1979 02 272810 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING - REGULAR SESSION FEBRUARY 27,1979 POLICE/COUNCIL FACILITY 8 P.M. Members Present:Barry Ziegler,Eric Skaug,Kent Jones,Steve Shinn,Bob Hill, Don Swanson,and Jim Barney Mr.Jones moved that the minutes of the meeting of February 20 be approved as submitted,seconded by Mr.Shinn,and passed unanimously. APPROVAL OF BILLS REGULAR BILLS AMOUNT GENERAL $46,015.80 STREET 8,275.51 WATER/SEWER 21,904.79 SANITATION 1,085.33 EQUIPMENT RENTAL 14,669.82 FIREMEN'S PENSION 1,552.02 U.I.C.RESERVE 126.32 MUNICIPAL RESERVE 1,275.00 TOTAL $94,904.59 Mr.Jones moved that the bills be approved as submitted,seconded by Mr.Barney,and passed with Mr.Hill abstaining from voting for that portion of the bills to Pacific Northwest Bell.Warrants 7462 to 7528 were approved for payment. I.CITIZEN INPUT None II.CONSENT AGENDA Mr.Skaug moved that the following items on the Consent Agenda be approved: 1.Completion of Project -Winona Lift Station -30 day lien period to be entered/03^~ 2.Equipment Bid for Sub-Compact Pickup -awarded to Moses Lake Ford /o/7 seconded by Mr.Barney,and passed unanimously. III.CONSIDERATION OF BIDS None IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS None V.ORDINANCES AND RESOLUTIONS ORDINANCE -BUMGARDNER ANNEXATION - 1ST READING /o&f A letter was read from Stan Bech,Community Development Director,which stated that the ordinance calls for all property annexed to to assessed and taxed at the same rate and on the same basis as other property within the city and to be zoned 1-1, Industrial. The ordinance providing for the annexation of certain territory to the City of Moses Lake,Washington,and incorporating the same within the corporate limits thereof, providing for the assumption of existing indebtedness and zoning was read by title only. 2811 CITY COUNCIL MINUTES:2 February 27,1979 Ralph Kennison,representing a non-record property owner,stated that they opposed the annexation as a portion of this property is in litigation. Mr.Moberg stated that whether or not this piece of property is annexed into the city has no bearing on the decision of the court.The interest that Mr.Rathbone may have in this plat is the 100 feet along East Broadway and does not come close to the portion of land being annexed. Mr.Kenison stated that this property was proposed for platting,but only that portion south of the railroad right-of-way.Mr.Bumgardner decided to plat the — whole parcel and Mr.Rathbone filed suit against him.The court ordered that the | owners proceed with the original plat.; 0° \°' Mr.Jones moved that the annexation request be tabled,seconded by Mr.Ziegler. Mr.Moberg stated approval on the plat Mr.Kennison is talking about expired it was not completed within the time limit.Therefore,a new plat was initii because iated.A portion of that new plat was in the county and it was decided that the best thing to do would be to annex it into the city. The motion failed with Mr.Jones and Mr.Zieqler in favor and Mr.Barney,Mr.Swanson, Mr.Skaug,and Mr.Hill opposed.Mr.Shinn abstained. Mr.Skaug moved that the first reading of the ordinance be adopted,seconded by Mr. Hill,and passed with Mr.Skaug,Mr.Barney,Mr.Swanson,and Mr.Hill in favor,and Mr.Ziegler and Mr.Jones opposed,and Mr.Shinn abstaining. ,_j PUBLIC HEARING -ORDINANCE -CORNING ANNEXATION - 1ST READING The public hearing was opened. A letter was read from Stan Bech,Community Development Director,which stated that the ordinance calls for all property annexed to be assessed and taxed at the same rate and on the same basis as other property within the city and to be zoned R-l, Single Family Residential. Janet Riese,920 Lagoona,stated that the Washington State Department of Ecology has denied a Shorelines Management Substantial Development Permit for this project,and that she is opposed to it.Mrs.Reese presented a letter from Joe and Judy Rogers which requested that the annexation be tabled until the developer has submitted a plan that describes clearly,thoroughly,and firmly,the character of the development, Floyd Swenson,928 Lagoona,stated that he is concerned about the possible dust