Mayor Ebbert called the meeting to order and asked Louie Dendy to give the invocation. Mayor Ebbert called for approval,or any corrections of the minutes of the previous meeting on April 22,1975.Motion by Boyle to accept the minutes as presented. Second by Skaug. Motion carried. PUBLIC HEARING -BROAD RIPPLE ADDITION ZONE CHANGE -ORDINANCE NO. 722(2nd reading) Mayor Ebbert opened the public hearing and asked for comments from staff regarding the zone change /'7 request. Stan Bech,Associate City Planner,reviewed the recommendation submitted by the Planning Commission to rezone Lots 7, 8,9,10 and 11 of the Broad Ripple Addition No.I from R-3 Multi-family Residential to R-l Single Family Residential upon request of approximately 60 property owners in the area.Almost simultaneously an environmental assessment statement in conjunction with a building permit for an apart ment complex on these same lots were submitted,which was compatible with the present R-3 zoning. As mentioned at the Council meeting of March 25,1975,along with the Planning Commission's recom mendation to rezone the lots to R-l,that if the apartment complex developer cleared his environmental impact statement to their satisfaction then this development can go ahead,if not,the zone should be R-l and anyone in the future cannot come in and request an apartment building for this location. On May 1, 1975 at a regular Planning Commission meeting the Commission approved the apartment complex after the developer submitted revised plans by eliminating the swimming pool,and four • units and providing more parking space,as well as additional access off of Division Street instead of using the alley or Chuckle Lane.Although they did not change their recommendation for the Zone Change. Stan Bech added that if the Council passed the ordinance for rezoning,the apartment complex could go in and when finished it would be a non-conforming use and could not expand. City Manager,Chet Waggener,added that with the Planning Commission's recommendation,apparently it was their feeling that in a long range,the area should be R-l.But since the developer has applied for a building permit before the rezoning request and the questions of the environmental assessment have been cleared,they have the right to receive their permit and go ahead with the building.Many such projects get this far in the planning stage and thereis a change of mind and for some reason they do not proceed.Should that happen they would have to go over that all again. Mayor Ebbert stated if there was nothing further to add in reviewing the matter,he would open the hearing to those in attendance. Ann Fairbanks,1133 So.Ash.=1 think Mr.Waggener reiterated my thinking probably better than I could myself.We simply want this project included and have a zone change in the event that some thing happens then we won't have to go through the entire proceedings again.We would just like to have the Council show good faith and desire and change the lots in question to R-l. Bill Nichols -1116 So.Ash.=There were 63 involved In this and there are still 63 that want that changed. Mayor Ebbert asked if there was anyone else wished to be heard;there were none.He asked if any written protests had been submitted.There were none.He then turned the public hearing over to the Council for questions or comments. Bill Moe questioned the non-confroming use that Stan referred to and stated he understood that any thing in a non-conforming use can be expanded with certain procedures. Chet Waggener added/that provision of the ordinance states if the City Council makes a finding that the expansion is not determental to the area then it can be granted. Otto Skaug contended-,notwithstanding with the assurance that it is not spot zoning,I am sure it is surely we are doing just that.I would think,if we are going to make the change it should encompass the whole block. ORDINANCE -AMENDING CITY CODE -SANITARY LANDFILL RATES Aletter was read from Robert Kimball,Building Official,stating the^ordinance f^»"J«J •"fjf.1}asChapter5.2 of the Moses Lake City Code,and alters the rates and charges atthe Sanitary Fi 1asreouestedbySuperiorDisposal.The balance of the amendment simply incorporates the remainingra?es and charges into the City Code.Previously they were attached as schedules to Ordinance No.695, which also amends Chapter 5.2 of the Code. Mr.Barney of Jim Barney Tire Center stated they average approximately 100 to 150 per store in the area or an average of every two weeks,or 300 a month.That is car tires.Right now pay about $50.00 a month to dispose of the tires by taking them out to the Fill,but if the price goes up it will cost about $75 to $100 per month,or make the customer take their scrap tires with them.It is a cost we have absorbed and don't feel we should be discriminated against with this type of disposal. Bob