COUNCIL MEETING -Regular Session April 14,1970
Council Chambers 8:00 o'clock PM.
Present were:Bob Hill,Bill Moe,Norman Johnson,Gordon Ebbert,
Dr.Lindell and Michael Boyle.
Mayor Otto Skaug called the meeting to order.Minutes of the March 23,1970
meeting were amended upon a motion by Bill Moe to show who voted for or against
the Longview Tracts Water Service.Second by Norman Johnson.Motion passed.
Those Councilmen in favor of furnishing domestic water to the Longview Tracts Area
were:Dr.Lindell,Gordon Ebbert and Michael Boyle.Those against:Bill Moe and
Norman Johnson.Bob Hill and Otto Skaug were absent.
Moved by Michael Bo^ile,second by Bill Moe to approve the minutes of March 24,
1970 meeting as corrected.Passed.
Minutes of the Special Meeting of March 31,1970 were approved upon a motion by
Bob Hill,second by Norman Johnson.Passed.

ORDINANCE NO.607 GRANTING FRANCHISE TO GRANT COUNTY PUBLIC UTILITY
DISTRICT NO.2 (2nd reading).
The ordinance was read by title only.The second reading was delayed at
the March 24th meeting due to clarification of the hold harmless clause for
the PUD attorneys,which has now been satisfied and accepted.

REQUEST FOR TAXI LICENSE
'3*The City Council held a private meeting with Mr.Alexander Reeves,who is
requesting a taxi license and Mr.Paul Manor,of the Moses Lake Cab Company.
Motion by Bob Hill to deny Mr.Reeves'request for a taxi license to operate
in Moses Lake,second by Bill Moe.Passed unarimously.
Mr.Reeves asked if he could appeal the decision of the City Council.He was
informed that should the Council wish to reconsider upon a member on the pre
vailing side wishing to change his vote,then it will be reconsidered;if
none is forthcoming,the action is final.
LONGVIEW TRACTS PROPOSED WATER SYSTEM
)&Mayor Skaug explained that on March 24,1970 the City Council was given
evidence with some 90-plus property owners signing an irrevocable agreement
whereby they asked the City of Moses Lake to furnish domestic water service
to the Longview Tracts area.Upon receipt of the required signatures,which
were checked for validity of ownersh ip before this date,the City Council
vot ed in favor of furnishing water to the Longview Tracts area.
Subsequently efforts have been made by an opposing group to reduce that
number by 17 or 18 with signatures on a Revocation of Water Service Agreement
submitted,which would reduce the required amount designated by the City
before it could consider undertaking the water service project.

Richard L.Weaver,Public Works Director,stated that in reviewing the City
Ordinance it showed he was in error when he required a meter per living unit
if two or more units are located on one lot,therefore,this represents an error
of 11 meters in the original count,and the total committed water meter-users
to date is 72 instead of 83 meters after subtracting 14 revocations from the 97
submitted.He also indicated there are 5 meters of owners not having signed
agreements and 3 meters not counted on the original agreement.
Bob Hill at this time called the Mayor's attention to the fac t that unless the
Council makes a motion for reconsideration of the Longview Tracts Water Project,
they are not acting rightly as a Council.
Moved by Michael Boyle to re-open and reconsider the Longview Tracts Project,
I i second by Dr.Lindell.Passed.
John Moberg,Attorney,representing Norman Vehrs of Longview Water,Inc.,
submitted another Revocation of Water Service Agreement with additional names
of two property owners in the area.
Jack Black submitted another Water Service Agreement with signatures of property
owners consisting of 17 lots or meters,apparently that the Public Works Director
did not have as yet,and 11 lots that are O.K.,but require some title clarification
due to probate,divorce or power of attorney,all of which can be cleared and
possibly could be accepted subject to title clearance according to John Lewis,
Attorney,representing the group that had signed the Water Service Agreement
with the City of Moses Lake as a binding document.
v John Lewis,Attorney,stated that Clause 5 of the Agreement states —"It is
understood that the agreement is irrevocable on the part of the property owner"
—and everyone signing did so by qualifying in every way in order to get city
water service and they cannot vacillate back and forth by signing Revocation
of Water Agreements.
At this time Mayor Skaug called for a five minute recess.Before calling the
meeting back to order,he asked the people in attendance to comply with the
President's request to offer one minute of silence,preferably in prayer,for the
Astronauts for their safe return to Earth.
The meeting was again called to order.
Dr.Lindell commented there was some confusion concerning the $125.00
fee and would the City Manager explain this once and for all.
The City Manager explained that the normal charge for connecting is a front
footage charge and $125.00 meter installation charge.In lieu of this,the
Longview Tracts people would be asked to pay a $2.00 monthly surcharge.
Did also recommend to Council that this apply only to people connecting
initially.Those comingin at a later date would be asked to pay the $125.00
meter installation charge and front footage charge,and in turn would not be
obligated to pay the $2.00 surcharge.The City would not propose to install
meters on vacant lots at this time.In the case of a trailer lot for rent and
definitely going to use water,it would be treated as a vacant house available
for rent,and considered an immediate water user.
He also explained that the City does not propose installing fire hiydrants at
this time,and therefore,would not allow the people an automatic drop in their
fire insurance rates.At present there may be four fire hydrants in the area,
which may not give good fire reduction or protection.A minimum 6"line is
required,and the 2"and 4"lines existing presently cannot meet the
requirements of sufficiently efective fire hydrants.As to property values,he
can only state that in discussion with mortgage companies,they point out that
FHA mortgages are not available in areas on private water systems.With this
type of financing available one would normally assume there would be an up-
grading/jbPoperty as a result of it through mortgaging.

