MINUTES
Mr.Edwards moved that the minutes of the meeting of November 24 be approved
as submitted,seconded by Mr.Frederickson,and passed unanimously.
APPROVAL OF BILLS AND WARRANTS ISSUED
Action Taken:Mr.Reese moved that the bills and warrants issued be approved,
seconded by Mr.Edwards,and passed with Mr.Rimple abstaining from voting for
that portion of the bills to Moses Lake Steel Supply.
Vouchers audited and certified by the Finance Director as required by RCW
42.24.080,and those expense reimbursement claims certified as required by RCW
42.24.090,have been recorded on a listing which has been made available to
the City Council.
The vouchers included on the above list as modified by the Council and noted
upon said list for the Council meeting of December 8,1987 for the funds list
ed below are approved in the amount of $352,649.67 for all funds.

The payroll issued on November 30,1987,having been approved pursuant to the
rule of the City Council set forth in Moses Lake Municipal Code 3.42.040,was
paid by warrants 31078 through 31214 in the amount of $133,915.76.
The payroll issued on November 30,1987,having been approved pursuant to the
rule of the City Council set forth in Moses Lake Municipal Code 3.42.040,was
paid by warrants 31215 through 31235 in the amount of $5,594.26.
The claims warrants 27145 through 27266 issued on November 25,1987 were ap
proved for payment at the Council meeting held on December 8,1987 in the to
tal amount of $112,874.70.

III.CONSIDERATION OF BIDS
GRADER
Seven bids were received for a grader,none of which exactly meets bid specs.IQ/l
Staff recommended the bid be awarded to the Howard Cooper Corporation in the
amount of $63,849.46 for a Dresser 400E grader with 123 hours on it and which
will be delivered by January 1,1988.

itch Haroldsen pointed out that none of the bids exactly met the specs but he
felt that their bid from Sahlberg for a Champion 710A grader came the closest.
Rita Perstac,Municipal Services Director,stated that staff evaluated the
bids following Council's direction that the cost be under $70,000 including
sales tax.Of the three bids under $70,000,staff felt the Dresser 400E best
meets the city needs.
Mr.Radcliff,representing Champion,compared the Dresser 400E to the Champion
710A.
Ms.Perstac stated that staff did not agree with the statements made by Mr.
Radcliff.She pointed out that none of the bids exactly meet the specifica
tions but if the Council had not set the $70,000 ceiling,staff would have
recommended the bid award be to NC Machinery for the CAT 120G.
Mr.Rimple stated that he would have a problem awarding the bid for the
Dresser 400E since it deviates quite a bit from the bid specs,even though it
is below $70,000.
Mr.Edwards pointed out that the $70,000 was a guideline for staff.
Mr.Biallas pointed out that if the cost of the grader is increased it brings
the economics into question and perhaps the city should look at contracting
again.
James A.Whitaker,City Attorney,pointed out that it is up to the Council to
decide which bidder is most responsive to the city's needs since all the bids
deviate somewhat from the specs.
Action Taken:Mr.Edwards moved that the bid from NC Machinery for a CAT 120G
be accepted.Motion died for lack of a second.
Action Taken:Mr.Rimple moved that the bid award be continued to the Decem-
ber 22 meeting and that a study session be held at 7 p.m.on December 22 with
staff to discuss the grader bids,seconded by Mr.Biallas,and passed with Mr.
Edwards opposed.
WELL #9
Lad Irrigation was the only bidder for the sealing of the lower portion of
Well #9.The work is the continuation of the water quality improvements being
performed by the city in an attempt to relieve the hydrogen sulfide gas in the
Knolls Vista area during the summer months.
Action Taken:Mr.Rimple moved that the bid be awarded to Lad Irrigation,
seconded by Mr.Reese,and passed unanimously.
IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS
COMMUNICATION -CHAMBER OF COMMERCE -TOURISM
Robert Russell,President of the Chamber of Commerce Board of Directors,and
John Jerentowski,President of the Moses Lake Tourism Council,requested time
to discuss a proposal relating to tourism and the promotion of tourism in
Moses Lake.
Action Taken:Mr.Rimple moved that the request be brought off the table,
seconded by Mr.Frederickson,and passed unanimously.
John Jerentowski requested that the Council donate $50,000 per year for five
years from the Convention Center Fund for the promotion of tourism in Moses
Lake.The request for a 5%increase in the donated funds for the five year
period has been deleted.He stated that a committee was set up to oversee the
tourism promotion funding consisting of Bob Russell,Karen Wagner,John Jeren
towski,Bill Bailey,and a City Councilman,who will be appointed by the
Council.
Mr.Edwards pointed out that the city has already given the Chamber $5,000 for
tourism in 1988 and he felt that amount should be deducted from the requested
$50,000.He stated that he was opposed to a 5 year commitment of $50,000 but
would be in favor of considering a request for funds each year.

