:I Mayor Ebbert called the meeting to order and asked Frank Jackson of the United Methodist Church tov_,Lli give the invocation, after which the Mayor proceeded with the order of business and called for approval
of the minutes of the previous meeting of October 28,1975.Motion by Hill and second by Boyle to
approve the minutes as written.Motion carried.

^PARK &RECREATION DEPARTMENT AWARD
Aletter was read from Richard T.Doughty,Bureau of Developmental Disabilities, Case Service office /O/JZ
in Spokane,Washington,stating Moses Lake received statewide recognition for outstanding leadership
with recreation programs for the handicapped at the Washington Recreation &Parks Society conference
recently.The Distinguished Service Award is for'the Moses Lake Park &Recreation Departmen:extra
ordinary efforts in a cooperative program with GrantCounty Training Center ina unique summer program
where the handicapped were successfully integrated into the mainstream of general public programs.I~"The main thrust was to attempt to normalize the handicapped by placing them in recreation prograr.s with
•non-handicapped.There are other programs for children,but not one that is so individually oriemed
( and geared toward integrated playexperiences. Most important,the children accepted oneanother, and^J the flexibility and dedication by the Grant County Training Center and Moses Lake Park &Recreation Depart
ment was the real key to the success of the program.The Moses Lake program is indeed a model for all
communities.
«Mayor Ebbert presented the Distinguished Service Award plaque to Cecil Lee,Park &Recreation Director.
Cecil Lee commented that the success of this program is a good example of what two agencies car.do
when they pool their resources.He also gave special recognition to the Grant County Training Center
for their part in the program,as wellas to his Assistant Jerry Thaut for the many hours he gave to this pro
gram,and also commended the Recreation Supervisors and Swimming Pool Staff for their efforts in this
porgram.
ORDINANCE 741 - PUBLIC HEARING - EASEMENTVACATION -KENT TONES
Aletter wasread from Stan Bech,Associate Planner,stating the Planning Commission at their regular /D/3
meeting on September25,1975,recommended to the City Council that the ten foot public right of ;vay
easement between Lots 8 and 9 of Dahlia Replat No. 1be vacated as requested by David "Kent"Jcnes.The easement in question was requiredin the original plat by the Moses Lake Subdivision and Platting
^Ordinance which calls for a ten-foot public easemertthrough any block which is over 660 feet in length.
He recommended the easement is not necessary and the Council approve the accompanying ordinance
and waive the second reading of the ordinance.He also added there are no utilities involved since this
is only a public right of way easement;it was not meant for utilities.
Mayor Ebbert opened the public hearing to determine if there careany objections to this vacation.
He called for comments or questions from those in attendance.There were none. He,therefore,closed
the public portionof the hearing and turned it over to the City Council for their comments or questions.
There were none.Neither were written protest filed.
Motion by Skaug to close the public hearing.Second by Boyle.Motion carried.
The ordinance was read by title only vacating a public right of way easement between Lot 8 and 9 of
Dahlia Replat No.1.
Motion by Hill to pass the ordinance.Second by Boyle.Motion carried.

City Council Meeting Minutes:2 November 11,1975
ORDINANCE -SAMMONS COMMUNICATIONS.INC.(first reading)
A letter was read from City Manager Chet Waggener,along with a franchise proposed by Sammbns
Communications Inc,to replace their existing T.V.Cable franchise which expires December 31,1975.
The City Attorney,Pat Acres and City Manager met with Bill Strange,Vice President of Corporate De
velopment for Sammons Communications,and the franchise incorporates the changes discussed.Also
the City Attorney will be prepared to suggest any changes resulting from that discussion.Should the
City Council approve the first reading of the franchise,a public hearing is required before adoption.
Mr.Strange was introduced and he reviewed the franchise ordinance in detail along with some of the
changes suggested in discussion with the City Attorney and City Manager,along with changes required
by the FCC.
A letter was also read from City Attorney Pat Acres submitting proposed modifications to the Franchise.
Motion by Hill to accept the first reading of the ordinance and set December 9,1975 as the public,
hearing date.Second by Swanson.Motion carried.
ORDINANCE -ENVIRONMENTAL POLICY REGULATIONS (first reading)
The Environmental Policy Regulations Ordinance has been reviewed by the Planning Commission and
recommended final approval by the City Council.The ordinance is an effort to provide Moses Lake
with a comprehensive yet easy to follow set of regulations which comply with the 1971 State Environ
mental Policy Act.The ordinance sets specific requirements on what projects require Environmental
Impact Assessment and/or Environmental Impact Statements.It also establishes what projects would
be exempt from the procedures.It clearly states exactly what procedure will be followed in reviewing
a project,assessment,or statement.