Hill commented that he thought Mr.Meling stated that he hauled them away?Mr.Meling concurred that he hauled away 2000 tires at a cost of $90.00.He added,that he will have to get a shredder, because tires don't decompose,and also the DOE wants them shredded up first,it is a new law which has gone into effect about the first of the year. Bob Hill voiced concern how the Fill rate increases,especially the $1.00 per cu.yard fdr 'AH other vehicles' would affect people such as SeniorCiUzens. It could work a hardshipforthem, and perhaps that should be absorbed In the overall rate schedule. Bill Moe commented that Mr.Meling contended at the City Council meeting of April 22,1975,that the new garbage contract Implied to him that a rate change at the Sanitary Landfill would be forth coming.I differ with him on that statement.I see no Council proceedings to include that.Specifically in the rate structure he has not really shown a hardship.The tire problem has gotten to be a critical factor.I think we should at least consider this a whole lot.more,and table this item at this time. ORDINANCE -AMENDING CITY CODE - FIRE ZONES (1st reading) A letter was read from Fire Chief Russ Beeman stating the City pouncil on April 22,1975 authorized reduction in size of Fire Zone No. 1 and subsequently increase Fire Zone No. 2. The present West boundary of Fire Zone No. 1 Is drawn at Marina and Commerce, with its East boundary drawn at BlockjStreet.The ordinance draws a new West boundary at Dogwood Street and a new East boundary at Balsam Street.Fire Zone No. 2 is altered to include the old East and West boundaries of Fire Zone No.I.Fire Zone No. 3 is not changed'. 1>|D* Motionby Johnson to adopt the first reading of the ordinance. RESOLUTION NO.711 -GIFT FROM LIONS CLUB -REIMBURSEMENT FOR LITTER CONTAINERS f)l Aletter was read from M.G.McLanahan,Asst.Public Works Director,statingthe Lions Club and i City of Moses Lake has particpated in the combined project of placing 16 litter containers on city- owned parking lots and city streets in the downtown areas.The resolution is to express ourapprecia tion forthe excellent cooperation and assistance by the Civic Improvement Committee of the Lions Club.Mr.Al Brlggs,Chairman ofthe Civic Improvement Committee,presented thecity with a check for $500. The Resolution was readin its entirety.Motion by Swanson to adopt the Resolution.Second by Johnson.Motion carried. n 2219 City Council Meeting Minutes:3 May 13, 1975 RESOLUTION NO.712 -PAVEMENT MARKING PROJECT -AMENDMENT TO SIX-YEAR STREET PROGRAM ///~7 A letter was read from Jerry Fay,Public Works Director,stating the City Council on April 22,1975 — 'authorized the expenditure of approximately $3,000 for engineering and preparation of plans and speci-JjJ'rj fications for the Pavement Marking Project.In order to expend funds from the Arterial Street Fund,it • is necessary to amend the Six-Year Street Program by Resolution and the \$Gas Tax Individual Project Prospectus must be submitted to the Washington State Highway Department.He recommended Council's acceptance of the Resolution. Tlje Resolution was read by title only amending Resolution No. 680 Adopting the Six Year Construction Program 1975-1980.Motion by Moe to adopt the resolution.Second by Hill.Motion carried. CORRESPONDENCE -CITIZEN'S PROTEST ON GROUP HOME IN LAKEVIEW TERRACE AREA A letter was submitted and from Mrs.Robert L.Hensley,1019 S.Evergreen Drive,stating a number of residents in the Lakeview Terrace area would like the opportunity to express their views regarding the proposed construction of a Group Home on the Southwest Corner of Grand and Hill Avenue by the Grant County Mental Health-Drug Abuse-Mental Retardation Board. Mayor Ebbert stated that as he understands this the Planning Commission has requested an environmental rating and has met with their approval of which they made a motion and passed May I,1975 at their meet ing.As far as I know the zoning is proper for this.He asked if Mrs.Hensley was present and whether she wanted to make any comments. Mrs.Robt.Hensley stated the letter was not intended to protest,we are here to express an opinion. Personally I am opposed because it is in a residential area.Also with Garden Heights,Lakeview School, Chief Moses Jr.High and the High School nearby,this territory could be used better in conjunction with the schools in the area.At the present time approximately six new homes are going into this area and all in R-l,with adjoining or adjacent area being R-2,and this small area zoned R-3.Feel it could be used to better advantage.I don't feel the proposed area for the Group Home is large enough. Mrs.Hensley continued stating she has no objection to the program,thinks it Is"a very terrific program". It is merely the location does not justify the expenditure of this much money in this small area,and in a residential