There was some discussion about the proposed budget presented by Mr.Jerentow
ski and the proposed brochures.
Mr.Jerentowski stated that Invoices for tourism promotion would be submitted
to the city for payment.
Action Taken:Mr.Frederickson moved that the request for funds for tourism
promotion be granted,with the funds not to exceed $50,000,including the
$5,000 budgeted for the Chamber of Commerce,seconded by Mr.Reese,and passed
unanimously.
COMMUNICATION - SEPTIC TANKS
Robert J.Wallenstien,in a letter to the City Manager,recommended that the JlC^C
sewer system provide the capital to establish a loan fund to be used by prop
erty owners and the city to finance hook up fees in hardship cases.
Joseph K.Gavinski,City Manager,stated that if Council wishes,a program as
suggested by Mr.Wallenstien could be established.
It was the consensus of the Council that staff look into the possibility.
V.ORDINANCES AND RESOLUTIONS
ORDINANCE - AMEND 1987 BUDGET - 1ST READING
The ordinance amending the 1987 budget was presented.
The ordinance amending the 1987 budget for the City of Moses Lake,Washington
was read by title only.
Action Taken:Mr.Edwards moved that the first reading of the ordinance be
adopted,seconded by Mr.Reese,and passed unanimously.
RESOLUTION -ACCEPT GIFT -PERRAULT
David J.and Pauline Perrault have donated $1,556.16 to the city for the pur-JOVh
chase of a Varda Silent Alarm System.
The resolution accepting a donation of $1,556.16 from David J.and Pauline
Perrault d/b/a/Jackpot Food Mart to be used by the City of Moses Lake for the
purchase of a Varda Silent Alarm System was read by title only.
Action Taken:Mr.Edwards moved that the resolution be adopted,seconded by
Mr.Rimple,and passed unanimously.

VII.REFERRALS FROM COMMISSIONS
MOSES LAKE SPORTS COMPLEX PRELIMINARY PLAT
Mick Hansen,representing the Moses Lake Sports Complex,has submitted a two J/JC
lot preliminary plat located south of and adjacent to the Moses Lake High
School.The sports complex will include a sunken footbal1/track stadium with
seating for approximately 17,100 people,parking,and future additional ath
letic fields.The Planning Commission recommended to Council that the plat be
approved as follows:
1.The preliminary plat be approved with variances to defer the construction
of all street and utility improvement requirements listed in the City
Engineer's October 26,1987 review,with the requirement that a covenant
be attached to the land requiring future street and utility improvements
as stipulated in the City Engineer's October 26,1987 comments at such
time as required by the city.The City Engineer's comments also ask for
a traffic study because this project may require a traffic light at Kit-
tleson and Highway 17.Therefore,the developer is required to prepare a
traffic study when requested by the city and to help pay for any traffic
control improvements required by the completed study.