Norman Johnson asked -what if the Council does reconsider and more names
are submitted going one way and then another ?
Mayor Skaug at this timeimoved to table any action pending detailed meter-
water user evaluation and establish once and for all the action the Council
will take at the next meeting,and the decision will be final.Second by
Bob Hill.Passed.
Dd„Lindell made a motion to amend the foregoing motion to not allow any
more filing of agreements or petitions for or against this as of tonight.Second
by Bob Hill.Passed.
The Council voted on the amended motion.Passed unanimously.
Gordon Ebbert made a motion to place the Longview Tracts Water Service
Agreement on the agenda for the April 28,1970 meeting.Second by Otto Skaug,
Passed unanimously.
POLICE DEPARTMENT -AWARD OF TRAINING CERTIFICATES
)Dl*Police Chief Wm.E.Bjork,presented diplomas to Patrolman Douglas B.
Edwards for his graduation from Basic Law Enforcement Training School
at Olympic College.He commended him for receiving a 3.0 grade average
and being placed on the Honor Roll at the college.
The Police Chief also presented a diploma to Patrolman David McNabb
for graduation from Basic School for Juvenile Control,at Issaquah,with a
Grade B,which speaks well for his standing in the class.
SHARON AVENUE -TRAFFIC REQUEST
\\' Apetition with approximately 26 signatures was presented by residents on
Sharon Avenue,East Montlake district,requesting immediate action in
impeding the speed of automobiles traveling on Sharon Avenue,and for the
safety of the children in the area request improvement in the large traffic
flow that seems to ignore the lawful speed limit for residential areas.
A letter was read from the Police Chief,indicating that a speed and peak
volume survey was taken by the Police Department during the months of
February and March,which proved that 14%of the traffic on Sharon Avenue
did exceed the speed limit,and it is his opinion that something needs to be
done to get sidewalks on Sharon Avenue to take the pedestrian traffiicjoff the
street,and possibly divert some of the peak traffic away from this residential
area.
A letter was also read from the Public Works Director,Richard L.Weaver,
stating after evaluating the problem,recommended that Monroe Street be
paved and sidewalks installed on Sharon Avenue.
Wayne Rumple,Howard Copenhaver,Karl Marks,Pete Erickson,Mr.Parvin,
Gene Boyd,all residents of East Montlake,expressed their opinion that some
thing needed to be done.They contend the daily peak traffic is caused from
the High School,but they are also subject to all the traffic from town when
special functions are going on at the High School,such as graduation exercises
plays and dances.Also the student traffic leaves them with debri to pick up
that is tossed from the cars,although their primary concern is for the safety of
the children in the area due to excessive speed by a large percent of the
vehicles.
Mayor Skaug informed the people concerned that their suggestions will be taken
under advisement and most likely the Council will have study sessions for
solutions and suggestions and come up with a solution for the problem.

LIONS CLUB -REQUEST TO SELL FIREWORKS
A letter was read from Larry Jobin,President of the Moses Lake Lions
Club stating the Club wished to sell safe-n-sane fireworks at two
locations this year,and request City Council approval.One stand to
be located at 504 Valley Road and a second stand near Smitty's Pancake
House.These are the same locations they had last year,and they have
obtained fireworks retail licenses for each location.Approval has been
given by Russ Beeman,Fire Chief.
Michael Boyle commented,the Lions Club should be complimented for
the wonderful public fireworks display last year,but that he definitely was
against the sale of fireworks.
Larry Jobin commented that under State Law no explosives can be sold;
only safe-n-sane fireworks may be sold.
Motion by Gordon Ebbert to allow the Lions Club to sell safe-n-sane fire
works at the two locations mentioned ,second by Norman Johnson.Motion
carried.Voting in favor:Johnson,Moe,Ebbert and Skaug.Not in favor:
Lindell,Boyle and Hill.
CASCADE PARK -PRELIMINARY DEVELOPMENT PLANS
A letter was read from Bill Skeels,Park &Recreation Director,stating
that Robert L.Woerner,Landscape Architect from Spokane,has completed
preliminary plans for development of Cascade Park.In order to submit an
application for funding with the Inter-Agency Committee for Outdoor Recrea
tion,it was necessary to come up with an overall development plan.
Bill Skeels noted that almost one-half of the area,according to the plan,
provides for a future Par Three Golf Course and swimming area which will be
diked to make a fresh water pool with fresh water flushing the swimming area
of algae and mud.Some of this has already been developed,such as a camping
area with 12 pick-up and camp trailer sites and 17 other camp sites,restrooms
and boat launching ramp.Priority items totaling $53,588 are restrooms,free play/
beach,diking,cleaning anddredging,pump,well,etc.,Buffer Area (A),Lakeshore
Area (B)and Camp Area.
This was presented to the Council for informational purposes only and for
their suggestions or changes .
