Members present:-Councilman,Robt.Hill,Bill Moe,Mike Boyle.Gordon Ebbert,Don Swanson and Otto Skaug.Councilman Norm Johnson was not present. Mayor Ebbert called the meeflng to order,and called for approval of the minutes of the Council meeting of November 25th.Motion by Hill to approve the minutes as written.Second by Boyle. ORDINANCE -PUBLIC HEARING -FRANCHISE FOR SAMMONS COMMUNICATIONS (second reading ) Mayor Ebbert opened the public hearing and asked for questions or comments from those In the . audience. Gene Oakley,1026 Cascade Avenue,also owner and operator of Superior T.V.Sales &Service, had a letter which he read,in which he stated he is interested in the new Cable T.V.ordinancesJ as a concerned citizen wanting to improve the future quality and dependability ofTV reception in our homes both through Cable TV and over TV translator stations.Has been a technician and businessman over the last 18 years and had many opportunities to assess the quality of TV pictures in his travels and chances to compare them with other operations.His observations lead him to believe there is need for improvement here in Moses Lake.Without going into detail,a good ex ample would be the utilization of microwave lengths to bring in clearer pictures from the Tri-Cities. Adjacentchameloperation seems to be the cause of muchJrouble necessitating the lowering of signal levels below the accepted standards to minimize interference between channels. There are many things the local cable company would like to do if .giventhe money to do so,although the City Administration apparently has not even a balance sheet from this company on the Moses Lake operation to use in their deliberations,though the ordinance allows for same.It may be in fact thewhere-withall to help the local people do a better job for us. Has no suggestion on how the city can Induceany changes in the local Cable TV system, other than bringing the forces of competitiontobearbydenyingthefranchisealtogether. His letter continued,statrng that it shouldbe noted that unlikeother monopolies there is no govern mental bodyregulating Cable TV companies in certain Important areas of performance other than the city issuing a franchise.The franchise before this city seems to be more protection for SammonsCommunicationsthan the citizens.With.paid TV no longer an idea, buta reality, ordinanceswith cities dealing with paid TV may be in order.Also the Council and Administration of Moses Lake recognizethat weare the hubof an expanding rural community;are these peoplegoingto be denied theipopular programs they now watch on free TV?While this may seem of little importance,the CouncilshouldbecognizanttonotethatCableTVcompaniesandtheirmicrowaveaffiliatesshouldberequiredtomaketheirsignalsavailabletoruralresidencesoverTVtranslatorsatreasonablerates.EveryonethenwillhaveavailablethequalityofTVprogrammingandnotjust a few who can afford to pay CableTViftheyarefortunatetohaveitpasstheirhome. BillStrange stated that we are hare in public hearing concerning the franchise,because our present franchise is expiring.To remind and refresh the Council's memory,.in-1972 the FCC published its reported order which states that any franchise thatexpires or is renewed after 1972 must contain cer tain provisions,and that every cable operator in the United States must receive a certificate of compliance to continue to operate,which is issued by the FCC. In the franchise,as presented to Moses Lake, the Administration has increased requirements on the cable company as an operatoralmostten-fold inthe amount of protection ofthe citizens,that is in insurance coverage,liability and operations within the city - which are all part of the franchise.He highlighted the franchise in case some had not had an opportunity to look at it. Bill Strange reminded the Council that the cable company at the present time does rot have rate control.When the new franchise is passed the.rates come under the city's regulations.This has been dictated by the FCC and applies to every city in the United States by March,1977.Alsowe are not regulated as a utility because we have been defined bythe courts as not a utility.Also have lots of competition -such as Gene Oakley and his Translator,and have 600 homes in this area that elect not to takethis service.When this franchise is passed,a complaint officer is established and the complaint officer's name is on record with the FCC in Washington.Also must malntal n a service log listing the complaint,the nature,the procedure and what has been done about it.Further more,we have to perform FCC tests every year. Regarilng protection to the citizens =if the franchise is passed,the new rates would not.become effective until February,1976.