area.It seems they need more room for perhaps recreational needs or a garden spot,and out door recreation.The Director noted,she added,that he would like space large enough for a baseball diamond. Mayor Ebbert said to Mrs.Hensley,that my interpretation of your feelings is the lot is not big enough. You feel it should have more room.Is there any area you would suggest?Mrs.Hensley suggested there is quite a bit of area out on the Peninsula and also on the Base,or perhaps some of the college buildings could be utilized.Feel in the area they chose,wouldn't give the most benefit for the people who need it the most.Also it is more than a mile to the downtown area and anyone with a physical difficulty will find it Inconvenient. Others voicing their opinion in opposition to the Group Home for this particular area was June Cole, 1011 S.Evergreen and Robert Hensley 1019 S.Evergreen. In order for everyone present to be familiar with the actual location being discussed,Stan Bech pointed out the location on the map,being off of Pioneer Way off of Hill Street on Grand Drive.Dale Yenney, A.C.S.W.Coordinator for Grant County Health-Drug Abuse-Mental Retardation Board,stated they have an option on this particular lot and an additional 25 or 30 feet adjacent to it,totaling approximately 151 by 280 feet.The Group Home would be for 16 to 20 people defectively developed and mildly retarded people,and as of right now,there are jobs at the processing plants in the area for these people of 18 to . 25 years of age.They need some supervision in their living.This will be a home.environment with full time supervision to make a program as near as we can to make a home atmosphere while they are away from the job.Drug Abusers would not be in this facility;that is just included within the title of our organi zation.It will be licensed for mildly retarded,people.Also he did not concur,or indicate to anyone that'the proposed location was not large enough for the.facility. Dale Yenney told those that expressed their opposition to locating the Group Home in that particular area,that it is their prerogative to appeal to the Grant County Commissioners and request they look at a different location.As far as the City is concerned,at this point,we are simply faced with the fact that it is zoned properly for this kind of use. City Council Meeting Minutes:5 May 13,1975 Jerry Fay added that the $587,000 total, that includes Reservoir #5 and other transmission mains tomakethe entire project. In fact Reservoir#5 is pertinent to that particular project. Tentative location of Reservoir #5 is east of Big Bend College. Bob Hill asked if this is approved,how soon will the people realize improved pressure?In other words how long will the job take? Jerry Fay replied that this particular jobis just a part ofthis pressure improvement.We are looking also at Reservoir#5 and newWell #11 to complete the entire problem. We could estimate completion of theentireprojectsometimemid-next year.This would be with the well drilling being completed andthe designandconstructionofReservoir#5.The project at this point will Improve pressure in Zone 2. The location of Reservoir #5, he added,is tentative because we are looking at various parcels in that areaandyes, it would be inthe County area.What we are looking at is a very advantageous situation because of the relative height of the area and the pressure increase by going to the higher elevation. Motion by Hillto grant permission to call for bids on.labor,materials and equipment to install a twelve inch water transmission main from Reservoir #2 to Pressure Zone #2. Second by Johnson. REQUEST TO CALL FOR BIDS - WELL #31 ROOF RECONSTRUCTION A letter was read from Jerry Fay requesting Council permission to negotiate a contract for the construction of a new roof for Well #31 Pumphouse, which is a portion of Well #31 project.It is estimated to costapproximately$2,500.Our estimate cf cost rangeforthe total Well #31 Transmission Main Project is$210,000 to $240,000,with 40%eligible forreimbursement from the Washington Futures Referendum#27 Program. Mayor Ebbert inquired why this wasn't figured in the other bid forWell #31 Pump,Motor,Electricaland Plumbing? Jerry Fay replied that essentially that project is of a different nature and,scope and would lookat a primebidderbiddingthat particular project out to anotherbidder possibly costs just for handling the paperwork and processing of sub-contracting.We felt it would be much simplerto work this intoourschedule and negotiate this particular portion of the contract. Don Swanson inquired =how big is that building?Fay replied 14 feet by 18 feet. BobHill asked - Why do you want to negotiate a contract,why don't you call for bids? Jerry Fay replied that in this particular portion we felt that it would be timeand cost saving in the fact that it would not have to