1979 10 092908 CITY OF MOSES LAKE MOSES LAKE,WASHINGTON CITY COUNCIL MEETING -REGULAR MEETING October 9,1979 POLICE/COUNCIL FACILITY 8 p.m. Members Present:Steve Shinn,Don Swanson,Barry Ziegler,Jim Barney,Eric Skaug,Bob Hill,and Kent Jones The meeting was called to order at 8 p.m.by Mayor Swanson. Mr.Jones moved that the minutes of the meeting of September 25 be approved as sub mitted,seconded by Mr.Barney,and passed unaimously. APPROVAL OF BILLS REGULAR BILLS AMOUNT GENERAL $20,982.45 STREET 5,503.37 WATER/SEWER 11,786.35 SANITATION 18,047.79 WATER/SEWER CONSTRUCTION 4,817.84 EQUIPMENT RENTAL 1,790.76 TOTAL $62,928.56 Mr.Shinn moved that the bills be approved as submitted,seconded by Mr.Hill,and passed unanimously.Warrants 9142 to 9254 were approved for payment. RESOLUTION -ACCEPTING $1,500 GIFT -JAPAN AIR LINES A letter was read from R.Douglas Zenor,City Manager,which stated that Japan Air Lines has donated $1,500 to the Moses Lake Park and Recreation Department to be used for the purchase of playground equipment at McCosh Park. Cecil Lee,Park and Recreation Director,showed the Council the design of the wood play structure that is proposed to be built with these funds.He stated that there is additional interest in the community to add to the structure but this would be the basic unit.It will be erected next year on the old Recreation Center site. The resolution accepting a gift from Japan Air Lines in the form of One Thousand Five Hundred Dollars for playground equipment to be placed at McCosh Park was read in its entirety. Mr.Shinn moved that the resolution be adopted,seconded by Mr.Jones,and passed unanimously. III.CONSIDERATION OF BIDS None 2909 CITY COUNCIL MINUTES:2 October 9,1979 IV.PETITIONS,COMMUNICATIONS,OR PUBLIC HEARINGS PROCLAMATION - JOB CORPS MONTH ,]3 The proclamation which set October 1979 as Job Corps Month was read in its entirety. Mr.Shinn moved that October 1979 be proclaimed as Job Corps month,sceonded by Mr. Barney,and passed unanimously. COMMUNICATION -SOFTBALL ASSOCIATIONS )D'A letter was read from the Softball Association which thanked the City of Moses Lake for helping make a successful softball season. PUBLIC HEARING -ORDINANCE -ZONE CHANGE REQUEST -VISTA ESTATES -2ND READING ,|^0 The public hearing was opened. A letter was read from R.Douglas Zenor,City Manager,which stated that Mr.Robert Stewart is requesting that Park Orchard Tracts 15 and 18 be changed from R-l, Single Family Residential,to MH,Mobile Home Subdivision. A petition was read from the homeowners in the area protesting this zone change for Park Orchard Tracts 15,and 19 even though there is a buffer zone of R-l between Vista Village and Vista Estates. Joe Gavinski,City Attorney,stated that the petition refers to portions of Park Orchards Tracts 14 and 18 which are not included in the zone change.He stated that Council should take that into consideration when considering this petition. Hugh Nielson,702 Village,stated that he was opposed to this zone change as he feels the buffer zone is useless as no one would want to built there. Jim Golly,502 Village,stated that he was opposed to the zone change. Clara Shorch,617 Village,stated that she had to sell her other home because of the proximity of mobile homes and she did not want that to happen here. Genevieve Thompson,609 Village,stated that she was opposed to it. Mr.Art Wentz,610 Village,stated that this is the quietest neighborhood in the city and he would like to keep it that way. There were no further comments,so the public response was closed. Mr.Ziegler stated that he felt it should remain R-l. Mr.Hill requested information on the buffer zone.Stan Bech,Community Develop ment Director,stated that the idea of the buffer zone on portions of Park Orchard Tracts 14 and 18 was brought out at the public hearing held by the Planning Commis sion.It was the recommendation of the Planning Commission that this buffer zone be given consideration. Mr.Jones felt that development should take place out there.He felt that this is a good piece of property for development. Mr.Hill moved that the public hearing be closed,seconded by Mr.Ziegler,and passed unanimously. 1 nTherewassomediscussionbytheCouncil. Mr.Hill moved that the zone change request be denied,seconded by Mr.Ziegler. Mr. Jones felt that the residents of the area did not understand what the MH zone consists of. Mr.Skaug felt this should be denied at this time as the problem of mobile homes should be considered in the Comprehensive Plan. The motion passed with Mr.Jones opposed. 