
of Stratford Road and Knolls Vista Drive.
Leonard Cook,239 W.Northshore,stated that he felt a pedestrian activated
light at Knolls Vista would be acceptable.He pointed out that routing the
pedestrian traffic to the light at Valley and Stratford would be difficult
since there is no sidewalk next to the gas station and the lights allow left
and right turns.It is very difficult for a pedestrian to cross there.He
stated that the left turners have and create problems by trying to turn left
from the mall side of Stratford Road.
Randy Aikens,531 Grant Drive,stated that he owns the Aikens Gas Station,and
that he did not feel a light would solve the problem since it would be syn
chronized with the one at Valley Road and the children would not wait for the
light since they already jaywalk.He felt a light would add to the congestion
during peak traffic hours.He stated that at the neighborhood meeting held on
Monday night several people from the Knolls Vista area stated that they did
not think a light at Knolls Vista and Stratford would be a good solution and
the residents would be willing to use the crosswalk at Valley if one were put
in.He also felt the speed limit should be 25 mph through there.

Fred Danz,General Manager of McDonalds,did not feel a light at the intersec
tion would be the best answer since with 1,700 cars per hour crossing the fill
it would probably back-up or impede the traffic.He suggested that the speed
be reduced to 25 mph,remove the crosswalk at Knolls Vista,and put in addi
tional walk/don't walk lights at Valley.
David Newton,owner of the Gull Service Station,stated that the city engineer
stated that if the light is put in at Knolls Vista there will be some conges
tion.He wanted to know how many cars would be backed up during peak traffic
hours since at the present time during peak traffic hours it is very common
for cars to be backed up by the Valley light clear to Baskin and Robbins.He
felt that a crosswalk should be placed on Stratford Road at Valley and a side
walk constructed on the west side of Stratford.
Richard Penhallurick,615 Riviera,felt that perhaps an undercrossing at
Knolls Vista would be used by pedestrians and it would be constructed so that
it would be safe.He also felt that reducing the speed would also help the
safety problem.
Bill Larkins,Manager of K-Mart,did not feel a light at Knolls Vista would
help the problem.He felt that perhaps slowing the speed would help some.
Chuck Edwards,Jr.,Vista Village,stated that at the meeting held Monday
those in attendance did not feel a light was a good solution to the problem.
They felt that an immediate solution was to reduce the speed to 25 mph and put
a crosswalk on the south side of the Valley and Stratford intersection.He
stated that a long-term solution needs to be found to the pedestrian and traf
fic problem in this area.He did not feel all the factors have been discussed
in attempting to arrive at a solution to this problem.
Joseph K.Gavinski,City Manager,stated that the Council directed that a
traffic study be done at this intersection.The traffic study was done and
the information provided to Council along with several alternatives.He
stated that at the meeting held Monday night it was the general feeling of
those present that a signal light at Knolls Vista and Stratford is not a solu
tion to the problem.
Mr.Edwards moved that the speed limit be lowered to 25 mph,the pedestrian
crossing at Knolls Vista be removed and replaced on the south side of the
intersection of Valley and Stratford,with suitable change in lights and ac
tivation.The motion died for lack of a second.
Mr.Rimple stated that he did not feel a traffic light would be a benefit to
the area.He was not in favor of lowering the speed limit.He would like to
see a pedestrian crossing at Valley Road and a sidewalk be constructed on the
west side of Stratford Road from Knolls Vista to Valley Road.
Mr.Reese stated that he is against the light as it could create problems in
the winter.He felt the crosswalk should be moved to Valley Road and the ex
isting crosswalk eliminated and a sidewalk constructed from Knolls Vista to
Valley Road.
Mr.Chandler felt that a light in this area would have cars backed up to
Broadway and he would not be in favor of it.
Action Taken: Mr.Edwards moved that the crosswalk be moved from Knolls Vista
Drive to the south side of the Stratford and Valley intersection,a sidewalk
be put in on the west side of Stratford from Knolls Vista to Valley,and the
stop lights be snychronized with pedestrian crossing controls,seconded by Mr.
Reese,and passed unanimously.
There was some discussion by the Council on reducing the speed limit on the
Alder Street Fill and Stratford Road.
Action Taken:Mr.Edwards moved that the speed limit be lowered to 25 mph
from Broadway to Highway 17,seconded by Mr.Chandler,and failed with Mr.
Chandler and Mr.Edwards in favor and Mr.Staat,Mr.Rimple,Mr.Reese,and
Mr.Johnson opposed.

