ORDINANCE NO. 730 -PARK CONCESSIONS - (2nd reading) The ordinance was read by title only amending Section 1.36.24 of Chapter 1.36 of the Moses Lake City Code entitled "Park Regulations"by changing the procedure for issuing concession permits. Motion by Skaug for the adoption of the ordinance.Second by Hill.Motion carried. ORDINANCE - STUDY SESSION (1st reading) Aletter was read from Mayor Ebbert stating the attached ordinance establishes the third Tuesday of each /(J$ month as a regularly scheduled study session.This conceptwas discussed at the study session heldWednesday,September 10,1975.The additional meeting is intended to allowthe Council to hear and dis cuss with city staff the variety of reports that take up space and time on a formal agenda. It will also provide an occasion to discuss other types of general information items,plus subjects that will becomingtoCouncilforaction at some time in the future.The ordinance also indicates these study sessions may also be designated as a regular Council meeting, should the need arise.He recommended the Council establish the third Tuesday of each month as a regular study session. Hill, Johnson and Swansonconcurred to the fact they felt an ordinance was not necessary since theMayor had the prerogative to call a special meeting or study session whenever he felt it was recessary, and also,therefore,felt/regularly"scheduled third meeting wasn't necessary. City Manager Waggener:By ordinance the meeting would have to be by official publication notification and with an agenda specifically listed,just as you would call any special meeting.The intent of the ordinance as I understood it from the Council,was it was to establish a regular study session on the third Tuesday of each month. We simply did not want by ordinance to lock that in where it could only be a Study Session and included the possibility of your calling a Special Council Meeting to conduct normal city business. Mayor Ebbert added that he was directed to have the City Attorney draft an ordinance to present to the Council tonight.It was my understanding that is what the council wanted. Skaug -"Mr.Mayor you have fulfilled the wishes of the Council.There were four of us at that study session,but we were unanimous in our directing Mr.Ebbert to propose this ordinance for our considera tion." Motion by Boyle to pass the first reading of the ordinance.Second by Moe.Motion carried. Opposed by Hill,Johnson and Swanson. ORDINANCE -MAYOR AND COUNCILMAN SALARIES (1st reading) A letter was read from Councilman Bill Moe stating because of increasing responsibilities and duties being required of the Mayor and Council members,that an adjustment in their salary schedule needs to be made at this time.He requested city staff to prepare the accompanying ordinance showing an increase in the Mayor's salary to $300 per month,and each Councilman would receive $100 per month with no requirement as far as attendance is concerned.At the present time there are 24 regularly scheduled council meetings that require the Council's attendance each year;twelve more are being planned soon.In addition to these meetings an effort must be made to attend as many city functions as possible.AWC meetings are important and should be attended by all.Budget time is near and this re quires more meetings.Every Councilman is appointed to various groups and committees that require attendance throughout the year.If the City is to be adequately represented at these meetings,then these meetings must have a representative there.He encouraged Council support on this proposed change in salary structure for the office of Mayor and Council.The ordinance was read In its entirety. Motion carried. /o/oh City Council Meeting Minutes:3 September 23,1975 .CONSIDERATION OF BIDS & REQUEST TO CALL BIDS - RESERVOIR #5 PROTECT A letter was read from Public Works Director Jerry Fay,stating bids were opened on August 27,1975 for the following Projects: 1.Reservoir No.5.2.Nelson Road Transmission Main.3.S.R.17 Undercrossing. He recommended the following be awarded: 1.Reservoir No. 5 -Alternate B=Pittsburgh-Des Moines Steel Company -$332,283.00 2.Nelson Road Transmission Main =Cass Brothers Construction - $50,968.64 3.S.R.17 Undercrossing =Empire Boring . - $11,970.00 These contracts are portions of the Reservoir No.5 Project and are funded,40% of construction costs by the Department of Social and Health Services through Referendeum 27. He also requested the Council grant permission to advertise for bids to construct the foundation as quickly as the tank contractor provides the design drawings and specifications.Estimated..cost of the foundation is between $60,000'and $80,000. Motion by Hill to accept Item No. 1to Pittsburgh-Des Moines Steel for $332,283.Second by Johnson. Motion carried. CIVIC CENTERCOMPLEX &RECREATION CENTERCITIZENS COMMITTEE - GUIDELINES yi ,* Otto Skaug inquired whether there is a total of 40 or 50 volunteers ?Mayor Ebbert stated that to date there are about 22 or 23.Skaug responded,stating that perhaps we are thinking in a larger number than that,and also we would like to get a complete cross-section of the community as we go;most committees operate on 40,60 or 80 people. Mike Boyle concurred that number is not large enough,nor enough to select a chairman at this upcoming