go out for bids and would give us more lattitude in scheduling the pump installa tion. Norm Johnson asked = What do we get besides a roof for $2500? Fay stated that what we are looking at isportionsof the roofhadto be removed.The pumphouse was substandard.We are looking at aesthetic treatment also to the structure which is included in this particular package;we are looking at the roof, a little more structural capability,we are looking at the ability to remove portions of the roof for pumpre moval. So it is not a very straight forward project and not just a re-roofing job that we are talking about. Motion by Boyle to authorfze negotiation for this project.Second by Skaug. Bob Hill commented =I still think you should go for bids on this.Don Swanson - I concur with Mr.Hill. Jerry Fay stated that a project of this small magnitude is an additional expense to go out for bids, even though if it is the desire of the Council, we would be morethan happy to do so. Theother point that we felt was of importance was the ability for us in this instance to schedule compatibly with the installation of the new pump facility.There are uncertainties now in ordering pumps,and we really could not say forsurewhen the pump will be delivered that when these phases could be tied together.Going for bid on this project would leave uncertainties when we could commence withthe project in possibly reasonable length of time,which could incur additional expenses in increased expenses by the contractor.These were basically for asking to negotiate. Bob Hill = Of course you are spending $11.60 odd cents for a roof for 216 square feet,if my figures are right.Seems like you could get an awfully good roof in a time frame to meet that on bids even. Jerry Fay stated we will be negotiating with local people as well in soliciting quotes.We are not negotiating with one particular party.Also added that the city would be saving several hundred dollars in not having to prepare detailed plans and specifications which we would have to do if we went for formal bids,and also the project of this size is well within the limitations by statutes. 2221 //fa The question was called..Motion carried.Opposed by Swanson and Hill, because he still thought it should be a bid. Hill commented he opposed MUNICIPAL AIRPORT MANAGERS CONTRACT -RENEWAL _/OC& A letter was read from Ferry Fay along with two reports detailing activities at the Municipal Airport during 1974 and the current contract with Daryl Jackson,Airport Manager.As requested in his report and in subsequent 2222 City Council Meeting Minutes:6 May 13,1975 o1*P discussions with Mr.Jackson,it was mutually agreed that his monthly fee of $225 be reduced to $175. After review of the reports,he sees no problem and recommends the city continue under the same manage ment at the reduced rate.He requested Council approval to modify the contract and reduce the monthly rate to $175. Ron Baker stated that clarification of what his expenses are might help.When we negotiated a contract with Mr.Jackson about a year ago,part of the total package was that he also supply some of the materials required in the performance of his duties.These are cleaning supplies,weed control,dust control and that type of material.In his report he states that his costs were not as great as he anticipated for that past year,and therefore,suggested a reduced fee.Another point to be considered/it is a*part-time func tion and he does have an operation at the Moses Lake Municipal.Airport.His main office is in Warden, but he has a full-time person at the Moses Lake office,who will be fulfilling the requirements of his contract,and carried out satisfactorily. Ebbert moved,that If he is doing a satisfactory job,recommend we retain his services at the reduced price.Second by Hill.Motion carried. MUNICIPAL AIRPORT LEASE AGREEMENT -MARVIN E.DAVIS A letter was read from Ron Baker,Asst.City Engineer,attaching for Council action a lease for Commercial Area #6-A,by Marvin E.Davis.The lease is for a five year term at $186.15 per year.Ron,added the lot is located between Moses Lake Air Service and Mayfields;it is a single lot,and Mr.Davis is a spray applicator. Motion by Moe that the lease be approved.Second by Swanson.Motion carried. MUNICIPAL AIRPORT RUNWAY LIGHTING -REQUEST TO SUBMIT'PROSPECTUS A letter was read from Ron Baker,Asst.City Engineer,requesting Council's permission to submit a grant prospectus to the Washington State Aeronautics Commission for funds to install a new runway lighting system at the Municipal Airport.The need for this project has been made evident by recent failure of lights to provide a minimum Intensity.Inspection of the system has revealed that insulation on the burled distribution wiring has deteriorated,allowing ground faults to occur at several points. For the past three years repairs to the system have