MINUTES
Mr.Edwards moved that the minutes of the meeting of July 14 be approved as
submitted,seconded by Mr.Rimple,and passed unanimously.
APPROVAL OF BILLS AND WARRANTS ISSUED
Mr.Johnson presented an additional bill from the PUD for electrical service
to the caretakers mobile home in Cascade Park in the amount of $140.
Action Taken:Mr.Edwards moved that the bill from the PUD and following
bills and warrants issued be approved,seconded by Mr.Chandler,and passed
with Mr.Rimple abstaining from voting for that portion of the bills to Moses
Lake Steel Supply and Mr.Biallas abstaining from voting for that portion of
the bills to A &H Printers.
Vouchers audited and certified by the Finance Director as required by RCW
42.24.080,and those expense reimbursement claims certified as required by RCW
42.24.090,have been recorded on a listing which has been made available to
the City Council.
The vouchers included on the above list as modified by the Council and noted
upon said list for the Council meeting of July 28,1987 for the funds listed
below 1n the amount of $231,928.36 for all funds.

Mr.Rimple moved that the following items on the Consent Agenda be approved,

1.Ordinance Summary:A summary of the ordinance amending Chapter 17.17 of /of/
the Moses Lake Municipal Code was presented and approved.
2.Annexation -Notice of Intent - Set Date to Consider:Property owners
along Stratford Road between Highway 17 and Kinder Road,have requested l&or
annexation into the city.August 11 was set as the date to consider the
notice of intent to annex.

A letter was read from the Moses Lake Business Association which requested the
use of Third Avenue from Alder to Beech for a cowboy breakfast and sidewalk
sale on August 14 and 15.
Action Taken:Mr.Frederickson moved that the request be granted,seconded by
Mr.Rimple,and passed unanimously.
COMMUNICATION -HEARTHSTONE INN - PARKING
A letter was read from Sara Milbrandt,Administrator of the Hearthstone Re
tirement Inn,which requested the city reconsider its decision to make Olive a
no parking zone on both sides from Pioneer to Juniper.There is adequate
parking on site for the staff and residents but when the Inn 1s used for spe
cial events additional parking is needed.She requested that the city study
the situation and consider lifting the no parking restrictions during the
spring and summer months.
Joseph K.Gavlnski,City Manager,mentioned that the Council had been peti
tioned for the no parking zone by residents of the area after the Retirement
Inn was built and the Council banned parking on Olive except for a portion in
front of Mr.Moberg's home.
Mr.Frederickson pointed out that Olive is a hazard in the winter and it was
his recollection that the Retirement Inn had indicated they would have ade
quate parking on-site.
There was some discussion by the Council on the problems of putting up and
taking down no parking signs twice a year and what months to do it in.No
action was taken.
COMMUNICATION -DEPARTMENT OF COMMUNITY DEVELOPMENT -DOWNTOWN REVITALIZATION
A letter was read from Joseph K.Gavinski,City Manager,concerning the De
partment of Community Development's "Revitalizing Washington's Downtowns:A
Training Institute".He felt this would be a good opportunity for the city to
participate in an in-depth study on downtown revitalization at a reasonable
cost and requested Council direction.
Action Taken:Mr.Frederickson moved that the City Manager be authorized to
apply for participation,seconded by Mr.Biallas,and passed unanimously.
COMMUNICATION - GRANT COUNTY - 911
A letter was read from Joseph K.Gavinski,City Manager,which stated that
Grant County 1s proposing to provide dispatch/911 service for Moses Lake.
Merlin Trayler,representing the 911 users board,stated that they are propos
ing to provide 911 dispatching for the City of Moses Lake.
Dick Canfield,1027 Edgewater Lane,recommended that the city not enter into
an agreement for 911 dispatching with the county because both Moses Lake and
Ephrata have their own successful 911 systems.

Mr.Gavinski recommended that the Council allow the staff time to prepare a
report comparing the pro's and con's of the proposal which will be presented
at the second meeting in August.

