The meeting was called to order at 8 p.m.by Mayor Johnson.
Mr.Edwards moved that the minutes of the meeting of October 28 be approved as
submitted,seconded by Mr.Reese,and passed unanimously.

Mr.Edwards moved that the bills be approved as submitted,seconded by Mr.
Rimple,and passed with Mr.Rimple abstaining from voting for that portion of
the bills to Moses Lake Steel Supply and Mr.Edwards abstaining from voting
for that portion of the bills to Coast to Coast.

ORDINANCE - CREATE CHAPTER 12.22 - SNOW REMOVAL -2ND READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an
ordinance creating a new chapter entitled Snow Removal.
Jack Black felt that a four hour time limit was not sufficient to remove snow
from sidewalks,especially for people who work.

George Knauss,representing the Central Washington Rental Association,stated
that the four hour time limit is not enough.He suggested that people be
given a reasonable amount of time,possibly 24 to 48 hours,to clean their
sidewalks before infractions notices are given.
Harold Sandberg stated that after he has cleaned his sidewalk the snow plow
comes along and plows to the side and covers the sidewalk again.He felt the
snow should be plowed to the center of the street.
Wayne Baker pointed out that the city,county,and state have passed laws and
ordinances based on complaints.He felt that this ordinance is like that and
he is opposed to that.He pointed out that the ordinance does not take into
account senior citizens,working couples,people on vacation,absentee proper
ty owners,etc.He did not feel the city could enforce the ordinance.He
also felt that the city could not comply with the four hour time limit.
Dee Quigley stated that she is opposed to this ordinance.
Gary Mann wanted to know if this ordinance is being created to address a moral
issue or a liability issue.He felt that the people should take the respon
sibility of cleaning their sidewalks without the need of an ordinance from the
city.
Mr.Gavinski stated that the city would have a problem meeting the four hour
time limit.
Mr.Frederickson stated that he received a great many calls last winter about
the snow on sidewalks but he felt the ordinance should only apply to the busi
ness core.
Mr.Reese stated that he is against the ordinance.
The ordinance repealing Chapter 12.20 of the Moses Lake Municipal Code enti
tled Snow Removal and creating a new Chapter 12.22 entitled Snow Removal was
read by title only.
Action Taken:Mr.Reese moved that the second reading of the ordinance be
denied,seconded by Mr.Johnson,and passed with Mr.Frederickson opposed.
ORDINANCE - ADOPT 1987 BUDGET - 1ST READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an
ordinance adopting the 1987 Budget.
The ordinance adopting the budget for the City of Moses Lake,Washington for
the year of 1987 was read by title only.
Action Taken:Mr.Edwards moved that the first reading of the ordinance be
adopted,seconded by Mr.Frederickson,and passed unanimously.
ORDINANCE -GAMBLING TAX - 1ST READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an
ordinance reducing the gambling tax to 4.5%beginning January 1,1987.
The ordinance amending Chapter 3.18 of the Moses Lake Municipal Code entitled
Gambling tax was read by title only.
Mr.Edwards stated that he is opposed to reducing the tax.
Action Taken:Mr.Frederickson moved that the first reading of the ordinance
be adopted,seconded by Mr.Rimple,and passed with Mr.Edwards opposed.
ORDINANCE - REAL ESTATE EXCISE TAX - 1ST READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an
ordinance enacting the optional 1/4%real estate excise tax.
The ordinance enacting a new chapter 3.27 of the Moses Lake Municipal Code
entitled Real Estate Excise Tax:1986 was read by title only.

