1972 06 06lJ COUNCIL MEETING -Regular Session June 6,1972 Council Chambers 8:00 P.M. Members present:Councilman Robt.E.Hill,W.B.Moe,Norman W.Johnson,Gordon M.Ebbert, Otto M.Skaug,Ernest V.Lindell and Michael Boyle. Mayor Skaug called the meeting to order,and called for approval of the minutes of the previous meeting of May 23,1972.Motion by Hill that the minutes be approved as written.Second by Johnson.Motion carried. • REGULAR BILLS FUND TOTAL AMOUNT PAID 1731 GENERAL-$2,725.40 STREET 996.00 PARK &RECREATION 60,124.96 r^K LIBRARY 15,306.59 URBAN ARTERIAL 4,352.41 WATER/SEWER 2,717.42 EQUIPMENT RENTAL 2,327.26 £2^Motion by Johnson that the regular bills be paid.Second by Lindell.Motion carried. REQUEST FOR BENEFIT MUSIC CONCERT IN McCOSH PARK AllJ A letter was read from Bill Skeels,Park ,s Recreation Director,stating that Nicholas Manning advised Charles Davenport,City Clerk,on June 1,that due to complications,he is withdrawing his request to hold a benefit dance at McCosh Park. In regard to bands Councilman Hill asked that several meetings ago we approved the use of the Park today, but there are three bands playing there tonight -is that correct?He mentioned that he heard three flashes on the radio referring to the "rock bands",and possibly we have a problem.We did not approve the bands. City Manager Waggener commented that they will be quitting in the early part of the evening.He also mentioned that normally this would have been cleared previously with the Park &Recreation Commission, such as this Community Day.The use of the Park normally would not come to the City Council,this was brought to you by the Big Bend people wanting ycu to be informed and wanted your recognition,and wanted you to know about it,and the easiest way for the Council to know was to put on as an Agenda item.We had several instances last year of bands in the Park. Councilman Hill still expressed that he is a little concerned especially since they had the rock band pro blem around the State,and yet we approved such a thing today.Several people mentioned to him that we have rock bands,and it seems to me a little shocking that we approved today's activities and then let rock bands come in.The Ephrata Jaycees were turned down when they v/anted to sponsor rock bands at the Fair Grounds.Suddenly something is approved and then suddenly a rock band shows up.That is why I am a little concerned -we approved the concept. Mayor Skaug inquired whether calls had been received at City Hall regarding disapproval of the bands? There were none. Councilman Lindell asked what are you referring to as a "rock band"- I don't -it was a band of 'High School kids. Hill -The radio station referred to them as "rock bands".I have been out of town today. Mayor Skaug - I was down there and they were playing music even I could dance to,and that is old. Johnson - I believe Steve Laughery was on earlier tonight and then more rock bands will be on tonight. One rock band came on from 11:30 to 2:30,and then a western band,and then Steve Laughery and then a rock band will play tonight. Mayor Skaug -Lindell's question is well taken -what makes up a rock band? Moe - I don't think it is the type of music we are concerned with. Johnson - I think the point here is -it does concern anything that comes to City Council when we condone one group,and when asked to bring in others,we refuse.We had a request last time and we asked them to obtain a sponsoring agency. City'Manager =This was because they were collectirrj fees or donations.I think the concern of the Council was the reason they wanted a sponsoring agency was to assure the public that the money would go to the miner's fund.I did not hear any question about the band itself as being any particular problem. 1732 \° Council Minutes:2 June 7,1972 Hill - My main question is concerned with =we are careful one way and then suddenly a rock band is playing tonight. City Manager -People are becoming a little hysterical when they are talking about a full-blown music festival,that is a little different.One thing that used to be enjoyable was the bands that played in parks on Sunday afternoons. Boyle -One thing that we have to look at as a community as such,I think -it would be a real slap in the face for the youth if we don't have something for them. Moe - I have heard a lot of favorable comments about today's activies,and am all for it. Boyle - I think there is a possibility in the years to come to have the whole community take part in it. Say,-Close at noon. City Manager -When Nancy Wolfe came to you with permission to have the Community Day -she came in with a concept and a brief outline of activities.As thi s developed it got a lot of interest and the con cept