been made with salvaged parts because replacements are not available from wholesale suppliers.The above combination of problems makes replacement of the entire system more desireable than repair of isolated failures. Informationreceived from the Washington State Aeronautics Commission staff indicates that their grant program would supply all new materials for runway lighting including lamps,mounts arid possibly wiring. This type of grant requires approximately 50%of cost be provided at the local level.Local matching funds include budgeted city crews and equipment,volunteer labor from the Moses Lake Civil Air Patrol, Vagabond Flying Club and local businessmen. Motion by Johnson to grant permission to submit the prospectus for grant funds.Second by Boyle.. Motion carried. REQUEST TO CHARGE ADMISSION -MOSES LAKE SCHOOL DISTRICT A letter was submitted by Jim Adamson of the Moses Lake School District requesting permission to charge admission on May 23 and 24,1975 at Larson Playfield for the Washington Interscholastic Activities Ass'n. to host the Quarter-finals and semi-finals baseball playoffs for Class "A"schools of Eastern Washington. Because of expenses that are incurred with this tournament it has been necessary to charge admission. A letter was read from Cecil Lee,Park &Recreation Director,stating the tournament will reimburse the Park and Recreation Department for all out-of-pocket expenses.Also in accordance with City Ordinance No.701 relating to City Park regulations,the sale of a product or services in a public park must be authorized by the City Council. Motion by Hill to grant the request.Second by Swanson.Motion carried. WESTLAKE HOUSING A letter was read from Chet Waggener,City Manager,- -"Ed Zavala had recently contacted me regard ing sanitation and general housing problems at Westlake.Mr.Zavala represents the State Commission on Mexican-American Affairs.We have visited with residents in the area and have had further discussions with representatives from the U.S.Bureau of Reclamation,Grant .County Health District,Grant County Housing Authority,General Services Administration and HUD.We had attempted discussions in the West- lake area last year but were thwarted in our efforts to establish open communications necessary to determin ing what the people there actually desire as problem solutions.The principle change at this time is Mr.Zavala,who has good rapport in the area,can communicate with the people and is genuinely interested in helping solve their problems."He requested Council concurrence in City Staff participation of continued efforts to work with various agencies toward a resolution of problems. Chet Waggener added,that following Mr. Zavala contacted him, he and Mr. Zavala spent 4|hours a week ago Sunday visiting with people In the area,discussing their problems;what possible alternatives there might be.Neither Mr.Zavala nor.I promised anything at that point other than simply an interest in trying to pursue alternatives to problemsand see what we could up with.Mr.Zavala is here this evening,it might be appropriate for him to address the Council,if he has any comments for you. Ed Zavala stated the basic reason that he came here was upon request of Nicki Ledgerwood,daughter of Manuela Hermandez,who are residents In Westlake,with the understanding that they were having trouble |P0\f \o: r~~i 2223 City Council Meeting Minutes:7 May 13, 1975 out there In the way the people were living and the conditions regarding the water problem'.I have had contact with Mr.Waggener,with the Bureau and the Housing Authority with the understanding that maybe we can work out something for the people as far as finding better homes or perhaps a sewage treatment plant,because the homes are substandard,they don't go by any code;they were built 30 to 35 years ago. As far as the city,the interest hasn't been there,and as far as the Bureau of Reclamation,in some cases I think the Bureau is liable for the underground water saturation.The problem of the water is throughout the whole Westlake area.Ttwas noted that Mr.Garcia,he is on a higher level,and he said his septic tank is supposed to be good. Mr.Garcia was present,and stated that last year we had several meetings with representatives from the Bureau.They talked about people having problems because of poor drain fields.I did hive problems with my property and also with another piece of property where it did start backing up. The first part of last year I established a new drain field and right now it is very good.Right now it is not a poor drain field problem,It is the water level is too high. Ed Zavala stated it is what you might call saturation.Right now the water level is somewhat lower ' than usual.But basically who is liable as far as the Westlake area I am not here to put anybody on the defensive,but only to make you people realize