Gary Mann,Gary Mann Real Estate,stated that this tax is not based on the
profit a person receives from the sale of his home and it could create prob
lems for some people.
George Knauss stated that this is not a good way to raise money at this time.
He also pointed out that there is no guarantee that the funds will be there
when the city needs it and not guarantee that the city will ever receive any
benefit from the funds collected.
Mr.Gavinski stated that by state law the funds are put into a trust account.
Action Taken:Mr.Rimple moved that the first reading of the ordinance be
adopted,seconded by Mr.Biallas.
Mr.Frederickson pointed out that the city has a balanced budget for 1987 and
he felt this should be considered in 1988.
Mr.Edwards stated that since the Council is proposing to reduce the gambling
tax he did not feel this tax should be imposed.
The motion passed with Mr.Frederickson and Mr.Edwards opposed.
ORDINANCE - SNOW EMERGENCY/TOWING VEHICLES - 1ST READING
A letter was read from Joseph K.Gavinski,City Manager,which presented an
ordinance allowing the Municipal Services Department to clear city streets of
parked motor vehicles during the time city crews are plowing snow from city
streets.
The ordinance creating a new Chapter 10.14 of the Moses Lake Municipal Code
entitled Snow Emergency -Towing Unauthorized Vehicles was read by title only.
There was some discussion about notification to residents of when the plowing
would take place and those places in the city where there is no off-street
parking.
Action Taken:Mr.Biallas moved that the first reading of the ordinance be
adopted,seconded by Mr.Rimple,and passed unanimously.
ORDINANCE -AMEND PARKING REGULATIONS -1ST READING
A letter was read from Rita Perstac,Municipal Services Director,which pres-'
ented an ordinance amending the parking regulations to eliminate parking on
Olive Street from Pioneer Way to Juniper Drive except for that portion in
front of 704 Olive Street,eliminate parking on Lakeshore Drive at Wanapum
Drive intersection,eliminate parking on northwest (lake)side of Marina Drive
from Gibby to Burress,eliminate parking on the Valley Road Hill,and allow
on-street parking on Central Drive from Pine to Sage Bay Drive.
The ordinance amending Chapter 10.12 of the Moses Lake Municipal Code entitled
Parking Regulations was read by title only.
Joseph K.Gavinski,City Manager,distributed a letter from Sara Milbrandt,
Administrator of The Hearthstone Retirement Inn,which stated that the city is
not being consistent by prohibiting parking on one side of Olive because it
would be hazardous and allowing parking on the other side.
It was pointed out that the allowed parking on Olive in front of the Moberg
residence would not be reserved for the Mobergs,it would be open parking,and
there is nothing the city could do about that.
Action Taken:Mr.Frederickson moved that the first reading of the ordinance
be adopted,seconded by Mr.Rimple,and failed with Mr.Rimple,Mr.Frederick-
son,and Mr.Johnson in favor and Mr.Edwards,Mr.Reese,and Mr.Biallas
opposed.
Action Taken:Mr.Edwards moved that the ordinance be amended to permit park
ing on the north side of Olive from Kiefer to Pioneer and no parking on the
south side,and the first reading of the ordinance be adopted,seconded by Mr.
Biol las.

Mr.Frederickson requested staff research the question of parking on Olive as
it relates to The Hearthstone Inn.
ORDINANCES - AMEND MUNICIPAL CODE - 1ST READINGS
A letter was read from Joseph K.Gavinski,City Manager,which presented
several ordinances amending the Municipal Code.The amendments are housekeep
ing matters which bring the ordinances into conformity with actual practice,
recent organizational changes,and/or court decisions.
Amend Chapter 2.08 -Mayor and Council
The ordinance amending Chapter 2.08 of the Moses Lake Municipal Code entitled
Mayor and Council was read by title only.
Action Taken:Mr.Rimple moved that the first reading of the ordinance be
adopted,seconded by Mr.Reese,and passed unanimously.
Create Chapter 2.26 -Municipal Services Department
The ordinance deleting Chapter 2.24 of the Moses Lake Municipal Code entitled
Public Works Department and Chapter 2.28 of the Moses Lake Municipal Code en
titled Community Development Department and creating a new Chapter 2.26 of the
Moses Lake Municipal Code entitled Municipal Services Department was read by
title only.
Action Taken:Mr.Frederickson moved that the first reading of the ordinance
be adopted,seconded by Mr.Rimple,and passed unanimously.
Amend Chapter 2.52 -Division of Emergency Services
The ordinance amending Chapter 2.52 of the Moses Lake Municipal Code entitled

