1988 09 064240 CITY COUNCIL CITY OF MOSES LAKE SPECIAL MEETING September 6,1988 Members Present:Wayne Rimple,Roger Biallas,Norm Johnson,Bill Reese, Charles Edwards,David Chandler,and Bill Frederickson I.CITIZEN INPUT -None II.CONSENT AGENDA -None III.CONSIDERATION OF BIDS -None IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS -None V.ORDINANCES AND RESOLUTIONS RESOLUTION -ULID4 PUBLIC HEARING DATE A resolution was presented which set September 27 as the date for a public hearing to consider a ULID for the Basin Homes area./^V0> The resolution of the City Council of the City of Moses Lake declaring its intention to improve Larson Plat,Larson Plat No.2,Replat of Block 2 Larson Plat No.2,SW 1/4 SW 1/4 SW 1/4 of Section 10,Township 19 North Range 28 EWM,and Tract 42 Park Orchard Tracts by constructing and installing a sani tary sewer system and connecting to existing sanitary sewer at Edgewater Lane and to create a utility local improvement district to assess the cost and ex pense of said improvements against property in such district specially bene fited thereby,and to notify all persons who may object to said improvement to appear and present their objections at a regular meeting of the City Council to be held on September 27,1988 at 8 p.m.was read by title only. Action Taken:Mr.Johnson moved that the resolution be adopted,seconded by Mr.Edwards,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS - None VII.REFERRALS FROM COMMISSIONS - None VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION REAL ESTATE CONTRACT -THOMPSON A real estate contract and escrow agreement with Carl and Minnie Thompson was //)*/{) presented.The documents relate to the city's purchase of property adjacent '<s/u to Larson Playfield. Action Taken:Mr.Johnson moved that the City Manager be authorized to ex ecute the real estate contract and escrow agreement,seconded by Mr. Frederickson,and passed unanimously. SIDEWALK -SYFORD Herbert Syford is requesting permission to install trees in the sidewalk adja-_ cent to his property by removing concrete to allow for the planting of the /OV<s trees and by removing a concrete strip to allow for the installation of an irrigation line.He does not intent to replace the sidewalk or the removed concrete strip with pavers at this time.He is requesting that a brick planter be installed around the trees so that other shrubbery could be plant ed.He has requested that the city pay for the irrigation line. After some discussion it was the consensus of the Council that the existing ordinance establishing standards for sidewalk improvements in the downtown area be adhered to. Action Taken:Mr.Reese moved that the request from Mr.Syford be denied, seconded by Mr.Johnson,and passed unanimously. IQO^ 4241 CITY COUNCIL MINUTES:2 September 6,1988 KITTLESON &HIGHWAY 17 TRAFFIC SIGNAL -APPEAL At their meeting on August 25,1988 the Planning Commission considered an En vironmental Checklist by Shiloh Inns for a proposed motel and restaurant lo cated near the intersection of Kittleson Road and Highway 17.The Commission declared the project to have a non-significant adverse impact on the environ ment with the stipulation that a signal warrant analysis be prepared and sub mitted to the Department of Transportation and the City Engineer and any im- provements required as a result of the signal warrant analysis be constructed or guaranteed before a building permit is issued. Shiloh Inns has appealed this decision which may,in effect,require them to install traffic signals at the intersection of Highway 17 and Kittleson Road. If the signals are required,Shiloh Inns is requesting that they be paid for by some other party. Rodger Forni,representing Shiloh Inns,stated that their budget cannot handle the cost of installing a $100,000 traffic signal along with the motel,res taurant,and other planned facilities.He felt that the traffic is an exist ing problem and did not feel Shiloh Inns should be required to pay the entire cost to alleviate it. Michael Riggs,who prepared the traffic analysis,explained it to the Council. Dave House,Department of Transportation,stated that by law it is the respon sibility of the DOT to install and maintain signals in cities under 15,000 population.With funding so limited,however,the DOT would prefer to see the cost of the signal shared with the city or developer.He pointed out that the DOT is concerned with safety and the smooth flow of traffic and it has not yet been determined that a signal is needed in this area. There was considerable discussion by the Council. Action Taken:Mr.Biallas moved that the decision of the Planning Commission be modified to declare the project to have a non-significant adverse impact on the environment with the condition that a traffic warrant analysis be prepared and submitted to the Department of Transportation and the City Engineer and any improvement,such as but not limited to a traffic signal,required as a result of the signal warrant analysis be paid for by the Department of Transportation and that a building permit be issued to Shiloh Inns after the signal warrant analysis is completed,seconded by Mr.Johnson,and passed unanimously. The reason for the modification of the Planning Commission's decision is that 3> it does not seem warranted for the developer to have to pay the expense of CD installing the traffic signal.C_ LIBRARY BUILDING USE AND MAINTENANCE AGREEMENT qj The North Central Regional Library District has presented anew Building Use (Jl and Maintenance Agreement.This agreement requires the city to provide library quarters in order to be reimbursed for a portion of its maintenance and operation costs.The existing agreement provides reimbursement for a por tion of the maintenance and operation costs if the city provides library quarters.The new agreement would increase the amount of reimbursement the city would receive but would not release,indemnify,or hold harmless the city from the negligence of the District's employees.He pointed out that if the proposed new contract is not signed,the old contract remains in effect. No action was taken by the Council. IX.COUNCIL QUESTIONS AND COMMENTS -None X.CITY MANAGER REPORTS AND COMMENTS D.A.R.E.PROGRAM Joseph K.Gavinski,City Manager,informed the Council that September 20 hasbeensetasthedatetomeetwiththeSchoolDistricttodiscusstheD.A.R.E. program. a ) CITY COUNCIL MINUTES: 3 SALES TAX/TRANSIENT TAX 4242 September 6,1988 Joseph K.Gavinski,City Manager,distributed a schedule of the sales tax received by the city since 1979.A scheduled showing the transient tax received by the city since 1985 was also distributed. The special meeting was adjourned at 10:20 p.m.