that you have not done enough..in that area.'They have been ignored for quite some time now. Mayor Ebbert asked Mr.Zavala,what is your recommendation ? Ed Zavala stated,at the present time we are trying to work something ou£with the Bureau.It is basically the water,and at the present time I don't have any recommendation.I have only investigated it.At the present time have looked into the HUD situation in order to get some funds.As far as the sewage treatment,if the City isn't going to do anything about it let's get HUD into it.Of what I hear 20%of all HUD grants go to the rural areas.Perhaps we will have to wait another year,but it is something to think about,-,but I think it also should be worked on as far as the City is concerned.Also hope the City Council will approve some way to solve the problems out there. Chet Waggener added that tests are being run today as soil moisture tests.One of the questions we have asked the Bureau to address themselves to,which they have never done before,is what is the effect ofcapillary action that raises the water perhaps above the actual watertable to Vgh^e^e the s°ii is saturated perhaps a foot or two above the water table itself where it would make septic/inoperable.They sent their field crews in and taking soil samples,immediately sealing them in airtight containers and sending them into the labs and checking soil content for moisture content of that soil.So this is a step beyond what they had done at least last year. Ed and I in our discussion agreed there are a lot of options that need to be reviewed with this,and I don't propose at solving those this evening.I wanted the Council to be aware that we have been doing some work on this,and again wanted the Council's approval to proceed with investigations in any direction that it leadsus with the understanding that we will report to Council periodically to advise what'is happening. Some of the possible alternatives are dependent upon the desires of the citizens in the area in terms of .what they want to do in the area.We need to be able to communicate with them and find out what they would like us to do.We will have some possible alternatives to go back to them with and see which approach they would like us to pursue.Perhaps a 'shotgun'approach at this point,but I think that is the necessary approach in order to find a solution to it.At this point we are only talking about staff time. Bob Hill asked whether families were offered to move out to the Base that Sunday you were out there? Chet Waggener replied that we discussed with them the possibility that if they desired to do that we might be willing to investigate that kind ofa program with them.They were not definitely told there was housing there nor were they encouraged.•:.-••'• Bob Hill -was there a dollar figure put on it?Chet Waggener replied,no,there was not. Ed Zavala added that he found out that the Housing Authority is buying some homes on the Base and it is their understanding if we work with them some sort of program or through HUD that if people desired to move on the Base then it could be done;there are homes there that could be renovated.Other than that no promises were made and no commitments were made.It is the desire of the people out there that they want something done.Prior to this there has been a lot of 'lip service'to the people of Westlake,and I hope that after this the people will look on things a little more concerned.I think the Council people should go out there one of these days and see what it looks like.Some of the people are concerned that water it self is poisonous.The children are playing in the soil and come up with ailments and yet at the same time you keep ignoring this.In Othello they have aljealth Center for people to go to for their needs in every,way, and here in Moses Lake there is a need,they go to the Doctor and the Doctor just sends them back home. We have a strong 40%Mexican-American-population here and yet,in my mind it is observed when it comes to the Mexican-American working for you it is fine,but when it comes to their needs,the City government as well as the Anglo community disregard their needs.U is time also we have some representation on the City Council.The Mexican-American has become a second class citizen within the system. Mayor Ebbert noted,I hope you realize Mr.Zavala as far as that water table is concerned our hands are tied,that is a Bureau problem.If we can force the Bureau to do something,then we ought to do it.As 2224 City Council Meeting Minutes:8 May 13, 1975 far as the City Council is concerned,hive somebody run.They have to be voted in by the people. As far as saving lives of kids playing in that dirty situation out there,I don't know what in the world we could do about except helping them to move out. Mr.Garcia stated he would like to see if could set a meeting so we could