CITY COUNCIL MEETING -REGULAR SESSION April 17,1979

Members Present:Barry Ziegler,Kent Jones,Steve Shinn,Jim Barney,Don Swanson,
Eric Skaug,and Bob Hill
Mr.Ziegler stated that the minutes of the meeting of April 10 show him as opposed
to the bid from McAtee and Heathe on the well site improvements.He stated that he
was in favor of it.Mr.Swanson stated that he was the fourth one opposed.Mr./£/(,
Ziegler also requested that the minutes show that the resolution on Plum and
Coolidge LID was tabled due to a lack of a map to show the area.Mr.Ziegler also
stated that the minutes should show that he and Mr.Hill are not opposed to the /^OO
Manta Ray's using the pool but they are opposed to the expenditure of funds to heat
the pool.
Mr.Hill stated that on the well house improvements he had originally opposed any /}{&$-
action on items 1 through 6 and that it was his impression that Mr.Skaug had moved"^"^-
that Mr.McLanahan go back to Mr.McAtee and reappraise that bid.He did not think •
that Mr.Skaug moved that the bid be approved.//73
Mr.Skaug stated that if items 1 through 6 were acceptable to Mr.McAtee that they -—•—

litMr.Jones stated that if Mr.McAtee approved what the Council did that Mr.McLanahan ,^y
had the authority to do those things.
Mr.Skaug stated that his motion was to approve it if it were acceptable to the
contractor to accept the bid award on items 1 through 6 only.
Mr.Hill felt that Mr.McLanahan was to meet with Mr.McAtee and negotiate a
difference because of the adjustments on the other items.
Mr.McLanahan stated that he had met with Mr.McAtee and he had accepted the bid
with the deletion of items 7,8, and 9.
Mr.Hill felt that the minutes were imperfectly written as he did not feel the
Council had awarded the bid on items 1 through 6 to McAtee and Heathe.He felt Mr.
McLanahan should come back before the Council with a report on his meeting with Mr.
McAtee.
Mr.Swanson stated that he understood that if items 1 through 6 were acceptable to
Mr.McAtee as he bid them they would be awarded as a contract and items 7,8,and
9 would be rebid at a later time.
Mr.Skaug moved that his motion at the April 10,1979 meeting should be changed to
read that items 1 through 6 be awarded to McAtee and Heathe,deleting items 7,8,
and 9,subject to the approval and acceptance of the contract by McAtee and Heathe,
seconded by Mr.Barney,and passed with Mr.Hill opposed.
Mr.Jones moved that the minutes of the meeting of April 10 be approved as amended,
seconded by Mr.Shinn,and passed with Mr.Hill opposed.

y ORDINANCE -AMENDING TITLE 18 (ZONING)-BUILDING HEIGHTS -1ST READING
A letter was read from Stan Bech,Community Development Director,which presented
an ordinance which would eliminate height limitations in commercial and industrial
zones.
The ordinance amending Title 18 of the Moses Lake City Code,entitled "Zoning",by
amending or repealing certain sections relating to building heights was read by
title only.
Mr.Ziegler moved that the first reading of the ordinance be adopted,seconded by
Mr.Shinn,and passed unanimously.

VI.REQUESTS TO CALL FOR BIDS
PAINT STRIPER
A letter was read from M.G.McLanahan,Acting Public Works Director,which stated
that the Public Works Department has received notification from the Traffic Safety
Commission that funds in the amount of $16,500 have been approved for purchase of a
paint striper.The negotiations for this 100%funding requests that the city make
this machine available on a rental basis to the county and other cities in the
Basin upon their request and consideration of our schedule.
Mr.Ziegler moved that staff be authorized to advertise for bids,seconded by Mr.
Barney,and passed unanimously.

VIII. OTHER ITEMS FOR COUNCIL CONSIDERATION
REQUEST TO ENTER AGREEMENT -DEPT.OF TRANSPORTATION -KETTLESON ROAD &HIGHWAY 17
INTERSECTION ~~~"_
A letter was read from M.G.McLanahan,Acting Public Works Director,which stated
that the Department of Transportation has provided Agreement GM 978 to the City of
Moses Lake whereby the state agrees to grant the city permission to construct 300
feet of roadway for entrance to the property west of Highway 17 and Kettleson Road.
This 300 foot roadway is access-controlled by the Department of Transportation and
they and the developers have agreed to construct the access road to the city's
minimum standards.
There was some discussion by the Council on this agreement.
Mr.Shinn moved that the agreement be approved subject to the agreement with the
developers for the cost,seconded by Mr.Ziegler,and passed unanimously.
REQUEST FOR CHANGE OF PUBLIC HEARING DATE -ZONE CHANGE REQUEST -HANNEMAN PROPERTY
A letter was read from Stan Bech,Community Development Director,which stated that
all parties concerned in the zone change request and the Montlake Addition #7
Preliminary Plat will be at the Council meeting on May 8.The public hearing is
requested to be changed to that date.
Mr.Skaug moved that the public hearing be changed to May 8,seconded by Mr.Jones,
and passed unanimously.

REQUEST FOR LID - PLUM AND COOLIDGE
A letter was read from M.G.McLanahan,Acting Public Works Director,which stated /£?/<£
that the city has received a petition from 69%of the property owners fronting on
Plum and Coolidge for paved streets.The staff has requested a determination of
the LID boundaries because of the USBR property involved.The Bureau will give an
easement for street purposes provided the fence will be relocated and a guard rail
installed on the west end of Terrace Avenue to protect their property,the U.S.
Government does not participate in LID's or other street improvements which border
their property.
Mr.Skaug wanted to know if the Bureau expects the city or some other agency to
bear the expense of relocating the fence and installing the guard rail.Mr.
McLanahan stated that it would be included in the LID price.
Mr.McLanahan showed the Council the boundaries of the LID and there was some
discussion on this project.
Mr.Ziegler moved that staff be authorized to prepare a resolution establishing
this LID,seconded by Mr.Jones,and passed with Mr.Hill abstaining.

X.CITY MANAGER REPORTS AND COMMENTS
PURCHASE OF EIGHT PASSENGER WAGON
A letter was read from M.G.McLanahan,Acting Public Works Director,which presented
a report on the purchase of a 1979 Caprice Wagon./o;7
Mr.Shinn pointed out that the bid was awarded excluding sales tax and he felt the
minutes should reflect that.
Mr.Shinn moved that the minutes of December 26,1978 show that the bid was for
$7,440.63 which excluded sales tax,seconded by Mr.Ziegler,and passed with Mr.
Hill opposed as he felt it was misleading to the Council not to include the sales
tax on the bid.
Mr.Hill stated that a bid was accepted for $7800 and then it was decided to add on
several items at a cost of $186.He felt that it is fooling around with the bids
and he would reject the $186 add on costs.
Mr.Ziegler stated that he agreed with Mr.Hill about adding to bids.
Mr.Ziegler moved that the Council be given a list of the bid specifications before
going to bid on vehicles,seconded by Mr.Shinn.
Mr.Shinn felt that there should be a basic bid and the options listed as alter
nates.
The motion passed with Mr.Skaug opposed as he felt this would be time consuming
and would cause petty bickerings.He felt that the details should be left to the
staff.
There was considerable discussion about the Council receiving the bid specifications.
ANNEXATION -BASE
A letter was read from R.Douglas Zenor,City Manager,which presented a list of
19 areas being reviewed by staff regarding annexation of the base.
The meeting was adjourned at 9:05 p.m.