2.A variance be approved so that Lot 2 is not required to front on an im
proved city street.
3.That adequate water mains be installed to the site to provide maximum
available fire flow regardless of when the utility covenants are called
in by the city.
4.A variance be approved allowing an all weather shot coat application as a
temporary road surface improvement for Clover Drive and the access ease
ment until Yonezawa Boulevard is constructed.If the right-of-way and
funding for the construction of Yonezawa Boulevard were to be secured
before the Sports Complex improves Clover Drive with a shot coat,the
Sports Complex would then like to switch funding from Improvement of the
Clover Drive access to assist the city in the construction of Yonezawa
Boulevard.However,if Yonezawa Boulevard is not built prior to the
development of the Sports Complex,the Clover Drive access to the Sports
Complex could become a secondary access point,primary access being from
Yonezawa Boulevard,after Yonezawa Boulevard is constructed.
There was some discussion by the Council on the requested variances.
Bob Crosthwaite,representing the previous landowners,Ms.Michel and Ms.
Campbell,requested that the Council not obligate them for any expenditure of
funds for the project.
Action Taken:Mr.Reese moved that preliminary plat be approved as recommen-
ded by the Planning Commission,and the Findings of Fact be accepted,seconded
by Mr.Frederickson.
Mr.Rimple stated that he was concerned about the requests 1n the future for
development of ball fields and other recreational areas,future access,etc.
He stated that he was concerned about the variances being granted for street
improvements since the city has no standards for one or two shot oiled roads.
The motion passed unanimously.
ICE SKATING PROJECT
The Park and Recreation Advisory Commission has recommended that a pilot ice
skating project be tried at McCosh Park on the old concrete tennis courts.
The primary purpose of the project this winter would be to determine if hose
spraying techniques will work to build ice for skating in our area.If the
ice making is 1s successful,some public skating would be scheduled.Staff
and the Commission will evaluate the success of the effort next spring and
determine if it is feasible to develop a larger scale program for skating for
the winter of 1988-89.
Action Taken:Mr.Edwards moved that the Park and Recreation be granted ap-
proval for the ice skating project,seconded by Mr.Biallas,and passed
unanimously.
VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION
RANDOLPH ROAD SEWER PROJECT -ACCEPT WORK
Marchand Construction has satisfactorily completed the Randolph Road Sewer
Project.Staff recommends the project be accepted and the city enter into the
required 30 day lien period.
Action Taken:Mr.Edwards moved that the work be accepted and the 30-day lien
period entered,seconded by Mr.Reese,and passed with Mr.Frederickson
opposed.
CASCADE PARK -IAC GRANT ACCEPTANCE
The Interagency Committee for Outdoor Recreation approved the city's grant
application for Cascade Park boating related improvements.
Action Taken:Mr.Edwards moved that the City Manager be authorized to sign
the agreement with the IAC,seconded by Mr.Johnson,and passed with Mr.
Frederickson opposed.

X.CITY MANAGER REPORTS AND COMMENTS
THIRD AND BEECH INTERSECTION
The Engineering Division made a study of the intersection of Third Avenue and ///7
Beech Street to determine if a signal light is needed.The study's conclusion
is that a traffic signal is not needed at this time because the traffic war
rants do not justify a signal.
The regular meeting was adjourned at 10:20 p.m.