have representatives of the Bureau present so we could talk to them and see what they can do about this problem,because the pro blem is there,and as far as myself,I am getting a little tired of waiting and nothing is getting done about it.Agroup meeting with the Bureau and the Health Department and ourselves and see what can be done. Mayor Ebbert stated that is something the Staff could work on that Mr.Waggener is requesting the Council's permission to let the Staff go ahead on something. Chet Waggener addressed himself to that a little bit.I hinted at it a little In my letter when I said last year our efforts to communicate with the people In the Westlake area were 'thwarted'.Those efforts have been attempted to be made again this year.For instance when Ed and I were out touring the area talking to the people,by the time we reached the fourth house to talk to people privately they were already getting tele phone calls telling them that we were misrepresenting ourselves and those people out there should not talk to us.That is the kind of thing that makes it very very difficult for us to do anything.As it happened the people told us that and they went ahead and talked to us anyway.Those kind of telephone calls don't help us a bit.We heard this evening - Pat Lightel,2426 W.Peninsula,Interrupted stating she got two phone calls from Westlake.I in turn told them I would do what I could for them.I in turn called Mr.Sylvester Gonzales and I said I understand Mr.Waggener and a Mexican fella are out there,he said he is from the government,I said,if he is from the government have him show you his credentials.That is the only phone call I made,because I thought it was kinda strange for you as a government employee to go out there on a Sunday afternoon when it was not discussed in Council,when these people have tried for one solid year to get help. Chet Waggener stated,Mr.Mayor the point I would make and the request I made in my letter is the opportunity to work with the people in Westlake to help solve their problems.I don't think we need the help from'other people representing the people in Westlake;•Lthink that has been the problem too long.I think we would like the opportunity to work with Mr.Zavala and to work directly with the people that live in Westlake to . determine their problems as they express!It,personally,not as it is expressed for them. Mayor Ebbert asked Mr.Zavala -is that what the.people in Westlake want?Ed Zavala stated the people in Westlake know exactly what is going on,and that they respond for themselves. Mayor Ebbert asked if there are any people living in Westlake at this time that would object to the City Staff working with the people out there? Cesar Adame,Dusty Street,Westlake,stated = I would like a special meeting with the people in Westlake and have them notified legally and have a.meeting here set for us with you and have Pat Lightel come in with her documents -she has all the papers from years back -bring it out and see what you people promised us and we haven't got.That is what I would like.I should know,I live otut there. Mayor Ebbert asked,do you object to the City Staff working with the people out there as per Mr.Waggener's request of the Council at this time? Cesar Adame responded -Yes,I do.Have the City Council and the people of Westlake and Pat to represent us because s,he has all the documents... . • Mayor Ebbert stated.The City Council can't go out there and do the job,the City Staff would have to do it. Cesar Adame - I don't care if they go out there. Unidentified Woman -Westlake resident - I think the Staff should go out there and look at our houses and look at the way we live and you can see for yourself.Maybe you will get something done. Mayor Ebbert - We are getting two answers here.Some people are objecting and some of them are not. Unidentified Woman - The only objection is that a lot of people can't speak English;misunderstand English, and they should have somebody who can interpret for them. Chet Waggener added,that the point wewould like to make Mr.Mayor,and I think the Council understands, that I have no objection whatever to a group meeting except I think,as you have seen before,that group meetings don't accomplish anything except re-hashing the problem of which I think we are very much aware. I think with working with Ed Zavala and working with the Bureau of Reclamation and I think we can try to find solutions to those problems instead of merely re-emphasizing them. I am not very interested in talking whattheproblemis at this point, I think we know the problem,and I think it is a serious problem and the people have a very legitimate complaint,and probably a very legitimate complaint that we haven't done enough for them in the last couple of years as far as that is concerned.I would liketo feel that we are expressing a genuine Interest in