1971 04 27COUNCIL MINUTES -Regular Session April 27,1971 Council Chambers 8:00 P.M. Members present:Councilmen,Robt.E.Hill,W.B.Moo,Norman W. Johnson,Gordon M.Ebbert,Otto M.Skaug, Ernest Lindcll and Michael Boyle. Mayor Skaug called the meeting to order.Minutes of the regular council meeting of April 13,1971 were approved as written upon a motion by Boyle, second by Lindell.Motion carried. REGULAR BILLS TOTAL AMOUNT PAID GENERAL .$2,846.11 LIBRARY 6,790.00 PARK 884.52 STREET 348.49 URBAN ARTERIAL 1,450.16 EQUIPMENT RENTAL 959.81 WATER AND SEWER 143 .93 SANITATION 7.66 Motion by Moe that the regular bills be paid.Second by Johnson.Motion carried. SPECIAL BILLS -NONE Warrant No's.291 through 380 in the amount of $13,430.6 8 were approved for payment. CONSIDERATION OF BIDS -WHEELER ROAD AND LOCUST LANE Bids were opened on the Wheeler Road and Locust Lane,Phase I,Project Contract 71-06 on April 23,1971 at 2:00 P.M.Engineer's Estimate for the Project was estimated at $141,400 for the two schedules.Low bid was submitted by Murphy Bros,Inc;,Spokane,Washington for $62,792.60 for Wheeler Road (Schedule I)and $39,105.60 for Locust Lane (Schedule II), making a total bid figure of $101,898.20. Motion by Hill that the bid of Murphy Bros.Inc.,be accepted.Second by Boyle.Motion carried. ORDINANCE NO.623 -AMENDING WATER RATES REGARDING LONGVIEVV TRACTS The ordinance was read by title only for the second reading.No written or verbal protests had been submitted.Motion by Ebbert to accept the second reading and adopt the ordinance.Motion carried. RESOLUTION NO.526 -AUTHORIZING SALE OF DOGWOOD PARK TO TRI-STAT1 STORES,INC. The Resolution was read in it's entirety.Pat Banks,as agent for Tri-State Stores, has submitted earnest money to purchase city owned property known as Tax #5350, out of 22-19-28,in the City of Moses Lake for the appraised price of $17,500. The Multiple Listing Bureau,Inc.,has appraised the property also at $17,5 00.The Resolution further provides authorization for the City Manager and the City Clerk to execute a warranty deed to Tri-State Stores for the above described property. Motion by Johnson that the resolution be adopted.Second byHill. City Manager,Waggener,stated that Tri-State Stores have specifically requested the City to handle maintenance and irrigation of the trees and mowing until such time they will be ready to utilize the property The City will keep this ata minimum maintenance level,at least it will stay green' until such time they are ready to use it. Upon inquiry by Councilman Moe,Waggoner,stated the •money for the sale of Dogwood Park would go into the General Fund. Mayor Skaug called for vote oi the motion.Motion carried. i573 /0/4 J7o 1574 April 27,1971 ORDINANCE NO.624 -PROVIDING FOR CONVEYANCE OF PROPERTY TO 1 TRI-STATE STORES,INC. |K,The ordinance was read by title only.It provides for the execution of a warranty deed to Tri-State Stores,Inc.,for Tax No.5350 out of 22-19-28, in the City of Moses Lake. Motion by Boyle that the Council adopt the ordinance.Second by Moe. Motion carried. RESOLUTION NO.527 -AMENDING SIX YEAR STREET PROGRAM A letter was read from Richard L.Weaver,Public Works Director,stating that evaluation of warrants has shown the need for installation of traffic signals at Fifth and Fourth Avenues at Division Street in conjunction with our Fifth Avenue Urban Arterial Project.In order to utilize the 1/2 gas tax monies,our Six Year Street Plan will have to be revised to include these improvements. Resolution No.527 was read in its entirety providing for revision and modi fication of the Six Year Comprehensive Street Program 1971 through 1976 by adding Street Name:'-Division Street;Termini:-Nelson Road and Third Avenue; Type of Work:-Traffic Control;Estimate:-$60,000. Councilman Hill -asked what was meant by "evaluation of warrants"? Richard Weaver -There is a manual of Uniform Control of National Standards and warrant units are designated by accidents,such as what type are they, how many,are people on the side streets held up.If there are 6 or 7 warrants, they most likely justify traffic signals.In other words reference is made to traffic accidents,and traffic volume. Motion by Moe that the resolution be adopted.Second by Boyle.Motion carried. • -RESOLUTION NO.528 -URBAN ARTERIAL PROSPECTUS -GRAPE DRIVE H FROM SR-17 TO DALE ROAD A letter was read from Public Works Director, Weaver,stating that on [I April 15,1971,the Urban Arterial Board requested the City to submit a prospectus for the above project by May 7,1971,and also requested certification by the City Council that the project has been reviewed and is consistent with our comprehensive plan for community development. The Resolution to satisfy this requirement was read in its entirety. A draft of the prospectus was presented to the City Council. Councilman Lindell -asked,according to the design are