SANITARY LANDFILL -SITE ALTERNATIVES
A letter was read from Rita Perstac,Municipal Services Director,which stated /<?//
that staff had studied the complete Moses Lake area in order to locate alter
native sites for the sanitary landfill.One site was located about 12 miles
north of town and staff is requesting direction from Council on which site the
EIS should concentrate on.
David Bailey,Port of Moses Lake,stated that the Port owns and operates the
Grant County Airport and one of the alternative sites for the city's landfill
is about 3 1/2 miles north of the airport.This particular location is of
concern to the Port because it lies within the traffic pattern and a landfill
attracts a great number of seagulls and other birds.He stated that a 747
flying in the area hit a goose which caused $8 million worth of damage to an
engine.There has also been several hits caused by seagulls in this area
which caused some minor damage.He stated that the Port and Big Bend College
are not in favor of a landfill in this area because of the bird problem and
would be glad to work with the city to identify alternative sites.
Joe Gill,Tower Manager,stated that the FAA is opposed to any landfill on or
near an airport because of the introduction of bird hazards into a high densi
ty aviation operation area.The Council should consider the potential
liability of any operator of a landfill that introduces birds into an area
where they normally would not be and the high cost of insurance.
Pete Hammer,flight instructor at Big Bend Community College,stated that the
College is concerned about the safety of its aircraft as the proposed site is
right under primary arrival and departure flights.He stated that the planes
are usually about 800'above ground and the helicopters are about 300'above
ground.He felt that the concentration of birds caused by the landfill would
be a hazard.
Ed Penhallurick stated that he moved to the sand dunes area with the intention
of retiring in the area.He stated that a landfill in the area could contami
nate the water and that if the landfill is placed in this area,he would move.
Richard Pierce stated that the proposed site on Highway 17 is less than 4
miles from the college and the prevailing wind is northwest.This would blow
the debris in the direction of the college,mainly onto the flight line.He
stated that the aircraft are only about 800'above the ground and sometimes
less.Also,the landfill is on a direct line from the runway used by the col
lege to and from Ephrata.He stated that the Ephrata airport is used a great
deal as a reliever airport and there would be a definite problem with the
birds.He stated that one of their planes had been struck by a bird which
caused $800 in damage.This damage is paid for by the students.He stated
that a light aircraft such as the college uses generally comes out second best
in a collision with a bird,even one as light as a seagull.Such a colli son
could result in injury or death to a student pilot.
Dennis Connelly,American Potato and Sunspiced,stated that the city is not
going to be able to control the sand dunes.He stated that as well as bird
control the city will have to control rodents and insects because of the close
proximity of the food processing plants and crops.He also pointed out that
the roads have load restrictions placed on them in the spring which could cre
ate a problem if garbage trucks cannot use them for a month or more.He
stated that Basic American Foods owns about 1/4 of a mile of the road that
access the proposed site in the sand dunes.He stated that if the city even
tually decides to choose the sand dunes site for a landfill,American Potato
would take steps to try to have the site disqualified.
Mr.Edwards wanted to know if the city could purchase the 1-90 site from the
county.Joseph K.Gavinski,City Manager,stated that if the city bought the
site,the county would attach conditions so that it would operate in the same
manner and the city would like to operate a little differently in order to
save money.He pointed out that the county does not own the land,they just
have a license to operate the fill.
Mr.Rimple wanted to know how long the county has the license for.M.G.
McLanahan,Assistant Public Works Director,stated that the license runs to
1997.

Mr.Edwards pointed out that no matter what area is picked,it will be objec
tionable to some.He also felt the city should look elsewhere for a site.
Action Taken:Mr.Edwards moved that city staff continue looking for other
alternatives for a landfill site,seconded by Mr.Reese,and passed
unanimously.

