1970 09 22COUNCIL MEETING -Regular Session Council Chambers Present were Bob Hill,Norman Johnson,Bill Moe,Gordon Ernest Lindell,and Michael Boyle. 1503 September 22,1970 8:00 o'clock PM Ebbert,Otto Skaug, Mayor Otto Skaug called the meeting to order.Minutes of the September 8,1970 meeting were approved as written upon a motion by Bill Moe.Second by Bob Hill Motion passed. REGULAR BILLS GENERAL FUND LIBRARY PARK STREET URBAN ARTERIAL EQUIPMENT RENTAL WATER AND SEWER SANITATION TOTAL AMOUNT PAID 2,051.79 451.75 1,197.75 300.11 78.38 696.91 912.80 6,971.53 Motion by Norman Johnson that the regular bills be paid.Second by Michael Boyle.Passed NO SPECIAL BILLS Warrant Nos.5056 through 5138 in the amount of $12,661.02 were approved for payment. CONSIDERATION OF BIDS FOR LIQUID CHLORINE .-, A letter was read from the City Clerk,Charles Davenport,that bids were opened on September 17,1970 for the furnishing of liquid chlorine for the City of Moses Lake for the fiscal period October 1,1970 to September 30,1971. Two bids were received,one from Van Waters &Rogers,Seattle,Washington for a total cost on one-ton cylinders at $3,959.64,and $423 . 00 for the 150-pound cylinders.Pennwalt Chemicals Corporation,Tacoma,Washington bid $4,199,64 on the one-ton cylinders,and $423.00 for the 15 0-pound cylinders.The City Clerk recommended awarding the bid to Van Waters &Rogers,who is the apparent low bidder. Motion by Bob Hill that the Van Waters &Rogers bid be accepted. Dr.ftnest Lindell.Motion passed. Second by ORDINANCE -APPROPRIATING MONEY FOR FINANCING OF THE LONGVIEW TRACTS WATER PROJECT. The Ordinance was read by title only for appropriating monies to the 1970 Water- Sewer Fund to provide for installation of water mains and connections to the Longview area. A letter was read from the Finance Director,Charles Davenport,stating that the total estimated cost of the project would be $85,485.To meet,this expenditure $36,000 has been transferred within the 1970 Budget,and by use of City labor in the amount of $15,485,which is already budgeted,leaves $34,000 required to be appropriated to complete the financing of the Longview Project.He recommended that the Council adopt the ordinance appropriating the $34,000 from the unencumbered fund balance. Motion by Gordon Ebbert that the first reading of the ordinance be adopted, by Michael Boyle.Motion passed. Second 1504 September 22,1970 ORDINANCE NO.615 -ADOPTING THE 1971 TAX LEVY FOR THE CITY OF MOSES LAKE. J0>u'VOrdinance No.615 was read in its entirety,fixing the amount to be received for municipal purposes from taxations on assessed valuations of property Wthin the City of Moses Lake/Washington,for the year of 1971.The ordinance stipulates that the taxes for municipal purposes be and the same are levied upon the taxable property as determined in the year 1970.This amounts to approximately 8 mills for general purposes of taxation.The only change is the 1969 Special Levy. Motion by Bob Hill that the ordinance be adopted and that provisions of Section 17 of Ordinance No.474 be waived in order to adopt the ordinance on the date of its first reading.Second by Norman Johnson.Motion passed. REQUEST FOR AUTHORITY TO APPLY FOR FEDERAL FUNDS FOR A NEW STEPHENSON BREATHOLIZER. /)7^Aletter was read from the Police Chief,Wm.E.Bjork,requesting authority to submit an application for Federal Highway Safety Funds to the Washington State Traffic Safety Commission and the National Highway Safety Bureau for the funding of a project on alcohol in relation to highway safety,which will provide the City with a new Stephenson Breatholizer.He stated that in 1955 the Police Department purchased a Stephenson Breatholizer,one of the first released for purchase to local agencies in the State of Washington,and the fourth in the United States.Since then improvements have been many in breatholizer equip ment,and the department's machine is becoming obsolete to the extent that it is difficult to obtain parts for it,and have been advised by the Washington State Patrol that it be replaced. Chief Bjork was present,and elaborated on the fact that the National Highway Safety Bureau is not put together just to buy equipment,but also to train officers to operate equipment.In that way our officers in taking training in operating and testifying in court regarding the machine,establishes our City matching funds.The project amounts to about $1000 per officer's time and the machine costs approximately $1000.He stated that the City has been dealing with the Traffic Safety Commission for the last two months and every department must be and has been represented by a member,as required by the Commi ssion.The Commission evaluates