VII.REFERRALS FROM COMMISSIONS
LPS CHURCH FINAL PLAT
A letter was read from Rita Perstac,Municipal Services Director,which stated /^^
that the Church of Jesus Christ of Latter Day Saints has submitted a final
plat for a one lot subdivision on Grape Drive.The lots is 4.26 acres,zoned
R-3,Multi-family Residential,and served with city water and sewer.
Action Taken:Mr.Reese moved that the LDS Church Final Plat be approved with
the stipulation the City Engineer's comments be addressed and the Findings of
Fact be accepted,seconded by Mr.Rimple,and passed unanimously.
MUNICIPAL TRACT NO. 11 FINAL PLAT
A letter was read from Rita Perstac,Municipal Services Director,which stated
that the City of Moses Lake has submitted a final plat for a 3 lot,6.55 acre
subdivision of city-owned land located on Pioneer Way,Fifth Avenue,and Bal
sam Street.This is the site of City Hall,library,and the Fire Station.
The plat is served with city water and sewer.
Action Taken:Mr.Rimple moved that the Municipal Tract No.11 Final Plat be
approved as recommended by the Planning Commission and the Findings of Fact be
accepted,seconded by Mr.Frederickson,and passed unanimously.
NORTHWEST MOBILE HOME SHORT PLAT -VARIANCE
A letter was read from Rita Perstac,Municipal Services Director,which stated
that Ken Rose has submitted a four lot short plat located on West Broadway
between Schnierla and Burress.The lots are 8,475 square feet and front on
West Broadway and Main Street.The plat is zoned C-2,General Commercial and
Business.Each lot is 95'deep because Mr.Rose is dedicating 5'for needed
right-of-way on Main Street.Main Street is presently a graveled street with
out water and sewer in the portion adjacent to this plat.Plat requirements
are for Main Street to be improved with full width street improvements and
city water and sewer main extensions the length of the plat on Main Street.
Sewer and water are available on Broadway and/or Schnierla to serve these
lots.A variance is requested to the 100'lot depth requirement and to the
requirement for installing street and utility improvements at this time on
Main Street,or sewer on Broadway.Mr.Rose is requesting a covenant to in
stall street and utility improvements at a later date as required by the city.
The Planning Commission recommended to Council the variance request be ap
proved for lot depth and a covenant be allowed for full-width street improve
ments and the extension of water on Main Street and sewer extension either on
Main or Broadway as required by the city in the future,and comments from the
City Engineer and Fire Marshal be addressed on the final plat.
Action Taken:Mr.Frederickson moved that the variance be granted as recom-
mended by the Planning Commission,seconded by Mr.Reese,and passed
unanimously.
WATSON SHORT PLAT -VARIANCE
A letter was read from Rita Perstac,Municipal Services Director,which stated
that Thomas Watson of Moses Lake has submitted a one lot short plat located at
the intersection of Broadway,Barbara Street,and Main Street.The lot is
15,000 square feet and is zoned C-2,General Commercial and Business.The lot
is 95'deep because Mr.Watson is dedicating 5'for needed right-of-way on
Main Street.Main Street is presently a graveled street without water and
sewer in the portion adjacent to this plat.Plat requirements are for full

Commission be accepted,seconded by Mr.Rimple,and passed unanimously.
BATTERY ORCHARD TRACTS 174 &175 PLAT ALTERATION
A letter was read from Rita Perstac,Municipal Services Director,which stated
that Craig Dorsing and Larry Shannon,owners of Battery Orchard Tracts 174 and
175 respectively,have submitted a petition requesting the alteration of the
plat to eliminate a portion of dedicated right-of-way lying between the two
lots.Battery Orchard Tracts was platted in 1914 and dedicated 40'of right-
of-way between lots 174 and 175 between Lakeshore Drive and the lake.The
right-of-way has never been improved except for a storm sewer installed in
1984 from Lakeshore Drive to the lake.The plat alteration provides a 20'
utility easement for the storm sewer.The Planning Commission recommended to
Council that this plat alteration be approved.
Action Taken:Mr.Rimple moved that the plat alteration be approved and the
Findings of Fact be accepted,seconded by Mr.Edwards,and passed unanimously.
yfr HANSEN/CITY -BUILD ON UNPLATTED PROPERTY -MUNICIPAL AIRPORT -RESOLUTION
A letter was read from Rita Perstac,Municipal Services Director,which stated
that the City of Moses Lake owns the Municipal Airport land,which is all un
platted property.Mick Hansen contracts with the City of Moses Lake to manage
the airport and is requesting permission to place a double wide mobile home on
the west side of the airport as a residence for security purposes.The Plan
ning Commission recommended to Council the City of Moses Lake and Mr.Hansen
be allowed to build on unplatted property with the condition the City of Moses
Lake plat the property as soon as possible.
The resolution allowing the City of Moses Lake (Mick Hansen)to build on un
platted property was read by title only.
Action Taken:Mr.Edwards moved that the resolution be adopted,seconded by
Mr.Reese,and passed unanimously.
VIII. OTHER ITEMS FOR COUNCIL CONSIDERATION
REQUEST FOR FUNDS FOR INSURANCE PURCHASE -HANSEN AIR WEST
A letter was read from Joseph K.Gavinski,City Manager,which stated that the
city has a lease with Hansen Air West to operate the Municipal Airport until
March 31,1992.The city has contributed $2,800 each year toward the purchase
of insurance for the airport since the lease was signed in 1977.Hansen Air
West has requested the Council continue the $2,800 per year contribution for
insurance for the next five years.
A letter was read from Mick Hansen,President of Hansen Air West,Inc.,which
outlined the improvements done at the Municipal Airport in the last 10 years
and requesting the city to contribute up to $2,800 per year for insurance for
the next five years.
Action Taken:Mr.Rimple moved that the city contribute $2,800 per year to-
ward the purchase of insurance for the airport for the next five years,secon
ded by Mr.Frederickson,and passed unanimously.
PUD EASEMENT
A letter was read from Rita Perstac,Municipal Services Director,which stated
that the PUD is requesting two 27'wide easements through two parcels of city-
owned property to build a 115 KV transmission line.One parcel is Cascade
Park and the other is undeveloped park property in Basin Homes.Staff