3.The plat is for a 60.5 acre,two lot subdivision.Lot 1 is a flag lot of
33.9 acres with 30'of frontage on the proposed Yonezawa Boulevard.Lot
2 is 26.6 acres and fronts upon the proposed Kittleson Road.
4.Major access is proposed through an existing 60'access easement to
Clover Drive from Lot 1.Right-of-way has been dedicated and deeded to
the city for Yonezawa Boulevard,a presently non-existent street.Clover
Drive is a gravel road.The Kittleson Road right-of-way,along the sec
tion line,was given to Adams County years ago as Atwood Road.The city
does not maintain the right-of-way west of Clover Drive.
5.The area is zoned Agriculture.
6.Extension of sanitary sewer and water mains,storm drainage,and street
improvements will be required to and through the proposed plat.A
variance has been requested to the requirement that the subdivision front
on an existing city street.
7.At their meeting on August 13,1987 the Planning Commission approved a
conditional use permit allowing the construction and operation of the
proposed sports complex.
8.At their meeting on July 30,1987 the Planning Commission declared this
project to have a non-significant adverse impact on the environment.
9.A public hearing scheduled upon notice before the Planning Commission on
the issue of platting the land in question was held on November 5,1987.
10.Written comments were received from the City Engineer as follows:
Plat
A.The 80 foot Yonezawa Boulevard right-of-way is not shown on the
plat;the 40'right-of-way on the north edge of the plat is part of
this right-of-way.Show the name of the street on the plat and site
plan.
B.Show Yonezawa Boulevard right-of-way on the vicinity map.
C.Show the name of Clover Drive on the plat and the site plan.
D.Show Kittleson Road on the plat,vicinity map,and site plan.Kit
tleson Road is a public road granted to the county and previous
known as Atwood Road No.608.
Kittleson Road is shown as a 60'right-of-way located on the north
side of the section line.The existing right-of-way is 30'on each
side of the section line.
The angle in the road at the intersection of 1-90 right-of-way does
not met community standards.A minimum 200'radius is required by
city ordinance.Washington state standards for cities requires a
minimum 715' centerline radius.
E.Water,street,storm drainage and sewer are required to be extended
to and through the plat.At present the plat is not served by city
utilities and streets bordering on the plat are not improved to com
munity standards.The following street and utility improvements are
required by city ordinance:
Street and storm drainage on Yonezawa Boulevard and Kittleson
Road.
Water and sewer utilities on Yonezawa Boulevard and Kittleson
Road.
All lots are required to be served by city water.
A cul de sac is required on the end of Kittleson Road.

If Yonezawa Boulevard is not improved as part of this plat,Lots 1
and 2 will not front on improved city streets.The city presently
owns the right-of-way for Yonezawa Boulevard,adjacent to this plat,
but no street exists in that right-of-way and the city does not
maintain it.The access to the west on Yonezawa Boulevard is a 1/2
width improved street and accesses into a residential area.If
Yonezawa Boulevard is not improved to Pioneer Way,as part of this
complex,this westerly access should be blocked.
Lot 2 has an access to Clover Drive.Clover Drive is a gravel
street and not presently improved to handle the traffic from the
proposed complex.Clover Drive should be improved to city standards
prior to the completion of construction of this project.The
developers should be responsible for their impact on this street.
This could include signalization at Clover Drive and Pioneer Way
and/or Kittleson Road and SR 17.
The Kittleson Road right-of-way,along the section line,was given
to Adams County many years ago as Atwood Road.The city does not
presently maintain the right-of-way west of Clover Drive.
A traffic study should be required as part of this proposal to show
the impact of the proposed complex on adjacent residential and ar
terial streets.
You may request a variance from these requirements.The variance
must be approved by the Planning Commission and City Council.This
complex will generate significant traffic and will impact the area.
Direct access must be provided to the city arterial streets.Move
ment of traffic through residential areas is unacceptable.Streets
must be improved to handle the proposed traffic.

11.A public hearing scheduled upon notice was held on November 5,1987.
12.Mick Hansen wanted to know what the Commission intended with the word
paved.He stated that there would not be much foot traffic,especially
along Kittleson Road and felt a county road improvement would be suffi
cient.He pointed out that Yonezawa Boulevard is within 600'of the
project and if it is ever constructed that would be the ideal access
point to the complex.They do not want to construct Kittleson with full
width pavement,curbs,gutters,and sidewalks if in a few years most ac
cess will be from a different street.
13.Mrs.Kvamme wanted to know if Yonezawa could be improved instead of
Clover and Kittleson.
14.Joseph K.Gavinski,City Manager,stated that Yonezawa is an arterial and
it is the city's responsibility to construct arterials.He stated that
agreements have been worked out with developers to help construct ar
terials if it would be to their advantage.The developers are required
to pay for a normal full width street with curbs,gutters,and sidewalks
and the city pays for the oversizing.