-Always have the right to inspect the records.The Cable Company complies with standards of the National Electrical Code and Safety Code. Procedures for public hearings;heretofore in many instances it was not required.Once this franchise is passed we can not touch the rates without an advertised public hearing,which then would be a rate hearing.If the FCC modifies the rules,the Cable Company is required to pay if any costs are involved. Bill Strange responded to Paid TV that was mentioned. = This is in an experimental stage he noted. We have five systems wherein we use paid television - not on a program basis,but on a monthly charge.We are not happy with it -20%of our subscribers take it;it is a tremendous cost,and have incurred a lot of complaints because the quality of themovies that we have to show.In one city when the movie Lenny was shown,we lost 200 customers the rext day.We are testing paid TV and we will offer at such time as we feel that we can make that investment,and it should be made then. In response to rural rates,he commented that for instance with most companies such as utilities and possibly telephones,when they have to make an expansion into an area where there is not abundant population,there is usually an additional charge. Bill Strange continued,stating that when we adjusted the rates about a year ago,we gave as a courtesy to the administration an operating statement.We do not have a separate corporation In the State of Washington,this is a division.We have theexpertise and managerial skills and that experience to provide good cable TV service in Moses Lake.We do have financial sources to enable us to sustain in less than "reasonable return"..Although it is difficult to determine what is considered a base rate of return on what investment.In 1974 our company showed a small profit in the complex of Ephrata,Moses Lake and Othelloon the divisional income statements of allocation actions and expenditures.These are our ways of determination of operation here in the Moses Lake area.Even with all operations grouped together,the profitability on a million dollar:investment is extremely small.With that Mr.Strange concluded his remarks,and asked if anyone else had any questions. Clint Connelly -T.V.Retail Businessman,stated he Is not a'technician,but does understand picture quality and asked if there are any plans in the future for anything to be put on television that will be better than we are getting now.Especially the channels from the Tri-citles,he added, and suggested they either be taken off the air or improved. Bill Strange replied -We do have to have good rapport with Television Dealers;we need them and want them,but as far as taking something off the air,we never do it;once it is on people want it, and .you have worse problems by taking it off.But any picture that we have that is not clear and not performing correctly,yes;it should be. Rolf Bauge responded to that also - In respect to the Tri-Citles Channel,when we first put them on they were mainly for a standby system becuase we did have quite a few outages with the micro wave system.They are not very good most of the time and fluctuate very much with weather condi tions,but are at the present time looking at an antenna site mostly around the south campus area and are coming up with quite a bit of improvement in the quality of the picture.If it shows to be a good enough investment,we will be going ahead with It,possibly in the spring. Gene Oakley - You say some of the channels you have on your system aren't up to par,but yet 1 ' U 2297 Council Meeting Minutes:3 December 9,1975 you want to charge us the same rate forthis service that other communities that have good pictureshavereasonablecharges- is there some reason other than pleading poverty -you can't afford to put ..a microwave in to bring these other channels in? Bill Strange:-Our charge is for full cable service. Ifwe have channels that are not up to performancewe would take them off,but it is the FCC that won't permitus to do so. We have had two differentsetsofengineersoutto see about a different tower to bring the signal in.I checked out our complaint log, andwe have not ted this complaint,apparently youdealers have handled the complaint. Thatdoesnotsay thatwe are satisfied withanything less thanthe best,and thatis what we are pledging to do tobringin.But if we haveto hook up more microwave -we spend nearly $100,000 a yearon microwave • m?w/,we y*111 have to come back before,in a publichearing, andask for a rate increaseto take careofadditionalmicrowave. Gene Oakley =You saythatthe FCC has regulations which you are.under,governing the quality ofthepictures.Do you have a copy ofthose regulations ? I have never heard ofan FCC man coming in. Bill Strange =We do have the regulations andthey do comein on a surprise visit at least once'a year to check.We can send you a copy of the FCC standards that we must meet. gene Oakley - I am interested in this FCC regulation - I think it should be of vital interest to this Council. Kent Tones commented on the audit statement of yearending December 31,1974.