believes the PUD easement language is too restrictive for the city and has
drafted alternate easement language for Council review.
Bill Wood,Senior Right-of-Way Agent for the PUD,presented a report on the
project and explained the proposed route of the 115 KV line.
Action Taken:Mr.Frederickson moved that staff be directed to work with the
PUD on the easement language,seconded by Mr.Reese,and passed with Mr.Rim
ple opposed as he was concerned about transmission lines running through city
park property.
UTILITIES OUTSIDE CITY LIMITS - K & N AND EXXON
A letter was read from Rita Perstac,Municipal Services Director,which stated
that the owners of K &N Electric and the Exxon gas station located outside
the city limits just north of Highway 17 and west of Stratford Road have re
quested permission to connect to city water.
Action Taken:Mr.Edwards moved that K & N Electric and Exxon be allowed to
hook to city water provided they annex to the city,seconded by Mr.Frederick-
son, and passed unanimously.

INVESTMENT REPORT
Joseph K.Gavinski,City Manager,distributed the investment report for Oc
tober 1986.
CITY HALL REMODEL -STATUS REPORT
Joseph K.Gavinski,City Manager,presented a report from Arkitex,Inc.which
gave the status of the construction of the City Hall building.This report
showed the approved and proposed changes in the contract.
Mr.Rimple did not feel the proposed deletions of the cabinets in the mail/
workroom,Room 122,and drafting room should be done just to keep the change
orders below the 5%set by the Council.He felt the cabinets are needed and
would have to be put in at a later date any way and at a higher cost.
Layne Stark,Arkitex,Inc.,stated that it would cost more to put the cabinets
in at a later date than it would be to put them in now but they are attempting
to stay within the budget set by the Council.
There was some discussion by the Council on moving the computer operation to
the basement.Mr.Gavinski stated that it was originally planned to leave the
computer where it was in the old building during the remodeling.When it was
discovered that the computer had to be moved because of the asbestos removal,
it was decided to place it in the basement along with the computer operator
and computer programmer.This releases more space for city staff expansion in
the new section of the City Hall.
Action Taken:Mr.Rimple moved that the cabinets in Mail/Workroom 113,the
bookcase in Room 122,and the cabinets in the drafting room remain in the con
tract,seconded by Mr.Reese,and passed unanimously.
The regular meeting was recessed at 10:30 p.m.and the Council met in execu
tive session to discuss personnel matters and real estate acquisition.The
executive session was adjourned at 11:30 p.m.and the regular meeting was