we going to have sidewalks on both sides? Richard Weaver -That's what we have,and I think in the original it shows side walks on one side.Thought it would be easier to take sidewalks out on one side in case they are not approved and also after we realize how much they are going to cost,they might not be worth it. Councilman Hill -Are we going to call for a light on Valley Road and Grape Drive? \0 \t Richard Weaver - I think we are going to ask for it and if they do not allow it,we can take it out. Motion by Johnson to adopt the resolution.Second by Hill.Motion carried. RESOLUTION NO.529 -AUTHORIZING A GRANT APPLICATION - GRANT COUNTY J^AIRPORT SEWAGE FACILITIES A letter was read from the Public Works Director,Weaver,referring to the letter received from the Department of Ecology noting the deadline of May 15, if we are to be considered for State and Federal Funding for this next period. Motion by Ebbert to adopt the resolution authorizing the City Manager to sign and submit on behalf of the City,forms requesting grants from the Federal Government under the Federal Water Pollution Control Act (Public Law 84-660) as amended,and in addition to request a State grant from the State of Washington under the 660 Program.Second by Lindell.Motion carried. n n i1 / 1S7SApril27,1971 AGREEMENT WITH DEPARTMENT OF LABOR &INDUSTRIES -MAKING THE CITY OF MOSES LAKE A LOCAL ENFORCEMENT AGENCY FOR MODULAR HOME CONSTRUCTION. A letter was read from the Pubic Works Director,Weaver,submitting an agreement for consideration whereby the City of Moses Lake would be certi fied to perform inspections in accordance to the Factory-Built Housing Law RCW 43.22.470 pursuant to the Rules and Regulations of WAC 296-150-425 and -430;Inspections Delegated. The Department has specified a standard rate for the State cf $11.00 per hour. $2.50 per hour is remitted to the State for administration and $8.50 per hour retained by the City to cover our costs. Councilman Ebbert -How often is it necessary to make these inspection, and is the State doing it now? Councilman Moe -Does'nt this come under the State's responsibility? Weaver -they do not have staff enough to cover these areas and made pro visions for local enforcement agencies to make these inspections and certify for the State and accept our inspection certification. Councilman Ebbert -Who pays this approximately,$100 per week? Richard Weaver -Vista Homes does.-The inspection is done at their place of operation.This agreement is specifically for Vista Homes at the Grant County Airport. Councilman Ebbert - I take it,it would cost them more if the State would do it. Richard Weaver -That is Vista Homes and the State's feeling also.Council authorization is needed to enter into the agreement. Motion by Hill,that the City Manager execute the agreement with the Depart ment of Labor &Industries on behalf of the City of Moses Lake.Second by Boyle.Motion carried. PROGRESS REPORT -"701"PLANNING STUDY - VAL RUPEIKS Val Rupeiks,assisted by Mike Rancich,of Clark,Coleman &Rupeiks,Inc., Planning Consulting firm,were present to give the report. Val Rupeiks stated that some time ago they introduced a Planning Program, and would like to present some of the areas that were covered,'and in addition are prepared to present some seven topics and hoped to continue on this pro gram policy.Numerous copies of the seven topics have been printed and put together into a package containing a lot of information. We requested,through the City Manager,for the Mayor to appoint various committees on Residential,Industrial,Arterial Streets,Commercial,Central Business District,and Community Facilities,and about six members have been requested to serve on each of these committies.The information in the seven topics will help to arrive at an overall development policy and eventually reach a Comprehensive Plan,and implementation of how exactly this community can grow and redevelop those areas where it is needed. We expect these groups to become organized and begin to have regular work sessions . It will probably take between three or four months to crystalize each of these groups that will serve as directives for us. It is not an easy job,and I believe there might be a need by the various six groups for coordina tion and reach some sort of consensus of opinion that we can use.We hope these committies will give us certain policy guidelines to follow - how much land we will use for single family,multiple family,commercial use;the area lb<?