1970 03 24S i ! u I 14S2 COUNCIL MEETING -Regular Session March 24,1970 Council Chambers 8 o'clock PM Present were:Bill Moe,Norman Johnson,Gordon Ebbert,Dr.Lindell and Michael Boyle. Not present:Bob Hill and Otto Skaug. Due to the absence of Mayor Otto Skaug,Gordon Ebbert was elected as Mayor Pro Tern. Mayor Ebbert called the meeting to order.Minutes of the previous meeting of March 10,1970 were approved as wrtiten upon a motion by Dr.Lindell.Second by Bill Moe.Carried. SPECIAL BILLS -NONE Warrant'No's.4094 through 4163 in the amount of $14,487.08 were approved for payment. ORDINANCE GRANTING FRANCHISE TO GRANT COUNTY PUD #2 (SecondReading) City Manager,Chester L.Waggener,stated that the terminolbgy of Section 9 of the Ordinance has been questioned by the PUD attorney,and as yet not had an opportunity to be cleared by the PUD attorney and the City Attorney,and suggested postponing the second reading until the terminology is clarified. The City Council concurred by delaying the second neading of the ordinance. REQUEST FOR TAXI LICENSE A letter was read from Paul J.Manor,operator of the Moses Lake Cab Company, requesting a closed meeting with the City Council pertaining to theCouncil's consideration of a request for another taxi license in the City. Attorney Peterson was present and asked to be heard on behalf of Mr.Reeves in regard to his request for the taxi license,and he also suggested meeting in private with the Council. He also presented two petitions containing approximately 100 signatures from people resiging at Grant CountyAirport and approximately 150 signatures from people residing in Moses Lake,requesting 24 hour taxi service in the City of Moses Lake.The petitions,he felt,constituted adequate evidence that a mini-bus would be favorable to operate between the Grant County Airport and the City of Moses Lake,and also evidence from the petitions signed that there is sufficient business for Mr.Reeves to operate a taxi in Moses Lake on a 24-hour basis.Mr.Reeves has applied to the Depart ment of Utilities and Transportation for a license to operate at theGrant County Airport,which at the present time is pending.The only request would be for a business license in Moses Lake to discharge passengers in the City.He plans to pick up passengers at the Grant County Airport, proceed through the housing area there and discharge passengers at the corner of Ash and Broadway and continue down to the Greyhound Bus Depot. The taxi office will be located at 116 W.Broadway,and if a taxi stand at curb space is allowed,he will operate from the office address. Dr.Lindell suggested that Mr.Reeves break down the request into two 1453 March 24,1970 applications,that of a mini-bus service and that of a taxi service license and then the City Council could act on them individually. Mr.Reeves asked the Council to disregard the mini-bus service request for the present and make a decision on the taxi license,and the mini-bus re quest can be taken up later.Attorney Peterson suggested the Mini-bus be held in abeyance until Mr.Reeves receives his certificate from the Department of Utilities and Transportation. Motion by Bill Moe to deny the applicant the taxi license.The motion died for lack of a second. Dr.Lindell moved that the City Council meet in private with Mr.Manor and Mr.Reeves before making a decision on Mr.Reeves'application.Second by Michael Boyle.The date for the meeting was set for April 7,1970 at 7:30 P.M.Motion passed unanimously. LONGVIEW TRACTS PROPOSED WATER SYSTEM Mayor Pro Tern Gordon Ebbert explained that upon request of property owners in the Longview Tracts area,an agreement was written whereby those in favor of the City of Moses Lake furnishing water to the area,could sign.At least 90 signatures were needed before the City could consider it.The agreement has now been submitted with at least 97 legal property owner signatures in favor of receiving city water service.This constitutes 97 out of approximately 150 property owners. Mr.Fred Hinrichs submitted a petition containing over 100 signatures wishing to keep their present water system.Upon examination this was the same petition submitted in October,1969,and since then the picture has changed somewhat,and the City of Moses Lake was again approached to furnish water to the area. It was pointed out by City Manager Waggener that the City asked the people to sign an Agreement,not a Petition.This agreement is binding and runs with the property in event the property is sold.He quoted the last section of the agreement -"It is understood that the agreement is irrevocable on the part of the property owner.It is further understood that the City of Moses Lake shall incur no liability to provide water service to the Longview Tracts area unless ninety (90)property owners execute this agreement,and subject to the acceptance of this agreement by the City Council of the City of Moses Lake,Washington." He further stated that the agreementswere not circulated by the City,but by private individuals as property owners in the area. Upon inquiry by Don Copeland of 135 Parkway Drive,he was informed that fire hydrants were not included in the agreement,although T's and gate valves willibe installed for later hydrant installation. A letter was read from the Public Works Director,Richard L.Weaver,stating that a minimum of ninety property owners have agreed to hook on to the proposed system,and should the City Council decide to extend water service to the Longview Tracts area,he requested the following: 1.That the City Council authorize the Public Works Director to prepare contract plans,specifications and estimates for construction of water mains to provide domestic water service to the Longview Tracts Area. 2 .That the City Council authorize the City Manager to seek a franchise from Grant County to construct,operate and maintain a water system in the Longview Tracts area. 3 .That in order to facilitate proper construction scheduling,the City Council authorize the Public Works Department to treat all water users requesting service after June 24,1970,as subsequent users and subject n n J U March 24,1970 1454 to the requirements of Ordinance #580 of the City of Moses Lake when making service hook ups with a front foot reimbursement charge to be determined after construction is complete. Also attached to the letter was a preliminary schedule for providing water service to the Longview Tracts area. Dr.Lindell made a motion that the City of Moses Lake extend domestic water service into the Longview Tracts area and accept the requests of the Public Works Director by giving authorization according to Items 1,2 and 3 of his letter.Second by Michael Boyle.The motion carried 3 -in favor;2 -against. The schedule submitted by the Public Works Director was discussed.Plans, specifications and estimates would be submitted for Council ap proval on or about May 26,1970 with bid opening to be set for June 23,1970 and construction completion in approximately 17 weeks -approximately October 23. REQUEST FOR SPECfcL MEETING -MARCH 31,FOR APPROVAL OF PIONEER WAY PLANS /oo9 A motion was made by Norman Johnson to approve March 31,1970 as the ' date for the Special Meeting regarding Pioneer Way Plans .Second by Dr.Lindell.Passed. GASOLINE BID A letter was read from Charles Davenport, City Clerk, that joint bids of the /&'/ City of Moses Lake;the Moses Lake School District and the Port District have been received,and recommended the City Council concur in the awarding of the bids to the Shell Oil Company with the low bid of .2152 per gallon of gasoline. Motion by Gordon Ebbert to accept the Shell Oil Company bid price of .2152 per gallon.Second by Norman Johnson.Passed. SEMINAR FOR MAYORS AND COUNCILMEN A Seminar for Mayors and Counoilmen will be held at Eastern Washington ' State College at Cheney April 28-29.It is being sponsored by the Association of Washington Cities and the Planning and Community Affairs Agency.The City Manager mentioned that only the brochure had been received and presumes there will be more details to follow. meeting adjourned.
