1985 12 103900 CITY COUNCIL CITY OF MOSES LAKE December 10, 1985 Members Present:Norm Johnson,Bill Reese,David Chandler,Wayne Rimple,Norm Staat,Bob Wallenstien,and Charles Edwards The meeting was called to order at 8 p.m.by Mayor Johnson. Mr.Edwards moved that the minutes of the meeting of November 26 be approved as submitted,seconded by Mr.Chandler,and passed unanimously. PLAQUE /OS* Mr.Johnson stated that the Board of Directors of the Washington Finance Of ficers Association certifies that Walter Fry has successfully completed educa tional and training requirements and is recognized as a Professional Finance Officer of the State of Washington.The plaque was presented to Walter Fry. CERTIFICATE A letter was read from the Acting Police Chief which stated that Sgt.Dean /"y^ Mitchell attended the Rural and Small Community Homicide Investigation course held at Central Washington University in Ellensburg during the last week of October.A certificate of completion was presented to Sgt.Mitchell. I.CITIZEN INPUT None II.CONSENT AGENDA None III.CONSIDERATION OF BIDS 1986 FUEL SUPPLY /j/y A letter was read from Rita Perstac,Municipal Services Director,which pres ented the bids for the 1986 fuel supply. Action Taken:Mr.Wallenstien moved that the bid for gas be awarded to Whitney Distributing and the bid for diesel fuel be awarded to Falesafe, seconded by Mr.Chandler,and passed unanimously. oi1 \oo^ 0^ J 3901 CITY COUNCIL MINUTES:2 December 10,1985 POLICE VEHICLES A letter was read from Rita Perstac,Municipal Services Director,which stated that only one bid was received from C &V Dodge for a police package Plymouth Reliant. Mr.Wallenstien wanted to know the difference in price from 1984.It was pointed out that the bid for 1985 is approximately $1,500 per car more. Action Taken:Mr.Edwards moved that the bid from C &V Dodge be accepted, seconded by Mr.Chandler,and passed with Mr.Wallenstien opposed. IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS SAMMONS COMMUNICATIONS A letter was read from Dawn Hill,General Manager of Sammons Communications, which gave notice to the Council of Sammons'intent to raise their rates 5% per year as allowed by law. No action was taken by Council. V.ORDINANCES AND RESOLUTIONS ^ORDINANCE -AMEND GARBAGE RATES -1ST READING Joseph K.Gavinski,City Manager,stated that the county's Solid Waste Adviso ry Committee recommended that the 1-90 landfill be kept open after January 1, 1986 if a couple of conditions are met.One of those conditions is that a study be made of the ground water problem in the area of the 1-90 Landfill with the city requested to pay approximately 60%of the cost of the study.He recommended that staff gather the information on the cost of the study and establish a rate that will take into account the city's cost for this study and pass the ordinance at the next meeting.He pointed out that there is no guarantee that the landfill would remain open during the course of the study and it may cost as much as the extra cost for transporting the solid waste to the Ephrata Landfill. Action Taken:Mr.Rimple moved that the garbage rate ordinance be tabled, seconded by Mr.Edwards,and passed unanimously. Mr.Gavinski stated that the city has been informed by the Department of Ecol ogy and the city will be funded for a feasibility study for the incineration site. ORDINANCE -INDUSTRIAL WATER/SEWER SURCHARGE - 1ST READING A letter was read from Joseph K.Gavinski,City Manager,which presented an ordinance establishing a surcharge for those industries and other properties along Wheeler Road which utilize Reservoir #6 for part of their needs. The ordinance amending Chapter 13.12 of the Moses Lake Municipal Code entitled "Water and Sewer Rates"was read by title only. Action Taken:Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by Mr.Chandler,and passed unanimously. ORDINANCE - SEWER RATES -UNION CARBIDE/ITI - 1ST READING A letter was read from Rita Perstac,Municipal Services Director,which pres ented an ordinance establishing sewer rates for Union Carbide and Internation al Titanium,Inc. The ordinance repealing Ordinance #1095 and setting the sewer rates for sewer service utilized by Union Carbide Corporation and re-establishing the sewer rates for sewer service utilized by International Titanium,Inc.was read by title only. Action Taken:Mr.Edwards moved that the first reading of the ordinance be adopted,seconded by Mr.Chandler,and passed unanimously n n 3902 CITY COUNCIL MINUTES:3 December 10,1985 ORDINANCE - PUBLIC SAFETY DEPARTMENT - 1ST READING jo!