& 157£April 27,1971 of the downtown-/also parks,playgrounds,auditoriums,convention facili ties,etc.The arterial requirements will have to be taken from the freeway to the collective streets. The committies can meet in a work session and supply the information for us and we will be available to consult with the committies and give them certain guides and hope they will come up with recommendations they can call their own.Any recommendation will have an effect and counter-effect on other recommendations.The main task is to form a Comprehensive Plan, and hope the committies will arrive at the kind of plan they will support, and the more people get involved in that type of activity,the better acceptance you get from the people.The planning area covers 40 square miles.(*"""! We evaluated water current,water source,topography,erosion,vegetation, prevailing winds,sun exposure;you may be happy to know that we are doing an environmental plan.In relation to enviornmental planning,Mike Rancich presented maps covering Land Use,Housing,Commercial,Land Capabilities and Commercial Floor Space Analyses maps.These maps will be left for the committies to use in their work sessions. Representatives from the Planning &Community Affairs Agency were also present to hear the progress report;Ron Clarke ,from the Olympia office, and Allen deLaubenfels,from the Spokane office. Val Rupeiks asked if there were any questions. Councilman Ebbert - Are you programming with the County? Mike Rancich -Eventually we will have to. Councilman Ebbert - You showed us floor area diagrams and concentration. To what extent is our responsibility to determine as to how much concentration; are we qualified to determine this ? Val Rupeiks -We are prepared to supply you information.j Don Hollingbery -May we have a complete list of all the Committies and ' the people on these commi tties.-Yes,this will be supplied to each one involved (by Mayor Skaug). City Manager,Waggener -Everyone has the "Generalized Planning Standards" pamphlet;is it your thought that the Committies at this point will review these standards as related to residential,commercial,etc.,or are they going into the various zones. Val Rupeiks:-The Generalized Planning Standards for Moses Lake have been written very candidly,almost identically for any community this size.The difficult task is to finalize these Planning Standards that will eventually in volve into policies.They will supply you basic principles that are good and sound.You may not agree with everything suggested.We.hope you will change, modify and argue with us,and particularly apply them automatically. City Manager,Waggener -Would the Committies go beyond their designating the zoning? Val Rupeiks -Not at this time,that is premature.Let us finish the ground-! work and then we will meet again.You will see what you initially agreed upon \J and additional information that is yet to come,and when you apply it to your (J land map,you will not like it,and you will automatically change it according to specific locations. City Manager,Waggener -How often may the Committies expect to receive help from you,in terms of meeting with you ?.. Val Rupeiks - As often as they need us.I think what you should do first is for the Chairmen of each Committee set a date and come together and under stand what the General Planning Standards are,then read the rest of the informa tion and should study those topics of information that fall into their group.You might say this is some kind of class assignment -well,it is. April 27,1971 1377 Councilman Boyle - If this study incorporates approximately 40 square miles, are we going to be planning shopping centers,etc., or the ultimate effect and possible control of ? Val Rupeiks - We hope that you will arrive at the over-all development policy that will be a containment policy and discourage sprawl,and where the City will cooperate with the County.A shopping center will have to meet certain acreage amount,arterial access,etc., if it is to be good for the community. There will be very few select locations for a natural shopping center. Councilman Hill - Do I understand,from the map,you left the Grant County Airport out of the map? Val Rupeiks - We have it in the area,but don't know what to do with it. Mayor Skaug -We,of the Council and the Planning Commission have felt the need to expand the thinking to many many people of which you are a great part, to assist the City in this big project.The job is big and we have pre vailed upon you to assist us,who are in government here now, and to arrive at a plan for the betterment ofthe whole community,and I think that with that in mind we have called you together and appreciate your coming here.Your response has been gratifying to the City Council and the Planning Commission. A list of all committies with the respective personnel will be made available to you.A City Councilman and a Planning Commission member is on each one of these committies to counsel and guide you in the work of the committies. Councilman Ebbert -Do we have any deadline to meet? Val Rupeiks - We met our contract financial deadline.Once we know when financing will be available through the Planning &Community Affairs Agency, a schedule will be submitted.