Associate Planner Stan Bech recommended Council approval of the first reading of the ordinance and
set November 25,1975 as the public hearing date in order to consider the second reading of the ordinance.
Upon inquiry from Mayor Ebbert whether there is a possibility the State can come in and overide our
ordinance,Stan stated,in the final review of the State Guidelines which the State is considering
there may be some small changes that we will have to amend the ordinance at that time.
The ordinance was read by title only.Motion by Moe to accept the first reading of the ordinance
and set November 25,1975 as the public hearing date.Second by Boyle.Motion carried.
^RESOLUTION NO.738 -REQUEST TO BUILD ON UNPLATTED PROPERTY -CARL THOMPSON
A letter was read from Stan Bech stating the Planning Commission at their regular meeting of October 30,
1975,recommended to the City Council that Carl Thompson be granted permission to build on unplatted
property with the following condition:That no occupancy permits shall be issued for any buildings until
all platting requirements have been completed.Hefecommended that the accompanyihgresolutl^rt^&f^•-
build on unplatted property be approved.Stan also pointed out on the plat map what improvements
Carl Thompson would be responsible for in order to meet platting requirements.
The resolution was read by title only permitting Carl N.Thompson to build on unplatted property
in accordance with Chapter 3.4,Section 3.4.08 of the Moses Lake City.Code.
.Motion by Boyle;second by Hill to grant the request for Carl Thompson to build on unplatted property,
and adopt the resolution accordingly.Motion carried.
CONDITIONAL USE PERMIT -SHOREWOOD TRAILER PARK
The Planning Commission at their regular meeting on October 30,1975,recommended to the City Council
that J. D.Jameson be issued a conditional use permit to expand the Shorewood Trailer Park.The^area.._._.
is zcned R-3, (Multi-Family Residential),which permits trailer parks,as a conditional use.The Planning
Commission did.not recommend any special conditions be set on this permit.Stan Bech recommended the
conditional use permit be approved.
Stan pointed out on thevicinity map the expansion area consisting,of Lots 28,29, 40 and 41, and noted
these new additions will be served by sewer.
Motion by Moe that J. D.Jameson be issued a conditional use permit to expand the Shorewood Trailer^
park as Indicated in Stan Bech's letter and recommended by the Planning Commission.Second by Boyle.
Motion carried unanimously.
.\REQUEST TO BUILD ON UNPLATTED PROPERTY -STANLEY AECK
A letter was read from Stan Bech stating a letter had been received from Stanley and Rose Aeck requestingthey be granted permission to buildon unplatted property.In his letter Stan Bech called City Council's
attention to Ordinance No. 204,Section 2,as passed by the City Council of Moses Lake on July 28, 1953
which states:"No building permits shall be issued in unplatted areas)except upon resolution by the CityCouncil and with such requirements and conditions as the City Council may require.".He.also added that
in the past if a person desired to build on unplatted property he was first required to submita preliminary
plat ofthe property in question to the Planning Commission and a public hearing is scheduled two weeksfollowingthe initial presentation, to consider the preliminary plat. If the preliminary plat is approved atthe public hearing, then the Planning Commission will consider the request to build on unplatted property.

At this point, one or both of the following conditions could be stipulated:1. One condition would be
to require a bond in an amount which would cover the cost of completing the'plat,including all minimum
improvements; or 2.Asecond condition would be to state that no occupancy permits shall be issued
for any buildings until all platting requirements are completed.
This preliminary plat has not yet been considered by the Planning Commission,nor has the request to
build on unplatted property been considered by the Planning Commission.He recommenced this request
be sent to the Planning Commission and follow the same procedures as have been followed in the past.
• The letter from Mr. &Mrs.Stanley Aeck was also read,stating they would like the City Council to
hear their request for a building permit to construct a mini-storage facility on property located at Third
and Fig Streets,which property at this time is unplatted. 'Their goal on this project is to get it started
and completed before freezing weather conditions prevail.In view of the elements involved,time,costs,
etc.,they are most anxious to get started,and,therefore,request issuance of a building permit. Also
added they have a preliminary plat of the prperty in question for review at the next Planning Commission
-meeting.
