1971 10 26\I COUNCIL MEETING -Regular Session Council Chambers October 26,1971 8:00 P.M. Members present:Councilman Robt.E.Hill,W.B.Moe,Norman W.Johnson,Gordon M.Ebbert, Otto M.Skaug,Ernest V.Lindeil and Michael Boyle. Mayor Skaug called the meeting to order. Minutes cf the previous council meeting of October 12,1971, 1971,were approved as written upon a motion by Hill;second by Tohnson. Motion carried. REFERRAL FROM PLANNING COMMISSION -REQUEST FOR ADDITION TO MAYFLOWER BUILDING. —/OOIAletterwas read from City Manager Chet Waggener,stating that the Planning Commmssion, on their regular meeting of October 14,1971,recommended to the City Council that a building permit for an addi tion to the Mayflower Building,located at 2000 W.Broadway,be grantedwith the provisionthat the entrance to the front doorbe closed in such a manner that it is notusable and that a 40-foot setback be maintained to prevent parking and/or loading and unloading of trucks in front ofthe building.Their recommendation is in accordance with Ordinance No. 593, Section 3.24.270.90.The City Council has in similar requests requireda bond of $2,000 to assure compliancewith the plans and specifications. Mr.Armstrong,the owner ofthe building, was not present to submit a proposal or plansas to meet the stipulation regarding the front entrance.The Planning Commission was concerned only tothe extent the doorat frontbe closed and doors be placed on the side or rear to suit their needs of loadingand unloading. Motion byHillto table the request until we see some plansas to what the building planswill be. Second by Johnson.Motion carried. REFERRAL FROM PLANNING COMMISSION -REQUEST FOR ADDITION TO PARKER CHEVRON SERVICE STATION.^ Aletter wasread from City Manager ChetWaggener,stating that the Planning Commission,ontheir regular meeting ofOctober 14,1971,recommended to the City Council thata building permit for an addition to the Parker Chevron Station,located at 101 W.Broadway,be granted with the provision that shrubbery intheproposedplanterbelimitedtoamaximumheightof24inches.Their recommendation is in accordance with Ordinance No.593,Section 3.24.270.90.The City Council has in similar requests required a bond of $2,000 to assure compliance with the plans and specifications. F. M.Stratton,Project Engineer for Standard Oil Company,was not presentnora representative to submitplansandspecifications.Motion by Ebbert to table this request until such time jilans and specifications are presented.Second by Hill.Motion carried. CHURCH OF THE NAZARENE -REQUEST FOR PARKING PRIVILEGES ON FIFTH AVENUE Aletter was read from Robert E.King,Pastor of the First Church of the Nazarene,located at 422 S.Balsam ^Street,would like to request parking privileges on Fifth Avenue which runs beside the Church.He under stands thatthis streetis to have no parking according tothe plans for widening it,but they are requesting parking on Sundays only. Pastor King was present,and also Mr.Etulain,a member of the Church.Gordon Ebbert asked Pastor Kingwherearetheyparkingnow,and are they asking for a variance of the Code regarding required o"-ftreet . parking?Pastor King stated they have always parked along the same area until the street was widened.Basically their only problem would be on Sunday mornings,and if the Equest were not granted they wouldhavetoparkinbackwhereitwouldbelessconvenient.He further stated that they realize,as far as the City Code is concerned,off-street parkingis required. 1656 ^ Council Minutes:2 October 26,1971 Aletter wasread from Richard L.Weaver,Public Works Director,stating that 21 parking spacesare lost on Fifth Avenue dueto widening ofthe street.There are 21 spaces on Balsam between Fifth and Fourth Avenues;also 22 spaces on Balsam between Fifth and Sixth Avenue,and parking space potential on Church property in the alley ofapproximately 10 spaces,and recommended the request to park on Fifth Avenue be denied. Upon inquiry by Mayor Skaug,Pastor King informed the Council they have been averaging about 100 in Sunday School which wo.iid average about30cars based on 3to 5 in a family. Councilman Hill asked if anything is being done regarding parking in the alley area. Pastor King - No, not really,it is all in gravel. It is more convenientto parkon the street. City Manager Waggener commented,that when the City applied to the Urban Arterial Board it was understood funding would be granted on the basis Fifth Avenue would be four-laned,and alsoit will be posted "no parking." Motion byHill that the request be denied.Second byMoe.Mayor Skaug commented to Pastor King that perhaps there would bea possibility to absorb the approximate 21 parking spaces lost onFifth Avenue by utilizing the alley area andthe 50-foot strip onthe dher side ofthe church that is presently in lawn. Question called -motion carried. POLICE AND FIREMEN CIVIL SERVICE COMMISSION A letter was read from