COUNCIL MEETING -Regular Session June 27,1972 Council Chambers 8:00 P.M. _Members present:Councilman Robt.E.Hill,W.B<-Moe,Norman W.Johnson,Gordon M.Ebbert, •^Otto M.Skaug,Ernest V.Lindell and Michael Boyle. Mayor Skaug called the meeting to order.Pastor Emery Johnson,of the First Baptist Church gave the l„J invocation. Mayor Skaug called for approval of the minutes of the previous meeting on June 6,1972.Motion by Johnson that the minutes be approved as written.Second by.Liridell.Motion carried. Warrant No's.2614 through 2729 in the amount of $50,745.21 were approved for payment. CONSIDERATION OF BIDS -STREET SWEEPER Aletter was read from the Public Works Director,Richard L.Weaver,stating that bids were opened /O// on June 21,1972 ,for the purchase of a new four wheel street sweeper.The bid for the Wayne Street .Sweeper by Modern Machinery Company was for a net bid of $15,850.00 with a ninety day delivery date, and with the exceptions that self-cancelling turn signals were not available,and that instruments would need to be mounted above the windshield.The bid of Sahlberg Equipment Company was $15,887.50 or $37.60 higher than that of Modern Machinery Company.The Sahlberg bid had no exceptions,and a deliveryN| dayof sixty days.Because of the exceptions onthe Modern Machinery Company bid, a very smalldiffer ence of cost and the earlier delivery date for the Sahlberg Equipment sweeper,he recommended that the City Council accept the bid of Sahlberg Equipment Company for the purchase of the mobil sweeper at a cost of $15,887.60. City Manager Waggener stated that a subsequent letter was received from Modern Machinery following the opening of the bid they submitted stating that they would be able to furnish self-cancelling indicators and mount the instruments in the dash panel,which would leave Modern Machinery low,but still would recommend to accept the Sahlberg bid on the basis of earlier delivery schedule and the basis the bid initially met specifications.Also our Maintenance Superintendent is familiar with the mo del which is made by the same manufacturer of the sweeper we have now, and it also has an extra core broom on it which would be of some value to us. Motion by Hill to accept the bidof Sahlberg Equipment Company. Second by Johnson.Motion carried. RESOLUTION NO.574 -PROPOSED LID *27 -KNOLLS VISTA DRIVE Aletterwas read from Public Works Director,Richard L.Weaver,statingthat in preparing the LID #27 /O '<T s Assessment Rolls,problems concerning the proposed LID have arisen..(1) The original Knolls Vista Plats platted a street named Meridian Street what is now the Knolls Vista playground.This arrangement assured "Central Drive as the collector arterial for the majority of the Knolls Vista Area.At a later date a replat was done and Meridian Street between Central Drive and Knolls Vista Drive was vacated. When the Pilgrim Congregational Plat was accepted,a portion of Pine Drive between Central Drive and Knolls Vista Drive was dedicated to the City.Since that time Pine Drive between Knolls Vista Drive and Central Drive has been used as a street.There is only a partial right of way for this street,therefore, at the present time it is not a legal street. Property owners In the area south of Central Drive oppose Pine Drive being dedicated and remaining open ]because the location ofthis street has turned Knolls Vista Drive and Northshore Drive into collector arterials for the area to the west of Central Drive.The driving time between Central and Pine to the Broad way and Alder intersection is almost exactly the same as a trip using Knolls Vista Drive and Northshore„,j Drive.Apetition is now being circulated for action by the City Council to vacate the small portion ofthis street that is dedicated.This problem associated with Pine Drive is being referred to the Planning Commission for consideration. (2) In the period when the City was going to build Knolls Vista Park adjacent to the School,a trade was proposed.We proposed trading Lot 2 of the Knolls Vista Third Addition for Tax No. 3379. In this process ,. *i- i&n jiff. fl\o Council Minutes:2 June 27,1972 § Tax #3379 was to be platted and then a property exchange carried out between the School District and the City of Moses Lake.Because of legal description and platting problems this trade was never officially made,although each party has assumed control and maintenance of the respective property as if the trade has been made.We will need to plat Tax No.3379,and trade property with the School District officially so that proper assessments can be made on Local Improvement District No.27.This r problem Is also being referred to the City Planning Commission. (3)Because of these problems and errors in assessment computations,he requests that a public hear ing be re-established to July 25,1972. Resolution No.574 was read by title only declaring the City's intention to improve area oh Knolls Vista Drive from Ridge Road to Pine Street and Pine Street from Knolls Vista Drive to Northshore Drive by grading,graveling,constructing and installing storm drainage,curbs,sidewalks and asphalt con crete pavement,and to create a local improvement district to assess the cost and expense of said improvements against properties in such district especially benefited thereby and notifying all persons who may object to said improvement to appear and present their objections at a meeting of the City Council to be held on July 25,1972,and repealing Resolution No.573. •$$$1: Motion by Lindellto adopt the Resolution. Secondby Boyle. Motioncarried.