The meeting was called to order at 8 p.m.by Mayor Johnson.
Mr.Rimple moved that the minutes of the meeting of May 28 be approved as sub
mitted,seconded by Mr.Wallenstien,and passed unanimously.

JUNIPER DRIVE
A letter was read from Rita Perstac,Municipal Services Director,which recom-/O//
mended that the city award the bid on the Juniper Drive storm drain and
reconstruction project to Central Washington Asphalt.
A letter was read from Philip Bloom,City Engineer,which stated that only two
bids were received for the storm drain and reconstruction of Juniper Drive.
Action Taken:Mr.Rimple moved that the bid be awarded to Central Washington
Asphalt,seconded by Mr.Edwards,and passed unanimously.
IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS
COMMUNICATIONS -LANDFILL SITE
A letter was read from Peter DeVries,President of Big Bend Community College,Jo<p-/.
which objected to the city placing a landfill northwest of the Grant County
Airport,adjacent to Highway 17.
A letter was read from Peter C.Hammer,Chief Pilot of Big Bend Community Col
lege,which objected to the city placing a landfill northwest of the Grant
County Airport,adjacent to Highway 17,because of the potential danger from
birds.This proposed site is directly in the flight path from GRant County
Airport to Ephrata.

A letter was read from David Bailey,Executive Manager of the Port of Moses
Lake,which stated that the Port was concerned about placing the landfill in
this area because of the danger of birds to the aircraft.
A letter was read from Vernon Kondra,Colonel,USAF,which stated that they
are concerned about the negative impact a landfill would have if it is placed
north of the Grant County Airport.The Grant County Airport is heavily used
by the Air Force C-120's and C-141's and the incidents of birdstrikes would
dramatically increase if a landfill is placed in this area.
A letter was read from Katsuyuki Yasuda,Director of Japan Air lines,which
stated that they were opposed to the placement of a landfill north of the
Grant County airport adjacent to Highway 17 because of the danger of birds to
aircraft.Since 1982 Japan Air Lines has had a total of 90 birdstrikes on its
aircraft.
Mr.DeVries stated stated that Big Bend has the largest flight training pro
gram of its kind in the Pacific Northwest and one of the best in the nation.
He stated that there are tens of thousands nesting in the Potholes and
0'Sullivan Dam areas and the seagulls frequent landfills.The concern is that
the flight pattern of the seagulls would interfere with the flight pattern of
the college's aircraft.The college's flight pattern is directly over the
proposed landfill site.He stated that in the 7 1/2 years he has been presi
dent they have not had any accidents caused by birds.He felt that placing a
landfill in this area would increase the possibility of an accident.
David Bailey,Airport Manager of Grant County Airport,explained the flight
patterns of the various users of the airport.The proposed landfill is di
rectly under a portion of the flight path.He stated that he had been in
formed that the seagull population in the Potholes Reservoir has increased
over the years and a landfill in this area would increase the possibility of
collisions between birds and aircraft.He suggested the city and the county
attempt to work out their problems about the use of the 1-90 landfill.He
stated that if a new landfill site is necessary,they would prefer it below I-
90 and west of the existing facility or east of American Potato or Highway 17.
A possible site is close to the existing facility and at a higher elevation or
perhaps the city could look into incineration.
Mr.Rimple wanted to know if the 1984 infestation of seagulls was do to the
grasshopper problem and he wanted to know if the bird population has decreased
since then.
Jim Taber,Department of Game,stated that it has not;that the gull popula
tion is increasing in the Moses Lake and Potholes Reservoir areas.He stated
that there has been a minor increase in the migrant waterfowl population in
the past year.He pointed out that the bird populations are dynamic and vary
from year to year depending on a variety of reasons such as weather,hunting,
etc.He stated that the two species of gulls in the Moses Lake are,the Cal
ifornia Gull and the Ring-billed Gull,normally fly about 100'or less but
under certain conditions they will utilize the thermals as a forging strategy
and during migration could fly up to 2,000'to 3,000*.He stated that the
gulls arrive in this area about March or April and fly south when the area
starts to freeze up.He pointed out that the gulls are opportunistic feeders
and are notorious for frequenting landfill sites,picnic grounds,etc.
Colonel Vernon Kondra,USAF,stated that 62d military airlift wing,has en
joyed a good relationship with Moses Lake and they are concerned about the
safety of their aircraft if the landfill is placed on the proposed site.He
stated that they have about 300 landings per month and spent over $700,000 in
the area last year.He stated that they have a problem with the migratory
birds during the spring and fall and additional birds in the flight path are
not needed.He stated that all bird strikes have occurred below 3,000'and
the traffic pattern altitude at the Grant County Airport is 1500'.He stated
that in 1984 the Air Force had over 2,300 bird strikes and since 1964 the Air
Force has lost 25 aircraft,10 pilots,and over $100 million worth of equip
ment.He stated that they are very concerned about the safety of their pilots
and aircraft and birds are a major problem.