tryihg to work with the, people in solving their prciiems in a manner satisfactory to them. The only way we can do that is if we can work with them on a direct basis. Bob Hill inquired if Mr. Zavala lived in Westlake.Zalvala stated he did not. Hill noted that perhaps one of their own Westlake residents would represent them. Ed Zavala stated it is not his job to represent them,Cesar Adame could do just as well,because he lives out there,and Pat Lightelwho is Just plain concerned. I don't think she comes to those meetings to be a radical element,I think she does give a darn what Is going on out there.I think this should end once and for all.Instead of what has happened before and arguing about it and what never happened, it is time to get on the case and start working on the situation.I think the people in the area themselves that live in that area should get together with the Staff and then come up with some solutions. Pat Lightel - If Cesar wants my help I will be more than glad to. I don't want to cause nobody any trouble,because those people reed help. Ed Zavala commented = I will work with Pat, because I can understand their problems too.Inlhe samecaseI feel that the people of Westlake can do better if they have some representative speaking for them. Pat Lightel -But I also ask this, that I ask for no private meetings,I do not think it is fairto the people of Westlake that if Mr. Waggener gets your authority to go ahead and do It that he hds a private meeting with the Bureau Reclamation or others.Before he talks to any of these people someone from Westlake should be right there with him. ChetWaggener - If the inference Mr.Mayor Is that therehave been private meetings,the meetings thatI have had with the Bureau of Reclamation,with the Health Department or whatever meetings we have hadin the last week and one-half Mr. Zavala has been at every meeting I have attended,and there have been no others. Mayor Ebbert stated that coordination is the onlything that will do it. Is the Council In favorof giving the staff the go-ahead on it? Motion by Boyle the City Staff be directed to wo.rk with the people in Westlake and report back at Council meeting of any progress that has been made and possibly set up at Citizen Input or some other time at Council meeting,a time when there can be Input from the people at Westlake as to what they feel whether progress has been made or not madein the particular area.Second by Moe. DEDICATION OF LARSON SEWAGE TREATMENT PLANT A letter was read from Jerry Fay stating on May 1,1975,representatives from the Department of Ecology and Environmental Protection Agency completed their final inspection of the Larson Sewage .Treatment Plant. The only item remaining to be completed by the EPA is their audit,which will take place some time this year.The final project cost was approximately $818,000. As the plant is completed and in total operation, he recommended the City Council conduct an openhouse at the plant on May 23,1975 for official dedication.If this meets with Council approval,Bob West will be in charge of coordinating the open house and arranging publicity. Jerry Fay addedthat possibly the timeto be 2:00 P.M. to 4:00 P.M. onthat day. Hedid also call the Council's attention to the three drawings on display that will be permanently placed at the LarsonSewageTreatmentPlant, these drawings explain whatis involved out there and whatwe spent $818,000 on.Headdedthat we have had some suggestions on unique types of ceremony, not.a ribbon cutting but a flushing type ceremony - mounta toilet and flush it.The Council thought this very hilarious.Mayor Ebbert commented,"instead of cutting a ribbon,pull a chain'.' Jerry Fay stated the City Staff wL0£coordinate the open house, but the ceremony should be carried out by the City Officials. GUIDELINES FOR NAMING CITY PARKS \Mfc~A letter was read from Cecil Lee,Park &Recreation Director,stating at the January 13, 1975 City Council meeting, the Park &Recreation Commission was asked to establish guidelines for naming of Darks and other recreation facilities.He submitted guidelines which were unanimously recommended at the regular Commission meetirgin April,for City Council approval. Bob Hill asked,why wouldn't the Park &Recreation Commission be the Committee rather than the Mayor appointing another Committee? Cecil Lee replied,this discussion came up at the last Commission meeting and they stressed the thought if the Mayor so wanted the Commission to be that Committee he could do so orhave the prerogative of naming another group in case he wanted to.They thought it would be flexible that way. Mayor Ebbert commented that the final action would be by the Council regardless. Bill Moe commented that he thought the Commission should be complimented on touching all the bases possible,and it looks like they have done a real good job.