that she had,had grown tremendously and was a big success and a very good outlet at a key time - the last day of school. Mayor Skaug - I think the suggestion of Mr.Boyle's is good -could be that maybe the town could see fit to close up one afternoon for such a Community Day.He also mentioned that Mr.Waggener's comment regarding the Park &Recreation Commission approving such activities,prompts him to mention that we have now several vacancies which have existed for some time and implored the Councilmen for suggestions for 2 or possibly 3 people on that Commission that can make Recreation decisions -such as today's Community Day activities.Perhaps within the next month that particular slot be filled with some appointees to that commission. SANITARY LANDFILL CHARGES Mayor Skaug called on the City Manager for a report on the meeting today with the County Commissioners regarding County use of the landfill.' City Manager Waggener stated he was sorry that we didn't have a written report,but got back to the office about 5 o'clock.In reviewing Mr.Weaver's report,on the cost allocations,he recommended 69%of the cost beingborre by the City and 31% by the County.These figures were based on actual checks that were made over a period of time.Now we have further broken down the 31%so-called County refuse.Mr.Weaver considered everything out of the city as County,and the Port of Moses Lake contributes considerable to the fill site.They are a separate municipal corporation,and was determined that approximately 18%of the total was Port,with 13%County-rural garbage.We had to agree with some basic concepts with the County Commissioners.We have a general agreement v/ith the County they pay their portion of the refuse they deposit,whether it is 13%,15%or 20%,they pay their share of the total cost.We have not had an opportunity to contact the Port District.It should be with the contractor who is picking up garbage at the Port and delivering it to our landfill;it has • been Mr.Gillingham,who also hauls garbage in from the Base.We have suggested that the Port pay their share and establish what the fee schedule should be for compacted garbage. So we need to enter into an agreement with the County,or at least have something definite in the minutes;renegotiate our contract with Mr.Gillingham to provide for keeping the fill open,and the County pay us directly.We think charges need to be in effect on Sundays - no free dumping days. Also we need to change the basic fee structure somewhere in accord with Mr.Weaver's structure pre- ented a few weeks ago.Also we need a few changes or probably a separate fee schedule for compacted garbage brought into the landfill by trucks.We would request authorization to bring an ordinance back to you establishing amended fee charges,and we hope to have at that time a renegotiated contract-with Mr.Gillingham for your consideration. Mayor Skaug commented that the item was tabled for 30 days previously.If the Council wishes to ex-, tend that tabling for two weeks until we are presented an ordinance? City Manager -If you want to continue the tabling,or you can request us to prepare an ordinance for your consideration,and hopefully a renegotiated contract. Motion by Johnson that we have the City Manager prepare the ordinance and present it at the next Council meeting,and a renegotiated contract for the Council's consideration.Second by Moe. Moe inquired as to how do we set with the County regarding any payment in lieu of the amount the city subsidized them after their one-year contract expired -probably for about 8 months.Did they enter into discussion on it?It must be somewhere within the $2,000 area. City Manager =We did touch on it briefly,and I think they might appropriately contend that a large amount of refuse was brought in during spring clean-up which coincided with the period v/e were taking counts and that a similar amount of refuse would not have been brought in during the normal season. They have been paying the contractor $325 per month and 13%of 61700;-they probably have been paying more in order to keep the fill open,but of course,paying it directly to the contractor.That is when you divide the 31%between the Port and the County. - o r Council Minutes:3 June 6,1972 Lindell -Have we been handling the Port District's garbage and being paid by them for it?City Manager stated yes,we have been accepting it on a per yardage basis according to .our fee schedule in the present ordinance,although it is not enough.The processing plants have been dumping and being charged under that fee schedule also.The new ordinance would provide a fee schedule for the people who take their garbage out to the landfill for dumping. Councilman Hill suggested