Invocation -Rev.Roy Hutchison of the First Church of God.
Mayor Skaug called the meeting to order and called for approval of the minutes of the Special Council
meeting of December 5,1972.Motion by Boyle to approve the minutes as written.Second by Lindell.
Motion carried.Minutes of the continued special meeting on December 11,1972 were approved as written
.upon a motion by Hill and a second by Moe.Motion carried.Minutes of the regular council meeting of
December 12, 1972 were approved as written upon a motion by Hill and a second by Boyle.Motion carried.

ORDINANCE NO.661 -ADOPTING BUDGET FOR 1973 Sfi/CJ
The ordinance was read by title only.City Manager Waggener mentioned that some minor adjustments had
been made that he wished to call to the Council's attention,that of an addition of $2,000 for the purchase of
a new cash register and also minor adjustments on page 45 and 46 in the Planning section;and on page 80 in
the Park and Recreation Budget;-this was discussed under the administrative support section that part of
this should actually go into programs,instead of showing under administration -$21,015,decrease this bytj$6800 and distribute over several ofthe programs.Also on page 112 under Revenue Sharing $5,000 budgeted
for swimming pool lockers -delete this item and put it in the reserve fund because the original estimate was
not even close,and are looking at more like $10,000 or $15,000 and did not feel we could do it in time to sub
mit for the 1973 Budget; we will either drop it or come back with the request next year,and continue the opera
tion as it has been.Those are the only items of adjustment that were made.The adjustments mentioned would
not increase the total amount of the 1973 budget figure of $3,758,165.
Councilman Hill asked for clarification of the duties of the Public Works Coordinator,and City ManagerWaggenerexplainedit is one of the newpositions in the Public Works Department.Whatwe are tryingto do
is take responsibility divided between several people and on a pick-up basis from people in the engineering
category, and give one person all the responsibilities to spend more time withit instead of addingone additionalEngineeringTechnician. RichWeaver mentioned thatlhis position will take some of the things that get
sent back and shifted around and have a tendency to get lost,such as the new regulations on garbage service;
data from the Urban Arterial Board and the Six-Year Street program.These kinds of things are getting tossed
back and people had to be pulled off a project to do it.Also this position will provide staff assistance to theCommunityDevelopmentDirector, and in addition, whendevelopers come in asking for assistance we had topre-empt the work going oninthe Engineering division.Councilman Hill inquired if a lot ofthese duties could
be done by the Assistant City Engineer, and the City Manager commented that we propose his workbe spent
more ondesign and more on pure engineering. The Public Works Coordinator would be in charge of the work that
is moreor less of'an intenuption as far as the office is concerned;if it involves general or design engineering,
that would involve the Assistant Engineer.
Motion by Ebbert to adopt the Budget for 1973 and pass Ordinance No. 661. Secondby Boyle. Motioncarried..
ORDINANCE - SPECIAL REVENUESHARING FUND (1st reading)
The ordinance was read in its entirety,establishing a special .revenue fund as required by 51.40 -Regulations OgoverningFederalRevenueSharingProgram.That the City Treasurer ofthe City of Moses Lake be directed
to establish a special revenue fund andthat all monies received under Title I of the State and Local FiscalAssistanceActof1972bedepositedwith the fund and the disbursements from such fund shall be in compliance
with regulations established under Title I of the State &Local Fiscal Assistance act of 1972.

POLICE DEPARTMENT -PURCHASE OF RADAR EQUIPMENT
Earlier the Washington State Traffic Safety Commission approved a grantforthe purchase of new radar
equipment and has just been received by the Moses Lake Police Department.LT.Bakerand Sgt.McNabb
were present at the cduncil meeting to demonstrate the newunit.The cost of the unit was $1121 and includesabatterychargerandshouldercarryingcase.The new unithas a range of one-half mile andalso operatesfromInsidethe car through theglass windows and can clock vehicles directly away from you ordirectly
toward any police vehicle or patrolman carrying the radar unit.

RESOLUTION NO.588 -ESTABLISHING LOAD LIMITS ON CITY STREETS J0^7
A letter was read from the PublicWorks Director stating that forwarded for action by the Council is a
resolution that will allow the Public Works Director,based upon conditions,to impose special load
limits this spring on City of Moses Lake streets.This resolution is required by the City's Traffic Code
before load limitations can be imposed.
Motion by Boyle to adopt the resolution.Second by Hill.Motion carried.
LABOR AGREEMENT -INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS COVERING FIRE PROTECTION OFFICERS /A'?3
Aletter was read from City Manager, Chet Waggener,stating the following changes in the agreement relating
to Fire Protection Officers have been negotiated with Local No.2052:
1. Article X- Health and Welfare = changed to provide - - "the Employer shall contribute up to $13.00
per month foran employee's dependents coverage underthe Employer's Healthand Welfare Plan."
2.Article XV - Overtime -Section "D" -changed to provide - - "any overtime not used as time off
shall be paid to the employee at the end of each monthly pay period."