^ RESOLUTION NO.575 -ESTABLISHING SPEED LIMITS FOR CONSTRUCTION -VALLEY ROAD &GRAPE DRIVE L The resolution was read in its entirely to fix the maximum speed limit on the Grape Drive project, Contract No.72-04,within the City of Moses Lake,until completion of Roadway improvements. Motion by Hill to adopt the resolution.Second by Johnson.Motion carried. ORDINANCE NO.646 -ANNEXATION -WESTLAKE,WASHINGTON The ordinance was read in its entirety .for the annexation of Westlake,Washington by the City of '- Moses Lake on the effective date of this ordinance which shall be five days after its passage and publication,as provided by law. Motion by Boyle to adopt the ordinance.Second by Lindell.Motion carried.Opposed by Hill. CASCADE PARK -ACCEPTANCE OF PHASE I CONTRACT •— A letter was read from Public Works Director Weaver stating that Mahaffey Excavation has now completed all work on the above contract No.71-16,and recommended the City Council accept this work and enter the.thirty day lien period. Motion by Johnson that the recommendation be accepted.Second by Boyle.Motion carried. PIONEER WAY -ACCEPTANCE OF PHASE II-A CONTRACT NO.71-07 A letter was read from Public Works Director Weaver stating that the firm of Griffith and Estes,a partnership,has completed as much work as is possible under the terms of their contract. A portion of the trees and shrubs installed on this contract died.Under the terms of the contract, they are required to replant these trees and shrubs one time.Because of the weather conditions we are not allowing them to replant until thi s fall.This works a hardship on the firm,in that they are required to maintain a performance bond of approximately $30,000.00 and we are retaining 10%of the contract amount. The new firm,Griffith and Ries,has agreed to sign a contract for the remaining replanting work for mutual benefits.Therefore,he is requesting that the City Council authorize the City Manager to sign the new contract for the replanting of trees and shrubs,and subject to signing of the contract, accept the work which is completed and enter the 30 day lien period. The City Manager commented that the letter did not fully explain that the partnership of Griffith and Estes disbanded and new partnership formed,that of Griffith &Ries. Councilman Johnson inquired —do we get reimbursed for the work we had to do.The City Manager commented that all we did was take out the dead trees and they will replace them.Any work we did was after we accepted maintenance. Johnson -there were holes in the lawn above Hill Avenue and on the West side coming down. City Engineer Weaver -they came back later and filled them in and mowed the lawn and went in after that and re-adjusted all the sprinkler heads.We may have had to fill in somedirt after the last rain f storm. Johnson —it does seem we are a little fast on the maintenance grab. City Engineer — In the contract they were only responsible for one replant -this was in the contract on purpose to get a lower price.We were anxious to take over maintenance to take care of them before we lost more. Johnson —Will 10%recover all the amount of the dead shrubs?City Engineer Weaver -Yes,more "than enough.What we are asking for is to release the retainage and performance bond and have them sign a new performance bond for twice the amount of the value of the plants and shrubs to be replanted. Council Minutes:3 June 27,1972 By doing that we release $30,000 of bonding capacity,which is very critical to a small company, and in turn they will drop any claims for holding them up.I am saying that we want to accept the contract,but do not want to release the bonding before we have a new contract for twice the amount of the value of the shrubs and trees to be replaced.If the alive shrubs die in this period,they will have to replace them also. City Manager Waggener stated,this has been discussed with the firm and they are anxious to do this in order to release the bonding,which would serve no actual good purpose to have that great amount out. Motion by Skaug that the request be .granted,subjectto the signing of the new contract;that it be in ''hand before therelease of the present bond.Motion carried. REQUEST TO CALL FOR BIDS -ALLEY CONNECTING FOURTH & FIFTH AVENUES (LID #26) A letter was read from Public Works Director Weaver,requesting permission to call for bids for paving /regarding LID No.26,alley connecting Fourth Avenue and Fifth Avenue between Ash Street and Beech Street,as provided in Ordinance No.645. .X c *>' 00 APPOINTMENTS TO PARK &RECREATION COMMISSION..X . •r~JQ7/C^i Aletter was read from Mayor Skaug asking for Council confirmation of Randy Carvo to the Commission; fN . his term to expire June 1,1976,and Mrs. Josephine Hoffman;her term toexpire June 1,1975. Motion by Ebbert to confirm,these appointments.Second by Johnson.