that possibly as a common courtesy the processing plants should be ad vised prior to the new ordinance. Councilman Moe irquired regarding to the method of computation of what goes into our landfill,did the County have any comments as to your plan? Rich Weaver,City Engineer,answered that the County Commissioners agreed that was the only possible way we could handle it.We have been using the scales at Monte Holm's. The question was called -Motion carried. ORDINANCE NO.645 -ESTABLISHING LID NO.26 Ordinance No. 645 was read by title only,ordering the improvement of the alley between Beech and Ash Streets running from Fourth and Fifth Avenue.A public hearing had been held regarding the improve ment,therefore,the provisions of Section 17,Ordinance No. 474 were waived and the ordinance read only once before its passage.Motion by Johnson that the ordinance be adopted.Second by Ebbert. Motion carried. 1733 INSURANCE CLAIM -WILLIAM M.LEF A letter was read from the City Manager stating that the accompanying claim has been forwarded to our Insurance agency for processing,and suggests that the Council minutes merely note receipt of the claim.Mr.Lee alleges he suffered injuries due to a stop sign was not replaced at the intersec tion of Nelson Road and Division Street. WW REQUEST TO CALL BIDS -STREET SWEEPER Forwarded to the Council were specifications for the puchase of a new four wheel street sweeper, which was included for purchase in the 1972 budget. Motion by Hill to authorize the request to call for bids.Second by Johnson.Motion carried. WATER &SEWER RATE STUDY -CAPITAL IMPROVEMENT PROPOSALS A letter was read from the City Manager stating that the City Council has previously authorized to proceed with a water and sewer rate study.I"conducting the study we will analyze maintenance and operating costs and capital improvements contemplated within the next 8 to 10 years.Arate will then be established to meet those needs. /o/7 /<POS The comprehensive water and sewer studies completed approximately one year ago can be used as a base for capital improvement proposals.This has been carefully reviewed by Mr.Weaver;Stevens,Thompson and Runyan,Inc., and the City Manager.The accompanying letter from Mr.Weaver lists those projects that we deem it advisable to finance in the next 10 years with construction costs updated from the original water and sewer study to an anticipated 1973 construction cost index. Before we proceed with a preliminary rate analysis,we would like tentative approval from the City Council regarding the capital improvements proposed.Following a preliminary rate structure to amortize the proposed costs,the City Council will again be requested to review the capital improvements in view of the rate structure necessary for amortization.It should be emphasized at this time that the water distribution system proposed should be considered as a general cost factor rather than for specific im provements enumerated in Mr.Weaver's letter.They were listed as a basis to arrive at preliminary cost figures with the assumption that growth will require installation of water lines somewhere within the community,although not necessarily in those specific locations. Richard L.Weaver,Public Works Director,presented a ten-year capital improvement program for water and sewer systems totaling approximately $1,300,000 for City Water and Sewer System and $568,000 for the Base Water and Sewer system. City Manager commented that we met today with representatives from Stevens,Thompson &Runyan,and wece discussing basic philosophies of establishing a rate structure.We talked about the things that need ed to go into it,but he emphasized it is not a hard and fast list of improvements,but would like to have Council accept this as a preliminary list,and then come back to Council with several types of rate struc tures by recommending one to them.He stated that possibly some funding assistance would be available. 1734 ••• Council Minutes:4 June 6,1972 establish a rate structure to pay for that. REQUEST TO CALL BIDS -LARSON SEWAGE TREATMENT PLANT Aletter was read from the Public Works Director,Richard Weaver,stating that thefinn of Stevens expects written confirmation ofthe approval in a day or so. Motion by Johnson to grant the request to call for bids.Second by Hill.Motion carried. MISCELLANEOUS Johnson mentioned that he had been approachedregarding Cascade Park -^there,i«a boat dock,butswimmersandfishermenseemtohavetakenitover.He is only relaying this on. Park &Recreation Director Skeeis stated that the Department did have a sign up marked "boat launchingonly"but during leveling and construction in the area,the sign was leveled with it.It will ne back up again shortly.