John E.Calbom,City Attorney,submitting an opinion in response to an inquiry bythe Council at previous meetings.He stated that underthe existing state lawand ordinancesof the of the City of Moses Lake one civil service commissionis sufficient for both the fire department and the police department.The state law pertaining to civil servicefor city firemen is set forth inthe Revised Code of Washington,Chapter 41.08.The state law pertaining to civil service for city police is set forth in the Revised Code.of Washington,Chapter 41.12. Both state laws set forth the qualifications of the civil service commissioners,but there is nothingcontained in either law which limits or requires a civil service commission to act only for city firemenor only for city policemen.Accordingly,underthe state code, one civil service commissionmay perform both functions.City ordinance adopting the firemen's civil service is found in Chapter 1.16.Said chapter adopts the state law by reference (Revised Code ofWashington,Chapter 41.08). City ordinancefor police civil service is found in Chapter1.20. Thisordinancealso adopts the state law by reference.(Revised Code of Washington,Chapter 41.12) Councilman Moe - I think he has come up with the right chapters 41.08 for fire and 41.12 for police civil service,but there is a difference in securing the commissioners.Isn't one commission appointed by the Mayor and one by the City Manager? John Calbom -The original ordinance says that the appointment shall be made bythe Mayor, and a more recent ordinance supersedes it by its terminology stating "by the City Manager".This was in 1960 when at that time the City adopted the City Manager form of government.Accordingly the state directs that the City Manager shall do certain things and the functions that would be performed by the Mayor when elected by the Council. Councilman Moe - not revealed this. Evidently there are a lot of things updated from time to time and all the research has City ManagerWaggener - In amending ordinances,only those sections of an existing ordinance being changed are noted in the new ordinance, and all other sections of the existing ordinance are not affected. It would be desirable if we could employee someone to spend probably a year or more to completely re write our city code. We have ordinances that are outdated.In some instances a direct reading of the ordinances that have been amended or completely repealed can give incorrect information unless you go to a more recent ordinance.Presumably our Municipal Code would be correctly updated annually,but the publishing company does not always correct sections as a result of enactment of new ordinances. REQUESTTO CALL FOR BIDS -WATER MAINS - CASCADE PARK AND RIDGE ROAD * Richard L.Weaver,Public Works Director,presented plans for replacement of the existing water main on Ridge Road and Mattson Drive.The existing main is of WorldWar II type pipe and it was not made intending to go underground for any duration of time.It is to be replaced with asbestos 8"pipe. Councilman Hill -Has anyone looked into the polyethylene type pipe? Rich Weaver - The cost is prohibitive.There is a new plastic with glass type pipe that is out.Right now there isn't for this use a cheaper pipe than asbestos. .<j (*\ u 1657 |! City Engineer Weaver- Asbestos has proved to havean extremely long life.There are isolated instances where even concrete pipe will decompose by certain active substances yet none of these have been active on asbestos pipe. Councilman Ebbert -Was the replacement of Ridge Road pipe in our budget this year? i • City Manager Waggener -Yes it is. Councilman Hill =About how long will Ridge Road be torn up? City Engineer Weaver -About 70 days. Councilman Hill -Are yourequiring the back'-iilllng and pavingof Ridge Road before going on to CascadePark? City Engineer Weaver - We have not considered this but we could havethe immediate paving included before going on to Cascade Park. Councilman Hill - All that pipe has been in a long time? City Manager Waggener - I think Mac has discussed with you previouslythe method of detecting leaks,and as I recall,our unaccounted water is less than 10%.It is only by replacement of lines that we achieve thi.s. Other cities recently are replacing old wooden pipe and they are running a loss of over 30%. Richard Weaver commented that combining the two projects in one bid call,it would most likely result in a better price.Cascade Park plans call for a 10-inch water main from a dug well nearby. Councilman Lindeil - Do you .plan on any fire hydrants in Cascade Park? Rich Weaver -We might with the development of restroom facilities. City Manager Waggener - The restroom facility is supposed to be a steel type facility.If we put in refrosh- •-atent facilities,then would be a more logical time to install,as to location. Motion by Ebbert to grant permission to call for