ORDINANCE -REIMBURSEMENT SCHEDULE -MARINA WATER/SEWER -1ST READING
A letter was read from Rita Perstac,Municipal Services Director,which pres
ented an ordinance amending the water and sewer connection charges in connec
tion with the Marina/Interlake Reconstruction Project.
The ordinance amending Chapter 13.08 of the Moses Lake Municipal Code entitled
"Water and Sewer Connections,was read by title only.
Action Taken:Mr.Rimple moved that the first reading of the ordinance be
adopted,seconded by Mr.Edwards,and passed unanimously.
ORDINANCE -INTERIM FINANCING - LID 55 - 1ST READING
A letter was read from Walter Fry,Finance Director,which presented an or
dinance providing for the interim financing of LID #55.
The ordinance providing for interim financing of LID #55 was read by title
only.
Action Taken:Mr.Rimple moved that the first reading of the ordinance be
adopted,seconded by Mr.Chandler,and passed unanimously.
ORDINANCE -AMEND 1987 BUDGET - 1ST READING
A letter was read from Walter Fry,Finance Director,which presented an or
dinance amending the 1987 budget.
The ordinance amending the 1987 budget for the City of Moses Lake,Washington,
was read by title only.
Action Taken:Mr.Chandler moved that the first reading of the ordinance be
adopted,seconded by Mr.Rimple,and passed unanimously.
ORDINANCE - AMEND CHAPTER 2.08 - 1ST READING
A letter was read from Walter Fry,Finance Director,which presented an or
dinance amending Chapter 2.08 to allow for ordinances relating to the Issuance
of bonds,bond anticipation notes,tax anticipation notes,revenue anticipa
tion notes,interfund loans,and registered warrants to receive only one
reading.
The ordinance amending Chapter 2.08 of the Moses Lake Municipal Code entitled
"Mayor and Council"was read by title only.
Action Taken:Mr.Edwards moved that the first reading of the ordinance be
adopted,seconded by Mr.Rimple,and passed unanimously.
ORDINANCE - AMEND 18.63 - MOBILE HOME PARKS - 1ST READING
A letter was read from Rita Perstac,Municipal Services Director,which pres
ented an ordinance amending the Mobile Home Park Regulations.The Planning
Commission recommended that the ordinance be amended to allow a set back from
city right-of-way of 15'and that it be retroactive.
The ordinance amending Moses Lake Municipal Code Chapter 18.63 entitled
"Mobile Home Parks"was read by title only.
Joseph K.Gavinski,City Manager,pointed out that all mobile homes require a
sight obscuring fence which is usually placed on the property line.The
mobile homes are then set back from this fence the required distance.
Action Taken:Mr.Edwards moved that the first reading of the ordinance be
adopted,seconded by Mr.Chandler,and passed with Mr.Rimple and Mr.Biallas
opposed.

Mr.Rimple felt that the ordinance would establish a different standard for
mobile home parks and conventionally built homes in the same area.
/QSp RESOLUTION -WITHDRAWAL OF TAX CODE AREA #72
A letter was read from Joseph K.Gavinski,City Manager,which presented a
resolution concurring in the request of Grant County Public Hospital District
#3 of the withdrawal of Tax Code Area #72 from Grant County Public Hospital
District #3.
The resolution concurring in the request of the Grant County Public Hospital
District No.3 for the withdrawal of Tax Code Area #72 of Grant County,a part
of the City of Moses Lake from Grant County Public Hospital District No.3 was
read by title only.
Action Taken:Mr.Frederickson moved that the resolution be adopted,seconded
by Mr.Rimple,and passed with Mr.Edwards opposed.