local standards and compares them with the standards set forth in the pamphlet submitted earlier to the City Council,entitled "Local Participation in State and Community Highway Safety Programs ".We have for warded our analysis to the Commission and in some particular categories we are low.We are lacking in city ordinances coming up to standards,and also lacking in standards of equipment.All of the officers of the Police Department have gone to school and learned to operate the equipment.The $1000 cost cf the breatholizer is borne by the Federal National Highway Safety Bureau. Motion by Gordon Ebbert to authorize making application for the breatholizer equipment.Second by Norman Johnson.Motion passed. Bob Hill asked about the lack of ordinance standards referred to and the Police Chief said he would have that information for the Council at the next meeting. SHARON AVENUE -TRAFFIC SURVEILLANCE RESULTS hi Mayor Skaug,asked the Police Chief,regarding results of the traffic surveillance after reducing speed on Sharon Avenue.He submmtted a log from August 31 through September 21, 1970, which consisted of 58£officers on-duty hours on Sharon Avenue,which resulted in 37 Juvenile arrest tickets issued and 82 adult tickets r, issued. He stated that we must establish a program up there whereby we try to do some thing,and therefore,issued orders to officers that there be no leniency granted to anyone going over the 20 miles per hour in that area. REQUEST BY STEVE MONEK,Tr.,TO LOCATE A TRAILER IN THE DOWNTOWN AREA REGARDING THE "VOICE OF THE UNBORN"COMMITTEE \\^\A letter was read from Steve Monek,Jr.,Chairman of the "Voice of the Unborn" n 1505September22,1970 Committee reque sting authority to locate a sixty-foot trailer in the downtown area on October 5,1970 for educational as well as political information regard ing Referendum No.20. Steve Monek was present and stated the location they would prefer is approximately four parking spaces in front of Menti Jewelers on 3rd Avenue. Bob Hill inquired if they had investigated locating the trailer on private property instead of on a public street,to which Mr.Monek replied they had not.Bob Hill felt if they were allowed to locate on a public street,it would likely appear the City is sponsoring a political issue. Norman Johnson thought the City would be setting a precedent if they allowed one trailer to locate on the public street for political purposes,they could not deny others Gordon Ebbert stated he is in favor of the educational part of this project,but does not want the City to influence a vote in either direction,and would rather see the City held free of any political involvement. Bill Moe suggested the Committee check into the possibility of locating in the Bank lot or the lot near the theatre. Otto Skaug cautioned the City Council to come to a determination since there will not be another meeting before October 5th. Motion by Bob Hill that the request be denied for parking on a public street. Second by Norman Johnson.Gordon Ebbert amended the motion to give Mr.Monek the choice of withdrawing his request rather than taking a denial.Steve Monek did not withdraw his request and Gordon Ebbert in turn withdrew the amendment.Gordon Ebbert offered his help to obtain a location on private property.Motion passed. ALLOCATION OF FUNDS FOR '701'COMPREHENSIVE PLANNING STUDY For information purposes,a letter was read from the Finance Director,Charles Davenport,stating that the City has received a letter from Richard H.Slavin , Director of the Planning and Community Affairs Agency ,advising that a planning grant in the amount of $10,000 has been awarded to the City of Moses Lake. This is funding of a '701'Comprehensive Planning Program,for which applica tion was authorized by the City Council on March 11,1969.The City Manager, Chet Waggener,will be contaqing the firm of Clark,Coleman &Rupeiks,Inc., Planning Consultants,in the near future to discuss implementation of the program. /0<?*' LONGVIEW WATER,INC., -LEGAL ACTION A letter was read from Charles Davenport,City Clerk-Finance Director,/£ for Council information,that on September 16,19 70 the City was served with legal papers where Longview Water Inc.,has brought action against the County Commissioners pertaining to the franchise granted to the City of Moses Lake. John Calbom,City Attorney,stated the legal action requested two things,that the franchise granted to use the public roadways be cancelled and also the City show cause and answer on why they should not be restrained from exercising any of the rights granted them by the franchise.He is hopeful the City will have a favorable decision on this matter on October 2nd.