meeting on September 24th. At this time no one has screened any of them,these guidelines simply give the committee direction as to how to go about forming their own function,stated Mayor Ebbert. After numerous suggestions from the Council,it was their consensus to have the committee meet and get to know each other and schedule a meeting two weeks hence,hopefully having more volunteers by that time also,and select a.chairman and co-chairman at the next meeting. Motion by Swanson to therefore change the guidelines under "Formation"A.to change the selection of a Chairman from the Meeting scheduled for September 24,1975 to the next meeting possibly two weeks hence if the City Council is satisfied the committee has broad community representation. Second by Johnson.Motion carried. GRANT OFFER -WASHINGTON STATE AERONAUTICS COMMISSION -AIRPORT LIGHTING A letter .was read from Asst.City Engineer Ron Baker,stating the City has been informed by the Washing ton State Aeronautics Commission that our grant application for new airport lighting has been approved on a limited basis.The State will supply the new lighing fixtures for the runway but they cannot provide the electrical wiring.He recommended the Council accept the offer and that purchase of the wiring (approximately $1,300) be authorized from the airport maintenance budget.Installation of the new lighting , system will be by volunteer labor assisted and supervised by City crews. Motion by Boyle to accept the offer.Second by Johnson.Motion carried. PERMIT TO EXPAND NON-CONFORMING USE -M.E.MAYFLOWER Aletter was read from Associate Planner Stan Bech stating,the Planning Commission held a public y/s^hearing on September 11,1975 to considera request from Bob Bernd to expand M.E.Mayflower at /OOI2000WestBroadway.The Planning Commission recommended to the City that the expansion be permitted.M.E/Floweris a non-conforming use in a Highway Service zone. Ordinance No. 593providesthat the City Council,after the Planning Commission has helda public hearing,may issue a permit for expansion of an existing non-conforming use or structure.No permitshall be issued unlessthe Council finds the proposed expansion will be compatible with the land involved and that itwill not be detrimental to the surrounding area. He recommended the Council grant the permit to expand and that no bond be required. Bill Moe inquired rfStan regarding the proposed rezonlng inthat area,whether MEMayflower would be conform,and Stan said they would be, but if the rezoning did not go through this would assurethem of compliance with the ordinance regarding expansion. P to City Council Meeting Minutes:4 September 23,1975 CITIZEN INPUT Harold Sandberg,living in the vicinity of 5th and Alder,stated there have been three bad accidents on that corner within the last eight days.He is not suggesting a remedy,but trying to call attention to this bad corner,that something needs to be done,if the city is aware of it.City Manager Waggener agreed it is an accident prone corner,although there is a stop sign there it is so far off the side,and the 'stop ahead'sign veers off.We tavo discussed this at the staff level this week.Since then the 'stop ahead'sign has been made larger and applied thermo-plastic to make it more visible. Virginia Hill -Want to compliment the Park Department.The Parks are in good shape.Have never' seen them this well-kept and green before.Chet Waggener agreed the Parks are looking better than any year before,that Cecil is doing a good job. If the Council will remember, in the Areas of Emphasis Cecil indicated he wanted to do a better job in the Parks than in any year. STATUS/INF ORMATIONAL a.Preliminary Draft -Affirmative Action Plan -City Manager: City Manager Waggener stated the City has been operating with a letter of intent as an "Equal Employment Opportunity Employer",but the law now requires a formal program of "Affirmative Action".(The Council received a copy of the preliminary draftl It is not in ordinance form, but will be eventually.The goals have not been filled out,and there are probably some changes in terminology when we refine it.It calls for a policy decision by the Council,and it would become by ordinance a policy statement.We will be coming back to the Council with more detailed information on it and probably with some refinement of the draft itself. ************** b.Introduced Pat Acres,Assistant City Attorney.Announced John Calbom,City Attorney,asked to be released as sucheffective November 1,1975, and Pat Acres will become the City Attorney. ************* c.Set the next Study Session -Council concurred to meet in Study Session on October 1,1975 at 8:P.M. ************ e.M. G.McLanahan,Chairman -Environmental Programs Policy Committee - by Public Works Director. A letter was read from Jerry Fay stating that at the August 21,1975 meeting of the Environmental Programs Policy Committee,formerly the Overall Program Policy Committee of the Water/Wastewater Training Advisory Committee,M.G.McLanahan was elected Chairman.He would like to take this opportunity to commend Mac for his past work on the Committee and his election as Chairman.He also submitted a copy of the Organizational Chart of the Environmental Programs Policy Committee which illustrates their role in environ mental policy decision making.