RESOLUTION -AUTHORIZE TELEPHONE AND/OR WRITTEN QUOTATIONS
A letter was read from James A.Whitaker,City Attorney,which presented a
resolution bringing the city into compliance with existing bid laws.
The resolution authorizing the use of a small works roster for public works
and authorizing the securing of telephone and/or written quotations pursuant
to RCW 35.23.352 was read by title only.
Mr.Whitaker recommended that section 2.3 in the resolution be changed to
state that the City Manager or his designee shall make the purchase from the
lowest responsible vendor.
Action Taken:Mr.Chandler moved that the resolution be changed and adopted,
seconded by Mr.Rimple,and passed unanimously.
RESOLUTION -ABANDON EASEMENT -GEAR
A letter was read from Rita Perstac,Municipal Services Director,which pres
ented a resolution abandoning the southerly 5'of a 10'utility easement adja
cent to the northerly property line of Lot 10,Block 2,Loop Plat.
The resolution authorizing abandonment of a portion of an easement was read by
title only.
Action Taken:Mr.Frederickson moved that the resolution be adopted,seconded
by Mr.Rimple,and passed unanimously.
</)RESOLUTION -INTERFUND LOAN
A letter was read from Walter Fry,Finance Director,which presented a resolu
tion providing for an interfund loan from the General Fund to the Street Fund.
The resolution authorizing an interfund loan was read by title only.
Action Taken:Mr.Biallas moved that the resolution be adopted,seconded by
Mr.Chandler,and passed unanimously.
RESOLUTION -DESTRUCTION OF WEEDS -VANDERWAL
A letter was read from Joseph K.Gavinski,City Manager,which presented a
resolution directing the destruction of weeds on private property.The prop
erty belongs to Mr.and Mrs.William Vanderwal,is located at 1048 Skyline
Drive,and is infested with weeds.
The resolution directing the destruction of weeds on private property was read
by title only.
Mr.Rimple stated that Mr.Vanderwal had contacted him and stated that he had
made arrangements with the Fire Department to burn the weeds at their
convenience.
Action Taken:Mr.Rimple moved that the resolution be tabled,seconded by Mr.
Biallas,and passed unanimously.

VI.REQUESTS TO CALL FOR BIDS

VII.REFERRALS FROM COMMISSIONS
REPLAT OF LOT 41,TERMINAL PARK ADDITION #2 -VARIANCE
A letter was read from Rita Perstac,Municipal Services Director,which stated
that Ron Eilers has requested a variance to defer the street improvements for
the Replat of Lot 41,Terminal Park Addition #2.The Planning Commission
recommended to Council that the variance be granted with the stipulation that
a covenant be executed providing for street improvements and for participation
in any LID for street improvements.
The Council discussed the fact that the two lots have less than the required
frontage on Lakeside Drive and the fact that the city plans to improve the
street in 1988.
Action Taken:Mr.Frederickson moved that the recommendation of the Planning
Commission be adopted,seconded by Mr.Chandler,and passed unanimously.
LAKESHORE MOBILE HOME PARK EXPANSION BINDING SITE PLAN
A letter was read from Rita Perstac,Municipal Services Director,which stated
that Leroy Johnson has submitted a binding site plan for a 33,770 square foot
expansion of the existing Lakeshore Mobile Home Park on Marina Drive.The
Planning Commission recommended that the binding site plan be accepted with
the stipulation the comments from the City Engineer be addressed.
Action Taken:Mr.Frederickson moved that the recommendation from the Plan-
ning commission and the Findings of Fact be adopted,seconded by Mr.Rimple,
and passed unanimously.
VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
MUTUAL AID AGREEMENT - GRANT COUNTY 5
A letter was read from Joseph K.Gavinski,City Manager,which presented an //3^
agreement providing for mutual aid between the city and Grant County Fire Dis
trict 5 covering fires in any school,day care center,hospital,nursing home,
residential dormitory facility,or apartments for the elderly.
Action Taken:Mr.Edwards moved that the City Manager be authorized to sign
the agreement,seconded by Mr.Frederickson,and passed unanimously.

BUDGET SCHEDULE
Joseph K.Gavinski,City Manager,distributed the budget calendar to the /O/O
Council.
TRAFFIC CONTROL
Joseph K.Gavinski,City Manager,distributed a letter that the City Engineer ///7
wrote to the Department of Transportation expressing concern about three
intersections near the City of Moses Lake -Grape Drive and Highway 17,Strat
ford Road and Highway 17 north ramps,and 1-90 and Hansen Road.
Mr.Frederickson felt that traffic signals are needed at Grape and Valley and
Grape and Highway 17.