=You mentionedthe milliondollar investment -$111,600 in interest.There area lot of things I don't understand but am tryingto make some sense; I amtrying to understand towcomea corporation of this sizeispaying11%on its total investment andactually has no equity,if you will,otherwise you wouldnotbepaying11%? ?ffi Stranqe responded =In 1974 the prime rate was 12%,most cable companies paid 2%to 5%over the12%on Interest.We paid, because the size of the company,1%over prime equally 13%.The interest allocationwe allocate whenwe look from a comparison standpoint of anyof ouroperations - we lookat a 20%equity and an 80%debt at an assigned amountof interest,that we use that a corporation pays.It is done on that basis. Aletter was read from James R.Newhouse,Certified Public Accountant,questioning the CableCompanysinformationalfinancestatements submitted, that any governmental body attempting toregulateorcontrolthecompany's activities would need complete and accurate information such as those documents filed annually with the Interstate Commerce Commissionto determine what wouldbeareasonablerateofreturn on the company's investment in this area. Otto Skaugcommented that it would seem to him that with the assurance and with the complaintdepartmentactingin the new capacity of taking care of those unhappy people,and with the im provement as we are assured that it will take,it looks like that would placate most the difficulty herevoiced this evening. I think the Council has to be assured that some shape Of improvement "- ln quality must be forthcoming in reasonable time. Mayor Ebbert added,that the new rate increase has to be authorized along with the new franchise. Bill Strange responded,that alongwiththe newrequirements by the FCC that the city has ratecontrol, weare telling you this is whatourrates are.When you pass the franchise youare pass ing an acknowledgement that this is what our rates are.In 1976 if we determine we need to have a rate increase,then we come in for a rate hearing. Mlkejoyje.inquired - Is it a correctassumption, accordingto this franchise document,that 14 years from now the quality of the three Tri-citles channels could be the same as now with no improvement,legally bound? Rolf Bauge -replied -As far as the technicalities of it,yes it could be. Mike Boyle - The company stands under no obligation to improve the quality of those three channels? Rolf Bauge - Yes, that is correct.Bill Strange, added, - based on the wordage in that ordinance. Gene Oaklev commented that it is his understanding that the Cable TV Company does not have to have a franchise to operate.They are very desirous of having one,but am wondering if they could stand to operate without one for a while until they shape up. I don't think there is anything in it that wecouldsatisfyour customerto guarantee a better picture, and that's all I amhere for. I think legal counsel could study this and defer this action. Bill Strange,added that they are required by the FCC upon the expiration of a franchise to have another one.The FCC knows of this franchise expiration.We have to have another franchise. What steps would occur if this Council elects not to grant us a franchise?That is between the FCC and attorneys.But we are presenting to you exactly what the FCC tells us.I think the Council is well aware of the requirements by the federal register. ORDINANCE NO.743 -IMPOSITION OF COURT COSTS A letter was read from City Attorney Pat Acres along with an ordinance which he believe should be adopted by the City for the Imposition of Criminal and Quasicriminal cases in municipal court.At the present time,Municipal Court receives no costs in criminal cases.To his knowledge,it is the only court in Grant County wo fails to do so.The additional income would help recover costs for maintaining the Court. The ordinance was read in its entirety,providing whenever,in any criminal or quasicriminal proceed ing ;the judge find the defendant guilty after trial or pleas of guilty,in addition to any penalty imposed for the ordinance violation,shall assess the costs as follows: For filing the cause $4.00 '"-For service of supoenas,each 2.00 For service of arrest warrants,each 2.00 The costs collected by the courts,:assessed hereunder,shall be paid into the city's current expense fund.These costs shall not be suspended by the Judge,except when the defendant is indigent. Motion by Hill to adopt the ordinance at the first reading,waiving the second reading.