2910 CITY COUNCIL MINUTES:3 October 9,1979 PUBLIC HEARING - ORDINANCE - ZONE CHANGE REQUEST - HOPE COMMUNITY CHURCH - 2ND READING A letter was read from R.Douglas Zenor,City Manager,which stated that the Plan ning Commission recommended that the zone change request for Hope Community Church //9o be granted.The church has requested that a 5 acre portion of land on the east side of the 1200 block of South Division be rezoned from Agriculture to R-l,Single Family Residential.It is proposed that a 7800 square foot church facility be built on this property. Rod Yerkza,527 Grand,stated that he was opposed to it because of the state of disrepair of Division Street. There were no further comments,so the public response was closed. Greg Bratzer,Pastor of the Hope Community Church,stated that this is one quarter of the land owned by the church.The rest of the 15 acres is zoned Agriculture. Mr.Hill moved that the public hearing be closed,seconded by Mr.Barney,and passed unanimously. The ordinance amending Section 18.09.020 of Chapter 18 of the Moses Lake City Code entitled Zoning was read by title only. Mr.Ziegler moved that the second reading of the ordinance be adopted,seconded by Mr.Jones,and passed unanimously. PRESENTATION - URS -SECOND LAKE CROSSING /Of 9 Ed Riggs of URS presented a report and discussed the plan for the proposed second lake crossing. After some discussion a study session was set for Tuesday,October 16 at 8 p.m.in the Council Chambers. V.ORDINANCES AND RESOLUTIONS ORDINANCE -AMENDING CHAPTER 6.20 -COMPENSATION OF CITY OFFICERS -2ND READING A r /Ofe A letter was read from R.Douglas Zenor,City Manager,which presented an ordinance revising the salaries received by the Mayor and Councilmen. The Ordinance amending Chapter 6.20 of the Moses Lake Municipal Code entitled "Compensation of City Officers"by increasing the compensation of the Mayor and Councilmen was read by title only. Mr.Ziegler moved that the second reading of the ordinance be adopted,seconded by Mr.Shinn,and passed unanimously. ORDINANCE - ANNEXATION - WESTLAKE AREA - POPLAR SANDS - 2ND READING A letter was read from R.Douglas Zenor,City Manager,which presented a proposed zoning plan for the Poplar Sands annexation in the Westlake area. Mr.Zenor stated that a public hearing is necessary for the adoption of the zoning plan and recommended that the annexation also be postponed for two weeks. Mr.Ziegler moved that this annexation and zoning be tabled for two weeks,seconded by Mr.Jones,and passed unanimously. ORDINANCE - CAT CONTROL - 1ST READING lit*6AletterwasreadfromJosephGavinski,City Attorney,which presented an ordinance which permits the city to impound and dispose of cats. The ordinance amending Chapter 6.04 of the Moses Lake Municipal Code entitled Dogs by adding a new section which permits the City of Moses Lake to accept cats for impoundment and disposition was read by title only. Mr.Hill moved that the first reading of the ordinance be adopted,seconded by Mr. Ziegler,and passed unanimously. 2911 CITY COUNCIL MINUTES:4 October 9,1979 ORDINANCE -AMENDING 1979 BUDGET -COMMUNITY DEVELOPMENT BLOCK GRANT FUND -1ST READING .^A letter was read from R.Douglas Zenor,City Manager,which presented an ordinance \which establishes a special revenue fund for the Community Development Block Grant. The ordinance establishing a special revenue fund as required under Title I of the Housing and Community Development Act of 1974 and conditions of the grant agreement was read by title only.- Mr.Barney moved that the first reading of the ordinance be adopted,seconded by Mr.Ziegler,and passed unanimously. RESOLUTION -MILWAUKEE RAILROAD SERVICE ,u \V A letter was read from R.Douglas Zenor,City Manager,which presented a resolution V which sets forth the concerns of the Milwaukee Railroad situation. The resolution relating to rail service to the City of Moses Lake was read in its entirety. Mr.Jones moved that the resolution be adopted,seconded by Mr.Ziegler,and passed unanimously. VI.REQUESTS TO CALL FOR BIDS None VII.REFERRALS FROM COMMISSIONS None VIII.OTHER ITEMS FOR COUNCIL CONSIDERATION REMODEL AND UTILIZATION OF OLD POLICE FACILITYr\-—————————————————^-^———^— \p"A letter was read from R.Douglas Zenor,City Manager,which presented a plan for utilizing the old Police Building.This plan calls for remodeling the facility which will cost approximately $8,000.A portion of the building wfll be rented which will generate approximately $6,000 during a period of 36 months. Russ Beeman,Fire Chief,explained the remodeling to the Council. Mr.Hill moved that permission be granted for staff to proceed with this remodel ing,seconded by Mr.Shinn,and passed unanimously. 