Joe Gill,Manager of Grant County Tower,stated that the FAA is in opposition
to a landfill that could potentially endanger the safety of aviation.He
stated that the gulls like water,the asphalt because it is warm in the eve
ning,and food.The only thing airports can control is the food source.He
stated that they attempt to eliminate the food source in the vicinity of an
airport to keep the bird population low.
Rich Childress,Chamber of Commerce,stated that the Chamber of Commerce will
not support a landfill site close to the landfill but would encourage the City
of Moses Lake to reconcile any differences between the city and Grant County
relating to the 1-90 landfill site.
Captain Casson,JAL,stated that they appreciate having their jet flight crew
training center at Grant County for the past 16 years and the support received
from the city.He stated that JAL makes approximately 800 landings a month at
the airport and spend over $11 million a year.He stated that he had experi
enced a birdstrike in 1965 in England which caused the loss of two engines.
He stated that it costs over $7 million to replace a 747 engine and over
$100,000 just to have it taken off and inspected and maintained.He stated
that there is another training area and efforts have been made to have JAL
move there;if there is an increase in costs and safety problems because of
the birds,efforts will probably be increased to have the JAL move.He stated
that yesterday Capt.Yasuda had a gull strike at 3,000'which put a large dent
in the strut of the engine.He stated that when the gulls migrate from the
plowed fields to the lake they pass over Grant County Airport in limited num
bers and at low altitudes.He stated that a landfill in this area would
greatly increase the bird population in the area of the Grant County Airport.
He requested the Council reconsider the location of a landfill in this area.
Al Hollenbeck,Grant County Aviation,stated that they are in opposition to
the landfill in this area.He stated that as a charter pilot he had visited a
variety of airports and invariably if there is a landfill in the vicinity of
the airport there is a bird problem.
Charles Issackson,Rt.4,Box 64,Moses Lake,stated that no matter where you
locate the landfill there is going to be a bird problem.
Ty Brickner,ASB President at Big Bend,stated that JAL and the military fly
at 1500'but the Big Bend students fly at 800'.He stated that the student
pilots would like the Council to reconsider their decision to place the land
fill near the Grant County Airport.
Mr.Edwards stated that the city and county have no problems with the 1-90
landfill.He stated that the county leases the landfill site and the lease
will probably not be renewed.He stated that the city wants a site that will
be good for 20 to 30 years.
Mr.Rimple stated that the DOE felt there is some problems with the 1-90 land
fill site and the lease may not be renewed.He felt that the city did have a
problem with the county as the county has not informed the cities in Grant
County of the costs related to the operation of the 1-90 landfill.The city
is looking into the possibility of their own landfill because there may be a
problem with the county's landfill.He stated that the city has studied the
sites in relation to land acquisition,transportation costs,etc.
Mr.Chandler stated that he also felt there is a problem with the county.He
stated that the report by R.W.Beck and Associates states that the city is
getting the short end of the stick.He stated that there is going to have to
be some major rehabilitation at the 1-90 landfill and the City of Moses Lake
is not going to be responsible for those costs.He pointed out that the city
has had no input into the costs assessed by the county at the landfill and the
City of Moses Lake is paying in excess of $40,000 per year so that garbage can
be transported from other areas of the county.The county has not provided
the city with any information requested on the costs incurred at the landfill.
Mr.Reese stated that he would like to see the city try to work with the coun
ty and perhaps look into incineration.