DELINQUENT WATER BILLS
July 28,1987
Joseph K.Gavinski,City Manager,explained the city's delinquent water bill
collection and turn off procedures.He recommended that the process be
changed so that a $5 fee is charged for a city employee to make contact with a
person on the delinquent list and a $10 fee if the account fails to pay by 1
p.m.and goes delinquent.Hopefully,this system would encourage people to
pay their bills on time and reduce the amount of staff time needed to make
contact with delinquent accounts.
It was the consensus of the Council that an ordinance be drafted and presented
at the next Council meeting.
The regular meeting was recessed at 9:30 p.m.and the Council met in executive
session to discuss real estate.The executive meeting was adjourned at 10:00
p.m.and the regular meeting was reconvened.The regular meeting was adjour
ned at 10:00 p.m.

This matter,having come on before the Moses Lake .CITY COUNCIL for ac
tion on July 28,1987,now makes the following:
FINDINGS OF FACT
1.Leroy Johnson has submitted the Lakeshore Mobile Home Park Binding Site
Plan,legally described on the attached Exhibits A and B.
2.The area is a 33,770 square foot (8 unit)expansion of the Lakeshore
Mobile Home Park.
3.The proposed expansion lies to the north and will have access through the
existing mobile home park onto Marina Drive.
4.The proposed expansion will be served with city water and sanitary sewer.
5.The area is zoned R-3,Multi-family Residential.
6.Mr.Johnson has submitted a petition requesting the vacation of a portion
of Marina Drive 10'in width and approximately 181'in length adjacent to
the proposed binding site plan.The vacation is being requested so that
the proposed expansion will be in compliance with the setback require
ments of the R-3 Zone.Mr.Johnson will provide an easement to the city
for utility purposes.
7.The City Engineer had the following comments:
A.Provide certificate of the city Finance Director.
B.A title report confirming the title of the Binding Site Plan is re
quired to be submitted prior to filing.

Major Plat".We have found this necessary in order to get Grant
County to file the document.
D.On-site utility plans must be approved by the Building Inspector.
Plans are being circulated for review and will be returned directly
to the engineer.
E.On-site utilities must be constructed prior to the issuance of a
building permit.
Binding Site Plan
A.Add the vacation ordinance number when the vacation is complete,and
prior to filing of the binding site plan.
B.Submit a boundary closure on the binding site plan.
C.Section 17.26.020.A.7 requires private streets to access onto a ded
icated street.A variance may be in order as the street accesses a
private street under the same ownership.
D.Show the Regan D.Schrag property.
E.Show the legal description of record.
F.I believe the last distance of the legal description of record
should be 162.92 feet.
G.The Land Surveyors'Declaration should read "upon an"actual survey.
Master Plan
A.The lot and block dimensions and designations are required to be
shown on the Master Plan.On the next binding site plan you submit,
the Master Plan is required to be on the same sheet size as the
binding site plan.Submit the original of the Master Plan when the
binding site plan is submitted for filing.
B.Show the proposed electrical,telephone,and cablevision lines.La
bel the existing lines.Does the PUD conduit connect to anything?
C.Are the dashed lines along Marina the retaining wall?Please label.
D.Label the existing asphalt drive and curb.
E.What is the dashed line through the dry well?
8.The Planning Commission recommended to Council that the Lakeshore Mobile
Home Park Binding Site Plan be accepted with the stipulation that the
City Engineer's comments be addressed.
CONCLUSIONS
1.The City Council of the City of Moses Lake is vested with the authority
and has the jurisdiction under the law to approve a binding site plan
within the city's corporate limits if the criterion required by law is
met.
2.There appears,after the public meeting before the City Council on the
Lakeshore Mobile Home Park Expansion Binding Site Plan,no opposition to
the binding site plan.
3.The City Council is cognizant of the need to serve the welfare and best
interests of the entire community,and believes that this binding site
plan will serve the best interests of the residents of the City of Moses
Lake and bears a substantial relationship to the public welfare of the
entire community.
DECISION
1.The Lakeshore Mobile Home Park Binding Site Plan is approved as recommen
ded by the Moses Lake Planning Commission.