*A letter was read from Joseph K.Gavinski,City Manager,which presented an ordinance repealing Chapters 2.32 and 2.16 of the Moses Lake Municipal Code regarding Police and Fire Departments and enacting Chapter 2.34 entitled Public Safety -Police Department and Fire Department. The ordinance repealing Chapter 2.32 of the Moses Lake Municipal Code entitled "Police Department"and repealing Chapter 2.16 of the Moses Lake Municipal Code entitled "Fire Department"and enacting a new Chapter 2.34 of the Moses Lake Municipal Code entitled "Public Safety -Police Department and Fire De partment"was read by title only. Bill Frederickson stated that he did not have a problem with the ordinance but did not feel it should be passed until the city was closer to hiring a Public Safety Director which could take several months. Action Taken:Mr.Chandler moved that the first reading of the ordinance be adopted,seconded by Mr.Edwards,and passed unanimously. RESOLUTION -SET PUBLIC HEARING DATE/PRELIMINARY ASSESSMENT ROLL -LID #53 /^y A letter was read from Rita Perstac,Municipal Services Director,which pres ented a resolution establishing January 14,1986 as the date for the public hearing on the preliminary assessment roll for LID #53.This LID is intended to improve Melva Lane,Kittelson Road east of Highway 17,one block of Eastlake Drive,and James Avenue. The resolution of the City Council of the City of Moses Lake declaring its intention to improve Melva Lane in Melva Addition 7,Kittelson Road from High way 17 east to the city limits,Eastlake Drive between Nelson Road and James Avenue in Broadripple Addition No.3 by grading,graveling,constructing and installing curbs,sidewalks,sewer side laterals,water services,asphalt con crete pavement and storm drainage and to create a local improvement district to assess the cost and expense of said improvements against property in such district specially benefited thereby,and to notify all persons who may object to said improvement to appear and present their objections at a regular meet ing of the City Council to be held on January 14,1986 at 8 p.m.was read by title only. Action Taken:Mr.Chandler moved that the resolution be adopted,seconded by Mr.Rimple,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS JANITORIAL SERVICES A letter was read from Rita Perstac,Municipal Services Director,which re quested authorization to call for bids for selecting a firm to provide daily janitorial services for city buildings. Action Taken:Mr.Edwards moved that staff be authorized to call for bids, seconded by Mr.Reese,and passed unanimously. VII. REFERRALS FROM COMMISSIONS None VIII. OTHER ITEMS FOR COUNCIL CONSIDERATION MARINA DRIVE DESIGN Marina Drive from Burress to Gibby is budgeted at $273,000 for improvements in 1986.Most property owners want two travel lanes,one lane on-street parking and one 8'sidewalk/bike path on the Broadway side,and rolled curb and gut ters.The major design problem is not having the necessary 50'of right-of- way.Two travel lanes and one parking lane can be built within 40'and the 40'segments all front on unplatted property.The additional 10'with an 8' sidewalk improvement can be acquired at property owner's expense when the land is platted.Staff is requesting Council direction on the design of Marina /o;(* /o/9 X»' \0P* 3903 CITY COUNCIL MINUTES:4 December 10,1985 Drive and if Burress Street should be improved with an LID,included with the Marina Drive project if bids come in low enough to stay within the existing overall 1986 street improvement budget,or added to the city's future street improvement plan. Leroy Johnson,owner of the Lakeshore Mobile Home Park,stated that on-street parking is not necessary on Marina and felt that the right-of-way should be left at 40'. Barry Queen pointed out that most of the area has 50'of right-of-way and he felt that if the street is reconstructed the utilities should be put in first. Roy Adamson stated that he would be opposed to the reconstruction of the street unless the sewer and water are put in first.He suggested that perhaps an LID could be initiated for the sewer and water mains