Mr.DeVries stated that the Council has been talking about the economy of
operating a landfill but he is not talking about economy,he is talking about
life.He stated that because of the safety factor he would take every legal
action possible to stop any landfill that would jeopardize the lives of the
students.
Mr.Johnson stated that the Council will take into consideration the comments
made concerning this proposed landfill site.
V.ORDINANCES AND RESOLUTIONS
ORDINANCE -ANNEXATION -KITTLESON ROAD AND HIGHWAY 17 - 1ST READING
A letter was read from Rita Perstac,Municipal Services Director,which pres
ented an ordinance providing for the annexation of two small parcels of right-
of-way located in Kittleson Road and Highway 17.
The ordinance providing for the annexation of certain territory to the City of
Moses Lake,Washington and incorporating the same within the corporate limits
thereof and providing for the assumption of existing indebtedness was read by
title only.
Action Taken:Mr.Edwards moved that the first reading of the ordinance be
adopted,seconded by Mr.Staat,and passed unanimously.
RESOLUTION -ACCEPT EASEMENT -SIMMONS
A letter was read from Rita Perstac,Municipal Services Director,which pres
ented a resolution accepting an easement for right-of-way so that the city may
someday extend the bicycle path on Division Street.
The resolution accepting an easement to the City of Moses Lake for right-of-
way was read by title only.
Action Taken:Mr.Edwards moved that the resolution be adopted,seconded by
Mr.Rimple,and passed unanimously.

VII.REFERRALS FROM COMMISSIONS
BROADWAY ESTATES MOBILE HOME PARK - BINDING SITE PLAN AND VARIANCE
Rita Perstac,Municipal Services Director,stated that Patrick Carroll of
Kirkland,Washington,owner of the existing Broadway Estates Mobile Home Park,
is proposing to expand the park on an adjacent 10 acre parcel located at the
intersection of Burress and Marina Drive.Mr.Carroll has submitted a binding
site plan and a variance request of the requirement to construct full width
street and utility improvements on Burress and Marina.The park expansion
will house 53 units,be served with city water and sewer,and be accessed from
Burress Street and through the existing Broadway Park entrance,next to Bill's
Market.The Planning Commission recommended to City Council the Broadway Es
tates Binding Site Plan and variance request be approved with the following
conditions:
1.Mr.Carroll be allowed to develop the property over a three year period
into an adult mobile home park.
2.Mr.Carroll donate to the city 10'of property the full length of his plat
on Marina Drive and Burress Street.
3.Mr.Carroll construct an 8"sewer main down Marina Drive in city right-of-
way and a reimbursement schedule be set up.The city will stub out sewer
lines to the Carroll property and property across Marina Drive when the
sewer is constructed.
4.Mr.Carroll agree to participate in an LID,if an LID becomes necessary,
for water improvements on Marina Drive.It may be feasible to install the
water main when the sewer main is installed to save cost and effort.