EAST BROADWAY -APPROVAL OF BIDS FOR CONSTRUCTION .•_——/0/?
A letter was read from the Public Works Director stating that the Washington State Highway Department has
submitted the accompanying results of the bid opening on East Broadway project for approval.We have budget
ed $45,000 for construction costs and $3,000 for engineering in the 1973 budget.The proposed contract will
obligate $40,463.81 in construction costs which is an increase of $5,534.56 over the 1971 estimated costs to
the City.He recommended approval of the bid and notify the State Highway Department to proceed.
Motion by Boyle to accept Rich Weaver's recommendation and notify the State Highway Department to proceed.

Mayor Skaug inquired whether this will result in any frustrations regarding meeting with the property owners ?
City Manager Waggener commented =no,it will either be two lanes with parking,or four lanes without parking.

RIVER BASIN STUDY -REPORT BY COUNCILMAN EBBERT //?/}-?
A written report had been submitted earlier to the Council.Gordon Ebbert noted that he along with other
representatives of various cities involved in the Basin Plan were appointed to make up a Co-ordinating
Committee.Grant County is involved in the Plan for Basins 36,41 and 42.The City of Moses Lake is located
in Basin 41.The Federal Government acting through the Environment Protection Agency and the State of Washing
ton through the Department of Ecology have mandated that by July 1,1974,the State of Washington must have
completed drainage basin studies that will outline implementation programs to preserve and protect the water
"quality of the State.Also a River Basin Technical Committee has been appointed,which works closely with
the consulting firm of Stevens,Thompson and Runyan engaged with funds to pay them coming from a Planning
Grant.The Technical Committee meets once a month and the Co-ordinating Committee meets every two months.
At the first meeting on November 21,1972,the Co-ordinating Committee came up with a few ideas that had to
be injected into the program.In Grant County,Crab Creek is their primary concern.In our area the Rivers
Committee controlling this area does not go up far enough for Crab Creek -so it became necessary to make
arrangements with joint meetings with different counties that have more of the control up the line as it comes
down into Grant County,and these people have progressed a little farther ahead.In turn,by State require
ment,the Committee found it necessary to project this program schedule to be completed by July of 1973.
It also points for a definite need for a multi-county approach to water quality planning.The Co-ordinating
Committee also charged the consultant and staff with the responsibility of seeing that any plan that was done
for these three basins was coordinated with those plans for the basins upstream.
City Engineer,Rich Weaver,is a member of the Technical Committee which met on December 13,1972,and
\began to attempt to more specifically state the goals and objectives for the Water Quality Basin Study.He
stated,the 1972 amendment to the Water Quality Act has changed the picture radically and will make require
ments of these Basin Plans much more stringent.He commented on the new permit system Change to this Act.J The United States were giving permission toissue discharge permits to persons,industries and municipal
corporations discharging to all waters of the United States be they intra-state or inter-state.The Federal
government has recently changed that and now only ten states have permission to issue their own permits.
This means that those ten states may now issue permits requiring that outflow are of equal,or better,quality
than the receiving waters.Under the hew permit system all discharges will be evaluated on a case by case
basis.According to the 1972 law,the agency issuing the permit may make discharges of waters from treatment

facilities be a much higher quality than the receiving waters themselves are.Washington State was one
of those states and has pursued a program of trying to handle its own problems concerning water quality
by working with its local governments and industry.However,this authority has been granted on an interim
basis by the Environmental Protection Agency.It will mean for all of us the adoption and the implementation
of a workable basin plan to insure water quality is very important.
GRAPE DRIVE -REDUCTION OF PERCENTAGE RETAINED ••'.%
A letter was read from the Public Works Director stating that the City has received a letter from the Contractor
on the Grape Drive project requesting the retainage withheld On this project be reduced as provided for in the
standard specifications and Revised Code of Washington.R.C.W.60.28.010 provides that the City Council
may reduce the amount retained to a minimum of 5%provided that:No liens have been filed;at least fifty
percent of the original contract work is complete,and that satisfactory progress is being made.All require
ments have been fulfilled by the Contractor,and he recommends the retainage be reduced accordingly.k
Motion by Boyle to accept the recommendation and reduce the retainage percentage to 5%.
Motion carried.