Bob Hill inquired if there is a zoning problem. Stan Bech stated that..is no problem, the development is ..
compatible with the zoning.
Motion by Hill the request go back to the Planning Commission and go through the proper procedure.
Second by Boyle.Motion carried.
Stan Bech added that in that instance it could possibly come back to the Council for their final approval
possibly on December 9,1975.
CONSIDERATION OF BIDS -RESERVOIR NO.5 FOUNDATION
Jerry Fay, Public Works Director,submitted a letter stating sealed bids were opened on November5,1975 /
for the foundation for Reservoir #5.The Engineering Division has thoroughly reviewed the low bidder and
their qualifications,and recommended the City Council award the contract to Northwestern Construction
of Spokane for $70,234.50 as the low bidder.
Motion by Boyle to accept Northwestern Construction's bid for the Reservoir #5 Foundation.Seccnd by
Moe.Motion carried.
ACCEPTANCE OF WORK:
a.Larson Tank Rehabilitation -Schedule B.
/ATheH.O.D.Company has satisfactorily completed all work on the removal of the old Larson Water
Tank under Water Tank Painting and Repair Contract -Schedule "B".Public Works Director Terry Fay
recommended accepting the work on the project and enter into the 30-day lien period.
Motion by Moe;second by Skaug to enter the 30-day lien period.Motion carried.
b.Lakevlew Terrace Transmission Main
The Ridge Construction Company has satisfactorily completed all work on the Lakeview Terrace
Transmission Main Project.This project consisted of a 12"water transmission main which connects
Reservoir #2 with Pressure Zone No.2.This is part of the Reservoir #5 Project.The Public Works Direct"
recommended accepting the work on the project and enter into the 30-day lien period.
Swanson moved to accept the recommendation and enter into the 30-day lien period.Second by Boyle.
Motion carried.
STATUS/INFORMATIONAL -Community Development Block Grant Workshop:
City Manager Chet Waggener reminded those that planned to attend the Richland meeting regarding
the Community Development Block Grant Workshop,that it is scheduled for November 16,1975 frcm
9:30 to 4:30 P.M.and will be held at the Federal Building.He added,the workshop held in.Spokane
was very informative and interesting.Although we cannot meet the pre-application date limitation
and requirements,but it is still important for the Council to avail themselves of the opportunity c:the
Community Development Act that will allow participation in it a year from now.There is a great deal of
good Information to be obtained;questions were well answered.Also the rules and regulations have
changed somewhat,and the government is very broad in restrictions as to how the funding would be
Implemented.
Street Design Standards Committee:
Chet Waggener informed the Council that he received an appointment from the AWC Present to
the Street Design Standards Committee.The Street Design Standards have not been revised sine.1962.Fie
accepted the appointment,if the council has no objection.The other members are the Public Works
Director of Tacoma;City Engineer from Spokane;City Engineer from Ellensburc;City Engineer frcm
Seattle and Public Works Director from Vancouver
Preliminary 1976 Budget:
The preliminary 1976 Budget was presented to City Council.City Manaaer Chet Waggener comme-ted it is i/

City Manager:-Council-Staff Team Development Workshop - December 4, 1975.
City Manager Chet Waggener commented,- at thefirst study session held regarding policy statements JQ/
by the City Council, communications was discussed,and indicated at that time the City has been work
ing at the staff level with DonSwartz,from Tacoma,who is with the Effective Resources Group, and held
an organizational development type meeting with him. This work was done through an IPA Grant,a govern
mental personnel association grant,100%funded at no cost to the City.Acommitment was made with Don
to have him paid in full and leave him owing the City one day.As was discussed with Council at that time
was the possibility of using that day to work with the Staff and City Council in a full day meeting to develop
definite action steps that could be taken for increasing and maintaining effective working relationships
dedicated to the same goal in providing the best possible services for the people in the community.It
could be very beneficial,however,only if we have a full commitment from both Staff and Council to partici
pate.December 4th is about the only day schedule-wise without delaying it beyond February.
The Council concurred on the date,and Council as well as new-members confirmed attendance at the
December 4th day meeting.
Change of date for November 18th Study Session:
In order not to conflict with the Farm-City Banquet on November 18, 1975,Council discussed changing 'V /
the date of the Study Session scheduled that same night.Motion by Hill to change the scheduled November 18,
Study Session to Wednesday,November 19,1975 at 8:00 P.M.Second by Boyle.Motion carried.