5.If the city's plans for reconstruction of Marina Drive do not materialize,
the city will reimburse Mr.Carroll for the fair market value of the do
nated property and he will participate in an LID for full width street
improvements on Marina Drive including curbs,gutters,sidewalks,paving,
etc.
6.Marina Drive be improved with a tentative design as follows:41'wide
street within a 50'right-of-way;two 11'vehicle travel lanes,one lane
each direction;one 8'on-street parking lane,on the Broadway side of
Marina;one 8'bike path/sidewalk on the Broadway side of Marina;3'for
curbs and gutters on both sides of the street.
7.Mr.Carroll agree to a covenant for an LID for street improvements on his
side of Burress Street.
8.The City Engineer's comments be addressed on the final binding site plan.
9.All other applicable city codes and regulations will be met.
Action Taken:Mr.Reese moved that the binding site plan and variance be ap-
proved with the stipulations as recommended by the Planning Commission and the
Findings of Fact be approved,seconded by Mr.Staat,and passed unanimously.
VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
FIREWORKS DISPLAY -AGREEMENT WITH LIONS CLUB
A letter was read from Joseph K.Gavinski,City Manager,which stated that the
Council had agreed to pay to the Moses Lake Lions Club up to $1,500 toward a
$4,200 4th of July fireworks display.The City Manager is requesting au
thorization to execute the agreement.
Action Taken:Mr.Chandler moved that the City Manager be authorized to sign
the agreement,seconded by Mr.Reese,and passed unanimously.
PARK AND RECREATION ADVISORY COMMISSION
Mr.Johnson stated that he had been informed by the Park and Recreation Direc
tor that there is a vacancy on the Park and Recreation Advisory Commission.
It was the consensus of the Council to appoint Jim Golly to the vacancy.

X.CITY MANAGER REPORTS AND COMMENTS
BOATING ORDINANCE
Joseph K.Gavinski,City Manager,stated that he received a letter from the
Moses Lake Yacht Club requesting the city to consider drafting a simplified
boating ordinance that would more fully meet the needs of the city.
A study session was set for June 25 at 7 p.m.in the Council Chambers.
FIRE DEPARTMENT
Joseph K.Gavinski,City Manager,stated that Russell Beeman,Moses Lake Fire 10%
Chief,has submitted his resignation as it is his intention to retire about
July 25,1985.
The regular meeting was adjourned at 9:35 p.m.

FINDINGS OF FACT,CONCLUSIONS,
AND DECISION

This matter,having come on before the Moses Lake City Council for action on
June 11,1985,now makes the following:
FINDINGS OF FACT
1.Patrick Carroll of Kirkland,Washington,submitted a binding site plan
for a proposed expansion of the Broadway Estates Mobile Home Park.
2.The property is situated in Grant County and is legally described as
fol1ows:
A portion of Lot 74,Plat of Battery Orchard Tracts as recorded in
Acreage Plats,Page 31,located in the office of the Auditor,Grant
County,Washington,and more particularly described as follows:
Commencing at the intersection of the west line of said Lot 74 with
the northerly right-of-way line of Broadway Avenue;thence along the
said west line of said Lot 74,north 45052'51"west 350.00 feet to
the point of beginning;thence continuing along said westerly line
north 45°52'51"west 262.81 feet to an intersection with the
southerly right-of-way line of Marina Drive;thence along said
right-of-way north 30°13'28"east 1343.27 feet to the most northerly
corner of said Lot 74;thence along the easterly line of said Lot 74
south 00°20'50"west 1354.91 feet to an intersection with the north
erly right-of-way line of Broadway Avenue;thence parallel with the
west line of said Lot 74 north 45°52'51"west 350.0 feet;thence
parallel with the centerline of Broadway Avenue south 44°27'34"west
325.59 feet to the point of beginning;containing 10.08 acres more
or less;subject to and including all easements and/or right-of-ways
recorded or apparent.
3.Mr.Carroll also requested a variance of the requirement to construct
full width street and utility improvements on Burress and Marina.
4.This proposed park is approximately 10 acres with approximately 53
mobile/manufactured home sites.The area is zoned C-2,Limited Commer
cial,and R-3,Multi-family Residential.The park will be served with
city sanitary sewer and water and access will be from Burress Street and
through the entrance to the existing Broadway Estates Mobile Home Park on
W.Broadway.
5.Patrick Carroll is requesting a variance of the requirement to construct
full width street and utility improvements on Burress and Marina the
length of the binding site plan.The cost of putting in interior streets
and utilities in the development as well as the improvements on Burress
and Marina would make the project unfeasible.He is requesting a
variance for the development of this binding site plan over a three year
period;not be required to improve Burress and Marina with full width
streets,curbs,gutters and sidewalks on both sides of the street;and
the on-site utilities be completed in stages consistent with good plan
ning and safety concerns such as fire protection,traffic,etc.In re
turn for the variance Mr.Carroll would agree to donate ten feet,at no
cost to the city,along his property along on Marina Drive for the pur
pose of the city's anticipated further widening of Marina Drive with the
anticipated improvements such as curbs,sidewalks/bicycle or pedestrian
path,and any parking be located on the Broadway side of Marina Drive;to
join in a future LID for the sole purpose of extending the sewer and
water from the intersection of Burress and Marina northeast for a dis
tance of approximately 1,350'to complete the unsewered portion of Mari
na;and to join in a future LID for the sole purpose of providing
streets,curbs,and gutters along Burress between W.Broadway and Marina.
The donation of land and the agreement to join the LID would be with the