•Motion carried. WATER &SEWER RATE STUDY -CAPITAL IMPROVEMENT PROPOSALS Action on this item was continued from the meeting ofJune 6,1972 until the Council could view city 'U facilities.A field day had been conducted for the Councilmen on June 8th and 12th. )City Manager Waggener stated that he does have some additional information received from Stevens, Thompson &Runyan,Inc.,this afternoon,by phone.Projecting on an operating income and indebted services -on two basis:Considering we would do all the improvements listed in the letter and accompany ing information so far as the Larson system is concerned,and one-half of what is proposed on the City system.If we do that,then over-all we would be short 11%.In other words we would need an 11%rate increase.Taking the Larson system,they would have an excess in the water system;they would have a 260%deficit in the sewer system for the major expansion of the treatment plant. City - 33%deficit in the sewer,and 27%excess in the water rate.These are assuming 20-year revenue bonds at 7\%interest rate.If we did all the improvements on both systems then there would be an over-all short age of 29%.It would not be 29%for both.Nor would it be suggested the rate be uniformly distributed between.all.The sewer system and water system should be operated that they would necessarily pay their own way.Our sewer rate is certainly low as compared to most communities,perhaps three times as high as ours.It definitely needs an adjustment.I am not trying to give you any information as to details, roughly what kind of percentage increases you will look at in accordance with the proposed capital im provement program. I don't think we should project ourselves too far in the project to do a preview that won't be needed for another 2Q years.We should consider only those projects needed within ihe next several years and issue bonds only for those,and review our situation again after that.Our present rate structure has been unchanged for about 20 years.I don't think we should establish a rate structure that you might find a need to change again in less than 5 years.I think we need to assure the public of a more permanent rate than that. Councilman Moe asked if the request is for tentative approval of this plan,and City Manager Waggener stated -yes,tentative approval only,and then come back to the Council with a rate structure that would finance this proposal,and then if they felt the rate structure v/as something they would not care to live with,then they could adjust it. Councilman Ebbert inquired if the improvements of the water tanks at the Basewould affect their rate, and was informed that this would not likely involve any change in the water rate.It will require a change in the sewer rate structure,unless you want to imbalance them,having one help pay for the other.In the City,the sewer system has never paid for itself. The City Manager emphasized the capital improvements proposed are intended to be tentative and a refine ment presented again later.Stevens,Thompson &Runyan,Inc.have 12 weeks to complete their contract from the time we give them an approved list of capital improvements,with a preliminary submitted to us in about 4 weeks.We are committed to go ahead on the treatment plant and go ahead with revenue bonds, and adjust the rate structure later. Councilman Hill noted the Montlake reservoir in the proposal and inquired if that is on a contingency basis? Mayor Skaug stated - - had we not spectulated that might not be the particular site - probably the Peninsula? Motion by Lindell that the request be granted.Second by Boyle.Motion carried. Council Minutes:4 June 27,1972 City Manager Waggener stated that STR in their report submitted to the Council within the past year, recommended that in the first phase of improvements,and they felt that tank is needed now,without additional growth.One more tank is needed at the present time,that is pretty well determined.The determination for Montlake is that we need another tank,one.of higher elevation*and the recent growth is in the area of Montlake.We are having some pressure problems in the area right now es pecially when the pump is running and when it cuts off again. Mayor Skaug -rather than deal with unknowns,would rather give approval until we can get something to go on. Motion by Skaug to grant tentative approval of the proposals.Second by Ebbert. Councilman Hill - I think it is a couple hundred thousand dollars too high for the city, the users are to pay for what is to be in 10 years -not what should happen in 1980. I don't think Motion carried. Mayor Skaug gave a brief report on the AWC Conference recently held in Seattle,which was also attended by Councilman Ebbert,City Manager and others of City staff,and hoped that more Councilmen could/ind time to attend future annual AWC Conferences.