15.There was considerable discussion by the Planning Commission on the pos
sibility of approving variances for street and utility improvements.
Since access to the site has not yet been determined,it was the consen
sus of the Commission that the plat be approved as submitted and the
developer can request variances at a later date if desired.
16.The Planning Commission recommended to the City Council that the Moses
Lake Sports Complex Preliminary Plat be approved with the stipulation
that the City Engineer's comments be addressed.
17.At their meeting on November 12 the Planning Commission considered the
following variances requested by the proponent:
A.A variance be granted for the construction of all of the utilities
on Kittleson Road be deferred until such time as the city deems
necessary for these improvements to be constructed.This variance
would allow for a more unified construction program on Kittleson
Road.The construction of these utilities would include a deferment
of street and storm sewer construction,the deferment of water and
sewer utilities construction,and the deferment of the cul-de-sac
construction required at the end of Kittleson Road.
B.A variance that Lot 3 shown on the preliminary plat,which will be
re-numbered to Lot 2 in the final configuration not be required to
have frontage on an improved city street.The right-of-way for Kit
tleson Road will be granted meeting the city requirements for the
extension of Kittleson Road.
C.That a waiver of the full city standards be granted for the con
struction of an access road into the site from Clover Drive.The
decrease in city standards would amount to allowing a shot coat type
of surface to be placed on the access road into the site from the
intersection of Clover and Highway 17.This variance for a substan
dard city street request and authorization to construct the access
to the Moses Lake Sports Complex along Clover Drive and then wester
ly to the mid-point of the Moses Lake Sports Complex would provide
access to the Sports Complex until such time as the city or future
developers in the vicinity of Yonezawa Boulevard extended to develop
a plan and secure the necessary right-of-way for the extension of
the Yonezawa Boulevard.If the right-of-way and funding for the
construction of Yonezawa Boulevard were to be secured,the Moses
Lake Sports Complex Association would like to then switch their
funding from the construction of the Clover Drive access to assist
the city in the construction of Yonezawa Boulevard.However,if
that does not materialize prior to the development of the Moses Lake
Sports Complex then the Clover Drive access to the Sports Complex
could then become a secondary point of access with the primary ac
cess being from Yonezawa Boulevard after Yonezawa Boulevard is
constructed.
18.The area will be served by sewer and water as sewer and water service
will have to be provided to the platted area as required by the state
health rules and regulations.An occupancy permit cannot be issued until
sewer and water is provided to the development.
19.The City Engineer has indicated the following improvements to the plat
are required:
A.Street and storm drainage on Yonezawa Boulevard to city standards
B.Extension of sewer main on Yonezawa Boulevard to city standards
C.Street and storm drainage on Kittleson Road to city standards
D.Extension of sewer and water mains on Kittleson Road through the
plat to city standards
E.Construction of a cul de sac at the end of Kittleson Road to city
standards
F.Access to the stadium area must be paved to city standard including
Clover Drive and the access easement

J.Signalization at Clover Drive and Pioneer Way and/or Kittleson Road
and Highway 17 may be necessary.A traffic study should be required