0 \\& CONFIRMATION OF APPOINTMENT TO PARK AND RECREATION ADVISORY COMMISSION A letter was read from Donald Swanson,Mayor,which requested Council confirmation of the appointment of Charles Krueger to the Park and Recreation Advisory Commis sion.Mr.Krueger will fill the unexpired term of Collins Griffith. Mr.Jones moved that Mr.Charles Kruger be appointed to the Park and Recreation Advisory Commission,seconded by Mr.Hill,and passed unanimously. REQUEST TO PURCHASE SEWER PIPE A letter was read from Robert E.Townsend,Public Works Director,which requested authorization to purchase sewer pipe for a submarine crossing of Parker Horn.The proposal is to buy the pipe and stockpile the materials until it is installed at a later date.This request to purchase the pipe is to protect the city against additional rising material costs. Mr.Ziegler moved that staff be authorized to purchase the sewer pipe,seconded by Mr.Barney,and passed unanimously. LJ 2912 CITY COUNCIL MINUTES:5 October 9,1979 ANIMAL CONTROL FACILITY COMMITTEE -MAYORIAL APPOINTMENT "93AletterwasreadfromR.Douglas Zenor,which requested that the Mayor appoint a committee of two Councilmen to meet with the Humane Society and city staff for the purpose of discussing the Humane Society's further involvement in the Animal Control process within the City of Moses Lake.Mayor Swanson requested that Mr. Ziegler and Mr.Hill form the committee. Mr.Shinn moved that Mr.Ziegler and Mr.Hill be appointed to this committee, seconded by Mr.Barney,and passed unanimously. AUTHORIZATION TO INVESTIGATE NEW ANIMAL CONTROL FACILITY joP^ A letter was read from R.Douglas Zenor,City Manager,which requested permission to formally request the Job Corps participate in the process of reviewing a new Animal Control Shelter.The Job Corps would be participating in the construction process. Mr.Ziegler moved that permission be granted,seconded by Mr.Shinn,and passed unanimously. IX.COUNCIL QUESTIONS AND COMMENTS None X.CITY MANAGER REPROTS AND COMMENTS WELL 21 -INSURANCE CLAIM /Orf R.Douglas Zenor,City Manager,reported that Well 21 which is located near the Grant County Airport was was damaged by lightening in the summer of 78.A claim was presented to the Safeco Insurance Co.for damages in the amount of $7,991.48. The insurance representative brought in a claim check dated August 30,1979 in the amount of $6,991.48.This amount is less the $1,000 deductible.This is presented to the Council for information only. REPORT ON SURPLUS AUCTION /o/y R.Douglas Zenor,City Manager,reported that the city participated in a govern mental auction on September 22,1979.The city received $6,285 from surplus equip ment.The city's participation in the commission fee of the auction was approxi mately $440.Therefore,the net to the city was approximately $5,845.This is for Council information only. TRAVEL REQUEST FOR FIRE CHIEF /.?.?0 A letter was read from R.Douglas Zenor,City Manager,which presented a request for authorization for the Fire Chief to attend a seminar in Eugene Oregon.This seminar is designed to increase the effectiveness of voluntary fire forces. Mr.Swanson moved that permission be granted,seconded by Mr.Ziegler,and passed unanimously. GRAPE DRIVE PAVING R.Douglas Zenor,City Manager,reported that Columbia Consolidated was the only bidder for paving the streets in Sage Heights No.1 of which the city will be paying for the extra right-of-way width construction from Arterial Street Funds. The developer is required to provide an asphalt paving width of 57 feet instead of the usual 33'paving width for residential streets,therefore,the city is paying for 24 feet of extra width of crushed stone and asphaltic concrete over a total length of 631 feet. JUNIOR WOMEN'S CLUB CIVIC PROJECT R.Douglas Zenor,City Manager,stated that the Junior Women's Club has agreed to paint the blue inserts of the City Hall building and the Adam East Museum as a Civic Center project.The Junior Women's Club will supply the labor and the mater ials will be supplied by the city.The painting will take place Saturday,October The meeting was adjournjed at 10:30 p.m. Donald t.Swanson,Mayor