bids on Cascade Park Phase II and replacement of water main on Ridge Road.Second by Boyle.Councilman Hill suggested including an alternate bid item that would call for completion of backfilling and paving of Ridge Road before work starts on Cascade Park portion of the contract. Ebbert revised his motion to incorporate Hill's suggestion,that the backfilling and paving of Ridge Road be completed immediately before starting Cascade Park,as an alternate on the bid request.Boyle seconding Bbbert's original motion,agreed.Motion carried. PARK FACILITIES -SLIDE PRESENTATION Park facility slides were presented by Bill Skeels,Park and Recreation Director.Aerial photo slides were J19*^ shown of improvements and planned improvements of Cascade Park and Larson Playfield,along with slides of other city parks,to show the Council what the City has in improved parks and future plans for park development.^. (CONTINUATION)- REFERRAL FROM PLANNING COMMISSION -Request for Additlonto Mayflower Building. '///'Mrs.Roy Bemd arrived after the Council tabled action onthe requestforthe Mayfiower building.The J. Bernds leas.e the building from Mr.Armstrong for operation of the ME Mayflower Transfer and Storage Agency. Mrs.Bernd stated their lease comes up for renewal the 1st of November and they they were rot aware of the request by Mr.Armstrong.She heard about it on the radio news covering the recent Planning Commission meeting,and indicated they could not very well approve the stipulation about the relocation of the front door of the building. Mayor Skaug commented that there seemed to be a lack of communication between them and the owner cf the building.Suggested inthat case,and sincethe City Council has notas yetacted upon the recommendation of the Planning Commission,^would be normal forthe Bernd's to present their objections to the Planning Commission,becausethe referral was forwarded to the City Council contingent upon the front door stipulation and the 40-foot setback requirement. City Manager Waggener suggested thatif they wished,to submit a lettertomorrow in order for the Planning Commission to considerat their Thursday evening (October 28th)regularmeeting. "1 1658 Council Minutes:4 October 26,1971 WASHINGTON FINANCE OFFICERS ASSOCIATION -CHARLES DAVENPORT ELECTED BOARD MEMBER yQi Aletter was read from the Washington Finance Officers Association announcing that Charles Davenport\has been elected a Board Member of the association for the ensuing year.The election took place in Olympia October 13-15.The organization works closely with the Regional Municipal Finance Officers Association and has been recognized as leaders in promoting improvement in governmental accounting, budgeting and reporting procedures in the State ofWashington.The Association is proud of Chuck and his many accomplishments,and the Council will want to recognize the honor that the Association hasbestoweduponhiminelectinghiminassistinginleadinganddirectingtheAssociationfor1971-72 year. Mayor Skaug congratulated Chuck on behalfofthe Council and himself.Also stated that it is indeed gratifying to know that our whole staff is so honored;recalling that earlier our City Manager Chet Waggener was elected President of the Washington City Management Association. \fl Before the meeting adjourned,-Councilman Moe asked if anyone recalled what the agreement was regard- 'ing off-street parking for the Chamber of Commerce office? City Manager Waggener -At the time they acquired their office,they purchased land from the City. I am not aware if they made a definite committment regarding development ofa parking lot in back. Councilman Moe - It seems to me it would bean advantage for the Chamber to provide off-street parking there and have more than the narrow space they have in front of the Chamber office.Would like some action to do something.I think it would be a good idea.I don't know if anyone else thinks so. Mayor Skaug -Is there a problem there? Councilman Moe - I don't thinkthere exists a great problem at the present time, but may be some problem there.Seems to me we could get it straightend out - we have to change lanes quite abruptlythere. Councilman Ebbert-It would make for a nicer street if they could straighten those lanes out. Mayor Skaug =Perhaps the City could approach the Chamber Board to get into some conversation on that. / \ip ***************** Councilman Hill -Several meetings ago we had discussed with the Retail Trades Division of the Chamber regarding the 509 overtime parking penalty.I think we should clarify this.The people were concerned about it and wanted some action on it. Mayor Skaug =Would be interesting to know just how many tickets were issued on the 259 fine. Councilman Hill -It was tabled and I think we should put it on the agenda.I so move then to bring it back for the next Council meeting on November 9th.Second by Johnson.Motion carried.