20.The Fire Department has indicated that the Uniform Fire Code requires
access roads for emergency equipment be designed and maintained to sup
port the weight of the vehicles and be provided with a surface that pro
ves all-weather driving capabilities.The heaviest piece of equipment
the city owns is approximately 34,000 lbs.Requirements for fire hy
drants and fire flow cannot be determined until construction plans are
submitted.Water mains for fire hydrants will be required to be extended
to and through the plat at such time.
21.The Planning Commission recommended to Council that the variances of the
subdivision requirements as stipulated by the City Engineer be granted
with the stipulation that adequate water mains be installed to provide
maximum available flow for fire protection,one primary access road
(either Clover Drive and the easement or Yonezawa Boulevard)be con
structed of a shot coat type surface to accommodate the 34,000 lb.fire
truck during all weathers,and a covenant be attached to the land requir
ing future street and utility improvements as stipulated in the City En
gineer's comments at such time as required by the city,seconded by Mr.
Law.
22. Mrs.Kvamme wanted to know if Yonezawa Boulevard would have to be im
proved by the developer or the city.
23.Joseph K.Gavinski,City Manager,stated that it is the city's respon
sibility to construct arterials but arrangements have been worked out
with developers when the arterial could be included in a plat to allevi
ate traffic circulation problems within the plat.
24.Mr.Skinner stated that the School District has indicated they would do
nate an additional 30'on the west side of their property so that the
access from Yonezawa Boulevard would be 90'wide in that area.They have
also indicated they would donate 120'on the east side for an access on
that side,he pointed out that if Yonezawa Boulevard were to be con
structed before the access from Clover is built,the developers would
prefer to participate in that and eliminate the Clover Drive access route
as a primary means of access to the stadium.
25.Mr.Bernd stated he was concerned about pedestrian and bicycle traffic
and wanted to know if the roads would be wide enough to accommodate them
or if a bike/pedestrian path would be provided.
26.Mr.Skinner stated that the bike and pedestrian traffic would be directed
in the opposite direction of the traffic as the residential areas are on
the other side of the stadium from the access roads.
27.Mick Hansen,developer,stated that they will be using some of the base
rock from the excavation on the roads through the school district proper
ty for use by pedestrians and bicycles.
28.On November 24,1987 the City Council set December 8,1987 as the date to
consider this preliminary plat.
29.On December 8,1987 the City Council considered the Moses Lake Sports
Complex Preliminary Plat.
30.The Planning Commission recommended to Council that the plat be approved
as follows:
A.The preliminary plat be approved with variances to defer the con
struction of all street and utility improvement requirements listed
in the City Engineer's October 26,1987 review,with the requirement
that a covenant be attached to the land requiring future street and
utility improvements as stipulated in the City Engineer's October
26,1987 comments at such time as required by the city.The City

Engineer's comments also ask for a traffic study because this proj
ect may require a traffic light at Kittleson and Highway 17.There
fore,the developer is required to prepare a traffic study when re
quested by the city and to help pay for any traffic control improve
ments required by the completed study.
B.A variance be approved so that Lot 2 is not required to front on an
improved city street.
C.That adequate water mains be installed to the site to provide maxi
mum available fire flow regardless of when the utility covenants are
called in by the city.
,D.A variance be approved allowing an all weather shot coat application
as a temporary road surface improvement for Clover Drive and the
access easement until Yonezawa Boulevard is constructed. If the
right-of-way and funding for the construction of Yonezawa Boulevard
were to be secured before the Sports Complex improves Clover Drive
with a shot coat,the Sports Complex would then like to switch fund
ing from improvement of the Clover Drive access to assist the city
in the construction of Yonezawa Boulevard.However,if Yonezawa
Boulevard is not built prior to the development of the Sports Com
plex,the Clover Drive access to the Sports Complex could become a
secondary access point,primary access being from Yonezawa
Boulevard,after Yonezawa Boulevard is constructed.
31.There was some discussion by the Council on the requested variances.
32.Bob Crosthwaite,representing the previous landowners,Ms.Michel and Ms.
Campbell,requested that the Council not obligate them for any expendi
ture of funds for the project.
33.Mr.Rimple stated that he was concerned about the requests in the future
for development of ballfields and other recreational areas,future access,
etc.He stated that he was concerned about the variances being granted
for street improvements since the city has no standards for one or two
shot oiled roads.
CONCLUSIONS
1.The City Council of the City of Moses Lake is vested with the authority
and has the jurisdiction under the law to approve a preliminary plat
within the city's corporate limits if the criterion required by law is
met.
2.There appears after the public meeting before the City Council on Decem
ber 8,1987 no opposition to its approval.
3.The City Council is cognizant of the need to serve the welfare and best
interests of the entire community,and believes that this plat will serve
the best interests of the residents of the City of Moses Lake and bears a
substantial relationship to the public welfare of the entire community.
DECISION
1.The Moses Lake Sports Complex Preliminary Plat is approved as recommended
by the Moses Lake Planning Commission