in this area before the street is constructed. There was some discussion by the Council. Action Taken:Mr.Rimple moved that staff be directed to reconstruct Marina Drive within the original 40'right-of-way providing two travel lanes and one parking lane (34'curb to curb)without sidewalk and/or bike path.This will leave 3'of right-of-way behind the curb for utilities.Construct an 8'side walk/bike path on the east side in areas where the city has the additional 10' of right-of-way,and include the 60'of right-of-way of Burress Street when Marina Drive is reconstructed,seconded by Mr.Wallenstien,and passed unanimously. CENTRAL DRIVE DESIGN A letter was read from Rita Perstac,Municipal Services Director,which stated that the Central Drive ditch is budgeted for improvement in 1986.Everyone agrees improving the ditch with landscaping similar to Grape Drive is a good project.The major design question is should additional on-street parking be provided on the ditch side of Central.Staff is requesting direction from Council on the design of Central Drive and whether or not the Knolls Vista Park parking lot should be included with the ditch project. Joseph K.Gavinski,City Manager,stated that he is concerned with the safety factor and the liability to the city if parking is allowed on the ditch side of Central. Bill Frederickson stated that he did not feel parking next to the ditch would be a good idea because of the safety problem and liability to the city. Mr.Chandler did not feel the Knolls Vista Park parking lot should be paved but would be in favor of two lanes of travel,one parking lane,and landscap ing in the center. Action Taken:Mr.Chandler moved that staff construct Central Drive with 34' of paving on each side;providing one parking lane and two travel lanes each way,and a 12'planted island in the center,seconded by Mr.Rimple,and passed with Mr.Edwards opposed as he felt additional parking should be provided. IX.COUNCIL QUESTIONS AND COMMENTS None X. CITY MANAGER REPORTS AND COMMENTS AWC Joseph K.Gavinski,City Manager,distributed a report on the legislative priorities established by the AWC. INVESTMENT REPORT Joseph K.Gavinski,City Manager,distributed the October 1985 Investment Re port to Council. u 3904 CITY COUNCIL MINUTES:5 December 10,1985 PUBLIC SAFETY DEPARTMENT Joseph K.Gavinski,City Manager,distributed an article from the Mill Creek Newspaper concerning their Public Safety Department and the selection of their Public Safety Officers. REAL ESTATE TAX Joseph K.Gavinski,City Manager,distributed a letter that was sent to all real estate brokers in Moses Lake concerning the state's 1/4 of \%real estate excise tax to be used for reconstruction or repair of existing public works facilities. NORTH CENTRAL WASHINGTON COUNCIL OF MAYORS Joseph K.Gavinski,City Manager,distributed a memo from the North Central Washington Council of Mayors concerning the organization and structure of the organization SEWER PROJECT Joseph K.Gavinski,City Manager,distributed an article to the Council con cerning sewer in the City of Spokane and the fact that the city is not enforc ing a law which require anyone within 200'of a sewer to be connected to the sewer system. URBAN AREA JURISDICTION CHANGE -STREETS Joseph K.Gavinski,City Manager,stated that the state has requested cities /Ol^ in the state to inform them of any jurisdictional changes in roads in the state.The City of Moses Lake is proposing the state take jurisdiction for Wapato Drive from Broadway to 1-90;Alder Street/Stratford Road from Highway 17 to Broadway;and the second lake crossing route as it offers a bypass from Broadway to Patton Boulevard,the route required by most traffic. SNOW REMOVAL Joseph K.Gavinski,City Manager,stated that because of the complaints the //*^ city has received about the snow in the middle of the streets and the dif ficulty of getting around,the city plowed the snow on Clark to the side and received many adverse comments about that because it blocked private driveways and sidewalks.He pointed out that it is impossible to satisfy everyone. Mr.Gavinski stated that residential streets that have not already been plowed will be plowed by the city crews but other than that the city is in a quandary about what to do. It was the consensus of the Council that the city crews were doing as well as they could.
