1986 08 263992 CITY COUNCIL CITY OF MOSES LAKE August 26,1986 Members Present:Norm Johnson,Bill Reese,David Chandler,Bill Frederickson, Charles Edwards,Wayne Rimple,and Roger Biallas. The meeting was called to order at 8 p.m.by Mayor Johnson Mr.Edwards moved that the minutes of the meeting of August 12 be approved as submitted,seconded by Mr.Chandler,and passed unanimously. I.CITIZEN INPUT None II.CONSENT AGENDA 1.Asbestos Abatement Project -accept work and enter the 30 day lien period 2.Larson Lift Station -Request to call for bids to rehabilitate the exist->^cr ing Larson #2 Lift Station with new pumps and electrical controls. Mr.Chandler moved that the Consent Agenda be approved,seconded by Mr.Rim ple,and passed unanimously. III.CONSIDERATION OF BIDS None IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS None V.ORDINANCES AND RESOLUTIONS ORDINANCE -HANDICAPPED AND FIRE LANE PARKING -2ND READING A letter was read from James Whitaker,City Attorney,which presented an or dinance which makes it an infraction to park in a handicapped or disabled space without the proper decal or to park in a designated fire lane. The ordinance amending Chapter 10.12 of the Moses Lake Municipal Code titled parking regulations was read by title only. Jfi 3993 CITY COUNCIL MINUTES:2 August 26,1986 Action Taken:Mr.Edwards moved that the second reading of the ordinance be adopted,seconded by Mr.Rimple,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS COVE WEST PHASE I FINAL PLAT A letter was read from Rita Perstac,Municipal Services Director,which stated that Vic Jansen has submitted a final plat for Phase I of the Cove West Plat. Phase I consists of 50 lots on 18.168 acres.The area is zoned R-l,Single Family Residential,and will be served with city water,sewer,and streets. A variance is requested for staking lots after the plat is finalized and eliminating corner elevations from the plat.The Planning Commission recom mended the Phase I Final Plat and variances be approved subject to the August 7,1986 comments from the City Engineer.A bond for street and utility im provements will be presented to the city on August 26.Because the City At torney probably will not have time to review the bond before the Council meet ing,it is recommended that the Cove West Phase I Final Plat be approved sub ject to the City Engineer's comments and approval by the City Attorney of the subdivision bond. Ms.Perstac stated that a bond has not been received by the city and the pro ponents are requesting they be allowed to use other approved surety rather than a bond. James A.Whitaker,City Attorney,stated that if the Council wishes to approve the final plat it should be subject to the developer providing sufficient surety to the city. Action Taken:Mr.Chandler moved that the Cove West Phase I Final Plat be approved subject to the City Engineer's comments and approval of sufficient surety by the City Attorney,seconded by Mr.Frederickson,and passed unanimously. VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION None IX.COUNCIL QUESTIONS AND COMMENTS None X.CITY MANAGER REPORTS AND COMMENTS None The regular meeting was adjourned at 8:15 p.m. /Mayor V(M&v •City Clerk n BEFORE THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON ) IN THE MATTER OF ) COVE WEST PHASE I FINAL PLAT )FINDINGS OF FACT,CONCLUSIONS, )AND DECISION ) This matter,having come on before the Moses Lake City Council for action on August 26,1986,now makes the following: FINDINGS OF FACT 1.The Findings of Fact,Conclusions,and Decision on the Cove West Prelimi nary Plat are incorporated herein. 2.Vic Jansen of Moses Lake has submitted the Cove West Phase I Final Plat. 3.Cove West Phase I consists of 50 lots on 18.168 acres legally described as follows: 4.The area is zoned R-l Single Family Residential. 5.The subdivision will be served with city water and sanitary sewer. 6.Access will be off of Westshore Drive. 7.Mr.Jansen is requesting a variance to defer staking of lot corners and establishing boundary corner elevations until earthwork has been complet ed.The street and utility bond will provide for staking all lot corners and providing elevations on the boundary corners. 8.The following comments were received from the City Engineer: A.A description of the parks and common areas should be included,i.e. private park and landscaped entrance at Westshore Drive and Cove West Drive,etc. B.Change County of Grant to City of Moses Lake. C.A variance for staking the lots after filing and elevations on lot corners must be requested by the developer and approved by the Plan ning Commission and City Council. D.The following dimensions should have arrows added to show dimension ing limit and clarify the plat: 1)Shoreline in front of Lot 16 and Park 2)Shoreline in front of Lots 17 to 20 3)Shoreline in front of Lots 21 to 27 4) Curve C-36 5)Frontage on Westshore Drive 9.The Planning Commission,at their meeting on August 7,1986 recommended to the Council that the Cove West Phase I Final Plat be accepted and the variances be approved subject to the comments of the City Engineer. CONCLUSIONS 1.The City Council of the City of Moses Lake is vested with the authority and has the jurisdiction under the law to approve a final plat within the city's corporate limits if the criterion required by law is met. 2. There appears after the public meeting before the City Council on August 27,1986,no opposition to the final plat. 3.The City Council is cognizant of the need to serve the welfare and best interests of the entire community,and believes that this plat will serve the best interests of the residents of the City of Moses Lake and bears a substantial relationship to the public welfare of the entire community. DECISION 1.The Cove West Phase I Final Plat is approved as recommended by the Moses Lake Planning Commission. Dated:August 27,1986 CITY OF MOSES LAKE Norman Johnso n