understanding that the other property owners along Burress would also be
involved in the Burress Street improvements.If the city is unable to
form the LID on Burress,Mr.Carroll would provide curbs,gutters,and
sidewalks along his property line.
6.Rita Perstac,Municipal Services Director,suggested the Planning Commis
sion consider the following when reviewing the binding site plan:
a.Mr.Carroll donate 10'for right-of-way on Marina Drive and Burress
Street.
b.Mr.Carroll agree to a covenant for an LID for street,water,and
sewer improvements on Marina Drive the length of his plat.
A covenant agreement for Marina Drive street and utility improve
ments attached to Mr.Carroll's binding site plan is a back-up fund
ing source if,for some reason city funded street reconstruction
plans fail to occur for Marina Drive.
c.Marina Drive be improved with a tentative design as follows:41'
wide street within a 50'right-of-way;two 11'vehicle travel lanes,
one lane each direction;one 8'on-street parking lane,on the
Broadway side of Marina;one 8'bike path/sidewalk on the Broadway
side of Marina;3'for curbs and gutters on both sides of the
street.
d.Mr.Carroll agree to a covenant for an LID for street improvements
on his side of Burress Street.
6.Mrs.Kvamme stated that the only complaints she has received about the
existing park is the traffic problem at the entrance.With the entrance
constructed on an angle to Broadway it makes it difficult getting in and
out from Broadway.
7.Mr.Carroll stated that he had talked to the adjoining property owner,
Mr.Clausen,about purchasing additional land to try to square up the
entrance with W.Broadway but that Mr.Clausen is not willing to sell any
additional land for improving this entrance.He stated that he does have
an extra 4'that can be paved which will help some.The construction of
the proposed expansion will help alleviate this traffic problem at the
entrance on W.Broadway as the residents can enter the park from the Bur
ress Street entrance.
8.Mr.Angell explained a binding site plan to the Commission.He stated
that he has received a request from Pacific Northwest Bell and the PUD
for provision of utility easements through the plat and the Fire Marshal
has requested fire hydrants through the plat.He stated that these re
quirements would be taken care of on the final Binding Site Plan.
9.Mr.Carroll stated that he is in agreement with the conditions suggested
by the Municipal Services Director except for the one requiring him to
participate in an LID for street and utility improvements on Marina Drive
if the city's reconstruction plans fail to occur.He stated that he is
planning to donate 10'of land on Marina and Burress to the city and that
he is only required to install a 6"sewer line for his development but
will be installing an 8"sewer instead.He pointed out that if the city
puts in a sewer line in Marina Drive it would simply be a duplication of
service and the property owners along Marina do not want to pay for this
sort of thing.He stated that he would be putting the water lines in the
interior streets and would like to develop the lots near W.Broadway and
Burress first.
10.Ms.Perstac pointed out that if Mr.Carroll would install his sewer line
in city right-of-way on Marina he could request a reimbursement schedule
be developed so that he would be reimbursed when others hook up to the
line.She pointed out that the city has not yet finalized engineering
plans for Marina reconstruction so the exact placement of the sewer line
is not known.
11.Mr.Carroll stated that he could see it would be to his benefit to con
struct the 8"sewer line in Marina Drive right-of-way.