-Second by Swanson.Motion carried. ORDINANCE NO.744 --.;;-INTER-RACIAL COMMISSION ON HUMAN RIGHTS A..... The City Manager noted that two ordinances are beirg presented.The differences are ln thefirst paragraph under l.09.010"Membershlpr In referring to .the membership,one ordinances states -'shall be composed from citizens from within the corporate limits'—.The other states - 'shall be composed from citizens from within the greater Moses Lake area'.The Council will have to consider which one they wish.The present ordinance does not specifically state that the membership shall be from within the corporate limits. _J City Council Meeting Minutes:5 .December 9,1975. Mayor Ebbert commented the Inter-Racial Commission for Human Rights much prefers the ordinance allowing membership within the greater Moses Lake area,because they are having such a problem getting membership on the Commission.Many people that would be active reside on the Base primarily,and it would help them get better qualified people to serve on this Commission.There fore,he.suggested adopting the ordinances allowing membership 'within the greater Moses Lake area'. Motion by Boyle to pass the ordinance allowing membership from the'greater Moses Lake area". Second by Skaug. Bill Moe commented that his contention all along has been that we should keep our appointments within our/auwority.I would be against passage as the motion indicates. Bob Hill added that he has made his feelings known in the past and must concur with Mr.Moe. Motion carried on the first reading of the ordinance.Opposed*by Hill and Moe. RESOLUTION NO.742 -REQUEST TO BUILD ON UNPLATTED LAND -STAN AECK 2299 A letter was read from Associate Planner Stan Bech,stating the Planning Commission at their regularmeeting on December 4,1975,held a-public hearing and approved the PreliminaryAeck Plat I.With approval of the Plat the Commission recommended to the City Council that Stanley V.Aeck be permitted to build on unplatted property with the following conditions: 1.That a bond be posted with the City Treasurer for the amount of $2400 to cover the cost of completing the plat including the installation of all minimum improvements.These minimum improvements shall be completed within two (2)years or the bond shall be forfeited.The developer may apply to the Planning Commission for an extension of that time limit. 2.That no occupancy permits shall be issued for any building on the above described property until all platting requirements have been completed. He recommended to Council the accompanying resolution be approved. Motion by Skaug,second by Hill to adopt the resolution.Motion carried. RESOLUTION NO.743 -AUTHORIZATION TO SIGN CHECKS -NAME CHANGE //•?/~/l A letter was read from Finance Director R. R.Gagnier,stating the Deputy Clerk-Treasurer, Daryl Ann Leonard was married on November 29,1975,which necessitates theettached resolution to authorize her signature as Daryl Ann Helton.The resolution was read by title only. Moved by Swanson to adopt the resolution regarding the name change.Second by Boyle. Motion carried. //tfO/4 RESOLUTION NO.744 -LEASE FROM MOSES LAKE CONSERVATION DISTRICT A letter was read from City Manager Chet Waggener along with a resolution authorizing execution ot a lease with the Moses Lake Conservation District in accord with approval granted by the City Council on the meeting of November 25,1975.The only change relates to the rent,which has been reduced from $250 per month to $220 per month. The resolution was read by title only.Motion by Hill,second by Boyle to adopt the resolution authorizing execution of the lease.Motion carried. CONFIRMATION OF APPOINTMENT -CHAIRMAN.INTER-RACIAL COMMISSION ^ A letter was read from Mayor Ebbert requestingCouncil confirmation of his appointment of Jesie Castro as Chairman of the Inter-Racial Commission for Human Rights.Noted that Darlene Skeels,Chairperson of the Commission is moving to Othello,therefore will no longer be serving on the Commission,nor in her capacity as Chairperson. Motion by Hill to concur ln this appointment.Second by Skaug.Motion carried. REQUEST TO CALL BIDS -TELEMETERING AND BOOSTER STATION Aletter was read from Public Works Director Jerry Fay,requesting Council permission to advertise '®'0 "v' for bids on construction of a Booster Station and Telemetering System as recommended in the Water System Operational Analysis.This will provide supervisory control of wells in order to distributepumpingdemand,provide pressure flowcontrol to balance water pressure and flows, and improvefireflowsInthecentralbusinessdistrict.City funds have beenallocated for this project,along with a 40%DSHS Grant.Construction costs is estimated between $125,000 and $150,000. /O30 2300 .. City Council Meeting Minutes:6 December 6,1975 Jerry Fay added that,with the relocation of our Well #11,the DSHS eliminated some costs from$300,000 and reduced it to a more realistic figure. STATUS/INFORMATIONAL - from City Manager City owned lots in the Garden Heights Addition #2: pyyJ Chet Waggener stated he has a letter from Safeco Title Insurance Company on behalf of United ' \\J Builders indicating ttat they have decided :to not buy Lots 22, 23, 24 and one-half of lot 25 ln GardenHeights Addition