problem during construction. Glen Corning stated that he would like this annexation put on ice until some of these things have been cleared up.He stated that he has a Shorelines Permit from the County and that the DOE is fighting with the county. There were no further comments,so the public response was closed. A letter was read from Benjamin Brown which opposed this annexation. Mr.Jones moved that the public hearing be continued to March 13,1979,seconded by Mr.Skaug,and passed unanimously. ORDINANCE - FINAL ASSESSMENT ROLL - LID #41 - 1ST READING A letter was read from M.G.McLanahan,Acting Public Works Director,which presented an ordinance accepting the final assessment roll on LID 41. The ordinance approving and confirming the assessments and assessment roll of Local Improvement District No.41 which has been created and established for the purpose of grading,graveling,constructing,and installing curbs,sidewalks,sewer side laterals,asphalt concrete pavement and storm drainage on Madison Avenue between Nelson Road and Brown Street in the City of Moses Lake as provided by Ordinance No. 870 and levying and assessing the amount thereof against the several lots,tracts, parcels of land and other property shown on said roll by title only. Mr.Shinn moved that the 1st reading of the ordinance be adopted,seconded by Mr. Hill,and passed with Mr.Swanson abstaining. 2812 CITY COUNCIL MINUTES:3 February 27,1979 RESOLUTION - PETTY CASH FUND - POLICE DEPARTMENT A letter was read from Robert Gazewood,Finance Director,which requested the establishment of a Petty Cash Fund for the Police Department. The resolution to establish an account within the General Fund to be entitled "Petty Cash Fund -Police Department"was read by title only. Mr.Barney moved that the resolution be adopted,seconded by Mr.Jones,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS NONE VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION None IX.COUNCIL QUESTIONS AND COMMENTS RESOLUTION -WRESTLING CHIEFS A resolution extending recognition to Ron Seibel,Jamie Wise,and the Moses Lake Wrestling Chiefs was read in its entirety. Mr.Ziegler moved that the resolution be adopted,seconded by Mr.Shinn,and passed unanimously. POLICE/COUNCIL FACILITY R.Douglas Zenor,City Manager,stated that the County Commissioners are working on ^3° a counter proposal to present to the city.He requested that the Council authorize the City Manager,the Mayor,and perhaps one other Councilman to meet and work with the County Commissioners on this proposal. • After some discussion it was the consensus of the Council that a dinner meeting be set up for 6 p.m.March 6 to discuss mutual problems with the Grant County Commis sioners. SOLICITING Mr.Zeigler requested that the City Manager research the legal aspects of soliciting by church affiliated groups and report back to the Council/ COUNCIL MEETINGS There was some discussion by Council on reserving the third Tuesday of the month for a regular study session instead of a regular meeting date.The City Manager was directed to look into this possibility and report back to Council. CENTRAL SCHOOL Mr.Skaug stated that he felt the city should look into purchasing Central School property and making a decision within the next 60 to 90 days on the possibility. X.CITY MANAGER REPORTS AND COMMENTS PIONEER WAY SAFETY ZONE M.G.McLanahan,Acting Public Works Director,stated that 4-way beacons will be installed at Sharon and Nelson on Pioneer Way.It will flash yellow on Pioneer and red on Sharon and Nelson.It will operate only on school days and will be off during the summer. 2813 vlP CITY COUNCIL MINUTES:4 February 27,1979 PARK AND RECREATION COMPREHENSIVE PLAN -PARKS Cecil Lee,Park and Recreation Director,gave a slide presentation on the Park and Recreation Comprehensive Plan. R.Douglas Zenor,City Manager,suggested bringing back a resolution on March 13 to adopt this Park and Recreation Comprehensive Plan.After some discussion it was the consensus of the Council that a resolution be drafted. STUDY SESSION A study session was set for March 6 at 8 p.m.to review the Peninsula Sewers, Water/Sewer Rates,and a PUD power line.