12.Mr.Carroll stated that he wished to develop the lots nearest W.Broadway
and along Burress first so that would give the engineers time to get
together on the placement of the sewer line on Marina.He stated that
since he is donating the 10'of land on Marina and Burress and willing to
construct the 8"sewer line on Marina at no cost to the city he would
like to get away from having to improve Marina Drive or participate in an
LID for the improvements to Marina Drive.
13.Ms.Perstac pointed out that the city is planning on reconstructing Mari
na Drive in 1986 and she knows of no reason why this will not be done.
The requirement for Mr.Carroll to covenant for an LID for street im
provements is for back-up funding in case the city does not reconstruct
Marina.
14.Mr.Carroll stated that he did not feel he should have to participate in
an overlay of Marina Drive since his development will receive no benefit
from it as the traffic will be onto Burress and W.Broadway.
15.Ms.Perstac wanted to know if Marina Drive is not reconstructed by the
city if Mr.Carroll would be willing to accept monetary reimbursement for
the donated land and then participate in an LID for that reconstruction.
16.Mr.Carroll stated that he would be agreeable to this.He stated that he
is agreeing to an LID on Burress Street and the water line on Marina
Drive but that he is putting in the sewer and does not want to have to
participate in the Marina Drive street improvements.
17.A public hearing scheduled upon notice before the Planning Commission on
the issue of the Broadway Estates II Binding Site Plan was held on May
16,1985.
18.The Planning Commission recommended to the City Council that the Broadway
Estates II Binding Site Plan be approved with the following stipulations:
a.Mr.Carroll be allowed to develop the property over a three year
period into an adult mobile home park.
b.Mr.Carroll donate to the city 10'of property the full length of
his plat on Marina Drive and Burress Street.
c.Mr.Carroll construct an 8"sewer main down Marina Drive in city
right-of-way and a reimbursement schedule be set up.The city will
stub out sewer lines to the Carroll property and property across
Marina Drive when the sewer is constructed.
d.Mr.Carroll agree to participate in an LID,if an LID becomes neces
sary,for water improvements on Marina Drive.It may be feasible to
install the water main when the sewer main is installed to save cost

CONCLUSIONS
1.The City Council of the City of Moses Lake is vested with the authority
and has the jurisdiction under the law to approve a Binding Site Plan
within the city's corporate limits if the criterion required by law is
met.
2.There appears after the public meeting before the City Council on June
11,1985,no opposition to its approval.
3.The City council is cognizant of the need to serve the welfare and best
interests of the entire community,and believes that this Binding Site
Plan will serve the best interests of the residents of the City of Moses
Lake and bears a substantial relationship to the public welfare of the
entire community.
DECISION
1.The Broadway Estates II Binding Site Plan and variance is approved with
the following stipulations:
a.Mr.Carroll be allowed to develop the property over a three year
period into an adult mobile home park.
b.Mr.Carroll donate to the city 10'of property the full length of
his plat on Marina Drive and Burress Street.
c.Mr.Carroll construct an 8"sewer main down Marina Drive in city
right-of-way and a reimbursement schedule be set up.The city will
stub out sewer lines to the Carroll property and property across
Marina Drive when the sewer is constructed.
d.Mr.Carroll agree to participate in an LID,if an LID becomes neces
sary,for water improvements on Marina Drive.It may be feasible to
install the water main when the sewer main is installed to save cost
and effort.
e.If the city's plans for reconstruction of Marina Drive do not
materialize,the city will reimburse Mr.Carroll for the fair market
value of the donated property and he will participate in an LID for
full width street improvements on Marina Drive including curbs,gut
ters,sidewalks,paving,etc.
f.Marina Drive be improved with a tentative design as follows:41'
wide street within a 50'right-of-way;two 11'vehicle travel lanes,
one lane each direction;one 8'on-street parking lane,on the
Broadway side of Marina;one 8'bike path/sidewalk on the Broadway
side of Marina;3'for curbs and gutters on both sides of the
street.
g.Mr.Carroll agree to a covenant for an LID for street improvements
on his side of Burress Street.
h.The comments from the City Engineer's May 10,1985 memo to the
Municipal Services Director be addressed on the final binding site
plan.
i.All other applicable city codes and regulations will be met.