No. 2. Thereason for that decision on their part is drainage problems that exist ln the GardenHeights area that have been unresolved at this point; there are continuing problems on It. Jerry Fay commented on the problems ln the Garden Heights area.The one portion of the line which was to intercept and pick up the drainage waters that are coming off the layers of caliche,which is-about 400 feetof subdrainage pipe of which portions ofit was .surveyed improperly and laid Improperly and did not intercept all of the water. We are currently in the process of lowering that section of the pipe in hopes of intercepting the water. This is being done by City crews now, the main project was done by a contractor.We still feel that we cannot guarantee even with lowering the pipe that we can Intercept all of the water,but are hoping this solution willtake care of the problem. City owned Lots listed for Sale: ,ry\The City Manager stated a listing is being updated to submit tothe Multiple Listing Board to yJ have them re-appraise lots and giveus a current listing.He suggested these particular lots in Garden Heights be kept off that list,or perhaps add them with the notation that they are not to be appraised or offered for sale until the drainage problem is resolved. Motion by Moe that the City Manager be authorized to hold those lots in question in GardenHeightsNo. 2 off the list submitted to the Multiple Listing Bureaufor re-appraisal.Second by Skaug. Motion carried. <P|0 \° BobHill .recommended that — in the future, a deposit is necessary of some sort. Chet Waggener agreed..The'city has never requested a deposit because we never found a need forone, but obviously'we have incurred some costs at this pointin draftingordinances and carrying things through to the City Council,and possibly we can work with the Multiple Listing Board as to what a reasonable amount of earnest money would.be,and come back to Council with a Resolution or Ordinance on this,after discussing it with the City Attorney. Also added we have asked the Multiple Listing Board to handle the sale of any available lots listed. We have handled this quite loosely ln the past.It would be then they would handle the disposition of it exclusively.The city would not sell it directly to any individuals,nor would we workwith any other realtors.The Council concurred this could be handled at the same time a Resolution be brought back regarding a deposit. Basic Introduction to Advanced Management for Local Government,sponsored by the Local Govern-. ment Personnel Institute.AWC.Washington Association of Counties and the U.S.Civil Service Commission: The workshop location for Eastern Washington Istobe held in Ellensburg on December 16th,it is an all day session,and it might be well worthwhile.Jim Barney and Don Swanson stated they would be Interested ln going.Some staff people are going also added Chet Waggener,and registration will be handled by the City for those Councilmen that are planning to go. Leasing Facilities from Conservation District for Planning and Building Department: The move into those facilities will take place as soon as telephones are installed,and they are in the process presently of doing just that.Change in organizational structure ln establishing a one- )0 stop permit system is putting a person in charge of that operation.The City Manager stated he has)designated Stan Bech to head that department and will be in full charge of Planning &Building Inspec tion facilities and operation.He also emphasized this is not a demotion*for Bob Kimball;he is still Building Official. Allthis does is restructure the organization and puts that persoj/mcnirge of the Planning process who usually works first with the developers.Building Inspection will still be done by Bob,but ifthere are any questions,expect him to go to Stan first rather than directly answerable ,. to the City Manager.' CETA Funds'., Chet Waggener Informed the Council the 1Employment Security Department has advised the city that CETA funds will be funded through June 30,1976 .That will allow the two people in the Park positions and one Finance Dept.and continue two people In the Police Department under CETA employment.At this time and basis it is considered temporary employment.If the funds are not forthcoming,the position and employee will be terminated. Motion by Boyle that the Council agrees to continue the CETA Program.Second by Swanson.Motion carried. City Council Minutes:7 December 9,1975 Continued Public Hearing -1976 Preliminary Budget: Because the lateness of the hour and a need for an Executive Session regarding Collective Bargain ing and Personnel matters,Mike Boyle made a motion that this Council Meeting be recessed until December 16,1975 at 8:00 P.M.and the continued public hearing regarding the 1976 budget be scheduled for December 15,1975 at 8:00 P.M.Second by Hill.Motion carried.