X.CITY MANAGER REPORTS AND COMMENTS
HAZARDOUS WASTE
Joseph K.Gavinski,City Manager,distributed a letter from Rabanco concerning
their proposed site of a hazardous waste site near the Columbia River.He
also distributed a letter from the City of Spokane asking for a meeting with
the communities which would be impacted by the travel routes of the hazardous
wastes.The City's of Spokane,Ritzville,Ellensburg,and Moses Lake will
meet in the City Manager's office on May 1.

Joseph K.Gavinski,City Manager,presented the investment report for March
1985.

which discussed their efforts during clean up week.
SALES TAX REPORT
Joseph K.Gavinski,City Manager,stated that for January and February 1985
the city received a little over $176,547.
The regular meeting was recessed at 10:45 and the Council met in an executive
session.The executive session was adjourned at 11 p.m.and the regular meet
ing was reconvened.The regular meeting was adjourned at 11 p.m.

This matter,having come on before the Moses Lake City Council for Action on
April 23,1985,now makes the following:
FINDINGS OF FACT
1.Columbia Federal Bank has submitted the Montiake Addition #6 Preliminary
Plat for approval.
2.The property is situated in Grant County and is legally described on At
tachment A.
3.The plat is for a 13.6 acre,46-1ot subdivision.Lots will range in size
from 1,700 square feet to 18,000 square feet.The subdivision is located
off of Division Street adjacent to 1-90.The area is zoned R-l,Single
Family Residential,and will be served with city water and sewer.
4.The proposed plat is a resubmittal of the 1978 Montiake Addition #6 Pre
liminary Plat.The 1978 preliminary plat expired June 1980.
5.At their meeting on March 14,1985 the Planning Commission declared this
project to have a non-significant adverse impact on the environment.
6.A public hearing scheduled upon notice before the Planning Commission on
the issue of platting the land in question was held on March 28,1985.
7.Written comments were received from the City Engineer,PUD,and Depart
ment of Transportation.There were no comments from the audience at the
public hearing.No written protests by any person were filed with the
city prior to or during the public hearing.
8.The PUD is requesting easements of ten feet on street fronts and five
feet down the sides of each lot.The telephone company is requesting an
easement on Lots 30 and 31.It was the consensus of the Planning Commis
sion to let the developer work out the easement requests with the PUD and
telephone company.
9.The Planning Commission recommended to the City Council that the Montiake
Addition #6 Preliminary Plat be approved with the following comments from
the City Engineer to be addressed on the final plat:
a.Street and utility construction was started and not completed under
previous platting.Streets and utilities must be completed to Com
munity Standards.Some existing improvements will have to be re
placed,i.e.those damaged during the last several years.Existing
underground utilities will have to be cleaned and retested.Service
stubs will have to be located and/or stubbed before completion of
the streets.Sewer may have to be TV'd to verify condition.
b.Proposed and existing PUD,gas,telephone,and cablevision should be
shown on the plat.
c.Previous construction plans show sidewalk on Belmont adjacent to
property line.The preferred location is adjacent to the curb.
d.Construction plans should address street signing and street name
signs.
e.Street lighting is required as part of the plat development.
10.On April 9 the City Council set April 23 as the date to consider this
preliminary plat.
11.On April 23 the City Council considered the Montiake Addition #6 Prelimi
nary Plat
CONCLUSIONS
1.The City Council of the City of Moses Lake is vested with the authority
and has the jurisdiction under the law to approve a final plat within the
city's corporate limits if the criterion required by law is met.
2.There appears after the public meeting before the City Council on April
23,1985,no opposition to its approval.
3.The City Council is cognizant of the need to serve the welfare and best
interests of the entire community,and believes that this plat will serve
the best interests of the residents of the City of Moses Lake and bears a
substantial relationship to the public welfare of the entire community.
DECISION
1.The Montiake Addition #6 Preliminary Plat is approved as recommended by
the Moses Lake Planning Commission