This matter,having come on before the Moses Lake City Council for action on
November 11,1986,now makes the following:
FINDINGS OF FACT
1.Craig Dorsing,4120 W.Lakeshore,and Larry Shannon,4204 W.Lakeshore,
have submitted the Battery Orchard Tracts 174 and 175 Plat Alteration for
approval.
2.The property is situated in Grant County and is legally described as
fol1ows:
Battery Orchard Tract 174 and Battery Orchard Tract 175
3.The plat alteration is proposed in order to eliminate a portion of dedi
cated right-of-way lying between the two lots.
4.The Battery Orchard Tracts Plat of 1914 dedicated 40'of right-of-way
lying between Lots 174 and 175 on the north and south and between Lake-
shore Drive and the lake on the east and west.The right-of-way has
never been improved or utilized.
5.The area is zoned R-l,Single Family Residential and the lots are served
with city water and sewer.
6.A storm sewer runs through the right-of-way to the lake.If the plat
alteration is approved,a storm sewer easement would be retained by the
city.
7.A public hearing scheduled upon notice before the Planning Commission on
the issue of the plat alteration of the area in question was held on Oc
tober 30,1986.
8.Mrs.Kvamme stated that this was discussed in prior years and the right-
of-way was retained so that the Fire Department could launch the rescue
boat from there if it was needed in that part of the lake.
9.Larry Angell,Asst.Director for Community Development,stated that he
checked with the Fire Department on this and they would be using the boat
launch at Peninsula Park for the rescue boat if it is needed.
10.Rita Perstac,Municipal Services Director,stated the City Manager dis
cussed the alternation with her and advised it is a new process for the
City of Moses Lake.He also stated that the plat alteration at this site
is an alternative to vacating right-of-way along a public body of water
which is prohibited by statute and this plat alteration is actually a
policy issue and not a legal issue.
11.There were no comments from the audience at the public hearing.No writ
ten protests by any person were filed with the city prior to or during
the public hearing.
12.The Planning Commission recommended to the City Council that the plat
alteration of Battery Orchard Tracts 174 and 175 be approved.
8.On October 28,1986 the City Council set November 11,1986 as the date to
consider this plat alteration.
9.On November 11,1986 the City Council considered the Battery Orchard
Tracts 174 and 175 Plat Alteration.
CONCLUSIONS
1.The City Council of the City of Moses Lake is vested with the authority
and has the jurisdiction under the law to approve a plat alteration
within the city's corporate limits if the criterion required by law is
met.
2.There appears after the public meeting before the City Council on Novem
ber 11,1986 no opposition to its approval.
3.The City Council is cognizant of the need to serve the welfare and best
interests of the entire community,and believes that this plat alteration
will serve the best interests of the residents of the City of Moses Lake
and bears a substantial relationship to the public welfare of the entire
community.
DECISION
1.The Battery Orchard Tracts 174 and 175 Plat Alteration is approved as
recommended by the Moses Lake Planning Commission.

The plat is the site of the City Hall Complex and is legally described as

quarter of Section 23 all in Township 19 North,Range 28 East,W.M.,
County of Grant,State of Washington described as follows:
Commencing at the monument at the intersection of Fourth Street and Alder
Street according to the Plat of Neppel filed October 15,1912;thence
north 53°40'54"east,a distance of 380.02 feet to the monument at the
intersection of Fourth Street and Balsam Street (formerly Birch Street);
thence north 36°17'02"west along the centerline of Balsam Street,a dis
tance of 179.87 feet;thence north 53°43'08"east,a distance of 40.00
feet to point of beginning on the northeasterly right-of-way of Balsam
Street and the southeasterly right-of-way of Zeta Alley;thence north
53°43'08":east along the south boundary of Zeta Alley,a distance of

2.The area is 6.55 acres and is zoned Public.
3.The area is served with city water and sewer and fronts on Pioneer Way,
Fifth Avenue,and Balsam Street -all of which are improved city streets.
4.At their meeting on March 27,1986 the Planning Commission declared this
project to have a non-significant adverse impact on the environment.
5.The City Engineer had the following comments:
a. Delete the number "1" on Lot 3 or add Block 1
b.Legal Description -last line 6.36 should be 6.55
c.PUD and PNB easements will be modified to reflect present construc
tion work prior to filing the plat
d.Irrigation easements or structures
6.The Moses Lake Irrigation District stated they do not require any irriga
tion easements or structures on the plat.
7.The Planning Commission recommended to the City Council that the
Municipal Tract 11 Final Plat be accepted with the stipulation that the
City Engineer's comments be addressed,a variance for the improvements
(full width street improvements)to Chestnut Street be approved with a
covenant to run with the land for the improvements,and a variance of the
requirement that a lot front on a dedicated street to permit access to
Lot #1 by a 30'access easement be granted.
CONCLUSIONS
1.The City Council of the City of Moses Lake is vested with the authority
and has the jurisdiction under the law to approve a final plat within the
city's corporate limits if the criterion required by law is met.
2.There appears after the public meeting before the City Council on Novem
ber 11,1986,no opposition to the final plat.
